Fed Appeals Court to DOJ: You Have Until Thursday to Explain What the President Meant by Unprecedented & Unelected GroupA federal appeals court has ordered the Justice Department to clarify comments made by the president when he said yesterday that it would be “unprecedented” for the Supreme Court to overturn his signature health care law (“Obamacare”).

“I am confident that this will be upheld because it should be upheld,” President Obama said.

“Ultimately I am confident that the Supreme Court will not take what would be an unprecedented, extraordinary step of overturning a law that was passed by a strong majority of a democratically elected Congress.”

He continued:

And I‘d just remind conservative commentators that for years what we’ve heard is the biggest problem on the bench was judicial activism or a lack of judicial restraint, that an unelected group of people would somehow overturn a duly constituted and passed law.

Well, this is a good example. And I’m pretty confident that this court will recognize that and not take that step.

And since making these remarks, a three-judge panel for the 5th Circuit Court of Appeals has told the DOJ that it has until Thursday to explain whether the Obama administration believes the courts have the right to strike down a federal law.

Fox reports:

One justice in particular chided the administration for what he said was being perceived as a “challenge” to judicial authority — referring directly to Obama‘s latest comments about the Supreme Court’s review of the health care case.

The testy exchange played out during a hearing over a separate ObamaCare challenge. It marked a new phase in the budding turf war between the executive and judicial branches.

Judge Jerry Smith asked the government attorney whether Attorney General Eric Holder believes judges can strike down federal laws.

“Does the Department of Justice recognize that federal courts have the authority in appropriate circumstances to strike federal statutes because of one or more constitutional infirmities?” Judge Smith asked.

The lawyer then cited Marbury v. Madison, “the landmark case that firmly established the principle of judicial review more than 200 years ago,” CBS News reports.

However, despite her response, Judge Smith was unsatisfied, specifically referencing when President Obama called the judges an “unelected group.”

He then told the attorneys that the DOJ must address this issue in “no less than three pages, single spaced” by noon on Thursday, according to Fox.

“I would like to have from you by noon on Thursday — that’s about 48 hours from now — a letter stating what is the position of the Attorney General and the Department of Justice, in regard to the recent statements by the president,” Smith said.

“What is the authority is of the federal courts in this regard in terms of judicial review?” Smith asked.

But what’s really going on here? Allahpundit of Hot Air (“Hot Gas,” if you’re from Texas) offers some insight:

…Obama himself never went so far yesterday as to say that the Supreme Court lacks the power to overturn laws. He said overturning ObamaCare specifically would be “unprecedented,” but no true-blue Warren-Court-loving lefty like The One would ever seriously impugn judicial review.

And the Fifth Circuit knows it. What they’re doing here is humiliating him as a way of getting him to stop the demagoguery, with the letter acting as the equivalent of a kid writing on the blackboard as punishment after class. “I will not question Marbury v. Madison, I will not question Marbury v. Madison, I will not question…”

Since the appeals court issued its order, the Obama administration has responded via White House Press Secretary Jay Carney.

“Of course we believe that the Supreme Court has, and the courts have, as their duty and responsibility the ability of striking down laws as unconstitutional,” Carney said Tuesday, according to Fox.

Carney said the president was specifically talking about “the precedent under the Commerce Clause” regarding a legislature’s ability to address “challenges to our national economy.”

Update - Attorney General Eric Holder said Wednesday that the Justice Department will respond “appropriately” to a federal appellate judge in Texas who demanded a letter recognizing the authority of the federal courts to strike down laws passed by Congress.

On Wednesday, Holder acknowledged the courts have “the final say” and defended the president’s remarks. He shrugged off a reporter‘s suggestion that reaction to Obama’s comments have become a distraction.

“What the president said a couple of days ago was appropriate. He indicated that we obviously respect the decisions that courts make,” Holder said at a press conference in Chicago.

“Under our system of government … courts have the final say on the constitutionality of statutes. The courts are also fairly deferential when it comes to overturning statutes that the duly elected representatives of the people, Congress, pass,” Holder said.

Obama‘s comments didn’t break “any new ground,” he added.

“I think he said in some ways that which is obvious,” Holder said. “He talked about the way in which Supreme Courts have typically looked at legislation.”

Holder said he’s confident the Supreme Court will find the Affordable Care Act constitutional “given the adequate, able representation” the law had during arguments before the justices.

