Experts: Zimmerman Attorney Made a Smart Move Questioning Investigator During Hearing

SANFORD, Fla. (The Blaze/AP) — By questioning a state investigator on the witness stand during a routine bail hearing, George Zimmerman‘s defense attorney showed some of the weaknesses in prosecutors’ claims that the neighborhood watch volunteer committed second-degree murder, legal experts say.
A judge ruled Friday that Zimmerman can be released on $150,000 bail while he awaits trial on murdering 17-year-old Trayvon Martin during a Feb. 26 confrontation in a Sanford, Fla. gated community.
Zimmerman was expected to post bond with a couple of days and leave jail possibly this weekend.
Zimmerman apologized to Martin’s parents, who were in the courtroom for the bail hearing, in a surprise appearance on the witness stand. Zimmerman is pleading not guilty and claims self-defense.
“I am sorry for the loss of your son,” said Zimmerman, marking the first time he has spoken in public about the confrontation with the unarmed black teen. “I did not know how old he was. I thought he was a little bit younger than I am. I did not know if he was armed or not.”
The apology came after Zimmerman’s defense attorney, Mark O’Mara, questioned an investigator for the special prosecutor, sentence by sentence, about a probable cause affidavit the investigator signed outlining certain facts in the case.
Investigator Dale Gilbreath testified that he does not know whether Martin or Zimmerman threw the first punch and that there is no evidence to disprove Zimmerman’s contention he was walking back to his vehicle when confronted by Martin. The affidavit says “Zimmerman confronted Martin and a struggle ensued.”
But Gilbreath also said Zimmerman’s claim that Martin was slamming his head against the sidewalk just before he shot the teenager was “not consistent with the evidence we found.” He gave no details.
Legal observers said the questioning of Gilbreath was strategically smart for O‘Mara since the investigator’s statements can be used at a later date to either contradict other testimony or be used to decide how to question other witnesses.
“I thought it was a really great thing to do,” said Tom Mesereau, a Los Angeles attorney whose clients have included singer Michael Jackson and actor Robert Blake. “He used the hearing to get information that can only help his defense. What was supposed to be strictly a hearing for bail, he used it as a discovery device, and was able to nail the investigator into making very, very pointed statements about the investigation and about what evidence they have.”
The questioning exposed some of the weaknesses in the state’s case, said Kendall Coffey, a former U.S. Attorney in Miami who is now in private practice.
“There are many miles left in this case but I think O’Mara helped the defense by eliciting those responses,” Coffey said. “He is going to look for the chance to cross-examine that same investigator and ask him the same questions. If the investigator changes his story, he is going to lose credibility with the jury.”
Prosecutor Bernie de la Rionda dismissed any notion that the investigator’s testimony chipped away at their case.
“You have not heard all of the evidence,” de la Rionda said after the hearing. “Please be patient and wait for the trial.”
Bail is not unheard of in second-degree murder cases, and legal experts had predicted it would be granted for Zimmerman because of his ties to the community, because he turned himself in after he was charged last week, and because he has never been convicted of a serious crime.
Prosecutors had asked for $1 million bail, citing two previous scrapes Zimmerman had with the law, neither of which resulted in charges. In 2005, he had to take anger management courses after he was accused of attacking an undercover officer who was trying to arrest Zimmerman’s friend. In another incident, a girlfriend accused him of attacking her.
In taking the stand, Zimmerman opened himself up to questions from de la Rionda, who grilled him on whether he made an apology to police on the night of the shooting, and why he waited so long to express remorse to Martin’s parents.
Zimmerman said he told police he felt sorry for the parents. He also said he didn’t say anything to them sooner because his former attorneys told him not to.
The parents, Tracy Martin and Sybrina Fulton, had no comment as they left the courtroom.. Their attorneys spurned the apology.
“This was the most disingenuous and unfair thing I’ve seen,” said attorney Natalie Jackson. “This was the most unmeaningful apology.”
As part of the bail hearing, Zimmerman‘s family testified that he wouldn’t flee if released and would be no threat to the community.
“He is absolutely not a violent person,” said his wife, Shellie Zimmerman.
Zimmerman’s father, Robert Zimmerman, said that even when confronted, his son was likely to “turn the other cheek.” The father also described his son’s injuries the morning after Martin was shot, saying he had a cut and swollen lip, a protective cover over his nose and gashes on the back of his head.
Zimmerman’s mother, Gladys, said her son worked with two black children as part of a mentoring program that required him to venture into a dangerous neighborhood. “He said, `Mom, if I don’t go, they don’t have nobody,’” she recalled.

