    These prisoners are enemy combatants. They are not entitled to a trial by their peers in our criminal justice system. The judge in this case refused to allow pertinent evidence gathered against the enemy combatant (because of the method used to retrieve said evidence) and therefore the court could not make it’s case. I have no faith in our judicial system. They have no business in our system of justice. Read the Geneva Convention. No other country would prosecute them by it’s laws either. This is purely a political move on the part of the current administration to add further embarrassment to America.

      I think that’s what General Pershing actually did at one point in history. If memory serves correctly, he was a FEDERAL employee. Dipped the executory bullets into freshly let pig’s blood too, I believe.

      It would appear that it all depends on your utility to the Federal government, as to what your treatment will be. Doesn’t it? The Federal government is out of control and likely to be lining folks who don’t suit its purpose up against brick walls, soon. I’ve read no less extreme suggestion against Christians and/or Republicans posted on liberal forums begging the same be done on a Federal level. As to how the Muslim’s feel about the situation, we have more than ample testament and example.

      Pick your level of Tyranny, there seems to be enough choice to go around. One is no better than the other when the extremist radicals of either side are in charge.

      We’ve seen nothing about the SB510 debate and vote status. Nor much about the exhaustive list of imporant legislations currently going on. We’ve seen nothing about the stances of states regarding these legislations and pending legal suits. We seem to be getting a steady diet of cotton-candy while the meat and potatos of our Republic is spoiling without attention.

The circus in this case being the terrorism trials our nut less wonders are trying to foist on us. Our government , past and current , had a chance to forgo circus they are creating with their criminalizing terror strategy , i.e. by death on the battlefield .       Well that depends on wether or not you believe that “all men are created equal..“ that they are ”endowed by their creator with certain unalienable rights…”. If this is true, that these rights are given to us by our creator, then they extend beyond our borders, and anyone in our custody is extended these rights, not because we have the power to give them or take them away, but because God gave them to all His children, to which the Constitution is just stating the fact. If we can give Ted Bundy, Jeffery Dahmer, pedophiles and rapist these rights, then why not ACCUSED terrorist? Either that, or they fall under the Geneva Convention. I’m fine with either one.

      Yes and no. She did appear to say we would detain and not release captured enemy combatants found not guilty. But then she said that a “not guilty” verdict by a jury of “terror obsessed” Americans would indicate a weak case. The two parts of the headlline merely reflect the cognitive dissonance inherent in Mr. Gregory‘s question AND Secretary Clinton’s non-answer.

      This is all about American confusion about what matrix to apply to a war declared and waged against us by a non-governmental organization (NGO) with unlawful combatants applying the military doctrine of “unrestricted warfare” (aka “terrorism”). My personal view is that a modified war matrix must be applied rather than a civilian criminal justice matrix that is better applied to bicycle thieves. I believe it is a dangerous mistake to underestimate or disrespect a movement that has formally declared war on us as part of its goal to establish a base in a failed nation-state from which it can expand to form an Islamic caliphate bent on world-wide jihad to accomplish the submission of all of us infidels to Islam and shari’a law. Are they a serious threat? Maybe not in the old war sense of an occupying army. But if they ever accomplish their stated goal of delivering seven nukes to seven major cities, would our constitutional republic survive?

      So … I agree with Secretary Clinton’s instinctive response that of course we will not release unlawful enemy combatants found not guilty in our civilian criminal justice system! We must kill or capture enemy combatants on the field of battle (Afghan mountains to downtown Hamburg). If we capture tham they must be detained … for the duration of the war – until there is a peace treaty or prisoner exchange. Already a large percentage of the hundreds released from Gitmo have returned to the field of battle to take part in future military attacks upon us. War is not a “catch and release” game.

      The Geneva Conventions do not completely apply to unlawful enemy combatants, but they do require humane treatment, which I believe we are providing. They also permit us to try them under our civilian laws. But what laws have they broken (unless being an unlawful combatant is a per se violation of the laws of warfare)? Ahmed Ghailani broke no civilian law – he waged war. If he violated the international law of war he should be tried in a war crimes tribunal – not the federal southern district of New York. His acquittal on all but one civilian charge in connection with the African embassy bombings was insane, and made a liar out of AG Holder who promised there would be no acquittals. Mr. Ghailani should be returned to detention for the duration.

      There are several troubling aspects of the never-ending jihad being waged on us by the NGO al Qaeda and other followers of the Islamist movement. First, the war they are waging will likely take a lot longer than most standard wars since the 100 Year War in the 14th and 15th centuries. That means detention will in many cases become the equivalent of a life sentence. The enemy combatants should have thought about that before enlisting. As an accomodation, I would not object to releasing them at an advanced age (at least 70) if their home country is willing to accept them. Again, they are not sentenced, they committed no crime (unless a war crime) and the purpose of detetion is to keep them from fighting another day. If they are too feeble to fight, detenntion loses its purpose.

      Second, some enemy combatants are and will be America citizens. These are entitled to due process in the determination of their enemy combatant status. Since I respect the military justice system I don‘t see why this can’t be provided in military tribunals. But, I am not entirely opposed to having their status as enemy combatants determined by a civilian court.

      Third, while most countries whose nationals have been captured want nothing further to do with those detainees who in all likelihood would wage war against their own countries as well if given half a chance, some countries might object to indefinite detention, and a legal mechanism needs to be available for determining those cases.

      The confusion must stop. As Andrew McCarthy – lead prosecutor 15 years ago in one of the country’s biggest terrorism trials: a group of men led by a blind Egyptian sheik had plotted to blow up the United Nations, the Lincoln and Holland Tunnels and other city landmarks, “A war is a war,” Mr. McCarthy declared. “A war is not a crime, and you don’t bring your enemies to a courthouse.”

      This is why I have had issue with the Patriot Act. It is anything but. Without debate, so much of what is in it is unconstitutional. Obviously Clinton has no problem holding someone indefinitely for simply being charged for terrorism. She even admits that should there be a trial and a person is found innocent, they would still hold them. Does this sound like America? Is this what a free nation would do? We are not free, nor have we been for some time. Its time to take our nation back.

      These terrorists captured on the battlefield are known as enemy combatants and under the Geneva Conventions can be tried by a military tribunal if I understand them correctly. Terrorists captured by our law enforcement agencies are conducted via civilian courts; as has happened in the past with a mix bag of success and failures.

      This administration needs to get the little brain power it has into high gear and soon.

      So the Obama administration begins trying terrorist combatants in US Courts and when they are found innocent, they remain in custody. How many times does this happen before an American citizen remains in custody following a trial where the jury found the citizen innocent? Could this be a “palatable” way of desensitizing Americans to the concept of an inconsequential judicial system? Why bother rigging a jury or stacking the courts if you can just be done with the judicial system altogether? A verdict which carries no consequences is a judicial system which is effectively non-existent.
