You may recall Jerome was arrested for felony gun possession during a visit to NYC last September. He voluntarily checked in his firearm at the Empire State Building, as it was legally registered in another state, and he believed he was in compliance with the law.

Not in the Big Apple. Possession of any firearm unregistered in NYC is a major crime under the law.

As a 28-year-old Indiana-based jeweler, Jerome brought his legally-registered .45-cal Ruger to New York because he was transporting $15,000 in gold to a Long Island refinery, according to the New York Post.

The somewhat good news for 2nd Amendment advocates is that the Manhattan District Attorney has offered a plea deal to a misdemeanor with no jail time. But Jerome adamantly refuses any deal. He wants all charges dropped. Period.

It is a felony to possess a handgun in New York City whether it is registered anywhere else or not. Those caught violating the statute face a mandatory 3 1/2 year sentence, but prosecutorial discretion often allows for plea deals and lesser punishments.

Former Marine Refuses Plea Deal in NYC Gun Possession CaseAs a former Marine, Jerome has received substantial support from his brothers-in-arms as well as from those in the chattering classes who believe New York’s draconian gun laws violate the 2nd Amendment. This public attention may have helped push prosecutors to treat this case less harshly than they could have.

“We continue to believe the case should be dismissed outright,” said Jerome’s lawyer, Mark Bederow, according to the New York Post.

The Post claims a document has been released regarding the case that states: “The New York District Attorney‘s Office is offering to allow your client to plead guilty to a single Class ’A’ misdemeanor in full satisfaction of all charges.” The letter was apparently addressed to Jerome’s lawyer from the prosecutor heading the case, Joseph Davis.

    I agree that the case should be dropped. However, it might not. And if he does not take the misdemeanor plea deal and if he is found guilty of a felony then he will never have the right to carry this gun legally again.

    Sometimes you have to know when to retreat in order to fight again another day.

      Right, he can’t carry it now nor would he ever been given a permit to carry it in NYC. His best defense is to push it all the way for the sake of the 2nd amendment. It should go all the way to the US Supreme Court if needed. We once more need to fight for our constitutionally protected rights.

      This again identifies the “lawyer” mentality that permeates law and creation of legislation from the lowest to highest levels in Government. That mentality is “can’t we compromise?”….show me a prosecutor that does not care about a win and will go to great lengths to get it! Too many are so wrapped up in the game, they tend to prosecute even those that are apparently not guilty, but hey…just going for the win and if they plea down..”I got a conviction!”.
      Same crap differnent scenario for all those lawyers in the Congress. All they want is a compromise so both sides can keep doing business as usual. It disturbs them when the people are demanding for them to take a side and stick with it. The Debt Ceiling – prime example….

      No state or local government can deny you of your federal rights. Imagine if NYC decided that the right of women to vote was not applicable in their town.

      If he gets the right lawyers behind him, along with the NRA, he will win. The NRA is pretty smart in that they are very selective on who they represent. If he is squeaky clean with no crimes or stupid stuff on his record, i can see the NRA helping him out. If NYC gets put in a position where they will lose big and have to change their laws, they will just drop this case and let him go. While the ******** in NYC hate gun ownership, they hate the though of having to comply with the 2nd amendment even worse.

      Many fights are being won by the gun owners in America to include concealed carry laws in states that were very anti gun just a few years back. Facts are facts, areas with the most gun control on the books are also the areas with the most gun violence.

      An interesting letter in the Australian Shooter Magazine this week:

      “If you consider that there has been an average of 160,000 troops in the Iraq Theater of operations during the past 22 months, and a total of 2112 deaths, that gives a firearm death rate of 60 per 100,000 soldiers.

      The firearm death rate in Washington , DC is 80.6 per 100,000 for the same period. That means you are about 25 per cent more likely to be shot and killed in the US capital which has some of the strictest gun control laws in the U..S., than you are in Iraq .

      Conclusion: The U.S. should pull out of Washington .