However, now that we know what Z actually looks like, there is something that troubles me about his story. Martin was tall and strong (a football player). Z is half his size and build, so it stands to reason that M would have overpowered him if the struggle happened before Z drew his gun. Here‘s the inconsistency in Z’s side of the story: He and his family claim that M jumped him from behind, knocked him to the ground, straddled him, broke his nose and banged his head against the sidewalk. Because M’s full weight was on him and his nose was bleeding profusely, Z was choking and beginning to lose consciousness. That is when Z allegedly drew his weapon.
Sorry, but I find it hard to believe that a tiny guy fighting a much stronger attacker who has pinned him down has the time, ability or even state of mind to repeatedly call for help. That’s not how a grown man reacts (but I teen might). If I were in Z’s shoes, I would have used the little air I had left in my lungs to fight the guy off me, not squeaked again and again for help. How did Z manage to cry out repeatedly and then draw his gun and shoot a far stronger man dead when the attacker was on top of him beating and choking the life out of him? M could have EASILY prevented Z from doing so. Sorry, this is real life, not the movies. Z’s story doesn’t add up.

This may be going too far, but Zimmerman had a Christ-like moment by apologizing, considering what he has been through since this season began. He turned the other cheek and tried to bring some comfort to the parents of a dead child, all while there is a tumult of violent rhetoric, calls for his head on a stick, and too many other sorrows thrust onto him and his family.

Yeah, and Z was busy squeaking for help. C’mon, man. If he didn’t instinctively reach for his gun BEFORE he started swallowing blood from a broken nose AND was wheezing from the weight of the perp on his chest AND was disoriented from having his head banged against the sidewalk, AND was starting to go unconscious, then I don’t see how it was easy for him to draw his gun AFTER suffering such physical injuries.
A knife is far easier to use in close combat than a gun, especially if your oxygen level is running low.

When somebody comes up to you at your father’s funeral and says “I’m sorry for your loss,” it doesn’t mean that they feel guilty or are apologizing for his death.

They exchanged words before the altercation, indicating he was facing Martin when the fight started. Calling for help was probably instinctive. He also said Martin tried to take his gun, which meant that he wasn‘t in the way of drawing it and probably wasn’t actively beating him when he did.
@ PoorRichard – I really can’t blame them for copyrighting it. If I were in their shoes, I wouldn‘t do some of the things they’ve done, but I wouldn‘t want others profiting off of my son’s name.

WHy did they wait three days to claim his body when they most assuredly knew he was the one who had been shot? They were clearly getting rid of evidence of them burglarizing homes in the area, and Trayvon was their new little lookout. A criminal family, now angling to trademark the name of their own boy to get a bag full of loot. Zimmerman is the victim here, and the lesson for everyone is when you shoot a thug, run like hell – the inept police will never figure out who shot him.

Then neighbors would have known who was involved. As soon as the word hit the street about it they would have been calling him or trying to reach him. If the GF was on the phone and talking to him as soon as she heard about the shooting one would think she would be calling TM as well… How with all these folks near by that knew him or would have known he was in the area did it take three days before an ID was made.
Did he have no ID in his pocket…
My brother died in a medical emergency on his own and they tracked me down within hours to tell me and had been trying to reach my Mom all morning by phone.

