Either You Were Involved in ‘Fast & Furious’ or You Are Asserting a Presidential Power That You Know to be Unjustified: Rep. Issa’s Scathing Letter to President Obama

Rep. Darrel Issa (R-CA), the chairman of the House oversight committee investigating the Justice Department’s ill-conceived “Fast and Furious” program responsible for the 2010 murder of U.S. Border Patrol agent Brian Terry, appears to have lost his patience with the Obama administration.

In a letter to President Barack Obama, Rep. Issa harshly criticizes the White House’s decision to assert executive privileges in order to withhold subpoenaed documents from the Government Reform and Oversight Committee.

Rep. Issa’s letter says the decision to withhold certain documents raises two very serious issues:

Either you or your most senior advisers were involved in managing Operation Fast & Furious and the fallout from it … or, you are asserting a Presidential power that you know to be unjustified solely for the purpose of further obstructing a congressional investigation.

To date, the White House has steadfastly maintained that it has not had any role in advising the Department with respect to the congressional investigation. The surprising assertion of executive privilege raised the question of whether that is still the case.

As most Blaze already readers know, the Justice Department’s failure to turn over said documents prompted Rep. Issa’s committee last week to vote to hold Attorney General Eric Holder in contempt of Congress.

Not surprisingly, based on past behavior that is, the White House blew off the congressman’s letter.

“The congressman’s analysis has as much merit as his absurd contention that Operation Fast and Furious was created in order to promote gun control,” said White House spokesman Eric Schultz.

“The Courts have routinely considered deliberative process privilege claims and affirmed the right of the executive branch to invoke the privilege even when White House documents are not involved,” he added.

The House is scheduled to vote this Thursday, the same day the Supreme Court will rule on the constitutionality of the Affordable Care Act (“Obamacare”), on recommendations that Holder be held in contempt of Congress for failing to produce requested “Fast and Furious” documents.

“Rep. Steny Hoyer of Maryland, the House Democrats’ chief head counter, said he expected some Democrats to follow the National Rifle Association’s call for a ‘yes’ vote on contempt,” the Associated Press reports.

“The NRA has written to all members of Congress, saying the White House wanted to use the Operation Fast and Furious gun-tracking operation to advance a gun control agenda,” the report adds.

Rep. Hoyer didn’t specify the number of potential defectors.

      How stealth, as though it is not obvious that Issa is the attack dog during the election cycle. No doubt he made a sweet deal with the Republican power brokers and Romney. Would love to see his explanation of the similar programs that were operated under Bush… and let’s not forget an explanation for the WMDs in Iraq justification for the Iraq War. WMDs that didn’t exist. At least Colin Powell had the integrity and honor to leave the administration after lying to the UN.

The Bush program wasn’t like anything like fast and furious, they tracked the weapons, caught bad guys, and nobody got killed. Like all things liberal they took a good program corrupted it for evil, and people died. There were all the pieces of weapons of mass destruction in the country they just were not assembled yet, only a moron would have active gas around that they weren’t going to use in the next few hours. Anyone with a brain, would consider weapons that could be assembled in a few hours to be weapons, only in a liberal mind where every day is opposites day would they not.

      Contempt of Congress is initiated by a congressional committee which can cite any individual for contempt. ,,,,,, This has been done by Issa’s Committee

      The resolution must then be adopted by the House or Senate….this is the vote by the House on Thursday

      If the House passes the vote for Holder’s Contempt…. the charge is referred to a U.S. Attorney for prosecution. The U.S. Attorney may call in a grand jury to decide whether or not to indict and prosecute. If prosecuted by the courts and found guilty of contempt, the punishment is presently set at up to one year in prison and/or up to $1,000 in fines.

      Not much chance of an indictment and trial since Holder is in charge of all U.S. Attorneys………

      So the House votes a contempt charge….and the Justice Dept under Holder stops it from going any further.

      I believe the contempt charge would civil contempt. If found in willfull noncompliance, he would be locked up for up to 1 year or until such time as he complies with the subpeona. If you recall, Susan McDougal went to prison for a year rather than provide evidence in the Whitewater scandal.

      Criminal contempt would be an actual crime – but I don’t think that is the case here (in a legal sense.)

      Ob should be used to “giving up” licenses and positions……The State of Illinois made him give up his law license for lying on the application and Moochell had to give hers up for “insurance fraud”.       Sweety, Wide Receiver under George W, was ended in 2007. Holder wasn’t AG until 2010, so he couldn’t have ended anything George W. started, right? What happened, Sweety, was that a NEW program was started when Holder was AG. Issa is just trying to find out who authorized Fast & Furious – the program that Holder ended.

