Florida Judge Dismisses ACLU‘s ’Kick a Jew Day’ Lawsuit

The ACLU’s battle to obtain school records surrounding a 2009 incident in Collier County, Florida, referred to as “Kick a Jew Day,” have failed. A judge has dismissed the group’s lawsuit, which sought to obtain records detailing 10 middle school students‘ discriminatory plans and behaviors as well the school district’s investigation of the incident.

Two years ago, on November 19, 2009, the children decided to imitate a “South Park” episode — with a twist. While the fictional cartoon characters in the show targeted red-heded individuals with a “Kick a Ginger Day,” the Collier County students apparently did something similar — an effort to target and kick Jews. In the end, they were punished with a one-day in-school suspension, which some critics believe wasn’t enough.

Since the incident, the ACLU has continued to seek the documents in an effort to look further into the incident. While the group cannot refile the case, it may be heard by the Second District Court of Appeal. Once the judge signs the final order, the appellate court may offer a different decision regarding the students’ education records. NaplesNews.com reports:

The three-judge panel could decline to hear the appeal or issue a decision and possibly certify it as “a question of great public importance.” It would then go to the state Supreme Court, which could clarify the state constitution and state laws involving education records, public records and student confidentiality.

At the heart of the debate is whether student records should be private or public. The ACLU has argued that if the children’s names are removed, then the documents are no longer considered “education records.” The ACLU claims that it does not wish to have the children’s names, but that the group only wants to review associated documentation.

The school has declined these requests thus far.

“Kick a Jew Day” events have occurred in other middle and high schools across America as well. Last December, a similar incident unfolded at Vestal High School in Vestal, New York.

    I am left-handed. I remember when I was in middle-school (a long time ago) they started the rumor that Friday would be “hit a lefty day”. Sure enough Friday came and me and maybe 30 other lefties got hit on the arm all day by different people. It went like this. I would be walking in the hall and kids who knew I was left-handed would pass by and hit me on the arm..and smile and say..“hit a lefty day”. I would smile back and tell them I was waiting for “hit a righty day”. The hits were no more than taps and it was good spirited. I must have got tapped on the arm 40 times that day and laughed about it. Monday came and it was “hit someone wearing red” day. Lefties were left alone.
    This…“kick a jew ” day would have probably been similar but was blown out of proportion.

      I typically do not resort to name calling in response to what people say/think/do, but if you think this was something that was no big deal and blown out of proportion, then you are a complete and total moron. Comparing this to kick a lefty day is an absolutely dispicable comparison. Yes there is group identity happening in both situations, but how long have left-handed people been mass-persecuted, and sought out for extermination? Forgive my childishness, but you are an idiot.

      How often does The Blaze post articles about local arguments concerning crosses and other religious symbols on public land? Or flags? And NOW you criticize the ACLU for not minding its own business?

      The ACLU said their names could be removed from the records. They just want to look at the facts to see if an injustice has occurred within the confines of practical justice itself. No one wants those kids names smeared so JEWS can kick them. Maybe we should just ban SOUTH PARK so this kind of childish incescreton will not occur.

      PUBLIUSPENCILMAN … Are you serious? You can’t distinguish between a news organization reporting the issue and a legal organization getting involved in the issue? The Blaze isn’t asking for the records of the incident to “investigate” but merely reporting what happened. The ACLU is a group of LAWYERS out to stick their LEGAL noses into to something that should concern them not at all. You were right about one thing, though, the stupidity here, YOURS, is almost unimaginable.

    When I was in 8th grade the 9th graders had a kick an 8th grader day. The guy that kicked me hurt for a week afterward and meanwhile the teacher on the lunch grounds, turned his back on the fight so I could finish what the other guy had started, and came up to me afterwards and gave me some pointers in boxing for the next time anything like that ever happened. It was great and I’ll never forget that teacher.
    Yeah, this was before schools had cops, your parents didn’t divorce, and you weren’t supposed to ever start a fight but you were expected to finish one… you know the old days where kids got into trouble for running in the halls and we had a moment of silence in the lunch room before you could start to eat. :)

    South Park, as well as other cartoons with raunchy adult themes are fine with today’s parents, but Daffy Duck getting shot by a hunting Elmer Fudd, so that his “bill” is sideways, is deemed too harsh by today’s parents.

