Did James Holmes Really Spit at Guards? Local ABC Report Contradicts National One

ABC News has found itself at the center of yet another controversy regarding its reporting about the Aurora shooting. This time, the question concerns a story that both ABC and the New York Daily News reported, which alleged that Aurora shooter James Holmes had been restrained with a mouth guard after he had spat at guards.
However, one local investigative reporter has taken to Twitter to dispute the account. John Ferrugia, at local station KMGH, says the story is false, according to his sources:
ABC hasn’t retracted the story, and it is not clear whether they have reason to do so. They,have, however, issued an editors’ note in their story about Holmes:
Editor’s Note: On Tuesday night, ABC News local affiliate station KMGH reported that sources they contacted denied that James Holmes had spit at guards or was made to wear a facemask.
The confusion over this question stems, in part, from a gag order by the judge presiding over Holmes’ case, which bars prison employees from describing exactly how Holmes is being treated.

I didn’t see any bruises on him in his Monday Court appearance.

I did a google search, and James Holmes of the Tea Party denies spitting on any guards, Brian Ross did state, “We don’t know at this time if this is the James Holmes that did spit on a guard, but we are reporting it.”
Also in other news, Nancy Pelosi reported that James Holmes is not as big as his Brother John. She knows first hand.
