Feds Attack Family Farms. . . Again

Last summer The Blaze reported on the Obama administration’s double-pronged attack on family farms. This was seen in the new set of regulations coming from both the DOT and the Department of Labor.

The main focus of the new regulations proposed last year was on the operation of farm equipment. The DOT was trying to mandate that anyone operating a piece of mechanized farm equipment be subject to the same rules that apply to drivers of semi-tractor trailers. These changes would have essentially blocked all young people who work on family farms from operating even the smallest tractor or truck, unless those people would be able to pass the stringent tests and maintain the detailed logs that are required of truckers.

These rules would also open the door for the potential unionization of all farm workers in America. Even family farm workers.

During the comment period for the proposal,  the outcry from the farming communities seemed to bring clarity to the situation. However, the DOT and Labor Departments continued churning in the background, writing new and different rules that would soon surface. In August the new rules were posted. They proposed barring anyone under the age of 16 from performing dangerous jobs, like driving tractors, handling pesticides and even branding cattle. A december 1st deadline for public comments was set and the public responded with more than 18,000 comments.

After December 1, 2011, a bi-partisan group of 28 Senators and 70 members of the House sent a letter to the Secretary of Labor, complaining about the new rules and asking that they be withdrawn until such time as the Labor Dept can prove the rules will significantly improve the safety of youth workers while having no significant economic impact on the farms.

The Des Moines Star Register’s coverage featured some significant passages from the letter:

“After having additional time to review the Proposed Rule and compare the proposed changes to existing statutory law, regulations, and the Department’s existing interpretive documents, we believe initial concerns were well-founded. As a result of these concerns, we request the Department withdraw the Proposed Rule in its entirety,” the Senators state in a letter to Secretary Solis. “It is puzzling why the Department would suddenly propose changes to existing regulations, particularly considering the advancements in farm equipment and adoption of technologies that have improved operator safety in the last 35 years.”

The statement from the group said “until recently, farms jointly owned and operated by multiple family members had discretion over the responsibilities they gave their children on the farm. But the proposed rule change would do away with that freedom and extend the parental exemption to farms owned solely by a parent. It is common in rural America for siblings to jointly own and operate farms and for extended family and neighbors to participate in agriculture production. With this rule change, the government is proposing to tell farmers and ranchers: We know what’s best for your children, and what they should and should not be doing.”

The note cited the fact that the Labor Secretary was using statistics from 13 years ago. This outdated information regarding accidents in rural settings was flawed and did not reflect the latest safety innovations that have come to the farming world.

Despite the 18,000 comments and Congressional opposition, the regulations appear to be moving ahead as Solis has planned. Local farm communities are quite concerned that this. Here is one of the dozens of local news stories highlighting the problems this will create:

 

Yesterday, Secretary Solis testified before a Senate Subcommittee on Labor, Health & Human Services, Education and Related Agencies, and Pensions. Ms. Solis’ comments on the restrictions on family farms were brief, only stating that her department was open to hearing comments on the new regulations.

It should also be noted that today is the anniversary of the death of State Farming in the former Soviet Union.

On this day back in 1989, the USSR’s Communist party leader Mikhail Gorbachev announced that Central Farming was not working. This was underscored by the fact that his country was forced to import tons of staples like wheat and meat. Mr. Gorbachev sounded like a Free Market Capitalist when he told the Soviets:

“The essence of economic change in the countryside should be in granting farmers broad opportunities for displaying independence, enterprise, and initiative.”

Farmers would be granted the opportunity to be independent, enterprising and succeed or fail based on their own initiative. An interesting concept.

      I’ve gotten to the point where I stopped sending in the next protest & the next etc etc but that’s exactly what we should not do. It’s a small price to pay to prevent the bad guys from thinking they can gt away with it and let the good guys know they (& we) are not alone.

      Ah… Ms. Hilda Solis of La Raza… Appears to be so concerned for the safety of “the children”… Wouldn’t want young farm hands to get hurt…

      Yet, this same woman has been pushing for wide open borders and mass amnesty for years. If Ms. Solis is “so concerned” for the safety of our young, why would she push for open borders resulting in rampant illegal immigration and endless drug trafficking…

      It’s never “about the children”… Just as Glenn said, it’s all about CONTROL!