      You must not be a Marine cause retreat is not in our blood. This will be a much larger fight and could possibly lead to changing New York’s ridiculous gun laws. If the Marine gets convicted for me it will be the final nail and I will be taking myself and family out of this state. I understand the stance you take and trying to play their game but sometimes the fight has to be taken to the end. If he pleads guilty it just says NY’s gun laws are right and he is wrong. This would be a horrible thing to do and allow the state government to get away with.

      It seems to me that the reason why the prosecution is offering this deal is that they are searching for a face-saving exit.

      They can feel the ground shifting underneath them and the politicians involved doubtless fear unpredictable consequences further down the track.

      Since according to the supreme law of the United States, “…the right of the people to keep and bear Arms, shall not be infringed…”, it makes sense that he naturally adhered to a different set of rules concerning gun ownership, where the first is the following:

      1) Treat every gun as if it was loaded.

      I might as well post the other 3 for any readers who are unfamiliar.

      2) Never point a gun at anything you are not willing to destroy.
      3) Be sure of your target and what is beyond it.
      4) Keep your finger off the trigger until the gun is lined up on target.

      I have to agree with the guy all or nothing. I live in Pa have a registered gun and a permit to carry it consealed, but NY NJ does not recognize our conseal permits from Pa. guess they don’t trust our law enforcement to do a good check.

      I have an ankle holster you would never know I have a 380 strapped to my leg. I travel all over NY Nj for my job and feel much safer with it, but I don’t dare take it to those two states.

      congress did pass a law saying anybody with a consealed carry permit all other states would have to honor it, not this pick and choose states the way it is now.
      But of course Reid has it sitting in his desk with the rest of the bills he’s holding on to and doing nothing with.

      I had a pistol permit in NYS . You are told you can’t carry your gun in NYC. He had an out of state permit, NYS does recognize out of state permits. (unless they changed the law) So he broke state law too.

      So our government trusts him to carry a m4 or more on foreign soil and be able to control himself, but not here in the states while under the protection and duty of the 2nd amendment. This is a travesty, he shouldn’t have to accept a plea deal.

This honorable veteran is having his rights trampled on, and has recently been tazzed three times and thrown in solitary for the three weeks following his second mistrial. At that time, unlike now, there were very little “regulations” as compared to present day.       You are incorrect Encinom, a back-ground check is still a requirement for all gun sales by licensed gun dealers. You should research gun laws before making such incorrect statements.

      By the way, it is also illegal for anyone to knowingly sell a firearm to a felon.

      Laws that restrict law abiding citizens from carrying firearms do nothing to decrease crime but everything to increase innocent people becoming crime victims.

      The only laws needed are ones against illegal USE of a weapon, and, as afaik, it is already illegal to murder someone in NYC, and it is already illegal to rob someone. What more do you need?

      If someone at buys a gun at a gun show and is legitimately not legal to purchase one, how can it then be the governments job to attempt to keep everyone from purchasing a gun? That is what we’ve come to with almost everything in this nation. Rather than being smart and seeing that whether or not a convict buys a gun at a gun show, he’ll get it somewhere!!!! Go out and buy one for yourself! Quit expecting the government to protect you from the evil in this world. DO IT YOURSELF. Go get yourself a gun and a security system and some decent weapons training so when some crack head tries to take your money or property, you can actually protect your family. Get off your a$$ America. Do something proactive to protect yourself.

    I hope this marine gets some pro bono help fighting this unconstitutional law.

    He’s in for at least 5 years of legal headaches, and may go to jail because of the horrendous liberal lower court judges.

    Those judges won’t care that the Supreme Court struck down the D.C. handgun ban, since liberals are prone to be tyrants.

    He’ll have to keep fighting this to the Supreme Court, and hope the 5 conservatives stay on the court or get replaced by a new Republican president and senate.

    I disagree with gun laws that are draconian. I am pro-2nd amendment. Just wanted to say that in preface to:

    Ryan Jerome did not get CAUGHT with a handgun. He did not commit a crime like DUI, and they FOUND the handgun. No one snitched him out and told police he had a handgun.

