Former Agent: New Bill Effectively Outlaws Protests Anywhere Secret Service Deems Off Limits

Could protestors unknowingly run afoul of the Feds and face prison for exercising their First Amendment rights?

Yes, according to some analysts, and all that‘s needed is President Obama’s signature for a new law to give the Secret Service powers more befitting the Praetorian Guard.

Even former 15-year Secret Service veteran Dan Bongino has raised alarms, as he told the Blaze that House Resolution 347 creates an America in which ”you could accidentally be in a cordoned off secret service controlled area and find yourself in jail.”

“This was done to send a message to both sides,” Bongino said, “Occupy Wall Street and the Tea Party” could be affected by this. “It’s a very serious issue.”

Bongino, who is a candidate for Senate in Maryland, added that ”you have to ask yourself as an American, do you believe in liberty or not? You cannot have it both ways. You cannot empower government bureaucrats to take your liberty.”

The concern about the new authority stems from the quietly-passed resolution, which according to Bongino and others has created a legal grey area that infringes upon freedom of speech. The devil, of course, is in the details.

Here are the facts: the House of Representatives passed a bill called the Federal Restricted Buildings and Grounds Improvement Act  this past week. Ostensibly, the bill expands federal law protections for the areas near the president, vice president, and those under the protection of the Secret Service. For example, jumping over the fence at the White House and running across the lawn would be elevated to a federal crime once the bill is signed into law.

But there’s more. Here is a section from the H.R 347:

“Whoever knowingly, and with intent to impede or disrupt the orderly conduct of Government business or official functions, engages in disorderly or disruptive conduct in, or within such proximity to, any restricted building or grounds when, or so that, such conduct, in fact, impedes or disrupts the orderly conduct of Government business or official functions…”

By failing to include the term “willfully,” the statute apparently changes the definition of Section 1752 of title 18, United States Code  in such a way that one only has to be in a restricted area — with or without prior knowledge of that fact — to violate the law. This is arguably a change required in the mens rea (state of mind) necessary to commit the crime covered in the new statute.

So if you plan to protest at the next Obama, Romney or Santorum speech, you could unwittingly violate the statute and be thrown in jail for standing in a place the Secret Service deems specially protected.

Thus Reason.com has written that “a more truthful moniker for HR 347 would be the ”First Amendment Rights Eradication Act.” While that description goes a bit far, Congressman Amash, one of the three lone votes against the bill, also wrote the following on his Facebook page:

“Current law makes it illegal to enter or remain in an area where certain government officials (more particularly, those with Secret Service protection) will be visiting temporarily if and only if the person knows it’s illegal to enter the restricted area but does so anyway. The bill expands current law to make it a crime to enter or remain in an area where an official is visiting even if the person does not know it‘s illegal to be in that area and has no reason to suspect it’s illegal. (It expands the law by changing “willfully and knowingly” to just “knowingly” with respect to the mental state required to be charged with a crime.)”

And it’s not just conservatives who are concerned about what the interpretations of this bill could mean for liberty. Leftwing opinion site Salon.com posed its objection this way in a blog post:

“At 7:03pm ET on Tuesday, 28 February 2012, our 112th Congress violated this covenant with the American people by voting 399 to 3 in favor of H.R. 347, a bill which breezed through the Senate with unanimous consent and now lacks only corporate… puppet President Barack Obama’s signature to become law. The three patriots who voted Nay were Paul Broun, Justin Amash, and Ron Paul.”

Of course, most on the Hill and inside the Beltway think the objections are hogwash. Michael Mahassey, the communications director for the bill’s sponsor, Rep. Thomas J.Rooney (R-Florida), told Reason.com that the negative reaction to the bill is “a whole lot of kerfuffle over nothing. This doesn’t affect anyone’s right to protest anywhere at any time. Ever.”

Whether or not the interpretation of the bill that caused three Congressman to vote against it is correct, H.R. 347 bears some similarities to the NDAA “Indefinite Detention” Bill in that vague verbiage has led some to believe that serious infringements on basic liberties could result.

And amidst all this discussion, there is also the growing sense that federal officials seem increasingly imperious to those they govern. Spend a few days in Washington DC and you will often see traffic stopped and enormous motorcades of agents armed for a warzone ferrying officials of all kinds across town.

Regardless, as President Obama makes dozens of fundraising visits on the campaign trail this year, citizens can expect massive traffic and pedestrian delays, and perhaps if they are in the wrong place at the wrong time — federal criminal charges under H.R. 347.

      I hear you. Didn’t quite comprende all of the last part, but se comprende todo. Yes, the EPA with the restrictions on drilling is driving up prices at the pump .After gas hit 4 dollar a gallon in 2008, Bush said we were gonna start more drilling. Fuel prices dropped immediately.($1.70 gal.). Grocery prices dropped. People had more money in their pocket. Obama and his minions stopped that. The reason we can’t have that is because of the democraps in the senate.

      Agree on this particular topic. But it’s always nice to see Paul commend a traitor and call him a hero and patriot… right? Ron Paul’s values are a bit skewed in the direction of Michael Moore in many cases like Pvt Bradley Manning and endorsing America haters for Potus like Cynthia McKinney as an example.

