Family of Murdered Border Patrol Agent Files $25M Suit Against ATF

The family of murdered Border Patrol agent Brian Terry has reportedly filed a $25 million wrongful death suit against the Bureau of Alcohol, Tobacco, Firearms and Explosives – claiming Terry was killed with AK-47s that were knowingly sold under the Fast and Furious gunrunning probe to a straw purchaser for drug cartels.
Fox reports:
In a 65-page complaint, attorneys for the family claim ATF “wrongdoing” in Fast and Furious.
“ATF‘s failures were not only negligent but in violation of ATF’s own policies and procedures,” the complaint claims.
The family has also filed suit against the Lone Wolf Trading Company seeking unspecified damages for selling the weapons to the straw purchaser.
The suit says Lone Wolf knowingly sold “hundreds of weapons” to various straw purchasers and realized “hundreds of thousands of dollars in profits from these sales.”
The suit alleges that “but for defendants’ negligent and illegal sales … Brian Terry would not have been murdered in the Arizona desert on December 14, 2010.”
The family is seeking a jury trial.

If not he needs a suit of his own…What a mess.

The judge hopefully will rule against them for not appearing. If the state of GA., wins their case, they will remove Obama from the ballot this year. I understand that a half dozen other states are taking the same approach as GA.

The individual immunity does not hold id the individual involved breaks the law or govt; regulations in his actions as could be argued here. Anyway my bet is that they will settle…….even for $25M. After all, ti‘s YOUR money and thay can not permit ’discovery’ to take place. No, they will settle…..or just ‘take out’ those involved in the tort. Heck, now they can just label them terrorists, kids & all, and have the Army snatch them up in the middle of the night, never to be heard from again. Perfectly ‘legal’ according to the NDAA.

The Bush admin was working with the mexican Gov to nab the runners as they crossed the border but Mexico didnt hold up their end of the bargain (surprise) Then I believe they tried a GPS tracking system that didnt work out so they prretty much nixed the operation. They didnt just let the weapons walk accross the boarder like these assclowns (Obama, Holder) etc. Know your facts before you spew

The point is, under both administrations guns have been going into the hands of Mexican cartels. Being upset with only one administration for the exact same thing shows how biases of people like you and other Blazers.
So, just to be clear, you don’t care that guns ended up in Mexico because of Bush era policies and you only think there is a problem with the policies and operations of the Obama administration. Got it.

Brian’s death was a result of arrogance and treason and the ATF needs to squirm.. why Eric Holder isn’t behind bars makes me madder than a hen.. him and who ever else was in on this Fast and Furious. I hope the family gets every last dime of the 25 million and that finally ISSA will do something more than play like he is doing something. He knows and everyone else knows that Holder is an accessory to the murder of Brian and probably lots of Mexican’s. God help us!

I know they have or would have complete immunity, but they would be technically guilty of murder (they both knew beforehand and there was a reasonable possibility that someone would get hurt). These TRAITORS need to be held accountable. The courts will not do it, so maybe poblic scorn is the best that this poor family can hope for!!!

Hmmmm. Suing the ATF I can definitely understand, but suing the Gun Store is a bit of a stretch. The store owner did not want to make these sales, he was told to by the ATF as I understand it. I deeply feel for this family and understand their anger and frustration but it should be limited to our government and the ATF.

That’s why we have accessory laws as in “accessory to murder.” There also needs to be malicious intent, for which a gun, car or any other inanimate object has no ability to posess. The day a memo from a gun manufacturer is found advocating an unjust killing of a person by a product they intend to manufacturer will be the day we all turn in our arms from that manufacturer, but not until then.
