Federal Judge Blocks Oklahoma Voters’ Ban on Sharia Law

Just days after 70 percent of Oklahoma voters approved an amendment to the state constitution that would bar state courts from using international law from deciding cases — namely Islamic Sharia law — the Council on American-Islamic Relations (CAIR) filed suit to block the measure.
Muneer Awad, the head of CAIR’s Oklahoma chapter says the new law “demonizes” his religion and violates his First Amendment rights by embedding an “official disapproval of his faith” in the state constitution. He also argues that the ban would make it impossible for his family to legally execute his will, much of which is based on Islam.
On Monday, Federal District Judge Vicki Miles-LaGrange issued a temporary restraining blocking the amendment.
The judge‘s injunction prohibits the state from certifying last week’s election results. Without this legal maneuver, the amendment to the Oklahoma state constitution would’ve gone into effect Tuesday.
The measure will now be temporarily delayed from taking effect until after the court holds another hearing on the matter, scheduled for Nov. 22.

We even have days when Christians are arrested for daring to show their faces in the public parks and streets. This is the moment the toe gets in the door and before you know it the door is kicked wide open in this country and we have lost all of what our forefathers created. This is what I suspect is the evil that boils within our Government, that is destined to take us down as a nation from within. Bit by bit is how they work and over the years they have put people in places of power within, have put people in our country to study our laws to use our laws against us (ie: CAIR) to put forth their agenda of having a muslim nation, of making damn sure our one nation under God becomes their nation of islam under allah. Oklahoman’s please do the right thing and storm the courts with emails, letters and phone calls to your officials and judges to let them know WE THE PEOPLE do not want shariah law in America–PERIOD!

How do you think many of them have made it into the positions they’re in (speaking generally of politicians and judges)?
Look at obama for example, claimed to be moderate, though had the most liberal rating & record, but sold people on something he wasn’t. Aside from a few slips where he openly stated his goals….share the wealth….. fundamentally transform America….. he lied about what he was. Only a few people who looked beyond the smiley face actually seen the commie within.

She had little choice but to stay the amendment until the challenge could be heard and resolved.
This is the way it should be.
You want it to be different, then you change the laws. The judges can only work with what they have, and so many laws get passed with loopholes so the majority party can take advantage of them. That’s part of the big problem with the legal system right there.

Posted on November 9, 2010 at 2:52pmum, hey, guys… we got a lot of vitriol going to the judges right now, and I don’t think it is deserved.
You know how we all hear about ‘activist judges’ and the criticism against their rulings… it is when one political party or the other ends up not getting the ruling they wanted, and are having a temper tantrum.
Some judges lean liberal, sure… some lean conservative. They’re still just men and women after all, and they don’t always see things the same way.
Overall, however, they try to do a good and thorough job, and that’s all this ruling is right now.
There was a challenge to the amendment, and the challenge must be heard.
The challenge was on constitutional grounds, and so the amendment needs to be stayed until the challenge is either upheld (which I doubt), or torn apart (which I’d bet money on).
This is our process that is supposed to keep the gov’t from running roughshod over us.
I feel for many of you that want it implemented immediately, but this is just part of the process.
Even amendments, have to pass tests for them being constitutional, and not in conflict with already-existing amendments, before it can be implemented.
This is not a bad thing. Please, be patient, and let our system work.
This same system so many of us are apparently trying to tear apart, that we are holding up as the model against Sharia… so if we’re going to support our system, then, how about we SUPPORT OUR SYSTEM…

She is following the judicial process.
A group filed a challenge, and she has to adjudicate it. Anything less would be a dereliction of her duty.
It is completely reasonable to stay the implementation of the amendment until that challenge is heard and resolved.
She did nothing wrong. She did exactly what her duty demands of her.
Why are so many of you blaming her for upholding the system we’re SUPPOSED to be fighting to save?!

Posted on November 9, 2010 at 7:18amListen, I don’t agree with the judge on this one. However, people on the board completely misunderstand the role of the judiciary. Their job is to ensure liberty. They exist because we have a Republic and NOT a democracy. Democracy is the equivilant of mob rule. The purpose of the republic is that we have liberty and laws that ensure everyone has a set of unalienable rights that even a 95% majority could not take away. These comments about the “judges ruling against the people should be removed” are not only lunacy, but they are in direct conflict with how the founders viewed the republic.
If you‘d like to make a legal argument about the validity of the ruling then I’d love to hear it. As I said, I think the judges interpretation is a bit of a stretch and shouldn’t hold up.