    Dont forget about the Dpt. of Homeland Security and the TSA were created under a GOP lead administration controlling Whitehouse and Congress. It is funny that they say Obama is a big governement lib when in fact the public sector jobs are being shreddeed by Obama. Yet all the GOP has done is factual and they claim to be small government. Just like they say Obama is rasing taxes, when in fact they are lower. Pesky facts always get in the way of the GOP/TEA

      I’m listening to this as Beck is interviewing this guy. It is simply amazing. As for where is the Congress, it’s a Republican Congressman who sponsored the bill. Just more proof in my opinion that many of the Republicans as marching further to the left only slightly slower than the Democrats.

      Um, the congress was the one who passed the bill. The only time the D‘s and R’s can get together is to crap on our Constitutional rights. Tom Woods said it best that we have a stupid party and an evil party. When they get together on something we get evil stupid laws.

      Those that voted for this bill can all go to hell as far as I’m concerned. The United States Constitution does not allow for such a bill even being passed. The principles are in opposition to each other and it will not work. freedom or tyranny – one or the other. Not both.

      There is some man in the White House we really don’t know because he is a fraud. The corrupt senate has gone rogue on the people. What should we expect from such corrupt individuals?

      I don’t know about the rest of you citizens and citizen-veterans but I took an oath to GOD and to you all to defend this nation against ALL enemies, foreign and domestic.

      The powers that be are scared to death of you and me and are attempting to control us at every turn. They will not! We are determined to remain free and we shall do just that. There is always a price for freedom.

      Where are We the People? Yes, it is Congress’ job to represent us but it is ultimately our job to uphold and defend the Constitution. As long as there is beer in the fridge, mind numbing “entertainment” on the televison and gas is under $15 per gallon, we just don’t give a damn!

    These are the only 4 topics that should determine our next president. If you candidate agrees with Obama on them or doesnt show contrast from him, you are voting for the wrong guy. It seems once a week a freedom we once had is being trampled by this government. Dont be fooled into thinking this is a Democrat issue, this is assault on the four main topics is from both sides.       MARTINEZ. You are mostly correct… those 4 areas are very, very important. However Ron Paul is not the man to lead this nation anywhere except into a discussion regarding a few of those topics.

      The absurd history of Ron Paul makes Ron Paul an absurd candidate for POTUS.

      So we agree on the problems but not the solution. If we can both agree Obama isnt the answer then we need to discuss the 4 other options.

      Santorum wants more war, he has a budget that cuts nothing but future increases which wont end up cutting the debt, and he has stated he doesnt believe in individual freedoms. So he agrees with Obama on more war, he has in principle the same idea on the economy as Obama in that neither cut the spending and both say they want to cut the debt but dont, and outside of the birth control issue pretty much agree that the government makes better choices for you. To top it off Obama will hammer Rick with the fact that he never voted against GWB. Obama blames everything on GWB just like now all the talking heads blame Obama for everything. Rick will crushed by being labeled Bush Jr.

      Gingrich wants more overseas wars, his budget is worse than Santorum‘s and Romney’s, and believes in things like a health care mandate and global warming crap. So Newt agrees with Obama on wars, on spending, debt, and freedoms. Newt will get hammered by Obama for being a hypocrite. Remember the left and many independents love Bill Clinton, and Newt was a total Dbag in attacking Clinton while having affairs at the same time.

      Romney agrees with Obama on war, his budget cuts only future increases also minus like 30 billion which is like find a dime on the street compared to our problems, and he is for the NDAA.

      Romney cannot attack Obama on Obamacare, but Romneycare can be used against Romney since Romney is now against it, even though in 2009 he was for it, but then against it, and then for it, and then against it. Romney has no spine, he will shapeshift into whatever he thinks will get him elected. Similar to his Church, which has no problems change controversial positions when the heat is on. Romney has been on the side of Obama on almost every issue and has even said he is a progressive. Want a preview of how Obama will spend his billion dollar campaign money?

      Ron Paul is against the wars, he has a budget that cuts real spending, he balances the budget in three years, and there is no one that will be stronger on American citizen freedoms. Ron Paul is the opposite of Obama. Ron Paul is for small limited government. Obama is for huge bloated government.

      You will say “but his foreign policy”, well his cuts dont hurt our defense. Under Ron Paul we still spend 4 times as much as China who is second in military spending. Why should we continue to have our troops in harms way in places like Afghanistan. Their people hate us and they will never been a civilized nation. You cannot make people quit cutting each others heads off and blowing themselves up. These people are willing to strap bombs to kids, that type of thinking cannot be reasoned with.

      Okay MARTINEZ… I appreciate your SuperPAC commercial for Ron Paul, but what I am waiting for is for the average Ron Paul supporter to admit why clear thinking America sees Ron Paul as an absolute putz on many levels and maybe an even bigger danger to these “United” States than even Obama. Tough comparison, but IMO… very true.

      I have shown over and over again why this is so, and why most of America thinks it’s so. If it wasn’t so… Ron Paul supporters wouldn’t have to try and rationalize him like a drug addict trying to rationalize the use of heroin or crack.

      It’s the talk of a kid who has the only ball in town, but hasn’t the slightest idea what to do with the ball because the kid never cared to learn team sports. The kid gets frustrated because of his own personal failings and lack of abilities. In a huff he takes the ball home while stomping his feet and kicking at the dirt while muttering to himself… I’ll get them… it’s their fault I suck.
