Exclusive: 2nd N.C. Mother Says Daughter’s School Lunch Replaced for Not Being Healthy Enough

North Carolina officials have said there was a misunderstanding when a preschooler’s homemade lunch was sent home for not meeting certain nutritional requirements, but now a second mother from the same school has come forward exclusively to The Blaze to say the same thing happened to her daughter.

Diane Zambrano says her 4-year-old daughter, Jazlyn, is in the same West Hoke Elementary School class as the little girl whose lunch gained national attention earlier this week. When Zambrano picked Jazlyn up from school late last month, she was told by Jazlyn’s teacher that the lunch she had packed that day did not meet the necessary guidelines and that Jazlyn had been sent to the cafeteria.

The lunch Zambrano packed for her daughter? A cheese and salami sandwich on a wheat bun with apple juice. The lunch she got in the cafeteria? Chicken nuggets, a sweet potato, bread and milk.

“She never eats breakfast or lunch at the school,” Zambrano said of her daughter during an interview with The Blaze. “We always wake up early and make her lunch.”

It happens “every so often”

That day, Zambrano said she picked Jazlyn up from school and asked if she ate her lunch.

“She’s not picky about food but you have to be on top of her,” she explained.

When Jazlyn said she didn’t eat what her mother had made her, Zambrano went to her teacher and demanded to know what happened. She said the teacher told her an official had come through that day to inspect students’ lunches and that those who were lacking certain food groups were sent to the cafeteria. After she received her cafeteria food, the teacher told Zambrano, Jazlyn was told to put her homemade lunch back in her lunchbox and set it on the floor.

Zambrano said the teacher told her it was not the first time student lunches have been inspected, and that officials come “every so often.”

Part of a regular program?

The policing of children’s food at West Hoke has been portrayed as an isolated incident, but a curious memo Jazlyn brought home to her mother seems to point to something more.

The memo Jazlyn brought from the school outlines the necessary nutritional requirements students’ homemade lunches must contain: two servings of fruit or vegetables, one serving of dairy, one serving of grain and one serving of meat or meat substitute. Included with the memo was a separate sheet, this one a bill for the cafeteria food Jazlyn was served.

The memo, dated Jan. 27 with the subject line “RE: Healthy Lunches,” was signed by school principal Jackie Samuels and said, while “we welcome students to bring lunches from home … it must be a nutritious, balanced meal with the above requirements. Students, who do not bring a healthy lunch, will be offered the missing portions which may result in a fee from the cafeteria.”

Zambrano, who’s volunteered at the school in the past, said she was never told about any such nutritional requirements before her daughter’s lunch was replaced.

“That‘s not really the school’s responsibility,” she said, adding she’s extremely health-conscious and doesn’t feed her daughter junk food or let her drink soda — or even eat the tater tots or other fried foods often served in the cafeteria.

“They give the choice of pizza and hot donuts…none of that is healthy,” Zambrano said.

According to the program requirements for North Carolina’s pre-kindergarten program, schools “must provide breakfast and/or snacks and lunch meeting USDA requirements during the regular school day.”

The partial or full cost of meals, the requirements state, “may be charged when families do not qualify for free/reduced price meals. 
When children bring their own food for meals and snacks to the center, if the food does not meet the specified nutritional requirements, the center must provide additional food necessary to meet those requirements.”

Reached Friday morning, a representative from the Hoke County School Superintendent‘s office denied knowing anything about what happened with Jazlyn’s lunch and said they had no record of a complaint. Reached again, a different representative said they had “no information at this time” about the situation. A West Hoke Elementary official similarly denied any knowledge and referred all questions to the school district.

Principal Samuels previously told the Carolina Journal he “didn’t know anything about” parents being charged for cafeteria meals after the first preschooler’s mother — who has not been identified — came forward.

Bob Barnes, assistant superintendent of curriculum and instruction, told the McClatchy News Service Thursday that the first preschooler to make headlines just misunderstood her teacher when she thought she was told to ditch her homemade lunch for one from the cafeteria: the cafeteria items were only meant to supplement the food groups missing from the homemade lunch.