    He brought the gun with him from a state where it was legal, to a state with different laws. He did so because he was transporting valuables (gold in this case). He then VOLUNTARILY turned in the gun.

    There is a crucial concept in law: Rens Mea (guilty mind) – that’s where you have an INTENT to break the law. Now, you can cross a property line and trespass without knowing, or speed without intending to, but this isn’t that kind of case.

    He may have known that NY has decided that us unwashed masses don’t deserve the same protection as “our betters” and he should have left the weapon at in his hotel safe.

    I mean, he’s not completely innocent, but it goes a LONG WAY when someone turns in the weapon.

      You can not take something to the supreme court without realizing that they could refuse to hear the case. That is like losing. I don’t understand what kind of face saving action can be taken by the city. Either way they look stupid. Maybe the legislature or the body that made the law could bail the prosecutor out by making an exception or coming up with a better law.

      Now, we *do* have a Constitutional problem here, though, in the incorporated vs. unincorporated Constitutional definitions.

      The Incorporated Constitution would say that if something applies at the Federal level, it also applies at the state level (as in the Second Amendment argument here).

      If that’s the case, then it also means (by nature of “a stupid parsing of the Constitution,” as David Barton calls it) that the 10 Commandments can’t be in local courtrooms, on public property, or taught in schools, as we Social Conservatives would prefer.

      On the other hand, the 10th Amendment can be argued in favor of an unincorporated Constitution, which in essence means that while the Federal government can’t effectively ban guns as NYC has, the local level can (and in NYC’s case, has).

      Applying it back to the 10 Commandments, this parsing would mean that while the (capital S) State can’t establish a religion, the many states can (and in the past, have). This is the side of the argument we non-Atheist Social Conservatives fall on, more often than not.

      We’re on both sides of this argument, depending upon the issue.

      Not a pretty place to be. :-/

      P.S. a note to the Blaze… There’s no such thing as a “Former Marine.“ The proper term is ”Prior Service“ or ”Veteran” Marine. Please correct accordingly.

      Thanks for this amazingly insightful post, and I mean that sincerely. I never realized I was playing both sides of the fence until you explained it to me. I think I would find myself in the “Incorporated Constitution” camp, because that would help stomp out the 2nd amendment infringements by the liberal socialist goverments of some states or cities.
      However, concerning the 10 commandments, I think it could be argued that the State is not necessarily establishing a religion by displaying them, but simply espousing a philosophy? Don’t you think?

      In any case, lets hope this Marine wins this battle. It could affect all of us in the long run.

      Incorporated Constitution:

      Result: Guns can be banned by state or local government, if that government’s constituency so decides, and (theoretically) God can be worshipped in an open forum in state or local government buildings, if that state’s constituency so decides. BTW, “this is what Democracy looks like.”

      Frankly, I’m torn. The question boils down to, which tyrant would you rather have? Federal or local?

      The whole thing kinda breaks down when you really look at how the 10th has been applied until now:

      “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the People.”

      The power to limit guns, religious freedom, etc. is not delegated to the Federal gov’t, but under the current interpretation, the Constitution does prohibit the states from making those moves.

      Unfortunately, Progressives within SCotUS are using the “living, breathing” argument & looking at int’l law instead of our own laws are interpreting, so you never know if this is going to end up being reinterpreted.

      Gun to my head? I guess I fall on the Incorporated side. I can handle not being able to worship on gov’t property if I can retain “the People‘s Liberty’s teeth” b/c I‘d still be allowed to worship in any building not owned by the gov’t.

      Here’s the danger: how many of our own homes or small businesses are at least in part owned by the gov’t via Fannie, Freddie, or the VA? When does the “ban God” SCotUS Progressive get the bright idea to make a move on worship in any home with a loan funded by gov’t?

      I wouldn’t put that move past Progressives, but we‘d still have a right to alter that gov’t; or abolish it, using said “People‘s Liberty’s teeth,” if absolutely
