Fed Judge: Calif. School Was Right to Forbid Students’ American Flag T-Shirts on Cinco de Mayo

This question has been at the heart of a California court battle between the Morgan Hill Unified School District and students who were told by a principal and assistant principal that they could not wear American flag t-shirts on the Mexican holiday back in 2010.

Following the incident, a lawsuit against the district was launched by the students and their families. This week, the case came to a close, with a federal judge ruling against the students — a blow that is likely to infuriate some free speech advocates.

According to U. S. District Court Judge James Ware, the district did not violate the students’ first amendment rights. The judge also found that officials‘ concern over the potential violence that could be incited by the students’ pro-American outfits justified the school’s actions. The Morgan Hill Times has more about the case:

[The parents and students] filed the lawsuit against the school district alleging violations against their First and Fourteenth Amendment rights after their children wore American-themed T-shirts to Live Oak and were sent home after refusing to remove the shirts and apparel after Boden and Rodriguez were concerned about the potential for violence on campus…

The lawsuit sought nominal damages including changing school policies to clearly state students’ rights and protections under the Bill of Rights and reimbursing lawyer fees and expenses for the cost of litigation.

Here’s a bit more of the background: After noticing that the students were wearing pro-American garb on May 5, 2010, Assistant Principal Miguel Rodriguez subsequently approached the kids, telling them to to either remove the garments or to turn their shirts inside out. School Principal Nick Boden was apparently also concerned over the potential for the outfits to create issues between Hispanic students and those wearing the clothing (both men were named in the lawsuit as well).

Following their refusal to comply, the students were allegedly taken to the school’s office where Rodriguez talked with them about Cinco de Mayo. He apparently told them that their clothing would offend Hispanic students who observe the holiday.

The Rutherford Institute and the Thomas More Law Center teamed up to represent the students and their families. John Whitehead, the president of Rutherford, was obviously less than content with the final decision. “This is nothing more than political correctness,” he said. “If these kinds of decisions are upheld, they will destroy our First Amendment rights.”

The school district, though, defends the principal’s actions and is elated by the recent decision. Wes Smith, who served as superintendent of the school district, says that he is very satisfied by the outcome. “We were encouraged to hear that the federal court found student safety paramount,” he said.

These comments seem somewhat disconnected from the statements Smith made just days after the incident unfolded. ”This has certainly been a very difficult time for our school district,” he said at a press conference on May 7, 2010. ”School leaders have to make judgment calls on when to take preventative measures to pre-empt a possible incident or conflict. In this situation, it appears that a decision was made too quickly.”

Rutherford is planning to appeal the court’s decision.

    First of all… It is very disrespectful to wear the flag of the united states of America anywhere on your body!!!! There are strict guidelines for the display of our flag. People are only showing their ignorance by wearing it.

      The flag may only be worn on the utility and organizational uniforms (such as the camouflage BDU). The flag may only be worn during joint-duty and multinational deployments. When the servicemember returns to home station, the flag must be removed. (Guide Note: A message went out in February 2004 changing this restriction, and making the U.S. Flag a mandatory uniform componant for all soldiers, effective October 1, 2005). Then every soldier in the U.S army must be pretty disrespectful because it’s part of their uniform.

      First of all, you are a twit. There is a difference between cutting up a flag, using it as clothing or putting it around your neck as a cape and using material that has images of the flag on it or are made of material that is printed to look like the flag.

Let each State decide how the money that is presently being stolen from their residents should be spent. The government does not know best, look at all the failed policies and practices.

It is celebrated nationwide in the United States and regionally in Mexico, primarily in the state of Puebla.. The whole country doesn’t celebrate the damn day… Contrary to widespread popular belief, Cinco de Mayo is not Mexico’s Independence Day—the most important national patriotic holiday in Mexico—which is actually celebrated on September 16…….They should ask all those mexicans if their parents were throwing a party that evening to celebrate.. Nope !!!

      I’m so confused. Do I love my flag if I wear it or am I disrespecting it? Is it OK to wear a picture of a flag and not an actual flag? If a flag has 40 stars is not really a flag and I can wear it? Can I wear the flag only above my waist? Can I fashion it into a cute little sun dress with spaghetti straps for Barber2 to wear? This is just so difficult. Perhaps we should just burn all the flags and fix the problem once and for all. (OK, now that’s called a cue. All the veterans and chickenhawks who insist on taking all the credit for America are officially invited to chime in.       First of all the real issue is that the school and fed excuse for a judge are cowards and liberal pieces of crap…this is America and we are proud of our flag and every American has the right to wear it and it is everywhere on all types of clothing. I believe that this is the PC BS that is killing this country and the attitude of every American should be if the mex **** roaches don’t like it…get the hell out of our country. The school officials need to be fired and replaced as well as the coward socialiast pc person who is in the judges position (I won’t call him a judge because he is clearly not capable of the role).