      People all over the world are laughing at us! Here people are starving and we are burning our grains in cars. Here in Oklahoma we have to many poor people that have older cars and know of a engine repair bill because of ethinol. Our gas stations have big signs and banners stating “No Ethinol.” My sons signed up for the Government program CRP known as CRAP here to not grow crops. My sons actually made money last year. They didn’t have to buy hay and cubes and are getting paid to do nothing. In 2010 corn, oats and wheat seeds were out of sight. Neighbors lost badly last year because of the drought and had to sell their cows. Some say they will never be able to buy back the herds.

      OK, here’s my take on ALL of these regulations and executive orders. Every one of them has one thing in common. Do you know what that one thing is? Think about it before reading on please…..

      The one thing in common is that they make people mad. Last week when that reporter asked Obama about gas prices and BHO said, “Now, do you think a President running for reelection would want high gas prices?” And most everyone in the room laughed. That hit me. Obama wants high gas prices. He is trying to make the masses mad, even his own followers. Why you ask?

      For the “bottom up, top down, inside out” to work the bottom (US citizens) need to rise up so the top can come crushing down. Obama needs to make this happen before the Nov elections so there will not be any elections. He doesn’t care about the polls. He plans on martial law and taking over.

      Obama and crew wants everyone to be so mad that they rebel. Expect more regulations at a much more hurried pace. Obama thinks you will become another OWS. Why? Because all of these socialist commies only know one way to react; with violence.

      Glenn missed the reason for the farm regulations. It is an attack on the Amish religion. Obama is attacking religion one faith at a time. It will harm farmers in general but primarily Amish who were also targeted for selling raw milk.

      This outrage is a perfect reason for needing to elect Governors that believe in and will support and defend the Constitution. These Governors need to tell the Labor Dept and the DOT where to stuff their new regulations. The Governors have the right to do so using the 10th Amendment.

      Why are our congressman and senators not working on regulation to take away the authority of these agencies to regulate these issues? Why… Because it is really easy for them to say they disapprove but very difficult for them to do their damn job. And the sheeple will believe them when they say they tried.

      Not to mention the fact that companies such as Tyson, Cargill (big pushers of the “pink slime” ) and other large agri business want these regulations to push out the family farm.

      Most farmers lost their farms in the 80s to big corporations, its hard to believe they want more than what they have already basically confiscated through default. GB is right! People will starve when government trys to run the farms….centralized planning of farming has never worked! America is in trouble when her farms are lost to intellectuals. The world will starve as well as a result since we still are the main exporter of foods worldwide esp to those in need. God has blessed us richly and it takes MAN to undo this blessing….its clear to see. Its by choice and freewill! We will all suffer in the near future as a result.

      What you have said makes more sense than most will want to even consider; but I have thought the same thing for the last 2 years… Even when NC gov. Bev P. made the statement 2 years ago that we should forgo the elections for a while until things got better in our financial situation??? Makes you think when other Dem. favorites say things they are thinking???

      And then you hear Ms Obama say things like we HAVE to do this and You WILL do that; really do not like being told what to eat, not eat, etc. Oh well… I think the farm is one of the last freedom areas on the earth and it would be a shame to eliminate the rights of the food growers to plow without a DOT commercial license… What will be next…

      When I was 9 years old a old 76 years old man hired me at $.60 a hour to mow and rake hay. At that time adults were getting $1.50 an Hr. and he told me he was risking equipment for my learning. That winter he died and the next summer I was hired by neighbors for $1.50 and had a stash to buy new cloths for school.

You will need the duct tape to keep your head from exploding. Obama is using all of the agencies that are not under the control of Congress. The Republicans have been able to push back on some of these by refusing to fund them and are still trying to stop these land grabs. Obama is telling the Czars not to put anything in writing and pretend they have Congress approval and go ahead and regulate. They are using the Antiquities Act of 1906 to set up monuments and grab millions of acres of land that contain oil, minerals, gold, etc., in Otero Mesa NM; Great Basin, NV; Owyhee Desert, OR; Bodie Hills, CA and Modoc Plateau, CA. The US Fish and Wildlife is being used to protect the spotted owl to destroy the timber industry in Oregon; polar bear in Alaska to keep land from being drilled. At the same time, the EPA and the Army Corps are grabbing all of the water and waterways. I WILL NOT COMPLY!

      This is NO DIFFERENT then when 180 MILLION of us called our senators and congressmen and told them that WE DO NOT WANT socialized health care and ALL the other unconstitutional bills that they voted into law.       I grew up on a farm. It wasn’t huge, 380 acres, but we had more than 120 ‘milk” cows and a grade B dairy, about 20 rabbits, several horses, miles of fences and a lot of agricultural products, including two large gardens, that needed to be tended to… daily. Going to school only cut the available hours of day light to get the same amount of work done.
      We barely had enough to survive on. As a kid, if I didn’t work, I didn’t get fed. Illness aside. Life “IS” tough all over.

