Federal Judge Denies ‘Underwear Bomber’s’ Request to Be Judged By Islamic Law

On Tuesday, The Blaze covered the ongoing debate over Sharia (Islamic law) in America. In Oklahoma, courts are debating whether citizens have the right to ban Sharia and in Michigan, a group of Muslims have come out in strong opposition to Islamic law.
These are only two examples of states in which restrictions are being sought on foreign laws that some fear will work their way into the American judicial system.
Earlier on Wednesday, the debate over Islamic law found its way back into the headlines when a judge refused Umar Farouk Abdulmutallab’s request to be judged by Islamic, rather than American, law.
Abdulmutallab, a Nigerian man accused of trying to blow up a Detroit-bound airliner on Christmas day back in 2009, expressed disappointment with Federal Judge Nancy Edmunds’ decision. He reiterated his belief that the Quran, Islam’s holy book, should set the rules governing his case. So far, the suspected terrorist has been less than compliant. The Detroit News reports:
A defiant Umar Farouk Abdulmutallab tried to disrupt the start of jury selection Wednesday by shouting,”Osama is alive!” and propping his feet on the defense table.
His behavior — including his refusal to stand for the judge — marked an odd start to a highly anticipated terror trial in federal court in downtown Detroit.
In a separate complaint, the alleged terrorist claims that he was not read his Miranda rights. As a result, he wants incriminating statements he may have made during his initial detention thrown out. But an FBI agent says that his rights were purposefully not read, because authorities feared there might be more attacks to come.
Agent Timothy Waters testified Wednesday that Umar Farouk Abdulmutallab might not have cooperated if given the option to remain silent. Waters says al-Qaida often stages coordinated attacks, and that the government needed to know if there were other planes with “suicide bombers” that day.
Abdulmutallab is charged with trying to detonate a bomb in his underwear on an Amsterdam-to-Detroit flight.

when a city tries a muslim for something like this (and it will be in the not so distant future – betting Dearborn will be first) and the muslim judge duly elected by the muslim majority population will conduct a “sham trial” and the muslim judge and the muslm jury will throw a party for the muslim guy who will go right out and kill more non-muslims. .
No far fetched. European countries are sinking into Sharia Law now. In this country liberals and RINO’s played fast and loose with the Constitution for years and years (Patriot Act/ObamaCare/TSA feel up unwarrented searches/federal and state “agencies” making law with Congress approval/presidents going to war without Congress approval, etc. etc. etc. In the future it will be American muslims destroying what is left of the Constitution.

On Saturday it was reported that a “sharp-dressed man” had escorted Umar Farouk Abdul Mutallab when he boarded Northwest Airlines Flight 253 in Amsterdam. Mutallab was allowed on the plane without a passport. It was later reported that Mutallab seemed to be in a trance.
The alleged videotaping of the underwear bomber and his fudged attack is another oddity that the corporate media should zoom in on. Unfortunately, we no longer have a functioning investigative media in this country.
Instead we will hear endless pabulum about a resurgent al-Qaeda and murderous idiocy from neocons like Joe Lieberman who are screaming for another small and defenseless country to be bombed and more innocents slaughtered as the U.S. chases a phantom terror group created by the CIA.

Since he already burned off his unit, which is a pretty good punishment, I doubt there would be too much trouble finding volunteers to stone him while he was buried up to his waist. Nearly never in criminal (few cases were American law regarding bribery or other interactions with foriegn officials, and then only to clarify the american law). In civil cases, contracts may call for foriegn law to be applied, an arrangement between different parties my depend on a definition of a term from a foreign country. But this parade of xenophobia on display at the Blaze is nearly comical.
The bigger issue the the FBI not reading the suspect his miranda rights.

It’s kind of like if a gunman tosses his gun into a field next to a school the police do not have to read miranda to him because the immediate safety of others trumps the need to read miranda. They can ask him where the gun is and not risk losing the evidence for later prosecution. As with many bright line rules created by the Courts there are always exceptions.

It cannot be allowed based on the Constitution of the United States. How hard of a concept is that to understand? In order to allow Sharia concepts to be forced onto defendants, the Constitution would have to be amended. I do not see that happening.
As was pointed out, Muslims, as any other group of people, are fully free to enter into contracts that may have Sharia applied. They are allowed to do this, and if a dispute arises the Judge will correctly apply the law as based on what the contract says, which may or may not be Sharia. This is freedom of association and contract.

But that exception is limited, the threat must be real and would occur in a relatively short period of time. (gun thrown in the field at a time when the school is in recess, exception doesn;t apply). Also the exception is limited to information about the threat only not about his crime. Their failure to mirandize him may come back to bite them.

I appreciate your thoughts on this, however, I think you are being, at best, naive. Two of the most prominent issues that are unconstitutional, gun rights and the healthcare mandate, certainly violate the constitution. It can happen, particularly with the inordinate amount of activist judges sitting on benches today.

If there is reason to believe the man had a gun and the gun is near a school time doesn’t matter because the next day a child could pick up the gun. The potential that another attack when dealing with radical Islamists is generally high, so speed in gather information is essential.
Miranda is not a Constitutional right, it is a rule created by the Courts. Rules do not mean rights, they simply tell how the system will run. If the Supreme Court decided tomorrow that Miranda is not necessary no one could claim a Constitutional right is lost. It is simply a bright line rule nothing more. If there is potential to gather information of further attacks then the court will side on the safety of the public. Miranda Readings in simple terms are a technicality.

That Muslim women will not have the protection of our courts in our country is frightening…if you knew ANYTHING that is the Horror of Sharia, you would understand that for me, someone who’s sister is married to a Muslim man– it is something that a constitutes a rational fear…. ESPECIALLY when the ACLU is suing the state of Oklahoma in support of the enforcement of Islamic law in that State. The ACLU’s partner in the suit is CAIR, the Council on American-Islamic Relations, which has been tied to terrorist groups. If the implementation of Sharia in whatever form is an impossibility and we are sooo stupid for even suggesting it..then why is the lawsuit in Oklahoma only one of many that involve forcing judges to use Sharia with Muslims? Some universities are even teaching it because we are developing a “body of Islamic Law” in America. So Riverdog, chuckle away…. You are right, it is hilarious.

Any judge who even CONSIDERS whether it should be used or not is in violation of the Constitution (our only law) and should be taken OFF THE BENCH. There is no need to consider whether another law (let alone the law of a RELIGION) should be considered. Where are the separation of church and state bleaters all of a sudden? This (not prayer on public grounds or at events) is what separation of church and state is really about. If we EVER use Sharia in consideration over our laws, we are done. (and yes, I know some judges have already done so, they should be taken off the bench)