“We are not the lunch bag police,” Barnes told McClatchy. “We would never put a child in any type of embarrassing situation. But we are responsible to see that every child gets a nutritious meal.”

Barnes confirmed there was an agent from Department of Health and Human Services’ Division of Child Development and Early Education at the school Jan. 30 who examined six student lunches and determined one did not make the nutritional cut — presumably the first little girl whose story made news.

Zambrano said she‘s not positive which day Jazlyn’s lunch was inspected, whether it was Jan. 27 — the date the memo was issued — or Jan. 30. Either way, one of two conclusions seem plausible: more than one student’s lunch was changed, or an official inspected student lunches on more than one occasion — which Zambrano said Jazlyn’s teacher told her had been the case.

In a statement to The Blaze, the Division of Child Development and Early Education said it is investigating what happened but flatly denied any of its employees or contractors “instructed any child to replace or remove any meal items.” The division issued a similar statement to McClatchy even after Barnes said it was one of their agents who examined the lunches.

“It is not DHHS’ policy to inspect, go through or question any child about food items brought from home. The facts we have gathered confirm that no DHHS employee or contractor did this,” the statement said.

      What are the NAMES of these Food Nazi’s?? Why aren’t they named?? Who do they represent?? My wife is a middleschool teacher and has Never had a Lunch inspector in her classroom. If one came in she would have their name and would be on the phone to the Superintendent, demanding the NAMES of who this Food Nazi represents.

      To answer your question, “Who are these food Nazis?” I’d point out that, although the word “nutritional” does occur (once) in the letter from the school, the guidelines being enforced here do not come from the Department of Education, or Health and Human Services, but from the good old USDA. Dollars to fat- and carb-loaded donuts these policies are the work of the farm lobby, where dairy, grain and meat bulk large. You can’t substitute fruit juice one of your fruits/vegatables, or that would leave no room for milk as a beverage. Perhaps the cheese was imported from some nasty place like France, though I doubt these humorless inspectors have the wit to tell the difference.

      Hey, if I my kid can get by on PBJ and a bottle of water then thats good enough.

      This standards BS is just that. Its a screen to hide behind so parents are forced into the school meals program where they corporations make money and so does the district. They need their federal subsidies. My wife tried the county nutrition guide for her daycare kids and it had to be exact and to the letter or she could not get reimbursed. The meager reimbursement did not cover her real costs and she was subject to inspections for the system..so she dropped it and the kids eat healthy home cooked meals, meat, rice, vegetables, fruit, breads, snack crackers etc. The police state grows out of control everyday in this country and the zealots who think they are doing the right thing are part of the problem. Theres just not enough push back on the big government minded progressives like at the school system. This story will be forgotten in a couple of days and business as usual will continue.

      If I still had kids in school and they came thumbing through my sanitary food with dirty gloves or hands, I‘m afraid I’d make a stink. No one touches my kids food unless they go wash their hands and then put on clean gloves. If they want a problem they’ll get it. This is exactly why I hardly ever eat out, because I’m never sure where their hands have been and if they were washed satisfactorily.

      After looking over the image of the ‘guidelines’ and hearing about this inspector for a second time, it’s apparent that whoever on the school staff that authorized this and whoever sent the inspector think parents/legal guardians are incapable of providing healthy sack lunches regardless and/or just want more kids taking school provided lunch.

      The problem is not that they are looking into lunch bags. The problem is that the kids think that it is OK for a government person to inspect their things and take charge of them. That way when they are older the government will have more contol of their stuff.

      What the heck is Environment Rating Scale. I told all of my teacher family members that this is what would happen to all of the schools who were awarded money in Obama’s “Race to the Top” contest. I am absolutely incensed that this happens to innocent children in our school systems. This idiot principal is an Obama sycophant no doubt about it. She probably struts around with a “Holy-than-thou” smirk on her face.

      This makes me upset and angry. If they want a revolution I say we give them one that they will remember all the way back to the holes they crawled out of.

