Fort Hood Gunman Still Getting Paycheck

Accused Fort Hood shooter Major Nidal Hasan continues to draw a military paycheck from the government, the base commander said Wednesday.

Major Nidal Hasan, accused of the 2009 mass shooting rampage at Fort Hood that left 13 dead, has retained his military rank and continues to get paychecks from the government, the base commander said Wednesday.

Lieutenant General Donald Campbell, Jr., the commander of Fort Hood, said Hasan’s confinement and medical expenses are also being paid for by the military, KXXV-TV reported. He receives weekly medical treatment and is occasionally transported to meet with his defense team.

Hasan was shot during the attack and is reportedly paralyzed from the waist down.

Campbell said the actions are to ensure Hasan gets a fair trial.

“The bottom line is when you cut through everything we are as an army, we have to be fair to him regardless of what we saw or we think we saw or whatever the case may be,” Campbell said. “It’s imperative we maintain the integrity of the court martial so he gets as fair a shot as possible defending himself with his team.”

Hasan is awaiting a court martial set for March 5, 2012. He is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder. If convicted, he faces the death penalty.

The trial is set to be held at Fort Hood.

“It’s a delicate balance,” Campbell acknowledged. “We believe [Fort Hood] is a location where we can have a fair court martial.  We want it to stay here not for any ulterior reason, but that we have the capacity to have it here.”

    As much as it hurts in my gut… this is fair… but… this is one of the reasons for the Constitution’s 6th Amendment – Right to Speedy Trial.

    It‘s absurd the military has been at this case for over two years now and by the time it’s concluded will likely be three years. If he’s found guilty and he better be… they can then determine how he’ll repay his back pay and allowances over the time.

      Alas, even if he is found guilty, and it is hard to imagine he won’t be, and he loses all pay and benefits, he will continue to draw his pay until Congress (The Senate) takes away his rank. Congress commissions officers, and only Congress can take away the commission. There are, without doubt, officers in Leavenworth or other military prisons that cointinue to receive their pay because there has been no Congressional action to take away their rank. Thus, there will be no repayment or return of his pay.

      There is a former sheriff (Mike Corona) in California that is in prison, but draws a couple hundred thousand a year in retirement pay!

      I agree. At first I was outraged, and then I got to thinking. If we cut his pay and broke him in rank, it would be doing so without a trial. As much as we know he’s guilty, he deserves a trial. He is an American citizen. I think they should have been more speedy than 2 years. Maybe they want to keep paying him?

      I know in the law enforcement world its called Terminated/Suspended WITHOUT pay. His paychecks have nothing to do with him receiving a fair and just trail.

      The casey anthony case is why these cases take so long because they have to get it right and prove without a reasonable doubt. The casey anthony prosecution failed and they are a great example. Not that these two cases have similarities in them other then length of time.

    Can anyone verify something I read that was in an article some time ago about the Ft Hood attack? It, I believe, said that there was a survivor that had recorded the shooter on his cell phone during the attack and was commanded by a superior officer to delete it.

      You are right about innocent until proven guilty, however, that doesn’t mean that they have to pay him. This is where that he is suspended without pay until it is settled, then if he is found innocent then they can pay him his back pay. If a police officer had done something like this, at the very least he would be susupended without pay and that’s the way it is done.

      The beauty of the military is that you don’t need a trial to be separated from the military. The fact remains that he got himself arrested and missed movement to Afghanistan. That, alone, is reason enough to be discharged without trial or at the very least reduced significantly. But he remains a Major and he remains in the U.S. Army.

    Not only that – Major Nidal Hasan was on Obama’s “transition team”.

    It should also be investigated whether the WH closed down the FBI investigation of Major Nidal Hasan – and/or interfered in having Hasan removed from the US Military for his statements clearly indicating that he was a RADICALIZED MUSLIM – prior to his successful RADICAL MUSLIM TERRORIST ATTACK on A MILITARY BASE on US SOIL – FT. HOOD, TEXAS -

    especially since Obama interfered w the investigation of the Radical Muslim – who eventually shot up the recruiting station in Arkansas – killing one soldier, gravelywounding another
    closing down the FBI investigation as RACIAL PROFILING – although the radical Muslim convert was being tracked by the FBI as a potential terrorist on US soil – going in and out of the USA on phony passports, buying illegal firearms and assault weapons, training at Radical Muslim training camps in Syria and Afghanistan.
    Spokesman for the FBI stated that if the WH had not closed down the FBI investigation as RACIAL PROFILING – the FBI would have still had the radical muslim under survelliance – and could have prevented his killing rampage.

