Food and Drug Administration (FDA) employees are accusing the agency of secretly spying on staff members who told lawmakers it was improperly approving medical devices used to screen for cancer.
The FDA has yet to comment on pending litigation, but Fox News reports that FDA computers do say they have a right to monitor any communication:
Judge Napolitano joined Studio B to discuss the legality of this issue. He brought up the 4th Amendment and said that cases are all over the place. While federal judges have ruled that the employer can look at employee, work-related e-mails and cannot look at private e-mails, Napolitano said, “No judges have said that the employer can look at private e-mails and reveal what they see. That’s a fact and that’s apparently what the FDA did here.”

Posted on February 6, 2012 at 11:25amWhat we are really missing here is why the FDA would intimidate employees into approving medical devices that do no good–and could potentially do harm. The employees, who are all scientists and doctors, warned that three devices in question could miss signs necessary for detecting breast cancer. Another could falsely diagnose osteoporosis; yet another, an ultrasound device, could malfunction when monitoring women in labor. Let’s not let the underlying reason be covered up with a privacy issue!

Posted on January 30, 2012 at 10:07pmAnother example of Big Brother watching everything we do. FDA employees aren’t the only ones that are probably being spied on. There may be other government groups looking over our shoulders and reading everything in our mailboxes. Anything is possible with this administration.

Posted on January 30, 2012 at 10:14pmThe lib view is that individuals no longer have rights….we are all part of the global society. So get used to having your rights tromped upon. Unless we vote these socialists out of office in the next election, our individual rights will be disappearing one by one.

Report Post »The FDA is not impartial and unbiased?
They approve devices they should not?
Surely the device manufacturer has never given any money to anyone who has influence over the FDA – like, oh, I don’t know… President obama?

Posted on January 30, 2012 at 8:45pmNot really. In five years I have seen 3 people fired in my division. There is a “Parole” period, and there was a few “Old Timers” that were past retirement, and were pidgeon-holed, kind of forced to retire. But for the most part, you are correct, just go to the DMV, wonderful service, and such happy service (if they were only allowed to spit on you, that would make their day).

Posted on January 30, 2012 at 8:27pmThey may be able to look at the email but not persecute or penalize employees for talking to congress. That is a clear criminal violation of the Federal Whistle Blower Protection Act.