      The cafeteria food is probably union sponsored. We can’t have kids bringing their own lunch and bypassing the union. And everyone knows deep fried tator tots, pizza, deep fried chicken nuggets that are probably made from processed chicken parts ground up and from some other country or milk shipped from some far away union place are far better for the kiddies. I’ll be removing my tongue from my cheek now.

      You know what bothers me ALMOST as much as the nazi-policing of the lunches? Has anybody looked at the grammar in the principal’s letter? Quote: “Although, we welcome students to bring lunches from home; however, it must be a nutritious. . .” Omigosh, my old English teacher would have given me an “F” on this sentence. Better, though I’m no principal: “Although students are welcome to bring lunches from home, they should be nutritious. . .” I tell you, it‘s scary to think of what kind of ’eduction’ and indoctrination our students are receiving in these so-called ‘schools’!!

      Teach your children how to say this; “Where is your warrant sir/ mam?”
      When they continue to press the issue; “I am a minor and refuse to answer any questions without my parent/ guardian/ lawyer present. Any furhter action on your part will be considered harrassment and dealt with accordingly.”
      I would LOVE to see the look on their faces if a 4 or 5 year old dropped this bomb on these idiots.

    I wonder if my favorite sandwich would have been acceptable? I always got a plain jam sandwich. My friend got a peanut butter-lettuce and mayonnaise(PBLM) sandwich. He and I always switched. He liked jam. I like his mom’s PBLM sandwich. Oh and our drinks were almost always water from the water fountain since we were not $$ enough to buy a thermos until I was in Jr. high.

    I still eat my fav PBLM sandwichs anytime I want to see my children nearly throw up :-)

    Great Parenting huh?

    But then, as we have been shown on this site, only “Educators” know what is best for children, not parents.

      I took a half sandwich .. tuna fish with lettuce on white bread and small amount of potato chips to school everyday for a whole year .. I would only buy milk on Wed (chocolate milk day 3 cents) otherwise I too hit the water fountain…. boy I would be in BIG trouble with these food NAZI’S!

      I, occasionally, would have banana and mayonnaise… trying to one-up my brother’s PB and banana… My cousin, who was diagnosed with leukemia, would eat liver sausage. She always got to go home for lunch. Later on, there were always 4 things in my lunch: A sandwich, chips, fruit, a little Debbie or 4 cookies, and a juice box plus money for milk. We had 5 kids (In my family) in school at the same time, so we all got the same thing. Homepacked lunches were ALWAYS more cost effective than school lunches. Our school also always served (as we fondly called it) ‘BBQ Barf on a bun’ on Thursdays. Screw you, DHHS! (Dept. of Humanistic humanism services)

      I also had just a sandwich, it was a half of PBJ wrapped in brown grocery bag paper. The Carter Admin was so bad, we couldn’t afford lunch bags, my mother would take a grocery bag and cut it up into wrapping paper. These teachers seem to have no idea how tight money can be.
      This Admin doesn‘t seem to understand that their constant breaking into people’s wallets is making it more and more difficult for parents to afford to pack a decent lunch.
      I guess looking back, I should be glad I had nuns for teachers and not government goons. The nuns laughed at us for being poor, but at least we got to keep our sandwiches.

      Had a good laugh when I was telling my sister about lunches brought from home being checked out by the food police at schools. She reminded me of when our mom was out of everything else, she’d put rows of pecan halves on a mayo sandwich. You couldn’t afford pecans today, but they were probably more nutritious than anything, and I did remember those days.
      I honestly don’t remember eating at school cafeterias when growing up as it was an added expense and my sis & I seemed to do ok with our own lunches from home. (usually the best food) We were raised very frugally, my sis & I both worked at an upscale family restaurant 3 nights a week and all Sunday afternoon and got our meals. It was fun, helped our Mom out while she went to night school and was a good learning experience for us. We did this for over 3 years. Mom was able to get
      better jobs and finally had her own office about the time we left home. Good memories and I never knew how poor we really were because we made do without complaining. .

