Despite Court’s OK, D.C. Residents Unable to Legally Register Handguns

It’s been almost three years since the United States Supreme Court overturned Washington, D.C.’s ban on handguns, but residents of the District remain unable to register guns in the city. Why? A “temporary, de facto ban” is in now in place after the sole individual who facilitated handgun ownership in the nation’s capital stopped accepting registration orders.
WTOP reports:
Since the lifting of the handgun ban in June 2008, Charles Sykes has processed more than 1,000 handguns for District residents. Sykes tells WTOP he’s stopped taking orders for now. “I’ve lost my lease,” Sykes said in a phone interview. “I’ll take care of the customers who already placed orders, but I don’t want to take any more until I know where I will reopen.”
Sykes is the sole proprietor of C S Exchange, the only licensed firearm dealer in the city that will transfer guns for individuals. Sykes doesn’t sell the guns — there are no gun stores in D.C. His company facilitates the transfer of guns from out of state stores into the District for a fee of $125 per gun.
Federal law prohibits individuals from buying a handgun outside D.C. and then bringing it into the District. That transfer has to be done by someone with a Federal Firearms License.
Michelle Lane lives on Capitol Hill, and wanted a gun for protection and target practice. She bought two guns in Virginia: a Ruger LCR revolver and a Kahr K9 Elite 9mm. After buying them, she found out she couldn’t have them shipped into the city. “It’s not fair,” she tells WTOP. “I followed the law. Criminals bring guns into the city. It’s frustrating.”
It could be weeks before Sykes finds a new location for his store and even then, the Bureau of Alcohol, Tobacco & Firearms (ATF) requires 30 days advance notice of a move, followed by an additional 60 days to review and approve the location. Until then, D.C. residents are out of luck.
“The city government of Washington, D.C. has a responsibility to make sure that every resident of D.C. can exercise their constitutional rights. And one of those constitutional rights is the individual to have a right to bear arms,” Sen. Charles Grassley said Friday. It’s “absolutely wrong” that D.C. resident can’t currently legally purchase a gun, he added. “Let the city government do the licensing if you don’t have a licensed dealer.”

Courts are only listened to in a Constitutional Republic, we are now a quasi centrally controlled autocracy. Or you could define it as a crony capitalist, state capitalist, aka communist society. Notice that in a communist society the rights of property are abandoned, central control is installed, and law is dished out according to your position in power.

Posted on April 30, 2011 at 12:05amI would not register any gun if I owned one. If a criminal does not have to register, then neither do I. I‘d tell the gov’t to stick it where the sun down’t shine. It is my constitutional right to bear arms and the Constitution nevers says that I have to register them. A city ordinance can’t trump the Constitution. I think I‘d start sueing the B’s.

I cannot envision our forefathers having the foresight to understand this but call it blessed inspiration or whatever, the 2nd amendment is an easy to see, easy to understand, measure of your freedom. Posted on April 29, 2011 at 10:43pmAny notion that a full fledged ban is not going to be implemented soon would be rather naive. I recently attempted to purchase a shotgun and I was told that the FBI placed a “hold” on the purchase. No explanation given. I had to wait over 2 months to get my money back and was told that I was “denied” and no reason would be given.
So, the next option would be to appeal, which of course I did.
After being forced to wait over a month for the application from the Department of Justice, I was sent a letter and a fingerprint card and again told that I was “denied” without any reason being given but I could appeal by having my fingerprints taken at the local police station.
(Anyone seeing a problem yet – Hello…you are denied with no explanation, then forced to turn in prints like a criminal, in order to legally purchase a weapon).
Well, guess what?
5 months later and there is still no response by the Department of Justice nor has any reason been given on why I am denied in the first place.
Calls to the DOJ result in being told that they are still “investigating”.
Investigating, or perhaps just delaying as long as possible to ensure that the process is impossible to comply with?
This is in New York.

Posted on April 29, 2011 at 10:07pmFirst they took my neighbors gun – and I didn’t say anything….
Take a look at Switzerland – The Swiss army has long been a militia trained and structured to rapidly respond against foreign aggression. Swiss males grow up expecting to undergo basic military training, usually at age 20 in the Rekrutenschule (German for “recruit school”), the initial boot camp, after which Swiss men remain part of the “militia” in reserve capacity until age 30 (age 34 for officers). As of 2007, Switzerland had a population of about 7,600,000. This would put the rate of killings or attempted killings with firearms at about one for every quarter million residents yearly.

