Federal Judge Thinks Obama Should Have Bypassed Congress on Debt Ceiling

Federal Judge Richard Posner Obama Unilateral Debt Ceiling CongressDuring the entire debt debate, it was not unusual to hear liberals suggest that President Obama simply go over Congress’ head and raise the debt ceiling unilaterally. It is one thing for the left to endorse such an unconstitutional push, however, it is wholly another when an federal judge does it.

But shockingly, that seems to be what Judge Richard Allen Posner of the U.S. Court of Appeals for the Seventh Circuit did during an interview with Bloomberg Law’s Lee Pacchia about the legal implications of the recent S&P downgrade. What is even more shocking, however, is that the Reagan-appointed judge, apparently known for making controversial statements, is allegedly conservative-leaning.

So who exactly is Judge Posner, and what would posses a federal judge to suggest Obama bypass Congress unilaterally?

Posner is a Senior Lecturer at University of Chicago Law School, is a prolific writer, and some assert him to be one of the most influential thinkers regarding law and economics.

In an article for the left-wing site Slate, even Eliot Spitzer wrote of Posner:

Richard Posner, esteemed federal judge of the 7th Circuit, is one of the most respected and prolific conservative intellectuals. As a founder of the “Chicago School,” he is both a creator and defender of the free-market theory that has guided deregulation for the past 30 years.

During his Bloomberg interview, Posner asserted that, in a show of strength, the president should have just raised the debt ceiling, even though a lawsuit would have soon followed. As if to say, “big deal.”

Judge Posner’s eyebrow-raising comments on Bloomberg come at around the 5:00 minute mark:

    Does this really surprise anyone? A description by “Client #9″ that someone is Conservative that does not include some vitriolic accusation of racism or hatred is about as reliable as Rush Limbaugh endorsing Hillary Clinton during the 2008 Democratic Primaries: it’s not even worth the time to note! Lifetime appointments and positions of academic elitism warp the minds and words of even the most Principled Men & Women. And, he’s right in one regard: had the President done it, an injunction would have been mired in the courts, and no court would ever rescind the increase in the debt ceiling in a timely manner for fear of the economic repercussions of enforcing the Constitution. During the process, the Congress would eventually raise the debt ceiling anyway, rendering the issue moot. It wouldn’t have solved the problem, but it would have set a precedent that would allow our Executive Branch to become a dictatorship…a result no “Conservative” would EVER endorse!

      He‘s not fiscally conservative or he wouldn’t have liked the idea of raising the debt ceiling. And he doesn’t appear to be a constitutionalist because it specifically gives the right of enforcing the 14th amendment to congress, not the president.

      His “conservatism” must be narrowly focused.

      Look at Posner’s eyes. Shifting right to left to right (back and forth). I have a friend with a brain problem that does the same thing. Shifty eyes. And did the Bloomberg guy say “sar” instead of “saw” at 5 minutes into the clip? I would expect better verbiage from a Bloomberg guy.

      So, What are we going to do about it? Is this guy appointed, make SURE his appointment is removed at the next election! If he has a lifetime appointment, we MUST change the laws WITHOUT a grandfather clause that allows these Communist, Marxist people to maintain their job. If the laws cannot be changed or should not be changed, then we need the legal advice of a Constitutional lawyer who can show a court how this person has broken their oath to uphold the Constitution and therefore MUST be removed from his position!

      What would possess him? I don’t know…that whole University of CHICAGO thing comes to mind. And how many times do people have to say that the debt ceiling wasn’t what got us downgraded, it was the refusal to cut the appropriate amount of spending.

    This gives nw energy to the idea of either term or age limits on all Judges. Many Judges have decided to throw the Constitution out the window in favor of whatever social or political agenda they have. Oh, and Judges? The United States of America didn‘t get into the abyssmal shape it’s in by politicians alone…many of you contributed just as much as Washington to the moral, ethical and financial failure in this country.
    Together, you are in danger of losing the credibility and respect that the American people have always afforded you. All that you’ve accomplished, Sir, is to cement the belief that no Judge should have a lifetime appointment. The ‘Judges’ today seem to be getting bored with the Constitution. I mean, what‘s more fun than gathering together on a Saturday night and playing ’How to have fun changing the Constitution‘ with your other ’Judge’ friends.
    It’s simple, Sir. I can’t respect anyone who decides to make his or her own law, while disregarding the lives of the citizens you are supposed to be defending. I vote for term limits of twelve years, but no more. And, Obamacare and all other ‘regulations’ will apply to all Judges, politicians and government employees. You want to change the law for the American people, then you will live under the exact same conditions you impose.

    Posner is a scary man… an activist judge who sits on the bench to affect socialist policy, not to weigh cases with respect to the Constitution. The U. of Chicago is one of the biggest disgraceful blights on our educational system… nothing but destructive abhorrent policy makers come out of that horrible “school” of radicals.