      What’s more disrespectful to the flag is denying people the right to display it on their clothing. I‘ll proudly wear my flag T’s whenever and wherever I want and if someone thinks they can take it off me, they’re welcome to try. That includes you, Bushmaster. Your statement is so far from the truth it stinks. My vet organization sells hundreds of flag embossed T’s every year, among other items with the flag embossed on them- hats, knives, book covers, you name it. We’re proud of the flag and what it represents, have all fought for those colors.
      As for this POS school in Commiefornia: Cinco de Mayo is a Mexican holiday, not an American day of reverence of celebration and if the wetbax want to celebrate it, they can go back to Mexico.
      Personally, I think there should have been a larger disruption in the school than there was: every American student should have stood up for the flag wearers and if the wetbax wanted to do something, then go for it.
      Your statement does nothing for America but says a lot about your liberal position.

      Oh no I did not just read this. Are you serious? These students did not “wear American flags”, they wore patriotic attire. This flag belongs to us, the American people. I absolutely agree with SMITHCLAR3NC3 defund this district. I am not giving up California, (although I do believe at this point in time it is the land of fruits and nuts) it is part of our United States and I am no longer in the mindset to give them something so they will go away. I just want them to go away the same way they came in, empty handed! If they are afraid of violence there is a simple answer d-e-p-o-r-t-a-t-i-o-n.       Bushmaster, wearing a REAL American flag IS disrespectful. Showing your patriotism by wearing clothing that has DESIGNS that resemble the flag is not disrespectful. Had they cut up a flag and sewn it into clothes, I’d be with you. But they didn’t. No one does that.

      Also, the judge should who made this ruling should be strung up in the city center or at least thrown into a set of stocks for at least 2 days while people get to ridicule him and throw rotten vegetables at him. He should also lose his job and standing in society. He is an usurper of our rights as human beings and should be treated as such.

In the mean time, the rights of these kids have been violated once again over the display of our flag because it might have caused violence. Yeah? Violence FROM WHO?       Why is it “unsafe” to wear or display the American flag? If it’s “unsafe”, it’s not the display of the flag, it’s those who would react violently to it, that are the problem.       Time to deploy the National Guard all along the border. Maybe throw in some landmines, Abrams Tanks, some drones. After the border is secure I think it is also time to start charging Mexico for every single one of their citizens that decided it was a good idea to come over here and start squatting and using up resources that should be only going to natural or legalized citizens.

      Problem is, no one in our current political system HAVE THE BALLS to do such a thing.

      First of all, it is spelled “judgment.” More significantly, your slavish attitude towards the judiciary is downright scary. I suppose that you would have scoffed at critics of Scott v. Sanford (the “Dred Scott decision”) and Plessey v. Ferguson. After all, those were decisions favored by the Democartic Party.

      Yes, he was letting them know they offended “his people,“ like Eric Holder wants to give ”his people” a pass when they commit crimes against whites.

      This ignorant judge doesn‘t seem to understand that there wouldn’t be an issue if Cinco De Mayo were not allowed in the US, as would rightfully be the decision in this sitution. If he’s not a left-wing, rabid law maker he acts like one. Get him off the bench by any means necessary.

      These people come to our country to earn a living and not only refuse to honor our culture and tradition in gratitude for being allowed in they want to replace our sacred symbols with their own.

      Until whites in this country learn that every racial group here wants to replace their old country ways with ours and gain prominance and dominance for their own racial group this empire will continue to implode as it is doing right now.

      And, it is the brainwashed white fools who allow this all to occur. As Pat Buchanan says in essence, whitey doesn’t have the will anymore to protect his own and will therefore be eventually submerged by the other groups who will gain dominance and control.

      The one impediment to their victory, however, could well be the outbreak and pursuit of Civil War II, which will shatter this nation into racial enclaves, brought on by the plummeting economy.

      Yes, wearing the flag is improper display but telling American kids that they can not wear one because they may offend the sensibilities of illegal aliens is still disgusting. I wonder if the Mexican kids have been taught that Cinco de Mayo was a minor victory over the French and that Mexico did not have its full independence until after the American Civil War. It was only then that our battle scarred nation could offer the assistance they needed to oust the French occupyers for good. Grateful bunch, ain’t they!!!

      Americans have the right to wear the flag on May 5th, We run the French invaders off of Mexican soil in 1862 during our own civil war and that is why May 5th is celebrated. It is seldom celebrated in Mexico. Only in the last few yrs has it gained use in the USA because it used to boost their RACIAL pride against OUR NATION, sort of take this if you like it or not aka ATTITUDE.

      It is difficult to fully describe the rampant anti-Americanism that exists in some parts of this Country. To those of you have never been to these places, where English is seldom heard and The American Flag never seen, you have no idea. We are losing our Country.

      The Illegal mexican population is reproducing at an alarming rate, with no concern in regards to supporting their offspring. We will soon be out-numbered and out-voted as the “Dream Act” becomes a reality. White children are denied, college entrance, jobs and housing due to quotas, affirmative action and reverse-discrimination. We are close to the point of no return, if not already there.

      Eventually, there will be at least three countries in place of The United States. Yes, there will be another civil war, or at least seccession by States that have had enough and do not wish to be a part of this toxic melting pot.

      It is sad indeed, but this is the result of un-checked liberal white guilt.

