Fed Appeals Court Tosses Virginia Health Care Lawsuit Over Individual Mandate

Federal Court Rules Virginia Cant Challenge Individual MandateEarlier today, the 4th U.S. Circuit Court of Appeals overturned a lower-court ruling that found that the federal government cannot force Americans to purchase health care insurance.

Known as the “individual mandate,” this portion of the health care legislation has been highly controversial. This is a major victory for proponents of the legislation, though the battle is far from over. This most recent decision reinforces the notion that the health care battle will inevitably be settled in the Supreme Court. The Hill has more:

Most legal observers expect the [Supreme Court] to hear arguments during the term that begins in October and rule in the summer of 2012.

The 4th Circuit’s long-awaited decision isn’t a huge surprise: People who attended oral arguments in the suits said the judges seemed skeptical of the mandate’s critics, especially Cuccinelli. All three of the judges who heard the case were appointed by Democratic presidents, and two were appointed by Obama.

This is the second time an appellate court has ruled in favor of the government’s right to require that citizens purchase health care or pay a penalty. The decision follows another similar one in Cincinnati, where the law was also upheld. But a separate appeals court, in Atlanta, ruled against the individual mandate.

So far, more than 30 legal challenges have been launched against the law.

      Our entire system is corrupt. Liberalism aka progressivism is the most destructive force in this country operating in shadows for decades. Its only now that its all out in the open b/c these radicals can no longer hide their actions. The process of appointing judges needs to be changed they must be heavily vetted before appointment. The people need to know where these people stand politically so we know what we are getting.

      If this recent decision isnt an indicator of how dangerous it is to have liberal in positions of power I dont know what will at this point with everything going on. No part of our govt structure in this country is safe to run to at this point. We cant trust our executives, legislators and now our justices.

      I really have little confidence the Supreme Court will overturn Marxist-Care because people in general nowadays – especially those in positions of authority – have no stomach for controversy because life’s become much too easy for them. Well, they‘re certainly doing all they can to make sure life ain’t so easy for the up-and-comers that have their heads screwed on straight.

      It’s wild how what was fought for so brutally can be undone in a matter of a generation or two, and nobody really caring – it’s crazy.

      Either the Mandate is Legal or Illegal it’s not an opinion and not party affiliated, or is it? I’m not a lawyer but as a citizen of the US – ObamaCare is an illegal mandate and the federal government doesn’t have authority over my individual choice to purchase anything. This is another example and attack on peoples individual rights. Vote for the right people to change this destruction of our rights and the constitution. I ask, do we need another ponzi program? Why don’t we spend more time educating people on nutrition, improve the quality of our food supply (as opposed to toxic and nutritionally deficient), teach people self-help (in our schools K-12), advertising and incentives to restaurants. If you educate our generations to select the right products enterpreneurers will have no choice or go out of business. I could go on but you get the idea.

      The first one wasn’t over slavery, it was to beat down the south. The steam engine had been invented, and the south no longer needed fast moving northern streams to mill your wheat, corn and to run factories, all the wealth was migrating south. The rich progressive northerners couldn’t have the south becoming wealthy, so they came south took what they could, burned what they couldn’t.

      This law will either be removed as Unconstitutional or Al Qaeda will be remembered as the good olds when times were safe. Enslavement to the whim of a Government is not an option. If we are forced to declare our independence once again, I will be proud to stand on the side of Individual Liberty and Freedom as they did against the British and the South. Give Me Liberty or Give Me Death.

      Luckily with so many feeling this way, I doubt SCOTUS will let this stand.

      Given the state of our Federal courts these days–stuffed with Progressive appointees–it is very chancy to leave the fate of Obamacare to the courts. One ruling in the wrong place could torpedo the entire “kill Obamacare” movement. What we NEED is to elect people who will work to REPEAL this monstrosity. Everybody agrees that “something” needs to be done about the health care system in our country, but it is a complex issue involving excessive malpractice suits, greedy insurance companies and numerous other issues. What is NOT the solution is to hand control and the running of the ENTIRE health care system over to a government that has already proven on numerous occasions that they cannot handle ANYTHING without screwing it up and making matters worse.