      I’m glad they challenged him on it. I know it doesn’t mean much—but this isn’t the first time he has chided the courts. Anyone can play semantics on this and say it wasn’t exactly what he said—but I call b.s. He knew what would be HEARD was the courts didn’t have the right to turn over a law passed by a “democratically elected” (aka stolen) Congress. (notice he pulls the D.E. card whenever talking about a law he knows the public doesn’t like? “you voted them in–too bad, now we do what WE want) Not only did he do that, but he then called them an UNELECTED group of people as if their power is solely dependent upon his.       Over the years I have gotten good at reading between the lines and adept at political-speak. In the above sentence replace the word ‘challenge’ with the word “THREAT” and you have the exact meaning of that very short but accurate statement.

      I shouldn’t be, but I was still shocked by the president’s statements about this. It goes right along with the intentional brainwashing that this country is a democracy rather than a constitutional republic. I’ve been correcting people since high school, trying to get people to understand the difference. I’m amazed at how many brick walls I run into. Most people just have no clue and the lefties absolutely freak out if their precious “democracy” is challenged. It‘s the most provable thing in the world and still most people either don’t care or will fight against the assertion we are a republic.

      The first in a long line of steps to alter our form of govt into a democracy was when they passed the 17th amendment allowing senators to be elected by popular vote, rather than appointed by the states as intended. The courts have been under attack for just as long. They don’t even bother teaching lawyers the constitution any more, just precedent. Now we have a full-on assault on the judicial branch from the executive. The legislative branch has freely given their power, but it looks like the judicial may fight back. God bless this judge and all others who are willing to stand against this attack.

      Obama either doesn’t understand our system (unlikely), or is blatantly lying to subvert it (very likely). The next time someone asserts we are a democracy, or that democracy is the ideal, explain to them that democracy is 2 cats and 1 mouse deciding what’s for dinner.

      Goal all you want about this demand, but the 5th Circuit Court is making Obama’s case for him. The judiciary has become so politicized that judges no longer feel the need to follow court precedent, or even ask reasonable questions instead of following party talking points. Presidents have been commenting on Supreme Court cases forever without courts feeling the need to interrogate them on what they mean.

      The 5th Circuit Court covers Louisiana, Mississippi and Texas. Take a wild guess if most of those judges are Republicans or Democrats. Look at the way the judiciary reacted to the Health Care law: judges appointed by Democrats upheld it. Those appointed by Republicans rejected it. Every state that joined in the suit is Republican-run. Whatever issues of LAW are to be decided are completely subsumed by the POLITICS of the day.

      At least y’all will have a chance to vote Obama out this year and even if you fail, it’s just four more years. Imagine if you were stuck with him for life.

      The Judge overstep his bounds and needs to be smacked down. The Roberts court has become a 5/4 political body. The law and precedent is against finding the AHA unconstitutional, but the fact that Roberts didn‘t pressure Thomas to step down shows that this won’t be a legal decision but a political one.

If not, perhaps you can learn about debating skills (at least somewhat) once you get to Geometry and then Algebra II where you will learn about proofs. If you work hard, you may get the hang of the principles at least even is you don’t master the skill

He tried several years ago when he gave his State of the Union speech and Chief Justice Roberts mouthed “NOT TRUE”in 2010, concerning the Supreme Court’s decision on a campaign finance case. Soon, our courts will be obsolete – give it a few years.

It could be Romney, another man with a false facade. Romney could step into the WH with his MODERATE beliefs and seal what Obama has started – THE END OF AMERICA AS WE KNEW IT.

      I re-read the constitution and I see no indication that the SCOTUS is the sole arbiter of constitutinality.

      Jefferson indicates in later writings that ALL branches of government have the power to overturn laws based on a constitutional test, and as well states may nullify unconstitutional laws as unjust.

      SCOTUS may overturn passed legislation. Congress may pass laws overturning previous unconstitutional legislation. POTUS may refuse to enforce unconstitutional statues. States may officially disregard unconstitutional law, forbid enforcement, and even task state-level law enforcement to prevent federal action.

      I remember when I was attending college. One course, I had a B on the FIRST test of the semester. But, the Professor averaged it out and I got a C. I was furious. At the time, I had no clue that socialism was even in this country (thank God for Glenn Beck enlightening all of us). I went to the Prof and asked him why and he told me that the new policy was to average the grades in his class. At the time, I had no spine, but I did know that someone else got part of my B and the whole class did not do well. Since it was the first test of the semester, I dropped that class because from what I heard, not all Professors averaged grades. I worked hard for that B, working full-time and going to night school 5 nights a week and taking care of a family. From then on, I went to each Prof to ask them if it was their policy to average. Most said no, at least in the course curriculum I was taking, so I tried to get them as my Professors. I came out of that college with a 3.94 grade, without averaging, so you see what would have happened if I had teachers who averaged – it would have been probably, 2.94.

