Federal Court Aborts Contraception Mandate

Obamacare’s individual mandate may have been upheld as a tax, but it looks like another mandate could be well on its way to creating a headache for the Obama administration. LifeNews reports that a Federal court has upheld a lawsuit against the controversial contraception mandate, following a lawsuit by Catholic-owned employer Hercules Industries:

A federal court issued an order Friday that halts enforcement of the Obama administration’s abortion pill mandate against a Colorado family-owned business while an Alliance Defending Freedom lawsuit challenging the mandate continues in court.

The mandate has generated massive opposition from pro-life groups because it forces employers, regardless of their religious or moral convictions, to provide insurance coverage for abortion-inducing drugs, sterilization, and contraception under threat of heavy penalties.

Alliance Defending Freedom attorneys obtained the first-ever order against the mandate on behalf of Hercules Industries and the Catholic family that owns it. The administration opposed the order, arguing, contrary to the U.S. Constitution, that people of faith forfeit their religious liberty once they engage in business.[...]

In his order, Senior Judge John L. Kane of the U.S. District Court for the District of Colorado said that the government’s arguments “are countered, and indeed outweighed, by the public interest in the free exercise of religion. As the Tenth Circuit has noted, ‘there is a strong public interest in the free exercise of religion even where that interest may conflict with [another statutory scheme]….’ Accordingly, the public interest favors entry of an injunction in this case.”

This comes after two Federal District Courts had dismissed earlier lawsuits, citing lack of harm. With one Federal court willing to block the mandate, this decision all but forces the supporters of the mandate to take their case to an Appeals court – in this case, the Tenth Circuit Court of Appeals, which covers Colorado. The Tenth Circuit’s 19 Judges skew slightly Republican, 12 of them being nominated by Republicans, and 7 being nominated by Democrats, though two nominations by President Obama are pending. If this case is upheld at the 10th Circuit, the Obama administration will almost certainly appeal the decision to the United States Supreme Court. And if the case is struck down by the 10th Circuit, the law’s opponents will definitely appeal the decision. Either way, in the event that the Court grants certioari, this case would raise yet another drag-out fight over the law.

    Women who seek abortion are so genetically flawed that our society and its gene pool are better off WITHOUT the genetic contamination bythose who would murder their own children! Abortion, like drug abuse, is a self-solving problem when its most vociferous defenders are allowed to eliminate themselves as well as their offspring in pursuit of their “rights”.

      That is a totally evil thing to say. You have no clue what desperation goes on in someones heart, nor do you have the right to judge them. I hate abortion with all my heart, but I am not, or are you, judge of this world. Only God gets to do that. Thank God you are not the judge, there is no love and mercy in your statement.

      What an ignorant statement, until you figure out a way to stop man kind from having sex, the second most powerful instinct after that of survival, you have little to add to the conversation. The alternative to abortion is contraceptives, well, some religious folks of your elk would say that the act of taking a contraceptive is a form of abortion. Do you have any idea of what the world would look like without abortion, or contraception? Do you realize that not all the world is not Christian and do not share your belief in sky gods or the faux morals that the followers profess to the world?
      Read a book or two, go back to school, and leave that bible along and maybe, maybe, you can be enlightened a bit.
      I am not an abortion advocate, but to state that those that have one don’t deserve to live, is ignorant religious ideology at its worst.
      How about live and let live, and keep your archaic thoughts to yourself or stand to be chastised by the ones you spout this drivel to.

      You really need to get on reality. Please seek help. Oh, maybe your health insurance doesn’t cover the mental health services you so obviously require. I presume you’re a tea ****** or close so it is nearly impossible to reason with you. Abortion is a legal right. A woman has a right to privacy and control over her own body. Unfortunately the tea baggers in this Country think that they can sit in judgment and issue commandments that they alone have the right to determine what a woman can and cannot do with her body. Having a health insurance policy doesn‘t violate any Church’s right to preach its dogma. That’s a joke. All they have to do is provide insurance. It’s up to the insured and the doctors to determine what services are needed. Jesus never shoved His beliefs down the throats of anyone…it seems logical that people who profess to follow Him would actually do so instead of being self-appointed Pharisees.