      Interesting how the only time you see government “IS” when they want to take something from you or force you to do something it wants.

They would always say that the DEMS looked out for there interest more so anyway ( farm subsidies ,green acre subsidies ) Subsidies are another mans MONEY ! STOP IT !! Your good old DEM farmer labor ain’t what it used to be !! Once the democratic party continued it’s push on the right to kill (ABORTION ) via early 1970′s , any vote for the Democrat party was out of sheer GREED and disregard for human life !! All Americans and FARMERS, might end up paying a heavy toll for such actions (SOCIALISM ) DAMN IT -PLEASE STOP voting for your pocket book only !!       “Control control control” – yep, pretty soon the Feds will be telling us what we can & cannot grow in our gardens and when the crops come in they’ll collect the produce and take it to the “people’s“ grocery store”. If you’re caught with a secret stash of vegetables, off you go to the “re-eduction camps”. After all, they have to make sure the 1% doesn’t get most of the lettuce.

      “Soon we will be starving.” – Unless you stand in line at the “people’s grocery store”. The working 50% will be forced to grow enough food to support the other half so I wouldn’t count on being well fed. I‘m pretty sure that other half won’t be planting seeds, weeding or picking tomatoes anytime soon.

      This is the biggest bunch of CRAP I have ever heard of in my entire life. When I was young and during the summer months I would stay at my Grandmother and Grandfathers farm as well as my uncles farm. I worked at doing lots of things and loved it. This is Obama changing to his dictator for of governent. Folks, he hjas got to be stopped. He is giving away US land to a foreign country and now he is placing trucker rules on farmers. Its big BS.

      Until the kids are age 21, we need to waive the union dues. If you start at age 16 you might scare them away! If a kid is between 10 and age 16 waive the rules if Farmer Jopn pays an extra $500.00 for a temp permit.

      We are in the dairy business and still hanging. My family is one of the largest landowners in this part of the state and there is no way in hell any govt is going to take our land. At least while we are vertical. While we have some good business helping to keep us afloat, I enjoy the taste of raw milk & so do my friends….

      Myself & extended family are all prior military whith two nephs in the stan right now, & most of the hands are also military fellows. Theres one way up to the main CP and from our vantage point we can have it covered in seconds flat.

      We are praying the administration changes hands this fall, & they can seriously make some changes to these out of control useless thug bureaucrats & deliver a serious blow to the DOL in relation to private sector farms.

      I have heard through my contacts that the unions have been asking around about me, and from my response that filtered back thru the community , they got a real good idea what’ll happen to them if they come around here…..there’s alot of swampland around these parts& we’re well armed…..We handle issues the old fashioned way, I’ll defend this milk operationg base until my last dying breath…..One poster above was right, with the ballot boxes being as rigged as they are, it may well be time to crack open the ammo boxes….Semper Fi!

    We need to redefine the jobs of our congressmen and women and senators to one of repealing laws and regulations instead of composing them to decomposing them.

    This would keep them busy for about 100 years and our country and our lives would be so much better year ofter year without these elite’s getting rich under the guise of trying to make things perfect for us.

    If they want to make things more perfect for us just get rid of all these stiffling laws and regs and then get rid of themselves.

    Congress shouldn’t be begging the Dept. of Labor for anything. They should be passing a law which would abrogate these rules. After that, they should pass a law taking away the funding for the Dept. of Labor and abolishing the department. Why is the Federal government even involved in labor? This is a power reserved in the Constitution to the States. This is the legacy of FDR creating all these alphabet agencies to enable the Federal government to run the economy and usurp state’s rights.

    These new Labor Dept rules, by the way, are the first step being taken by the radical communists in the Obama Regime to collectivize our farms. Its what commies always do and it leads to sharp declines in food production and famine.

When you contact your representatives, do you ever get a response, or is it a pacified response? You almost never hear them speak up about our concerns, the regulations being forced in this country against the American people. The day will come, if this isn’t stopped, that every aspect of our lives will be under a microscope, a human gps. You already see the control this admin is pushing forward and why he wants gun control.

