Feds Trying to Silence Company Wanting to Reveal What Info the Gov’t Is Requesting About You

In 2010 alone, Wired’s Threat Level explains, the government sent more than 24,000 National Security Letters to Internet service providers and other companies such as credit and financial institutions. Letters such as these come with a gag order in place, which requires the companies to stay mum on the fact that the government was seeking to acquire information on individuals.

One company served with an NSL earlier this year is pushing back on this request for silence. Wired reports that it wants to tell its customers that their information has been requested by the government and give them the opportunity to take it to court, should they wish. This “minor defiance,” Wired states, has caused the government to file a request that the company, which remains unnamed, be forced to remain quiet because speaking out “may endanger the national security of the United States.”

Wired has more on a case that it believes “shed a little light” on NSLs post-9/11 when they were reformed to not require a court order and come with forced gag orders on companies:

The public has become aware of only a handful of some 300,000 NSLs handed out over the last decade, and those became public only after the recipients launched legal battles opposing them. As a result of these battles, courts have chipped away at the gag order requirement as a violation of the First Amendment, and internal watchdogs have uncovered some abuses of the FBI’s NSL authority. But the letters are still one of the FBI’s most powerful tools; a tool that is rarely discussed inside or outside Congress these days.

NSLs are a powerful tool because an FBI agent looking into a possible anti-terrorism case can essentially self-issue the NSL to a credit bureau, ISP or phone company with only the sign-off of the Special Agent in Charge of their office. The FBI has to merely assert that the information is “relevant” to an investigation.

The gag orders raise the possibility for extensive abuse of NSLs, under the cover of secrecy. In fact, in 2007, a Justice Department Inspector General audit found that the FBI, which issued almost 200,000 NSLs between 2003 and 2006, had indeed abused its authority and misused NSLs.

The inspector general found that the FBI evaded limits on (and sometimes illegally issued) NSLs to obtain phone, e-mail and financial information on American citizens, and that it had also underreported the use of NSLs to Congress. In 2006 alone, the FBI issued more than 49,000 NSLs, but that number dropped dramatically to 16,804 in 2007 following the inspector general’s report. After the Justice Department claimed it instituted reforms to address the legal lapses, the number of NSLs issued increased to 24,744 in 2008. In 2010, the most recent year for which statistics are available, the FBI issued 24,287 NSLs.

Wired reports on a couple court cases that brought up the constitutionality of gag orders, one of which took six years to remedy. Nicholas Merrill received a request for email addresses and billing information from the government when he was the owner of Calyx Internet Access. Merrill, who was not allowed at first to reveal his name or the company, with the ACLU brought the NSL request to court, stating that the customer information was protected under the Constitution. In a back-and -forth, the Second Circuit Court of Appeals ruled in 2008 — four years after the initial request — some parts of the NSL gag order were unconstitutional. From there, Wired reports that the U.S. District Court for the Southern District of New York said the feds had to justify why a gag order should be maintained. Here’s what happened next:

In June 2009, the government introduced secret evidence to the court to justify continuing the gag order, claiming that if information were revealed about the letter it would harm an ongoing investigation. Merrill and his attorneys were prevented from learning the specifics of the evidence in order to refute it. The government was then ordered by the court to produce an unclassified summary of its evidence.

Wired reports that eventually only a partial gag order was issued, giving Merrill the ability to share the name of himself and his company. This was in exchange for dropping the case and keeping other details secret. While this may seem like a small victory — if that — Wired reports that it gave NSL recipients the ability to challenge NSLs and gag orders, which they could not really do before, and requires the FBI to make a case for why a gag order should remain in place.

In the more recent case of the unnamed company “with employees dispersed across the world,” Wired reports that it challenged the gag order last week. This brings us to the FBI asking the court to enforce the gag because information requested by the government includes “international terrorism or clandestine intelligence activities.”

The FBI did not respond to Wired’s request for comment on the case.

      This is how our liberty and freedom is taken! History shows us that it has always been under the guise of protecting society and keeping us safe. Pay attention – this has been going on for a long time. When you try to talk to many in our country about these sorts of things happening I find they typically don‘t believe it’s that big of a problem or try to just blame it on one party or the other. We have been the proverbial ‘Frog in the Pot’ for a long time and the water is starting to get hot!

      Last week, President Obama signed into law the Federal Restricted Buildings and Grounds Improvement Act of 2011. This law permits Secret Service agents to designate any place they wish as a place where free speech, association and petition of the government are prohibited. And it permits the Secret Service to make these determinations based on the content of speech.

      Taken out of context and edited. Sorry. I have heard him respond to this stuff. What he was talking about was you can’t remove all government in a society that has no moral foundation. And that is true. You Ron Paul guys think your guy is the messiah just like Obama followers. Santorum does have a few faults and bad votes but overall he is the best choice still in the race. And I watched the interview of him on this issue (unedited) and what he was talking about is the Libertarian belief that we should be free from all government. Which would be great if we were a moral society. Be we are no longer a moral society and without any regulation we would dissolve into humanistic anarchy. Glen interviewed him on this point and his answer was great. We need laws to protect life for instance. He is not talking about laws to tell you, you can’t have sex or what possition to be in. You are forwarding on liberal propaganda my friend. And Ron Paul is not un-flawed himself nor is he the messiah.

