Get Ready for International Global Warming Lawsuits

As government officials gather this week in Tianjin, China for negotiations under the United Nations Framework Convention on Climate Change (UNFCCC), one group from the United Kingdom is urging developing countries to seek legal action against the world’s developed nations for their supposed role in global warming.

“A large part of the relevant legal literature suggests that the main polluting nations can be held responsible under international law for the harmful effects of their greenhouse-gas emissions,” says attorney Christoph Schwarte of the Foundation for International Environmental Law and Development (FIELD), a UK-based environmental law group.

“As a result affected countries may have a substantive right to demand the cessation of a certain amount of emissions. In selected cases they also have the procedural means to pursue an inter-state litigation in an international judicial forum such as the International Court of Justice in The Hague.”

In a new paper published in time for the UNFCCC meeting, FIELD outlines a proposed legal argument for a lawsuit on behalf of the world’s developing countries, offering some observations on the potential for a hypothetical case brought before an international court or tribunal.

“Today, a credible case for inter-state litigation on climate change can be made,” says Schwarte. “Developing country governments are understandably reluctant to challenge any of the big donor nations in an international court or tribunal. But this may change once the impacts of climate change become even more visible and an adequate agreement remains wanting,” he says.

While UN negotiations over climate change remedies have stalled, FIELD says that a threat of litigation “may help to create the political pressure and third-party guidance” environmental activists need to re-start international negotiations.

    They love to nudge us in every area to get what they want. Cap and trade, go on my pretties…….. Meanwhile ,Al and so many others including our president will get richer and richer. They do nothing unless it benefits them. Poor little stupid American people have to be nudged along for their own good. Redistribution of wealth goes right back into their own pockets leaving us to foot the bill.

      Well, I‘m not sure but I do believe we waved alot of those debts off and someone correct me if I’m wrong but didn’t we waive some debt to keep someone from cutting down some rain forests? Unlike our giving nation you can bet no one is going to waive our debt that’s for sure.

    We must, I repeat….we must stop all foreign aid. It’s the only thing that will get through to all these third world thugs. Cut them off and see how fast they start liking us again. Not to mention we can use the money in the good old USA.

    Then we need to escort the United Nations off our sovereign soil and let them bite some other hand that feeds them. I’m sorry but the U.N. is a total waste of our time and resources.

      I believe one day soon the UN will move out of NY. Maybe after we make it so uncomfortable for them to stay (like pulling out of the global goverment). I really believe that they will move the headquarters to Jersulem. It is the only city in the world that the UN has declared it to be an “international city”. They will do in part to bring peace to the region but its intentions is to take over God’s city because it believes it is the god of the world. This is all in the bible.

      Okay, in future I’ll refer to those gases as “Gases that further the so-called ‘greenhouse effect’ which is a feedback loop that radiates heat back into the atmosphere, causing it to warm up like a greenhouse”. That sure rolls off the tongue nicely.

    Suppressing dissent is nothing new. Italian cosmologist Giordano Bruno taught that stars were at different distances from each other surrounded by limitless territory. He was imprisoned in 1592, and eight years later he was tried as a heretic and burned at the stake. Because he disagreed that the Earth was the center of the universe, Galileo was ordered to stand trial on suspicion of heresy in 1633. Under the threat of torture, he recanted and was placed under house arrest for the rest of his life.”

      “State of Fear” by Michael Crichton is a book I read a few years ago, a great thriller, and the offered true, accurate information about “global warming” that started me thinking about whether the line I was being fed by Al and his crew was accurate. Crichton’s ideas are proving true……..