      When we needed special clothing for school dances, etc. my mom remodeled them from old clothes she got at used clothing store, and funny enough, our clothes were always admired because she was good at sewing (by hand) and didn‘t expect gov’t to raise us (even if there had been programs then, which there weren’t.) My mom is amazing. She is past mid-90′s now and still has great amount of pride in herself and proud of her 2 girls. Sorry, just came out, memori

    I think what the schools and some of these organizations fail to understand is that just because it is put on a child’s plate, does not mean it will be eaten. Along with that, each meal should not be looked at individually for nutrition purposes. Instead, you should look at what a child is eating over the entire day (or better yet, week).
    My daughter is 7 and takes half a pb sandwich, serving of fruit, 4-6 carrot sticks, and 6 ounces of water (sometimes a few chips or a treat, and once in a while she will get apple juice instead of water).

      That being said, I do think if the government is paying for kids, or families to eat (i.e. free lunches and food stamps) then it is their right to tell them what to eat. There should be a stamp for milk, a stamp for bread, a stamp for fruit, etc. If they do not like it then they can choose to get their food on their own.

      I think you actually believe all the crap you just said. That controlling, anal-retentive attitude will get you just exactly what you want. I’ll bet your spices are alphabetized, aren’t they? Your car’s oil gets changed every 3k miles and a 12 point inspection is done (at least they say it is….) You’ve never in your life been late for a credit card payment and your community is gated and everyone must adhere to HOA rules or they get “notified”.

      It’s people like that who deserve to live under socialism and eventually communism. Everything is ordered, regulated and inspected. Everything and everybody is micro-managed and if you don’t measure up – off to the “re-education” camps you go because you’re a misfit and must be “re-trained“ to follow the ”collective”.

I have worked in several places that actually had employees check off opening and closing procedures on a daily basis. “Turn on lights” “Adjust thermostat” “turn on computer” “enter password” blah blah blah and then are anxious to write you up if don’t do those common sense procedures in the exact order that they dictate!

    I wonder what perks the schools are getting for these “ratings?” Maybe that should be looked into. It‘s obvious that the schools are inspecting these children’s lunches. Wow! It’s sooooooo good to know that the government loves our children more than we do!

Now we see how Obama has managed to increase the debt by over 40% in just three years: We’re paying for things like “children’s lunch inspectors.” Re some other comments: Yes, the intention is to make people think the government knows best and they want to start brainwashing them early. They want parents to think they don‘t know what’s best for their children and to bow to government on all matters. The goal is to condition us all to go quietly into whatever fate the government chooses for us. Now is the time to start changing out our government.     I love they way the notes say the parent will be charged full price unless they meet full or reduced lunch standards. In order to reach those standards you have to fill out paperwork and be approved by the state. If all you ever do is send lunck to school then you have never filled out the paperwork so you will DEFINITLY be charged full price.

    i believe there is way more to this story. First of all, it seems by the memo that the ONLY thing the school is concerned about is their “ excellent ” rating. To achieve this, they must abide by the nazi food police to make sure everyone has “ healthy food ”. It also dawned on me that I would be willing to bet they are getting some kind of state or federal funding, the reason for their ever so important rating. What blows my mind is here in KY, when my kids were in daycare / preschool, they were private organizations, no outside grants. IMO, if it’s not coming to a state near you, it’s gonna. What a load of BS

Americans will say: there are idiots running our country, and they are justifying their jobs because they can’t do other things.       Right! I had custody of my grandsoon for awhile after years of being out of the “school loop” OMG! I couldn’t believe it! This school left little messages on your phone at least twice a day! It was constant fund raising or having to go to the school for “Pizza night” or something! Homework??? That is an understatement! Lets face it “I” was the teacher! ALL his schoolwork was brought home and HAD to be done! Im serious….it was hell on earth!! After a few months of that, I couldn’t handle it anymore..I yanked him out and homeschooled him for a year with a Christian curriculum and it was very pleasant for us…What a difference it made in our quality of life! There is no way in hell I would send a child to those public-useless indoctrination centers!!! Oh I forgot to tell you this part. When I went to the office and turned in his books and took him out they argued with me about it…then a few days later the Principal knocked on my door and questioned me!!!! I flat schooled her…..Of course this is Kahlifornia….but I seriously feel like Im in a HUGE Nazi concentration camp!!!!! Oh Lord come quickly!