      Averaging is a LIE of the devil and these socialist Professors should be thrown out of their tenure. Students can do this by STOP GOING TO THEIR CLASSES. When they fail to meet their quota each semesters, their classes will be cancelled. But, THE STUDENT MUST TALK TO THE PROFESSOR BEFORE THEY SIGN UP FOR CLASS TO SEE IF THEY ARE SOCIALIST OR NOT.

      In my humble opinion, Obama studied the Costitution not out of any admiration for it but only to understand how to undermine and dismantle it. Thankfully it is not that easy to do. The Founders in establishing three branches of government understood very well that the inherrent nature of men to be scoundrels when given power and thus set three groups of scoundrels to watch each other. They called it checks and balances. On any given issue you can almost guarantee that two of the groups will band together to keep the third from gaining the upper hand, or vice versa. Obama isn’t the first president who has tried to grab too much only to be taken down a notch. The courts may be liberal in many aspects but they are not about to have the Executive telling them how to do their own jobs.
      Don’t believe for a minute that “gridlock” is a bad thing. That is what checks & balances is all about.

      which covers due process and equal protection – applicable for a community organizer. That he has no concept of how the Constitution works was evident when he cited a pre-new deal state court case to back him up when he tried to clarify his original faux pas on Tuesday. Maybe he wrote something about all this in the Harvard Law Review unless he was really just a gofer.

    It is time to find the commerce clause, in spite of being a part of the constitution, unconstitutional. One can make an argument that it defeats every other clause in the constitution, so therefor, it is incompatible and illegal.

    Sure, the congress passed it, and states ratified it, but would anyone think that a law passed tomorrow erasing the authority of the courts and the congress and the rights of the people (all of them) would be constitutional?

    Because that is exactly what the commerce clause does.

      I would caution folks in the study of the “Commerce Clause”, because its not a Federalist triumph as is being falsely pushed. It was originally a tool of centralization and mercantilism.

      I‘ve long held issue that Glenn’s book, “Original Argument” only gives one side of the argument – and ignores the Anti-Federalists who actually are responsible for the Bill of Rights, which the Federalists were actually arguing against. The Anti-Federalists also had the commerce clause accurately pegged. No study of the Constitution should be undertaken without both viewpoints, Federalist and Anti-Federalist.

      The Confederate Constitution kept the Commerce Clause’s original wording, but added the following: “…but neither this, nor any other clause contained in the Constitution, shall ever be construed to delegate the power to Congress to appropriate money for any internal improvement intended to facilitate commerce;…”

      The Confederates backed this up further by adding clarifying language in the “to lay and collect taxes…” clause preceeding the commerce clause. The addition after a verbatim copy of the US Constitution said, “… no bounties shall be granted from the Treasury; nor shall any duties or taxes on importations from foreign nations be laid to promote or foster any branch of industry; …”

      This is a very interesting turn of events. If SCOTUS rules “unconstitutional” (and they will) POTUS will say it is a radical, payback move on their part for the (wrongly) perceived attack on them.

      POTUS clearly is trying to intimidate SOCTUS…I think this will get MUCH more ugly as we approach the “American Spring” being set up by these traitors.

      Buckle up people…gonna be a bumpy ride this summer. Are we going to see the Second American Revolution, another Civil War, Martial Law or Military Coup?

      I think POTUS is going to go for Martial Law to control the useful idiots called occupy and prevent the upcoming election, which will lead to one of the other examples I’ve listed above.

    President Obama in a state of the Union address talked about the Supreme Court decision regards corporation ability to contribute like an individual in elections. He made some strong statements then about how the court overturned 100 years of law. Apparently president Obama believes the court then could overturn “law” and knows the court is set up as the third branch of government with the duty to rule on constitutionality of law from the branch of government that makes law.

    President Obama is once again trying to make an issue “political” to gin up his base, especially since he most likely was given inside information about the decision the Court has already made. President Obama is more than happy to have courts overturn laws made by duly elected government legislature as long as the laws overturned are laws that he doesn’t agree with.
