Fed Appeals Court Tosses Virginia Health Care Lawsuit Over Individual Mandate

Earlier today, the 4th U.S. Circuit Court of Appeals overturned a lower-court ruling that found that the federal government cannot force Americans to purchase health care insurance.
Known as the “individual mandate,” this portion of the health care legislation has been highly controversial. This is a major victory for proponents of the legislation, though the battle is far from over. This most recent decision reinforces the notion that the health care battle will inevitably be settled in the Supreme Court. The Hill has more:
Most legal observers expect the [Supreme Court] to hear arguments during the term that begins in October and rule in the summer of 2012.
The 4th Circuit’s long-awaited decision isn’t a huge surprise: People who attended oral arguments in the suits said the judges seemed skeptical of the mandate’s critics, especially Cuccinelli. All three of the judges who heard the case were appointed by Democratic presidents, and two were appointed by Obama.
This is the second time an appellate court has ruled in favor of the government’s right to require that citizens purchase health care or pay a penalty. The decision follows another similar one in Cincinnati, where the law was also upheld. But a separate appeals court, in Atlanta, ruled against the individual mandate.
So far, more than 30 legal challenges have been launched against the law.

Our entire system is corrupt. Liberalism aka progressivism is the most destructive force in this country operating in shadows for decades. Its only now that its all out in the open b/c these radicals can no longer hide their actions. The process of appointing judges needs to be changed they must be heavily vetted before appointment. The people need to know where these people stand politically so we know what we are getting.
If this recent decision isnt an indicator of how dangerous it is to have liberal in positions of power I dont know what will at this point with everything going on. No part of our govt structure in this country is safe to run to at this point. We cant trust our executives, legislators and now our justices.

Well, they‘re certainly doing all they can to make sure life ain’t so easy for the up-and-comers that have their heads screwed on straight.

I’m not a lawyer but as a citizen of the US – ObamaCare is an illegal mandate and the federal government doesn’t have authority over my individual choice to purchase anything. This is another example and attack on peoples individual rights. Vote for the right people to change this destruction of our rights and the constitution. I ask, do we need another ponzi program? Why don’t we spend more time educating people on nutrition, improve the quality of our food supply (as opposed to toxic and nutritionally deficient), teach people self-help (in our schools K-12), advertising and incentives to restaurants. If you educate our generations to select the right products enterpreneurers will have no choice or go out of business. I could go on but you get the idea.

One ruling in the wrong place could torpedo the entire “kill Obamacare” movement. What we NEED is to elect people who will work to REPEAL this monstrosity. Everybody agrees that “something” needs to be done about the health care system in our country, but it is a complex issue involving excessive malpractice suits, greedy insurance companies and numerous other issues. What is NOT the solution is to hand control and the running of the ENTIRE health care system over to a government that has already proven on numerous occasions that they cannot handle ANYTHING without screwing it up and making matters worse.

Posted on September 8, 2011 at 1:29pmI’m worried…I read the ruling. What really bothers me is the reasoning that was used in coming to their decision. The court never addressed the issue of the constitutionality of the individual mandate; instead, they ruled that since the state of Virginia and it‘s sovereignty was not directly harmed by this mandate that the state of Virginia did not have the right to question it’s constitutionality. They ruled that the state of Virginia did not have the right to act on the behalf of it’s own citizens, but could only act on behalf of the state of Virginia (Are not the people what makes up the state?). With this logic (or lack thereof), can this hinder the efforts of the other states bringing similar suits? In the end, will this require a class action suit brought on behalf of millions of individual US citizens? This whole thing is totally insane!

Under Article III of the Constitution, a litigant must essentially “have a dog in the fight” in order for the courts to have jurisdiction. If a party loses based upon standing, though, the issue presented is not decided and another party WITH standing can bring it in a following case.

They have 10 very bad side, lethal effects including instant death from bleeding stomach, I am sorry you will have to endure those sniffles, until we find another drug”. “I don’t get it, These were approved by the FDA last month”
