Florida Hotel Fires Worker for Wearing American Flag Pin

A Florida hotel fired its front desk supervisor after the man wore an American flag lapel pin, a violation of the hotel’s personal appearance policies that prohibit employees from wearing badges and pins.
Sean May told Jacksonville’s WJXT that his manager at St. Augustine’s Casa Monica Hotel told him Thursday to remove the pin or leave. He refused to take it off and was sent home. The following day, the hotel informed him he was fired.
“I wear it with pride because I like where I live and I love this country,” May told the station. When his manager gave him the ultimatum, “I said I‘m not going to remove the pin so I guess I’m going home.”
May, 26, said he wore the pin everyday for two years and never had a problem with it until his manager approached him.

The hotel defended the decision to fire May in an email to the station:
“The Casa Monica Hotel located in St. Augustine, Florida, is an American-based, homegrown historic hotel,” the email reads. “The property reflects its pride in America and great patriotism by flying the Stars and Stripes high over the hotel. The American flag greets every guest and employee with its symbolism of our belief in this great country.”
“However, our employee handbook clearly states, ‘No other buttons, badges, pins or insignias of any kind are permitted to be worn.‘ No matter an individual’s national preference, political views or religious affiliation, it is a standard regulation which ensures equality for all Grand Performers [employees].”
According to the station, a recent upper level management change has led to a reinforcement of certain policies that may have been allowed to lapse.
May said he never received complaints about the pins from hotel guests, many of whom he said seemed to like it.
“I‘ve actually gotten more comments about it than any of the service I’ve actually done at the hotel,” he said. “Why would I want to work for a company that isn‘t going to be supportive of what I believe in and what I’m working towards?”
The station said it received a massive community response to May’s story, which first aired Thursday. One Florida resident, Air Force veteran Bruce Whalen, said the lapel pin should be a dress code requirement for all residents and is calling for a boycott of the hotel.
“Anybody who takes a chance on his livelihood to take a stand for patriotism is a hero and should be treated like a hero,” Whalen said.
Earlier this week, an Olive Garden restaurant in Alabama prompted national outrage for not allowing an 80-year-old patron to bring an American flag in for a Kiwanis club banquet.

Posted on October 15, 2011 at 5:39pmI work for the federal government of this United States and we aren’t allowed to wear any unauthorized pins on our uniform. Included as unauthorized is the small American flag pin. If it isn’t given to us by our dept. It is not allowed on the uniform. They should have given him authorization to wear it but a lot of employers have rules that prohibit adding extra things to your uniform. The smaller the number of employees the easier it is to make exceptions for things like this.

Posted on October 15, 2011 at 8:47pmAmericans who travel should take this story into account when booking hotel rooms in Jacksonville, and tell ALL of their family, friends and business associates to do the same. Let their consciences be their guide.
And if one REALLY want to get even with this hotel owner, they should offer to buy rooms for ANY Occupy Wall Street participant for a full weekend. That way, the hotel would become infested with all kinds of vermin (bed bugs, lice, and smelly/dirty people). Then, all one need do to punish this firm is book a room there, and when you subsequently get a bedbug bite, call the county health department to complain. I GUARANTEE this would result in the loss of THOUSANDS and THOUSANDS of dollars to this hotel (having worked in the hospitality industry for some time…)

While I’m all for wearing a flag pin, this employee knew the rules when he hired on and decided to break these rules. How can this be held against the company for enforcing the rules everybody has to live under while on the job? Sure the company can change this rule to let him wear his flag pin, but then where does it stop? Will the next employee want to wear a pin or button stating that they like to have sex with sheep? I know I’m going off into the extreme here but. If one rule is OK to break then how far will it go and what next rule will be OK to break?
He signed the employment application when he hired on. He knew the rules and chose to break them. The company has a right to dictate to their employees how to conduct themselves while on the job, up to and including how to wear their uniforms.

I didn’t think so.. So, in any case they set “rules” and they must be enforced, no matter how slight they are.. That being said, I’m siding with the hotel on this issue. As some others have already stated. This is not about the American flag. The employee handbook clearly states the rules. Granted, he’s been wearing it for quite some time now, but now the company apparently is under some sort of new management and they are now enforcing some old rules. I don’t see the problem. It’s not like they are saying you can wear other pins, but you can’t wear the flag pin. It’s against all pins or any other additions to their daily uniform. It seems obvious to me by the huge flag above the hotel that it has nothing against the flag or America. They simply want their uniforms to be clean and consistent.
Some of you need to back up the canoe and take another look at the situation.

It is fairly clear that they wish to serve the despicable, unpatriotic Liberals; great. I’m also free to patronize other hotels that cater to a more refined and patriotic class of people. As someone who has regularly traveled the world, I’m glad to be warned of this establishment, and believe that even Liberals will better served by knowing where they can stay among their own despicable kind. Sounds like a win-win to me.