      Sounds like the school thinks it is OK to give in to bullying. What happened to the anti- bullying policies all schools are supposed to be embracing? Was the safety of the students at risk if some of the students wore flags on their shirts? Maybe. However, I don’t see how pandering to the potential bullies while chastising the victims will be anything more than a very short-term solution.

      It’s the intent which matters. If the flag’s draped over the head of a dude with a joint hanging from his ulcerated mouth at an “Occupy” event…it’s disrespectful. If it’s a combination Mickey Mouse shirt/American flag at a Tea Party, it’s appropriate and completely respectful. Nice try though, slippery liberal. We know what you are.

      That’s how liberals dismantle America, isn’t it? They seek all sorts of justification for ways to restrict our expression of love for our great nation, just like they justify trashing our Christian traditions — like demanding that Christmas trees be called “Holiday Trees.”

      Seems to me if the principle is worried about the kids wearing their nations flag inciting violence with the Hispanics at the school, then he should be more worried about the Hispanics.       I remember this & how pissed off it made me. Correct me, but wasn’t the 4 kids freedom of speach protected in this case?

      The main issue that everybody here recognizes is that it’s somehow “ok” for U.S. born Mexicans to celebrate the flag of Mexico but images of the U.S. flag can incite violence…which is not ok.

      We must band together (no matter where our ancestors came from) and be the Melting Pot, not the segregated communities that wish nothing less than to take over from within. It’s war strategy in the modern era. Most may not realize it, but it’s true nonetheless. Teach our children who we are, lead by example, and pray that we will be on God’s side. I don’t know what else we can do. Buy food & ammo just in case. I hate war but it seems we’re being pushed. The problem is we have no one direct enemy like WWII. Insurgency is the order of the day.

      Thank you to all you Vets, families & friends. That’s what I initially came here to say.

      Good to see Ghost of Jefferson again. I know it’s difficult to take time to post all the time. There‘s a lot more of you I’m happy to read from too…just running out of characters…lol!!

      I agree that the flag should be displayed correctly, but I don’t see in the courts decision where that was the issue. The school was concerned about violence caused by the wearing of the U.S. flag, in America. While I’m sure that the students were doing this as a “in your face” demonstration, maybe the school should address the fact that the violence might occur with their students.

    So, what if these students had been wearing pro-homosexual shirts on the national day of prayer; would they have been told to turn them inside out?
    Also, if the school was concerned the shirts would incite violence why would it not take measures against the perpetraitors of said violence (had it come to that) and not the victims? I would wear an American shirt next Cinco de Mayo if I were them. They are not violating the constitution or anyone’s rights.

      It is not a “Holiday” anywhere, it was, and is, a promotion by the Corona Beer Company (see their website, they admit it) to sell beer. Although it does commemorate the Battle of Puebla on May 5th, 1862, it is not recognized in Mexico, and is only celebrated in the U.S.

      If the school wishes to avoid violence, maybe they should educate their students as to the history of this “holiday”.

Getting out altogether would probably be the best….I understand there is a movement afoot in Mexifornia to disallow home schooling to parents who do not have a degree in education.

      My brother is near retirement age, and I keep trying to lure him out of Mexifornia. He can’t find a job, he’s paying taxes out the wazoo, and his once pleasant neighborhood where he bought a house 25 years ago has turned into a barrio….CALIFORNIA IS NO LONGER A STATE OF THE UNION!
      So the finding of the nonAmerican judge is understandable….Either turn it back over to Mexico, or send in the Army to uproot and return these illegals to their legal country of origin…NOW!

      Reading the story about these kids is almost as bad as reading about Agent Jesus Diaz, who is being jailed for stopping an illegal 15 yr old drug smuggler who attempted to flee. Agent Diaz took control of him by putting his hands behind his back. No bruises were found (only those from carrying the bundles of marijuana on his shoulders). Agent Diaz was not found guilty of anything by U.S. standards, but the Mexican Government filed for Agent Diaz’s arrest, for miss treatment. Obama caved to the Mexican’s. Agent Diaz is being imprisioned for doing his job as a Boder Patrol Agent. Who is going to want to do that job, if you can end up in jail for detaining someone? Our Judicial System is turning into a laughing stalk, along with our Constitution. We had better Stand Up America, before it’s too late.

The mom who stood up for her son (her Hispanic heritage son) and emphatically stated that there would be NO APOLOGY is right! No apology is needed from those students who are proud to be an AMERICAN.       @Teddrunk, funny thing is Cinco de Mayo has nothing to do with Mexican Independance. It is a celebration for Mexicans winning the Battle of Pueblo. Mexican Independance is September 16th.

      Here’s the even funnier thing. Cinco de Mayo is an American holiday. They only place it is celbrated in Mexico is in Puebla but it is celebrated in every state in America.     Throw this Judge off the bench. What he did violated the first,and forth amendment rights of America students. I believe it’s time to remove all federal courts out of every single state in the nation. The only plave a federal court should exist is in D.C. Fact is federal courts violates the 10th amendment. There is np article in the Constitution that allows Congress to set up federal courts with in the states.