      Very good catch SnowLeopard! Control is exactly what this is about. They force the children to bring a lunch that has all of the approved food groups included. They then proceed to tell the child how incompetent or uncaring their parents are for providing such a pathetic lunch. It pits the child and his/her peers against their parents. It is embarrassing for a young child to be singled out in front of other children and told anything disparaging about their parents and the lunch they supplied. The bureaucrats are criticizing something provided with love by most parents for their children and then proceed to let the child know that the government cares more because they provide everything a growing child requires…….especially chicken nuggets. In the long run it is separation of the authority of the parents to feed the child as they see fit and the substitution of the government to supply what the parents will not or cannot. They want our children dependent on the government for everything. Soon parents will have very little say so in their children’s diet and education and the children will be government informants not realizing the goal is to separate the child from the parents. Parents will then fear saying anything anti-government in front of the children because they may get a visit from Homeland Security due to the children telling school officials what their parents said the night before. All of this government control and fear starting out as an improper lunch!

      Comment for GIRLNURSE: Your situation probably would not have happened before the “No Child Left Behind” policy came into being, my mom WAS a teacher and she told me that the No Child policy is a disaster. That and every time a kid is pulled from a school, that school receives just a bit less funding.

    These people are criminals if there ever were any. Suppose the slop they want your kids to eat is not something they like–that kid sits there for the rest of the day with nothing to eat. Who takes responsibility for the kid if they get sick? Trying to feed slop to kids when they want to eat food isn’t going to make them eat–it’ll just make them sick. Sweet potatoes—really !     Let me put this clearly and succinctly, “IT IS NONE OF DHHS BUSINESS”. I am not mandated nor can they mandate that I follow USDA guidelines. They can make the school lunchroom follow the guidelines, but when you start telling me what to feed my child and confiscating that lunch, we are going to have a problem. You better have a damn good lawyer, cause you will need it.

      I clearly think if you could get parents on board all over the country and pull your kids out for a week and everyone does it in the same week, that they will get the picture. They can’t sue you all, they can’t arrest you all, but they can change their policy. This is Michelle Obama’s doing, the same Michelle that says, do what I say and not what I do.       “Not” including the military, the US Gov. is the largest purchaser of
      FIREARMS in America!!!

      A few months back (if some people can remember that far?) the
      “dept.of education” updated their stock of firearms.
      With some mighty“ big stuff ” I might add!

      My question is, Do you think situations like this is why they want this stuff”??

    The food Nazis are coming….people best wise up. This is my state of NC that is doing this…yes, that stands for North Carolina…..We must be kicking off the new programs by the feds…too bad gay marriage will not be allowed in this state, we would be so democrat then. We just threw out the democrats after over 100 years of control, now we have to throw out the feds to finish the job. Geez, the tobacco state has been hit hard with the libterdism bug too, smokers are not received well in out state anymore…you taxes on smokes are though….

      I am also from NC….You are right about this state and democrats. The democrats have been in control for so long it seems like that is the way it is meant to be. However, most of our democrats….with the exception of our governor Purdue are moderate to almost conservative democrats. The party used to be largely populated by southern farmers and the liberalism had no place in NC…..Until Obama was elected. I cannot believe the voters of this state voted for Obama. Although they vote largely democrat in state and local elections they tend to vote republican in presidential elections. As far as the school lunches go, it is not state officials doing the inspection. It is federal employees from the USDA etc.They need to go back to DC or wherever they are from and worry about their own childrens lunch. One of the indicators of how this school nutrition is going is that they count ketchup as a vegetable…..and consider chicken nuggents more nutritious than a turkey and cheese sandwich…..Somehow I guess if the cheese on this poor girls sandwich had been American Cheese it would have counted as the missing dairy item from her lunch.

      this is the 21stc version of busy body women;this time they’re over educated and have to justify their education by meddling in peoples live by creating government policies..no ones dares challenge anything they say or do as they’ll be called anti-woman hence these intrusive prograns are put into place.a post modern form of hysteria and puritanism that feminist over educated women have saturated the culture with.
