Federal Appeals Court Upholds Obama’s Health Care Law

CINCINNATI (The Blaze/AP) — In the first ruling by a federal appeals court on President Barack Obama’s health care overhaul, a judicial panel in Cincinnati on Wednesday affirmed an earlier ruling that Congress can require Americans to have minimum insurance coverage (commonly referred to as the “individual mandate”).
A conservative law center had challenged the provision, saying that it was unconstitutional and that Congress was overstepping its powers.
The three-judge 6th U.S. Circuit Court of Appeals panel delivered a long opinion with disagreement on some issues.
The 2-1 majority opinion was written by a Jimmy Carter appointee and agreed with by a George W. Bush appointee. The dissenting judge was appointed by Ronald Reagan. MSNBC has more:
Today’s ruling by a federal appeals court in Ohio, upholding the Obama health care law, marks the first time a Republican-appointed judge has found the most controversial part of the law constitutional.
Earlier this month, The Blaze reported on a separate case being heard in the 11th Circuit Court. While this case is not expected to be ruled upon until the end of the summer, the judges had a negative tone when discussing the insurance coverage requirement. The Los Angeles Times has more:
“I can’t find any case like this,” said Chief Judge Joel Dubina of the 11th Circuit Court of Appeals. “If we uphold this, are there any limits” on the power of the federal government? he asked.
Judge Stanley Marcus appeared to agree. “I can’t find any case“ in the past where the courts upheld ”telling a private person they are compelled to purchase a product in the open market…. Is there anything that suggests Congress can do this?”
More than 30 legal challenges have been filed over the health care overhaul. So far, this latest case bring the total number of decisions upholding the law to four, with two other courts finding it unconstitutional. The case is expected to eventually reach the U.S. Supreme Court.

Posted on June 29, 2011 at 1:41pmThe problem here is the Supreme Court is going to drag out its review. The more time taken is more opportunity for one conservative justice to resign or die and Obama gets to appoint a liberal who will surely vote for sustaining the law as passed.
This issue has absolutely nothing to do with universal healthcare. It is libs trying to get themselves thoroughly imbedded in the electorate and saying conservatives will take the helathcare freebie away if you don’t vote for liberals. Since 43% of taxpayers pay no federal income tax now who do you they they will vote for?
Universal healthcare is fine as long as everyone pays who is able to pay. But, if they don’t pay the financial penalty should by higher – much much higher – like the average cost of healthcare coverage which eliminates the reason to dropout. Right now those opting out are essentially getting almost a free ride on my dime.
Medical coverage should be like dental and vision. If you can afford it and you don‘t pay for it you don’t get any. Duh!
But, that doesn’t work for the Medicaid class – the unfortunate due to no fault of their own, the real dumb, the uneducated and useless who can’t keep their knees together and especially those who spend it on non-essentials simply because they want it.

You are only forced to buy AUTO insurance if you drive. Also, you drive on public roads,right? Well, you need insurance. You own 1000 miles of private roads then you don’t need insurance. The hospitals, doctors and so forth are all private, yet you are forced to go through a government system? Government making the rules?
What if i were Prez and made you buy all food through my stores? That would be ok right? Because all people need to eat.

It would be nice to where when we work, we pay for healthcare when we can afford it, but nothing is free in life or given!

Report Post »Yes, Auto insurance is only “forced” to protect others property… they do not force you to protect your own auto ( only the bank does if you owe them for the auto). Plus in most states you can put up a bond or cash for the amount they ask for liability insurance amount. In healthcare you cover yourself. If we wanted to cover just those without health insurance, the 8,000,000 who really might need it…and of those they would maybe need it once in 10 years as they are all younger and cannot get Medicare.
Why not just open Medicaid to these 8 million the rare times they do need it? Or better yet medical saving accounts? It really wouldn’t take a whole new program that is meant to turn the whole healthcare system over to the Government.
As for military spending, like all other government programs there is plenty of waste that should be cut. Sadly, we have enemies in this world and even hate our liberals and will walk over your dead body when they take over even if you kiss their booty and tell them you want Sharia law. So we have to have a military no matter what you think.

Assuming all this will happen, no reasonable, fair-minded judge can put a stay on executing such a questionable law until the battles are settled? Just another disgusting attempt to shove socialism down our throats. By judges, no less.