I‘m sure you’ve heard of warning labels being put on blow dryers warning not to use them in the shower? Or, if you take this medicine it will save you. Or it will kill you. Every possible side effect has to be covered or they can get sued.
In today’s Sue, Sue society any and all companies and businesses have to cover all possible bases just to protect themselves. There are lots of people, and ambulance chasing lawyers, looking to sue anybody and everybody for anything and everything.
I’m all for wearing a flag pin. I have flags flying at my home. But that’s not the issue here. The issue is company rules that every employee reads, knows and agrees to live by in order to be employed at this establishment, or any other.

I have also noticed that it is hard to walk into a hotel with a lobby TV on that is showing Fox news. I probably would not have noticed the pin but I do have a problem going to a fast food restaurant when the the girl taking orders and making change is wearing a bejeweled booger valve in her nose. I would worry that stuff like that would attract lightning. I guess gen x and gen y folks don’t have enough pain in their life so they have to make some.

Followed shortly thereafter by remembering that employees who do not want to follow their jobs policies & requirements, not only CAN but SHOULD leave.

You are absolutely correct. But at the same time it is the prospective customer’s RIGHT to take the actions of the company into account when deciding whether or not to give them our money. And it is again our right to spread the news of this travesty to everyone we know not to visit said hotel, or any Marriot hotel at all for that matter.

This is NOT about an American Flag pin… the is about unauthorized additions to a uniform required to be worn by employees… the young gentleman apparently got away violating the terms of his application agreement for two years prior to being ask to remove it.
Nowdays, a manager MUST make these sorts of rules – and require employees to abide by them…
If you DO NOT spell the rules out IN WRITING (as this company did) and ask them to sign, before hire… some of these kids will show up for work with piercings in every possible facial/head area – with purple and/or green hair… wearing a button reading something atrocious re: *Nanny goats… now there‘s some Good lovin’*… and then SUE your butt, if you find it unacceptable.

While it might be sort of petty for the hotel to be so strict. It is their right to establish and enforce whatever dress code they want.
I say “good for you” for standing up for your beliefs. Now get a job that allows you to express them.

This is not UNAMERICAN for this company to expect this. What happens when another worker wants to wear a pin with whatever country they were from? Its company policy, give me a break. Every company has policies, follow them or see ya. Prepare to be like a piece of meat and a pack of wild dogs cause here they come….

Report Post »Besides, allowing a flag pin opens an avenue for others to claim discrimination if they want to wear, say, a probama pin or something. The regulation makes sense from the company’s point of view.

I have worked for many companies over the years and all have had written in stone requirements that begin to lapse due to current management focusing on dertain things and not on others…then, when new managers take over, they invariably expect every rule and regulation to be followed in order to make a point…and they then, ever so slowly, begin to focus on their pet peeves and let other things slide.
Two years going by means only that he was able to get away with a clear violation of their dress code for 2 years…now he needs to get in line with the rules his current manager seeks in enforce.
Jesus people….we seem to all be for capitalism and against government regulations telling us what to do in out businesses…yet here you all are complaining how one business operates, plus trying to act like the government by telling them what they have to do about this or that.
All or nothing policy’s rule the workplace…if he wears his flag lapel pin, should another employee with a Palestinian heritage be allowed to wear theirs?
Jesus people…your love for your country is in your words, deeds and your heart…not in some dime store knick-knack!

But, of late, labor departments/judges have sided with Muslims demanding i.e. being able to wear a hijab, even though the employer policy against such had been in place for decades. I am just glad to see a proud American taking the same stand the Muslim’s have.

Don’t worry, he isn’t. What is so hard to understand that if a business has the right to set policy that customers have the right not to patronize a business if they don’t agree with a particular policy?
We used to have a buffet around here that charged customers extra if they left too much food on their plate. Most people didn’t agree with that policy, so the buffet eventually closed down.
This is America. We have the right to not patronize a business for whatever silly ass reason we come up with.

Posted on October 15, 2011 at 2:59pmI live in AZ and our last district manager (after 3 years of handling this area) told all of us managers that we no longer had to wear ties (mandated by our company dress code) between July and October…cause it was 115 degrees at times.
We just got a new DM last April, and…you guessed it…we went back to wearing ties in the uncomfortable heat. We did not like it, but it is the company policy…and it sure was nice while it lasted.

If they would allow this guy who lives in America and is an American Citizen to wear his American Flag pin, then the wonderful ACLU would jump on the first chance they could to SUE the hotel if some illeagle working there wanted to wear their Cuba pin or Mexican Flag pin. I wish they would all either embrace being American or go back to where they came fom if they can’t embrace being an American. Can I be German-American and get minority status please? I could make a lot of money off the hand me out programs too.

I would hope that they do. I would also hope that they fly in the direction of agreeing that a person can refuse to patronize an establishment with a policy that the person doesn‘t agree with and also to voice his or her opinion of the establishment’s policy on a public forum.
I don‘t believe anyone here has ever claimed that the hotel doesn’t have right to set the anti-American policy, just that they disagree with it to the point that it will stop them from patronizing the hotel.