To thwart the will of the people by a single judge (even if it is temporary) does appear to undermine our system, not enhance it. The argument of Muneer Awad from what I read had no merit because if he lives in this country then he must live under our laws, not under his religions laws – rejecting Sharia does not prohibit him from his religion. A Muslim man cannot stone his wife for infidelity and claim it is his religious right – he cannot marry an eight year old girl and claim it is his right under his religion – if his religious right is against our country’s laws, out laws override his religious right. To give Sharia a foothold would be a danger to our constitution and for the judge to stretch the merits of his arguments does give the appearance of a judge being PC.

The STATE of Oklahoma is not a republic, the US is a republic. Any state could theoretically pass all manner of laws that the congress would not legally be able to pass. The Federal Government is limited to 18 powers, and everything else is left to the states (or to individuals.)
Theoretically, a state COULD sign into law that their state religion will be Xyzab. The US constitution says “CONGRESS shall make no law…” If strictly interpretted, this does NOT prohibit a state from “making a law.”
As an example, Mass. has a state run universal healthcare program. (it’s a disaster, but that’s getting off the subject…) I don’t see a legal problem with Mass. having a state run universal HC program, but I don’t see where the US is legally able to have a national HC program. (But I don;t want to stray too far off topic with this one here.)
In my opinion, this judge is overstepping his authority, as the fed has no business tell a state what can be included in their constituion. The states could theoretically be run is if it was a democracy, not a republic, if the state constitution supports that view. (Since I don‘t know OK state’s constitution without looking it up, this may not be accurate in the case of OK.)
At first glance, this is my thoughts on it. Upon deeper reflectinon, and if given new information, or hearing a new argument, I may change my mind, of course.

She is known to be very liberal and has on numerous occasions come out in support of CAIR and similar organizations… all of which are known vocal and monetary supporters of HAMAS, Hezbollah and Al Qaeda. She needs to go and I am certain come her election cycle she will be.
The DEMOCRATIC District Attorney who was just ousted was too busy crying and cleaning out his office to file a counter motion on behalf of the State — that right there is the basis for the appeal. November 22ns is the next date set to hear motions I believe and I do not see OK going the way of CA and overturning such a landslide vote. This is a court of LAW not OPINION which is what the CAIR counter-suit is built on.

The States have all the authority they need whith 70% of the population voting to put it in the constitution this makes it constitutional. The federal constitution was created for restrictions on and what the federal governmnt can do it has very limited what states can’t do and it is in direct corralation to the 18 enumerated powers. The states have all rights and priveledges to creating and amending their constitution as long as it does not interfere with the 18 enumerated powers.

(commie ideals, changing laws at will, destruction of Christianity and the suppression of rights), The people at this point in time have practically no voice in the legal arena. The laws, courts and other government agencies are loaded with commies wall to wall. They have done their preparation well and fixing this will take generations. I’m afraid we slept to long.

It’s chock full of liberal kids who need to be straightened out on subjects like this. I’m trying, but I need back up as I’m sure the liberal womens and gender studies association has dedicated itself against me. Any help is appreciated. BTW, I’m a student there and a vet, and I can’t stand the liberalism.

Sharia law is the last thing we need here. If they want it, move back wherever it is you came from and practice it there. If we want oppossum law (that’s where a gutless federal judge rolls over and plays dead when the going gets tough), can we get that too? Or will they just continue to rewrite the laws.

I don’t know why a court of law would try to defend sharia law in the united states. he is putting a stay on its enactment until arguments about the constitutionality are heard.
Personally, I’d rather have it go through this kind of review before enactment, than after the amendment is grafted in. Just less messy this way.
I hope the challenges fail and it gets implemented tho. I don‘t see why another culture’s laws have any bearing on our culture’s laws.
The executing the will argument is just silly. Have you guys seen some of the really silly stuff people have put in their wills that were upheld?
They immigrated to the US, they chose to be subject to the US justice system. If they still wanted to be bound by Sharia law, they should have stayed home, or emigrated to another country that follows it.

Judges have to be impartial.
We seriously gotta stop blaming judges for the laws they have to follow.
If our legislatures would put their laws through a rigorous constitutionality test before they even hit the floor, judges would have a much easier job.
I sure wouldn‘t want to have a judge deciding my case who’s decisions sway to the will of a mob instead of the law.