      It also causes the cartoon make no sense. We now see the coyote run off a cliff, then the next frame, he is doing something else, not flat on the ground. I think most kids know coyotes don‘t buy items from ACME and run around to try to blow up roadrunners and that rabbits don’t talk, but having a cartoon kid is more believable. Why what Bart and the kids on SouthPark do is allowable, but Looney Toons isn’t, I don’t know. It‘s today’s entertainment, to make fun of other’s misfortune. Back in the day, they mainly made fun of themselves.

    A stupid South Park episode, mixed with a bit of anti-semitisim doesn‘t equal a reason to breech the student’s confidentiality. The ACLU may not like what the kids did, but what do they expect to find – these kids tried to organize a middle school Klan during recess?

    They want to “investigate” this BECAUSE they don’t know of other events involving these kids, and what if the ACLU were to find something, what would they do with the information?

    I find the kids acts reprehensible, and the school probably acted appropriately (based on the cursory overview of both the crime and the punishment described above), but this is not a national crisis.

    Has anyone at the ACLU considered the possibility/probability of copy-cat acts at other schools as they drag this case through the courts? There apparently have already been a few already…

      I guess you don’t remember being a kid….The parents not letting a kid watch/do or have something makes them want it more, and they will find away to get it…The issue isn’t parents letting their kids watch this cr@p…It‘s that parents don’t get involved with their children to explain an issue such as this…To many parents send their kids off for someone else to handle it, and than complain when their kid does this kind of stuff…It’s obvious these kids got this anti-Jew stuff from the media, not the cartoon…Going from “kick a red-head“ to ”kick a Jew” is not the cartoons fault….ACLU shouldn’t be involved, the parents need to be..Kids mimic what they see on tv and always will…It’s up to parents to explain life to their children, not anyone else…School is for the 3 R’s not to teach life lessons…I‘m sick of all these parents on shows like Maury saying they can’t control their children, and pushing it off on someone else…Grow a pair and take responsibility for your own children

      I remember being a kid. I remember TRYING to get away with doing things my partents told me I couldn’t do. And I remember getting my ass beat for trying it.

      Sure older kids in high school you’re not going to be able to control as much as some parents might delude themselves into thinking they can. But you should have absolute control over a kid in middle school. They aren’t old enough to make decisions for themselves yet. If they‘re doing something you don’t think they should be, then you’re just a miserable failure as a parent. Period end of story.

      Okay, this is the same state (FL) where a kid rec’d the same punishment for giving a hug while at school. Privacy ‘rights’ be damned, something isn’t passing the smell test here. It appears to me the ‘kick a Jew’ miscreants are being protected. Why? Are they related to someone or on a sports team? Take a look at Penn State. Nothing prompts different rules for different people like nepotism and athletics. I’ve worked in the school system and seen this ugliness go down.
      Historically, hugs don’t lead to war and genocide. The ‘kick the Jew’ crowd is an ignorant, violent club that has existed thru history. I sure as hell would like them exposed and squeezed a bit harder than the hugging bandit. This IS assault. It’s not battery, but it’s planning to commit the crime. Defend at the risk of showing ugly bias.
      I’m no fan of the ACLU, but who says they can’t be a like stopped clock? They may be right once in a while. My experience in working w/the criminal justice system is that crime tends to negate your ‘right’ to privacy. Middle school kids damn well should know better than this garbage and this ‘kick the Jew’ nonsense shouldn’t be minimized.
      Damn, I love the consistency on this forum. Some folks are clearly knee-jerking their opinion because “gasp!” the ACLU is involved. It could just as easily be a conservative advocacy group pursuing this story.

    This article stinks. No detail just “There was kick a Jew day, and kids were suspended”. Wow, hard hitting.
    Now the ACLU is involved. Why? What do they plan to accomplish. If my kid were involved in any sort of “Kick ethnic_group Day” they’d be harshly punished by me, but if the ACLU tried to get involved in my kids life, I’d make sure they were sorry they ever did.
    As sickening as this sounds, I have yet to hear how these children broke any laws. Last I remember, the 1st Amendment applied to everyone, not just certain groups.