You could put Romney in charge of auditing federally funded agencies for efficiency. That would be playing to EVERYONES strengths.

    Point in fact. My kids do homework from school that is sometimes on topics I would not approve of.
    My kids interests are based on their ages and gender. Do to limiting factors our family travels the world through the
    eyes of the computer. I’m an Americans Citizen and I Do care about world affairs, I live here and so do my loved ones. What do you think my google affairs looks like? How often do you think my information could be misinterpreted? Really, the government is going to waste tax payer dollars on that when there are children in our own back yard (U. S.) with no place to live?
    There has to be a better way. Or a better, smaller, government that can figure it out.

As well I search all sorts of things on the internet I am sure some could be misinterpreted. I am tired of Big Brother and having to be concerned about everything I do how it could be interpreted.

    As a staunch Conservative, I remember complaining when the Patriot Act was first put in place and the government tried to get libraries to report when anyone checked out certain books. Folks I know said “If you’re not guilty of anything, why do you care if the government knows what you’re reading?”

    My response was always “this is where it starts. Give them an inch and they’ll take a mile.” To which some would offer a retort about me being paranoid… Well it’s coming…. Am I still ‘paranoid’?

The banks are finded heavely if they tell a customer they have to report a cash withdrawal of two thousand or more. The next four years will prove we are completely ruled by a police state but it will be too late. I sure hope I’m wrong but the evidence is everywhere.

Look, this might sound prog, but the reality is that with all the terrorist activity on the Internet, and in sleeper cells, mosques, madrasas and so forth, I believe monitoring the international calls of potential Islamists was necessary. I also firmly believe it saved America from further attacks during the Bush admin.

      It’s different now. Once a commie gets into power, it’s a whole new ball game. You are absolutely correct that we are already living under communism and don’t know it yet. That‘s because we’re in Stage I, where power has not yet been consolidated. Obama is using a lot of subterfuge, but at one point he will have to take control of the Internet, like the Communist Party did in China. Then it’ll all be over. We can kiss our freedom goodbye.

      While I agree the government has no right to threaten private companies, let’s face facts. If you have a bank account, a mortgage, a credit card, public utilities, insurance, use anything but cash to buy stuff etc etc, they know or can know everything about you, what you do, how you spend your money etc.
      If the government wants personal information, they will get it one way or another, legally or illegally. They’ve been doing it for decades. The internet just makes it easier for them.

Both conservatives and liberals need to address this and address this now. Vote for the only candidate that is for our Constitution and our personal liberties.

      I‘m not sure this is the Reich’s thing or if its just the FBI being as nosey as it can be….

      As much as I would like to blame this on Obama and his Ilk… Look at the graph and you see that this has been going on for a long time… and I am not sure that Das Fuhrer has ordered the S.S. to do this… I think it just may be the FBI trying to earn the Fuhrer’s favor by doing this on their own..

      But I admit, it IS entirely possible…

      The problem between Bush‘s version of the Patriot Act and Obama’s version is I don’t trust Obama. He will use it against anyone who speaks out against him or with Conservative groups. He has already labeled us as the violent ones, the racist ones, yet it is always the left who is commits violence and it is the left who always show their bigoted and racist views. The IRS is already discriminating against Tea Party and 9-12 non profits. It does not surprise me that some in the FBI are abusing their power. I am sure everyone on this site is on the FBI’s watch list; we know definitely Glenn Beck is and all his employee’s. I also stopped using Google a long time ago and I would never log on to their site.

      @ Dishevel – I wouldn’t clear Obama that easily….the Patriot Act was just a rewrite of a Bill that Joe Biden sponsored years before…both sides are guilty here.

      It HAS been going on for a long time, against our enemies. Now, it‘s going on against OBAMA’s enemies. That’s you and me and everyone else who loves America. And some of you, please stop calling Obama a Nazi. Hitler was as evil as they come, but he was a nationalist to the very core of his being. He wanted to make Germany the greatest nation on earth and all other nations subservient to them. Obama, however, is a foreign-minded Alinskyian. He wants America to decrease, and the commie-Islamic UN to become more powerful. Geez, wake up.

    Sheeple give so much personal information via FB and gmail accounts that I wouldn’t think Big Brother would have much difficulty compiling it. Oops…….I forgot for a second how much lefties love wasting money to bring the whole system down.

      Lefties love spending money on anything. Don’t forget some of the lefties have a FB account too. You can see what they say then, turn the TV on and watch them deny it or say something entirely different.
      But, you don’t have to have a FB, Twitter, My Space or other account for them to get information. They gather info from bank acct’s, medical offices, schools, people taking polls on line, credit card companies, work places, it is endless.
      This has become a spy nation on it’s own people, not to mention trying to take everything that belongs to them.