      YODECAT, I suggest that you do some research. Fast and Furious itself was not started under the Bush Administration. Operation Wide Receiver was the first similar op. Much like Narcotics detectives allow drugs to walk, the ATF did the same thing with about 300 weapons, and it was a joint op with the Mexican government being kept in the loop regarding each weapon. No weapons were lost and a lot of the bad guys were caught. After a short term, the op was ended as a success. Might I add that it ended without the loss of two US agents, or near three hundred Mexican citizens. If you recall, about two and half to three years ago when 0bama, and Hillary were in the news constantly complaining about weapons being purchased in this country were turning up in the hands of Mexican based drug cartels. And, that something had to be done about it, and that gun laws must be changed. Funny how the media dropped all of that when the whistle blower in the ATF came forward.
      Look it all up on the net and read what really happened. Otherwise you are suffering from your own amnesia, or just don’t want to put two and two together to come up with the correct answer.

    Of course, Holder should be held in contempt of congress for stonewalling for months BEFORE executive privilage was declared.

    Next, we need to figure out, is Obama admitting that he or his direct adivisors are involved, or does he need to admit that he claimed executive privilage on false grounds?

    Finally, and most importantly, we need to establish the real reason for letting so many weapons fall into criminal hands. Was it incompetence? Or a plan to discredit US gun ownership? Or maybe even an attempt to destabilize Mexico as a pretence for military intervention and long-term stewardship of Mexico?

    My personal bet is that it started as incompetence, but when Obama and his top advisors learned of it, they discussed how it would be useful to discredit gun ownership and provide an excuse to move into Mexico at some future date.

      I agree, but where is the media on this? Why are they not telling the real story here? You can hardly even find this press conference from March 24, 2009 on the internet anymore. This is where Robert Gibbs, Janet Napolitano, and Holder’s number two man David Ogden publicly launched the program using stimulus funds. Even Fox News isn’t reporting this, which is case closed. Why isn’t Issa using clips of the administration in their own words? This is one of the only places left where you can find this information that is really the only thing that matters. I’m sure this will disappear soon as well.

      Actually, someone on FNC did question those statements a while back — I think it was Hannity. However, both Holder and Napolitano contend that those statements were made in re Project Gunrunner, and that DOES seem to be the case. The only thing the video proves is that Holder and Obama had authorized appropriate and effective measures to stop the Mexican cartels under Project Gunrunner.

A contempt vote supported by a large contingent of House Democrats would go along way towards taking a step back in the right direction.       I hope I’m wrong, but I don’t foresee any Dim voting with Repubs on this issue. There is too much at stake, given that it’s an election year. Plus, Obama would go after him/her with a vengeance. He has zero tolerance for even mild criticism from anyone in his camp, let alone treason.       ENCINOM, Care elaborate on that? Please explain us, the obviously unintelligent, how Issa has made this a witch hunt.
      Operation Wide Receiver did occur through the ATF under the Bush Administration. Each and every single op was conducted jointly with the Mexican government. None of the 300 weapons eventually involved were lost. But, once the bad guys caught on and started to inspect the weapons and remove the tracking devices, entire op was stopped. But, it was successful, and a good number of bad guys were caught…and nobody died.
      Now, it took a whistle blower to bring Fast and Furious to the fore front, and the DOJ is still covering after all of this time. Two Americans have died as a result as well almost three hundred Mexican nationals. To you an investigation is a witch hunt? Again, fill us in.

      Steelhead, now, now, now. Let’s not be dishonest. In a real attempt to discover what went wrong with this misguided operation Issa asked a series of questions. Unfortunately Holder chose to lie about what he knew and now that must be investigated. Lying to congress is a felony. Try it sometime and see how you fare. Now Obama inserts himself which means that he either knew of what was going on or that he is laying down political cover for his bud. Either way is bad.

      Sorry you are wrong once again if there is evidence in any correspondence that Holder or any administration official lied during the investigation, executive privilege cannot be used to cover up the crime. This investigation started last year and could have been concluded long before now if your idiot leaders didn’t have something to hide. Guess that doesn’t concern you though they always have something to hide. I really can’t believe that you said that Clinton fiasco was a witchhunt, you really are a freaking moron.