      Stager, mcpappy, gottaetc, I am a Tea Party member, and a Christian. It saddens me that women don’t reach out for help to the many non-profit organizations when they become pregnant. I am saddened there are not enough or those places, when there are tons of abortion clinics, but all of you saying “teabaggers” are not compassionate towards them means you do not know any of us. Legal abortion in this country has not made us a better place when without thinking we destroy a life. Life then becomes cheap. Opposing something that is wrong does not make us bad and it doesn’t mean we do not care about the women who are going through this.

      Oh my. These are very hurtful, especially to those women, like me, who have had an abortion. YES, I had an abortion when I was very young, before it was legal to do so and I HAVE REGRETTED IT EVER SINCE. Know this: those women who do have abortions, HAVE NO IDEA THAT IT IS CONTRARY TO GOD’S LAW. I didn’t. It was when I became a Christian that God opened my eyes WIDE OPEN.

      These women who are contemplating having an abortion, or who have already had one, NEED OUR MERCY, UNDERSTANDING, LOVE, AND MOST OF ALL, INFORMATION about God’s love for them and their lives and the life(s) they are carrying – NOT HATE.

      God forgave me of my abortion because I asked Him to – HE FORGAVE AND HEALED ME OF ALL MY SINS. Those women who do not know God, NEED THE SAME OPPORTUNITY AS I HAD. Someone needs to tell them about God’s love for them and their child.

      DO NOT HATE THESE WOMEN. DO NOT CALL THEM EVIL. They do not know any better.

      And, IF YOU ARE A TRUE FOLLOWER OF CHRIST, YOU WILL NEVER EVER EVER be hostile to them. YOU WILL SHOW THEM GOD’S LOVE THROUGH YOUR WORDS AND ACTION.

The woman who is having an abortion is clearly NOT A CHRISTIAN, so NO, WE CANNOT JUDGE HER because as Christians, WE ALREADY KNOW SHE IS A SINNER. IS JUDGING HER, THE WAY TO WIN HER TO CHRIST??????.

      We should love her and try to talk to her showing her Christ’s LOVE, but the ultimate decision is hers, JUST LIKE SALVATION IS. God does not force Himself ON ANYONE!

      Staiger, I’m as pro-life as they come, but your statement is dead wrong. An abortion leaves 2 casualties: 1 dead and 1 wounded. Many women seek abortion because they see no alternative. The best thing we can do, and what many of us ARE doing is to show them that there are alternatives. Carry the child to term and either raise it yourself, with the help of your family and community (which does NOT necessarily mean government assistance) or give the child up for adoption. The list for adopting infants carries a waiting period of about a year in most states. Give these children a chance for life, and if you aren’t capable of providing a stable, loving home, let someone who is do it.

      How did this turn into a discussion about abortion? The article is about contraception. Even if you believe that both abortion and contraception are wrong, they are in no way the same thing.

      If you don’t like contraception, don’t use it. But for those of you that don’t believe contraception is morally wrong, don’t tell me I have to pay for other people to use it. If I choose to use contraception (and my wife does) I’ll pay for it myself. I shouldn‘t expect others to pick up part of the tab if they themselves don’t use it.

      If you think others need to pay your bills for you, you’re useless. End of story. Now, obviously there are some people who are down on their luck and need help. People need food to survive. People need shelter. People need clothing. We should have some sort of safety nets, both from government and our private communities, to help these people. (However, if you’re in need of this assistance from birth until death, you are, again, useless.) But contraception is not a necessity. Don‘t tell me I need to help those that can’t afford it. That is absolute ridiculousness. Be responsible for yourself.