    If Obama was so confident that his radical Obamacare law WAS in fact constitutional, then they would be the ones to fast track this to the Supreme Court. I guess they are waiting to see if maybe he can replace some conservative justices with liberal activist judges. Obamacare will be the thing that defeats Obama himself aside from his failure to grow the economy.

      You atre correct. I canceled my health care insurance since it was over $4,000 a year. I prefer paying the penalty which I believ is only $1,000 – that’s a svaings!. Then once the country goes belly up, we can blame Obama and the Demos for forcing this on us!

      This is not the case – reason why this is not fast tracked to the Supreme Court is merely due to the overwhelming size,scope and reach of this entitlement. This is the Cancer of all Cancer’s if you catch it early enough theres a very good chance of getting rid of vial disease. If you let it fester long enough it is impossible to get rid of it. I am sick and tired of this “Free County” in it’s current state, free for illegals, criminals, low lives, unjust and immoral individuals. If you believe that you are a rightous, caring, hard working, respectful to others type of an individual then this Free Country is too expensive.

      It’s a shame when the there is an overwhelming percent of the population (70 PERCENT) do not favor this law – over 1/2 the Union sued the Feds – THE BIGGEST ARGUMENT THAT HAS EVER DIRECTLY CHALLENGED OUR CONSTITUTION – can the federal government force its citizen to purchase a product ((sorry not a right never will be a right dont even bring that garbage up here)) CANNOT BE HEARD IN OUR SUPREME COURT FOR YEARS — SO RIDICULOUS – PREPOSTEROUS AND MAKES ME SICK.

      I’m worried…I read the ruling. What really bothers me is the reasoning that was used in coming to their decision. The court never addressed the issue of the constitutionality of the individual mandate; instead, they ruled that since the state of Virginia and it‘s sovereignty was not directly harmed by this mandate that the state of Virginia did not have the right to question it’s constitutionality. They ruled that the state of Virginia did not have the right to act on the behalf of it’s own citizens, but could only act on behalf of the state of Virginia (Are not the people what makes up the state?). With this logic (or lack thereof), can this hinder the efforts of the other states bringing similar suits? In the end, will this require a class action suit brought on behalf of millions of individual US citizens? This whole thing is totally insane!

      @ Janice I have not read the decision, but what you describe is a “standing” problem. Under Article III of the Constitution, a litigant must essentially “have a dog in the fight” in order for the courts to have jurisdiction. If a party loses based upon standing, though, the issue presented is not decided and another party WITH standing can bring it in a following case.

      You are soooo right. Nancy Pelosi said that the government run healthcare was necessary so that people didn’t have to worry about maintaining a 9 to 5 job, it would free them up to pursue painting (art), or music, or whatever your little heart desires.

      Pelosi: “We see it as an entrepreneurial bill, a bill that says to someone, if you want to be creative and be a musician or whatever, you can leave your work, focus on your talent, your skill, your passion, your aspirations because you will have health care. You won’t have to be job locked.”

      Yes and I know Obama appointed ‘a wise latino’ woman justice that is a egotistical racist, LA RAZA member and open borders advocate. I am sure she will vote for anything that is in opposition to the constitution.

      the law in on the books to allow the government to invade your band account to take the money to pay for your insurance. it is in the Health Care Act .. check it out! I wish it were otherwise. Tyranny in its purist form.

      Years ago, State and Federal employees were forced to accept direct deposit.
      Retirees also had no choice in the matter. They now have direct “access” to all State and Fed
      employee accounts.
      They also have access by SS numbers.

I WILL NOT go to a guy who says “well, it could be this, let’s try that“ or ” we tried different tests and it’s inconclusive“ or ”The knee we replaced last month has been recalled and we need to replace that one again“ ”Yes I know this is your 6th replacement“ or ” those drugs we gave you last week from that huge Pharma company, that has lobbyists in D.C., and is in bed with the Global elite, have been recalled. They have 10 very bad side, lethal effects including instant death from bleeding stomach, I am sorry you will have to endure those sniffles, until we find another drug”. “I don’t get it, These were approved by the FDA last month”

      There are other courts that have ruled that it is in fact unconstitutional. The justice system has not been hijacked, there are just different opinions among justices….like always.