Beck had a great episode a few months ago where he challenged our civilian police officers to contemplate seriously who’s side they were on….because this administration is manipulating public wrath and wedges not only between the classes and races…but also instigating paranoia and suspicion resulting in lack of respect and confidence for our police forces who, while in the process of ‘doing their job’, are forced to uphold laws and legislation contrary to our Constitution and the rights guaranteed by it. Many otherwise law-abiding patriotic American citizens will be forced to break ‘the law’ by not abiding to this piece of garbage Obamasurance legislation. The difference Sir, is that per the 10th amendment the States retain those rights. They can legislate all they want at the state level. As Reagan put it, if the people of a certain state do not like the policies of that state, they are free to vote with their feet and move. By requiring all American Citizens at a national level to pay for insurance it is a violation of the 10th amendment. Not only that but per the 10th, those unnamed rights are retained by the people.

The court said then that his decision to grow his own, rather than buying wheat on the national market, affected interstate commerce, which Congress has the authority to regulate.
Today, the Sixth Circuit appeals court said the same logic applies to health insurance.
Opponents had argued that while Congress has broad authority to regulate economic activity, it has no authority over inactivity, such as a failure to buy insurance. But the appeals court said today that Congress is actually regulating the market of self-insurance for health care, in which people try to find some way to cover their costs other than by purchasing insurance.
But the court said self-insuring affects interstate commerce, by shifting the costs of the un-insured to people who have insurance, just as the wheat farmer affected interstate commerce by growing and consuming his own wheat instead of buying it on the national market.

I told him then that there were 3 reasons it wasn’t going to happen. First there was NO logical reason for it to happen (other than his liberal mindset running amok and buying into Bush conspiracy theories) Two, this country has the largest armed populace in the world. Third even if he tried that means the military would have to be compliant in standing against the American people. Obama’s agenda may be the most un-American I’ve witnessed in my lifetime BUT there is no way in HELL that our all volunteer military will take up arms against the American people. If we ever got to that point I have 100% confidence that the military would stand with the citizens and they would honor the oath of corps to protect the Constitution against all enemies foreign or DOMESTIC. Sleep a little easier at night my friend, Obama isn’t taking over our country (albiet he is trying his best to fundamentally change it) anymore than my liberal friends thought Bush would. He‘s gone in 2012 and there’s not one thing he can do about it.

Posted on June 29, 2011 at 1:45pmOne judge gave the following explanation of her ruling: “”Congress had a rational basis for concluding that the minimum coverage provision is essential to the Affordable Care Act’s larger reforms to the national markets in health care delivery and health insurance”.
From my understanding, that means the government is free to force you to pay for a service if it helps to provide that service to others who can’t afford it (see socialism). Essentially, she looks at this as a tax, with revenues used to pay for the Government service of healthcare. According to this nutjob, maybe the Government can’t force you to buy something when no “greater good” can result, but it is apparently constitutional for you to be forced to pay for the healthcare of all other citizens through additional taxation.
Just another Tax and Spend scheme.

He proposed national health insurance because he realized the need to spread the costs out over the largest group of people possible. Don‘t remember exactly how he was going to fund it but the simple fact is you can’t support spending twice as much per capita as the next highest country with only 60% of the people paying for insurance. There has to be a standard set of coverage for all Americans and it has to be funded with something that everyone pays into.

The BIG difference here is that you don’t have to buy car insurance. You only have to if you drive on public roads. You can own a car and drive a car on you own land and do not have to buy insurance.
BUT with this medical insurance you HAVE to buy it, just for being alive. Even if you don’t subscribe to western medicine!! Comparing this to auto insurance is shear stupidity, as there is no comparison.

You are apparently very confused about the constitution. 1st the Commerce Clause,
Amendment X
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
Take note of “powers not delegated to the United States” and “reserved to the States”. That means unless the Constitution specifically gives authority to the Fed Gov it is pursuant to the States.
2nd the necessary and proper clause,
To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.
Nowhere in there do you see a foregoing power to force a citizen to buy something JUST for being a citizen and alive. No you could try to argue on the part of Section 8 clause 1 “The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States”. Unless the AHCA was a tax, but it’s not, so presented and argued by the Dems. It’s the State you live in that requires it and the State does have that right (hence Massechusettes healthcare law thougth I don’t agree with it). What powers not given to the Federal Government are retained by the State and it should be up to the individual states whether or not to require whatever insurance they feel that state needs their citizens to have. I don’t think the States ever relinquished that right to the Federal Government (healthcare included). :)