      If you believe that contraception is something that everyone in the country should share the bill for, you’re a moron in my opinion. According to that logic, we should all share in the cost of providing cars to everyone that wants one. Couches for everyone that wants one. Pets for everyone that wants one. Morons…

      I don‘t know anyone that doesn’t enjoy sex. But that doesn’t mean I have to cover your costs of doing it. If you have sex, and you don’t want to have a baby, then buy your own condoms or birth control. Or learn to pull out. But don‘t tell me it’s my responsibility to pay for you to have sex.

      I like playing video games. Is it your responsibility to make sure I own and XBOX, or to provide me with games to play on that XBOX?

      @JennyLInd – I also can’t imagine the desperation that goes on the mind of someone deciding whether or not to murder their brother, but somehow God asks us to not only judge, but enforce His simple commandment, “thou shalt not murder.” We can paint our whole world in grey and thereby escape accountability, but only for a time. Why should we rationalize something so horrific as the violent taking of a child’s life?

      There is some truth in everyones comments. The anger toward people that willfully kill their own babies is justified. However educating them and loving them is constructive and helpful. To say that children would be much better off not having women who abort as mothers seems like a no brainer, unless the women come to an understanding of the enormity of killing a baby safely in the womb as the epitome of selfishness, and not the selfless love that is the hallmark of motherhood. Disagree with the Catholics about birth control, BUT they should be free to adhere to their religious faith without government interference. The real problem is that the morals of society, religious or not, are so low that you never even hear the word promiscuity anymore and a prostitute is different from others only in that he/she gets paid for he/her services. A huge number of men are more interested and dedicated to avoiding their obligations to support their children than they are in raising them to be happy healthy adults. Society is damaged, families are in name only with the names constantly changing, and children are being forced into lives of chaos, instability, with the poorest excuses for parents ever. Abortion is just a symptom of the overall debasement and crudeness of life today. Discussion of sexual self control for a greater long term purpose has gone the way of the dodo bird.

      There is no stigma attached to pregnancy out of wedlock. There are too many abortions to say they are all fearful and confused. There are overlapping aid programs for unwed mothers. There are long waiting lines to adopt. The remaining question then becomes: what could POSSIBLY be going through a women’s mind that would end the life rather than giving life. Answer ……… the cheapening of life in that women’s mind and the thought that they might not look good on the beach pregnant.

      Ron, Humanity has somehow survived in spite of persons like child killers. In Bibical times people sacrificed their children to Baal. Today in Carthage you can still find cemetaries full of children killed in this manner. What manner of animal kills its own children whether it is because they are inconvenient or because they believe they will find favor in a god’s eye for the sacrifice. Today there are many, many different ways to avoid pregnancy, but that is apparently too, too difficult. Sex was not instituted into humanity strictly for personal pleasure, but for the continuation of the species. It necessitates responsibility which is an attribute of being human. Those whom claim defiance of this responsibility should find it more convenient to sterilize themselves to advoid it!

      We now need to not only repeal the 16th Amendment but re-clarify the meaning of the word “indirect”.

      While Obama is President, owning a business that does not forfeit all of its profits to the Federal Treasury is a crime punishable by taking away your rights and freedom. Note that he has successfully closed 200,000 small business, and is spending a trillion dollars a year more than taxes bring in. Obama has been steeped in Marxism all his life, and fervently believes in it as the only way to run a country. His goal was to take down our country to the level of a third world dictatorship. He has already spent us into so much debt that our income can only pay the interest.

Those poor women employed by religious companies or people need the free contraception as they. no doubt, can control themselves no more than an alley cat in heat; and if a pregnancy occurs, those poor women need the insurance so they can happily butcher their baby, and quickly get back to gapping’ their thighs.     So many memories of the Today sponge and Elaine’s stockpile of them. There was also Elaine’s judgement on whether or not a potential partner was “worth” wasting a Today sponge on. Then there was “George” who believed that he should get free sponges because he was a friend of both Jerry and Elaine.

    Back then, I actually used these sponges for birth control. I was a married woman, unready for another child. I had medical problems taking birth control pills, and the “sponge” worked for me. I never understood why it was banned in the first place. Birth control pills caused unwanted physical reactions in me. The sponge was the best contraceptive for me -yet it was taken away. I know that it’s back, but I no longer need it.