      Good job. You googled the episode and got the name and air date correct. Now do yourself a favor and just add ”script” to the end of your search. You can do a keyword search for ” kick a ginger day.” You will find fairly easily that it is not part of the episode. If you would like to apologize for calling me a douche bag, I’ll consider accepting it.

    Here we behold the ACLU targeting American school children. One of Glenn Beck’s favorite quotes is “Question with Boldness”. The full context of that phrase should be considered. Thomas Jefferson teaches us:

    “Question with boldness even the existence of a God; because, if there be one, he must more approve of the homage of reason, than that of blind-folded fear.”

    I would argue that we should also be granted permission to question the existence of all forces shaping our society</a, regardless of the threats from Abraham Foxman.

    The simpsons, south park, etc, have been doing“un” social work for a long time, teaching things I never would have allowed in my home when my children were growing up. All in the name of comedy of course. I have said it before and I’ll say it again, your kids have been carefully taught, to disrespect fathers, alienate their siblings and have no respect for authority. Grandparents are relics instead of sources of life’s wisdom to learn from. Dad’s an idiot that everyone is smarter and better than and Mom is real teacher all by herself. This isn’t an accident, it’s the undermining of the fabric of our society. I won’t even get into the destruction of black families, but it’s all there in living color. What a shame we let the left in hollywood in our doors as so-called entertainment.

      There you go, right on the money. People have better recollections for things they learned during happy moments, and becomes better lodged in memory. That’s why happy children recollect the details of things they learned in school better than miserable children. What a great society we live in, but I mean that more because of people’s inability or lack of want (because it doesn’t feel good)to take notice.     Oh I get it. The creators of South Park thought it to be funny to have a “Kick a Ginger Day” episode, which was of course the devil standing up in them to “subtly” ever so subtly introduce the idea of kicking Esau who was born all red and hairy. And then, once that idea was planted, the devil began standing up in children ever so subtly to just nudge them a little further into “Kick a Jew Day” way of thinking.

    School records should be private. That these kids were Middle Schoolers indicates they were Minors. Blacking out their names means nothing. They can cross reference School Board Meetings and get their names…then comes the lawsuits aimed at the kids/parents. Then comes the targeting of these kids’ homes. Here’s a question…

    Has anyone else noticed the rise of antisemitism in this country? It is growing big time. How do we talk about the what Hitler did being so horrible and then turn around have this going on? And few if any are speaking out about it. Even the Jewish people of this country are not saying much. In fact a good portion of them are against Israel. What is the world coming to?       I am afraid if we did this, we could be kicking a lot of Jews as well. There are a lot of professors, lawyers and activists who are “Jew in name only” who are at the center of the communist movement here in the US. I think that they use “being Jewish” to provide themselves with a level of armor, using political correctness/cultural marxism as their shield. (Even though they are Jewish in name (not in reality or practice) only.) It is funny, really. I have several Jewish friends who are VERY conservative…and can’t stand the fact that the “Jewish intelligentsia” are pushing for a form of government in the US JUST like ones they escaped years ago. Don’t misunderstand me. These are TWO, very differing type of Jews I am talking about here.

      Who in their right mind allows their kids to watch South Park anyway?? I won’t allow my kids to watch the Simpsons, Family Guy, American Dad, the Cartoon Network, Nickelodeon, Comedy Central, regular network TV channels, and most things on Disney (they do get to watch Phineas and Ferb, though). When we DO watch TV with them, it’s something we all feel comfortable watching together as a family. Old-fashioned and way out of date? Perhaps, but at least I know what my kids are watching when they are with me. And no, they do not have a TV nor a computer in their bedroom.

      A lot of things have ties to communism but that, in and of itself, doesn’t make it bad. I listen to Pacifica radio station every now and then… or to NPR. I read Consumer Reports… I picket at Planned Parenthood… I have lots of ties to communism and even think it will be a great system when the ‘leader’ is totally perfect with perfect love and judgement…maybe sometime after the 2nd coming.

      Eric, since Communism tells us the only “god” is the state, and has repressed religion in every country it’s been tried, I doubt it has anything to do with Our Savior’s return.