Posted on April 29, 2011 at 10:50pmI lived in Switzerland for a while. Everyone of military age has to keep their weapons at home when they are not on active service. A friend showed me his. SERIOUS military weapons. You would have to be pretty stupid to break into a Swiss house as they all have a ton of firepower immediately to hand and they have been very well trained in their use.
Incidentally, if attacked, the Swiss can deploy their standing army in 24 hours and their active reserves in 48 to 72 hours. They have flourmills, bakeries and other food processing plants built into railway wagons. Their farms have well maintained tank traps in place, and all their bridges are mined.
During an army open day that families are invited to (and me on one occasion) they showed a movie of an air base. Not unusual, you think? Well, this air base was entirely inside a mountain – including fuel and weapon storage, accommodation, hospital, and, believe it or not, the runways. The planes land and take off inside the mountain!
They make no secret of these things. The message is clear: Don’t attack us. You may not live long enough to regret it.

Posted on April 30, 2011 at 12:44amI think this makes a fanciful supposition, but if the Nazi war machine had wanted to invade Switzerland & take it, they would have & ruthlessly so. Maybe they would have suffered a disproportionate loss for a while, but since Switzerland had NO strategic value & perhaps “helped” in non-military ways, they were left alone (like Sweden & Portugal were).
Report Post »The Nazis did whatever they thought necessary (or crazy Adolf did) & even took Crete partly with gliders delivering troops. It invaded the Russian colossus & almost defeated it, Luckily Mussolini was an idiot too & decided to invade Greece on his own & was losing ground, so Germany took it for him, thus delaying the invasion of Russia from the spring until June 22, 1941 – which meant it ran into the coldest winter in the 20th century-to-date & oil was freezing in tanks when they got to the gates of Moscow. Russia regrouped & launched a counteroffensive with their prepared winter units.

The problem is that a majority of people are being black mailed by our own government. Aren‘t the housing prices still high in Washington and isn’t the economy doing very well. Sounds to me like everyone is scared of loosing money on their homes or loosing federal funding. The good news is that moths and rust will eat away their treasures. Posted on April 30, 2011 at 9:04am@ JZS – To answer your question to Snow: It has been announced by the DOJ that they will NO LONGER defend the Defensive Marriage Act in court (which is their JOB) b/c Obama has read through it & he believes it’s unconstitutional.

Posted on April 30, 2011 at 9:33amThe DC “Taxation Without Representation” license plate is even cooler than the proposed Arizona “Don’t Tread On Me” vanity plate, because it has been the basic “no cost” DC plate for 25 years!

Posted on April 30, 2011 at 10:51amIt is this way in DC because that is where those in the federal government hang out.
Maybe all guns she be taken out of DC, including the ones the secret service have to gun down snipers and angry mobs.
I bet there are a lot of households that have guns in DC, registered or not.
I can’t believe the citizens there put up with these hand gun bans for this long anyway.
They will try to disarm us soon because they all will fear for their lives once the uprisings start when Americans are informed that our Dollar has collapsed and the constitution has been suspended and we are now under “day to day” decree of the IMF and Chicago Carbon Exchange. The elected officials will hole up in their bunkers and high-five each other while the citizens fight each other on class warfare.
Own a business? The problem isn’t your employees.
Work for someone? The problem isn’t your employer.
Poor? The problem isn’t the rich.
Rich? The problem isn’t the poor.
Black? The problem isn’t whites.
White? The problem isn’t blacks.
Citizen? The problem isn’t illegal aliens.
Illegal Alien? The problem isn’t the citizens.
Whatever “class” or “group” you fall in, the PROBLEM IS THE GOVERNMENT overstepping its constitutional authority and stealing all it can from each and every group I mentioned above.

Posted on April 30, 2011 at 12:36pmThe simple way to look at this whole thing to understand it is “Can the Government grant you permission to do something that is unlawful? Can they give a license to murder?
Legal is NOT Lawful. Legal “proceedings” (statute) follows a prescribed “procedure” but may or may not be lawful.(Allowed by the Constitution).
Everyone has forgotten this fact.

Posted on April 30, 2011 at 4:18pm@mikem1969..EXACTLY.. I did not remember reading in the CONSTITUTION anything about REGISTERING the guns..IT DOES HOWEVER say WE ARE ALLOWED to have them and the government CAN’T infringe on that right … so SCREW them and the UN TOO.. and ANY kind of treaty they sign to try to take that right away..

Posted on May 1, 2011 at 9:13amIt seems that there is a time coming when we have to withdraw the very thing that gives them the ability to use force against us – the consent of the governed – without that consent all they can do is write worthless paper. It would take an event that would galvanize a critical mass of people but that feeling is out there in the ether I think.