    I’ve seen officers get separated, almost immediately, for drunk driving. No benefits. I’ve seen soldiers get separated for failing height and weight standard, no benefits. But an enemy combatant, murderer can’t get a timely discharge? Kind of outrageous.

      The only way that happens is if the accused accepts NJP (Non-Judicial Punishment)… Then the Commanding Officer acts as judge and jury… Everyone who is accused of anything can refuse NJP and select a court-martial where the accused fate is decided by a jury with a judge overseeing the proceedings…

      At this point in time, this man is accused of the terrible act at Ft. Hood… However, he has the right, as an American citizen, to face his accuser and have his fate decided by a jury of his peers…

    Ridiculous! I think we should have laws that make our country extremely UNappealing to criminals, terrorists, illegals, etc. It makes no sense at all that we who are legal citizens have to do with less because some in our government feel we should be financially supporting the whole planet.
    I can see feeding the man until trial… but it should not be taking this long for justice to occur.

    He is being paid while in military prison awaiting trial? Exactly what is he doing for us now to earn this pay? We are paying his medical bills also, because he was active duty when he did this…
    It should have lasted about a month, and then he should have been given a blindfold and two bullets to the heart.

      Sorry to tell you this, but it is NOT unconstitutional for him to get his pay or free medical treatment and calling your congressman is just telling the world that you are willing to take away someone‘s constitutional rights simply because you don’t like him. Well, I don’t like him either, but I won‘t call for taking away his rights just because I don’t like him. Your thinking is no better then a LIBERAL if this is the way you want him treated. The constitution is not there for your convenience and is there to protect his rights from people like you. You all seem to be willing to take his rights away, but how would you feel if they took yours away? Remember that he is innocent until proven guilty, and that includes getting free medical and his paycheck…………………………

      I don’t like this guy and will not feel the least bit of remorse after he has his day in court and if found guilty, is shot or whatever, but I will not wast my time even thinking about this guy while he is sitting there rotting in jail waiting for his trial. The last time I looked, this was still America and we still give a man his day in court no matter what he did or to whom.

    I wish they would just get on with a good old UCMJ courts martial. They’d find him guilty and put his sorry, traitor a$$ in front of a firing squad. I once sat in on a military courts martial, over a much lesser case. It wasn’t pretty! The military really knows how to put a defendent on the hot seat!

    Unless things have changed since I was in. Have they?
    I hear that a lot has changed in our military culture.
    I don’t want some cretins giving him a stacked civilian trial with a wimpy bleeding heart jury, like the one that Casey Anthony got.

      I am with you. He is subject to the provisions of the UCMJ. Until proven guilty, he remains a serving officer. We are a nation of laws. He committed an act of treason. The UCMJ provides the death penalty by firing squad. Get it done.

      Cold War Vet – you are correct. Most people do not understand Military Courts and the UCMJ. Yes, he still is a serving Officer, and as such receives his salary and benefits, until he is convicted by a CM and that court reduces his rank and can forfeit his pay and allowances plus a fine, confinement in a Military prison, or death. A Military Court Martial does not have the same burden of proof required as a Civil Court nor the legal rules. There is no such thing in the Military Courts as double jeopardy. He can be found guilty and sentenced. He then can be tried in Federal Court (crime committed on Federal property) or in a civilian court for the same offense. This happens all the time, a Military member can face a CM; be reduced in rank/grade, forfeit pay, serve time, be dis-honorably discharged and face a civilian court on the same charges.

      Here is another tid-bit…He could also be charged with damaging Government property…HE is government property and his will full act, caused an injury to himself. Another charge could be “conduct unbecoming”….I say these in tongue and cheek, but they have been used in the past.

      I truly believe the Military is taking their time in this case in order to dot all the “i” and cross all the “T” and build an airtight case.

      To make everyone feel better….he pays for his meals when in the brig …woops stockade.

      Heck, Britain gives social payments to people that go to fight in Afghanistan, against their own soldiers.

      Surprised, heck no. The US Federal government gave $700 million to build and repair old Mosques throughout the mideast.

      Heck, why not fund both sides of the conflict, it is what the warmongers do.