I know hispanic is a ethinical group meaning anyone who has spanish as their native language in latin america. There are a lot of black hispanics white hispanics etc… But when people in america refers to someone as looking hispanic they mean indian/native looking. Because most people use the term hispanic to describe “brown” people. For some reason it is that way. The term has become racial and not so much ethinical. Zimmerman is mixed(mestizo) but he looks native/indian.
The media thought they had a white, conservative republican and they want it to uses this as polical move to guilt white people to vote for Obama. When they realized the guy didn‘t look white they had to make him white somehow so they wouldn’t look stupid. That’s why they went out of their way to include white in the descrption of the guy.
He is a democrat, there’s no way they can twist and call him a republican. He calls himself hispanic, so the only thing the media can do is add the white to turn this into a racial issue to call white people racist and that‘s why they don’t for Obama etc… so if you’re not racist prove it and vote for Obama etc….. Hispanic means people from Spanish or Portuguese decent and may focus on only Latino/a vs Europeans. These people are a race and a culture. Some have intermixed with people of other European or African decent and Asian as well, but it does not remove their race or override it.
We don’t let the govt tell us who and what we are – that is their attempt to divide us.

Posted on April 21, 2012 at 1:11pmI noticed the prosecutor kept referring to Zimmerman’s act as “a crime.” It is hard for me to even determine how they have probable cause to arrest him based on some phone conversation that supposedly took place by a hostile witness.
It has not been established that Zimmerman committed a crime. That is inflammatory to the court. That prosecutor need to be objected to when he asked Zimmerman questions like “during this crime” did you………..” That prosecutor is playing politics.

They have been working steadily toward that for many years, making sure to fan the flames of hate so that they can live in luxury at the expense of the poorest of black folks. I do believe they actually want to see the country burn. And burn it will, however this case turns out.

Posted on April 21, 2012 at 12:52pmZimmerman is being railroaded .. local news coverage out of Tampa says little about all the threats and violence called for by the local NBPP .. and Trayvon’s lawyer and parents showed a real lack of class saying they did not accept his apology .. Zimmerman was sincere to me .. he didn’t want to kill their son .. but their son ATTACKED HIM .. there IS a lot of evidence to that. They are still being vile and making threats .. Zimmerman’s parents were not at the hearing because they fear for their lives .. Zimmerman was in court with a bulletproof vest under that suit. The Black community is showing their racism daily!

This is just like taking a lie detector test. If you pass the test, you just beat it. If you don’t pass the test then you lied. They got you either way.

To this date, questions about everything regarding the assassination but one thing stands out to me, what went on in the examining room…too many in that room. I only read alittle clip about the examiner of the dead teenager & his findings? Sure, I am a CSI fan, but simple tests are normally made & the examiner’s findings will be a big-part of this trial. After viewing the head & blood on Mr. Z…& what the examiner’s findings were regarding the hands/knuckles of the dead teenager..hummm. We know the “who is involved” but the “why” will never be truly answered (missing few minutes). One alive & one dead. THE EXAMINIER’s findings will be the key and all examiners are human & “never”? have an agenda….lets hope. Guess this trial will set another on going turmoil in today’s America. Second degree, must have (in my opinion which doesn’t mean ditt-a-lee-squat) been based on the examiner’s findings with the dead teenager. Let’s hope the examiner is a truthful & honest man.

I may have to by the “Killing Kennedy” since my relative was Secret Service in Dallas at the time .. in fact in the room when Kennedy was pronounced dead .. but may see if I can get it at the library .. usually load books on my Kindle Fire .. but don’t want him to get that money.

It is likely he has deceived enough delegates to win renomination. He has been vilifying those of us who wish to rid ourselves of him with such statements as the following:
“They’re not Republicans”.
“They’re not conservatives.”
“They’re a bunch of radical libertarians”
“I despise them.”
“I’d like to punch them in the mouth.”
Hatch is a real class act! He just lost my vote, no matter the outcome today at the Convention, and that of many other Republicans and conservatives, who have never voted libertarian in their lives. He will likely be the ONLY Republican I won’t vote for this fall!