Just reading the comments, I can feel the UNCHRISTIAN rage, hatred, bigotry, paranoia, etc. I doubt that Jesus is looking down and thinking that these commentators are “ood and faithful servants.” They do more harm to our society than anything else.     It’s a big deal to make ANY changes to the Constitution of the United States of America. Right now, we have Freedom of Religion. No where, no how, is it written that if you “start a business and hire employees, you lose your Constitutional RIGHT to your unfettered practice/belief of/in your religion. If your religion teaches that abortion is the murder of a potential human being – you have a Constitutional RIGHT to believe that. No one can force you to provide abortion services for those in your employ. It may take an extra step in the hiring process, where the potential hire is told – this Company DOES NOT support abortion because of their religious beliefs.       Right you are Diane….according to the WH Admin argument if an Amish farmer decides he wants to sell his bounty to the public and hires staff to sell it his own cultural beliefs would be null and void with regards to health insurnance coverage for employees ? What if all his employees are Amish ? By the same token if an Islamic meat shop were to open would they be forced to offer pork since the act of going into business should negate his religious convictions therfor if a customer wants pork they should be able to buy it (according to the boobs in the WH) ? It’s a patently ridiculous argument to make and yet the Obama Admin is making all kinds of patently ridculous arguments the past 4 years. It certainly has been bizzaro world the last half dozen years. The Carter Admin may have been inept but they weren’t anywhere near the level of this bunch when it comes to lunacy.

    It’s not just about freedom of conscience, either. If the government can compel you to give up your religious liberty in subjection to some government mandate, there is NO freedom or rights left. What other rights would they then be able to deny? Freedom of speech? The right of habeas corpus? The right to due process? Freedom literally hangs in the balance!

    As I’ve said before, Obama and Co. could have done away with some 2,000 pages of legalese and stated their intention: We will rule by fiat and make health care policy as we see fit.
    This mandate wasn’t about any specific provision in the original bill or law. It exemplefies how authoritarians (such as Kathleen Sebelius) and bureaucratic govt. agencies such as the EPA and HHS operate: “Your rights and responsibities are what we say they are. Thanks for the convenient Pandora’s Box.”
    I’ve seen this all too often at the state level here in WV when it comes to dealing with bureaucrats: Shut up and do as your told… we own you.

    The mandate is not a tax. Get real. SCOTUS is not the ultimate authority on the Constitution, and nothing in the Constitution gives them ultimate power to determine what is Constitutional, as that itself would violate separation of powers by making SCOTUS the sole legislating body.

    That said, this may hold or not, it doesn’t matter, we need to repeal the Marxist piece of sh*t legislation ASAP.

      It’s actually worse than “it’s not a tax”.

      The law USED to be that a tax was unconstitutional if it 1) was not reasonably calculated to generate revenue and 2) a penalty disguised as a tax. (This is why “drug taxes” were thrown out.)

      In Obamacare, the penalty was not calculated to generate revenue, it was calculated to force people to buy health insurance and it was not a pentlaty disguised as a tax, if was a penalty that was called a penalty.

      Roberts has overturned 70 years of restraint on the power of the Federal gov’t and given them unlimited power. Repealing Obamacare will make no difference if democrats ever get control of gov’t again because the damage Roberts has done is catastrophic.

      ghost, in some ways you are correct. The Supreme Court took the authority to interpret the Constitution in Marbury v. Madison sometime around 1802. (Roberts basically abdicated that by claiming it was not timentheir job to undo the will the the electorate – which is really incomprehensible giggerish given the Marbury case has been the bedrock of SCOTUS authority for over 200 years.

      But the whole “I will not comply” think is a little hard to implement. I‘m not going to give up my health insurance to prove a point and I don’t know many people who will.

      If we really want this law overturned, we need to pass a law that anyone who does not possess a photo ID will be “taxed”. Let the democrats and ACLU argue the same issue – and they will win because the leftists on the bench are nothing but ideologes. If not, we at least get free elections out of the deal.