      An example of how the government “regulates” an industry…

      My wife has been a licensed manicurist in CA for 23+ years. She follows the state board rules. Her salon gets visited fairly regularly…once a year. If anybody’s station is out of compliance (typically would be a sanitation issue…same as restaurants) a citation is given with a time limit to be corrected, if corrected, everything is fine.

      HOWEVER…the salon in the same center uses illegal (extremely toxic & dangerous) products, full of workers who don’t speak English with NO LICENSES displayed (every person who does a service MUST be licensed).

      The state has NEVER gone into that salon. We’ve visited several of salons of this same profile in the area & witness the same lack of licenses & use of illegal products. The odor is a dead giveaway.

      Only the LEGAL/LAW ABIDING salons get visited by the state. We’ve spoke with several other salon owners & the trend is the same.

      What does this say?

      It tells me it doesn’t pay to follow the law. What a pathetic excuse for government. All for the “safety” of customers & employees. I‘d say it’s a joke…but there’s nothing funny about it.

    Did anyone notice that the statistic they used 74% – what other industry’s are kids working in?? I worked in my dad’s printing plant when I was young but I knew a LOT more kids that worked on their family farms. Using this percentage without going into more detail makes the number of deaths look huge. 74% of what number? I don’t want any kids to be killed but death is part of life and accidents happen.

      I started working in my dads butcher shop in 1969. I was 8 years old at the time. I ran a grinder making hamburger and sausage. there were no O.S.H.A. guards on any of the machines at that time.
      My dad taught me how to use them properly and safely. Still have all my limbs. Did‘nt need no stink’in government then and I don’t need them NOW.

      From what I’ve seen around here, most of the accidents involving youth working in farm jobs is city kids. Seems like deaths due to suffocation in grain bins is the most common. (The grain in the top of the bin goes out the bottom first. If you’re standing on top of the grain, it sucks you to the bottom.) It all goes back to what the mom in the video said, kids who grow up around a farm are taught the dangers. Kids working on a farm for the first time when they‘re 16 don’t understand the hazards. I would much rather trust a 12 year old, that grew up around equipment, driving a tractor than a 16 year old that had the department of labor required training, but hasn’t been around equipment. (Although, I wasn’t allowed to drive a tractor until I was big enough to sit in the seat and safely reach all the controls.)

    How disgusting… farmers and their families are amazing.. things I found over the years since my childhood are that children have more responsibilities at a younger age, are trusted more have more religion.. a family that prays together, stays together. The family on farms and ranches are tighter knit..children don’t wile away the hours playing games on the computer or play station they are up and doing things outside. Child labor.. good grief.. they want our farm/ranch kids to become less responsible.. like the city kids.This administration is so blatantly trying to destroy family traditions.. is it any wonder that city kids are for the most part so messed up.. they haven’t the responsibilities that country kids have. Getting uo and making your bed and taking out the trash is totally different the plowing the field, or feeding the livestock or milking the cows.. This administration sucks!

      I called and I got the impression this was not he number that they wanted to have given out. After my comments they requesting my contact information. I said if you are asking for this info just to try and justify your existance, then that is not necessary, just take my comments. However, I did give my information. I would suggest everyone call.

      A loud shout of support for calling, voicing our opinions, and demanding retraction! As ProblemSolver stated earlier, these departments/organizations have absolutely no business or authority to promulgate rules for farms. All Americans must continue to demand the leaders, and administration follow the rules, laws, and constitution. There is no authority for the Executive Branch nor its cabinet departments to write nor enforce laws. When we, the people, stand up, talk, debate, and challenge big government, we take a crucial step to prevent a socialistic or communistic community of activists and radicals from destroying the USA and our freedoms.

    These kids are not hurt by working on family farms …. they are learning lessons that Obama and the libs don’t understand or have themselves .. the VALUE OF HARD WORK! Trying to put the family farms out of business and control all our food is the goal.

      Kids working on farms and ranches receive many benefits from their work. They are more awake and attentive during school. They have better stamina. How many overweight kids live and work on farms and ranches? They live a healthier life because of their diet. They understand the principles of personal responsibility and honest work. They are more self reliant. They have a healthy respect for all types of equipment and know the consequences of mishandling said equipment. I could go on but you get the picture. Farm kids have the traits that this administration does not want our kids to have.

    Well, when the agenda is for the government to be supplying all the doctored & engineered food from Russia, to control your thoughts ya know, (Codex Alimentarius, look it up if you don’t know what it is and get ready for a shock) the family farmer is getting in the way of that agenda. Consequently, they got to go cause Da furor said so.
