Fox‘s Krauthammer Goes ’Hard Left’ on Domestic Drones: ‘I Want a Ban’

With recent exposure of who is authorized to own and fly drones in the United States and a bill passed earlier this year opening up the sky more for military, commercial and private drone use, the Federal Aviation Administration has begun rolling out rules for how local law enforcement can use unmanned aerial vehicles. This has continued debate over what is considered an infringement on privacy.
And now Fox commentator Charles Krauthammer is weighing in, and his position might surprise you.
The FAA states on its website that its main concern is to “[streamline] the process for public agencies to safely fly UAS in the nation’s airspace.” Some of the recent progress the FAA says it has made includes developing a method to expedite the process for interested parties to obtain a Certificate of Waiver or Authorization (COA) to fly the drones; changing the length of authorization from 12 months to 24 months; and allowing law enforcement to fly a drone up to 25 pounds (the rule used to be 4.4 pounds) in controlled airspace within the operators line of sight.
Fox News describes some of these actions as “taking a tool that has become synonymous with U.S. counterterror warfare in countries like Pakistan and Yemen — and putting it in the hands of U.S. law enforcement.” Although, it notes that drones flying over U.S. soil would not be equipped with weapons and would be used for surveillance only. Charles Krauthammer on Special Report earlier this week said he wants a resounding ban on domestic drone use.
“I’m going to go hard left on you here. I’m going to go ACLU,” Krauthammer said in the show. “I don’t want regulations. I don’t want restrictions. I want a ban on this.”
Krauthammer explains that he considers drones “instruments of war” and cites the Founder’s aversion to such instruments maintaining a presence inside the United States. He compares a drone to a high-tech version of an old army and a musket.

Commenting off Krauthammer’s stance on domestic drones, Hot Air speculates that much of the negative reaction to drone use in the U.S. is over the “ick” factor that machines similar to those used against terrorists will now be increasing in our own airspace. It writes what really should be considered “icky” are privacy concerns. Hot Air also questions if drones will really be of value to law enforcement as other technology, such as cellphones and in-car GPS systems could be accessed by police following the appropriate legal channels:
If you have probable cause to find out where someone is, there are faster and more precise ways of finding out technologically than by sticking a camera a few thousand feet up. In fact, if Google’s self-driving car catches on, cops might eventually be able to remotely commandeer a perp’s car if necessary. In a world where, according to cybersecurity experts, there’s not a single unclassified computer network in America that’s secure from hackers, drones seem an odd place to draw the line in the sand.
Fox has more from those concerned about privacy infringement:
“Our Founding Fathers had no idea that there would be remote-control drones with television monitors that can feed back live data instantaneously — but if they had, they would have made darn sure … that these things were subject to the Fourth Amendment (protecting individual privacy),” Rep. Joe Barton, R-Texas, told Fox News.

Lawmakers like Barton say there are “legitimate uses” for drones on U.S. soil, but that strict privacy standards will be needed.
“It would be okay for a drone to be used in order to make sure that all the cattle on a ranch are identified on an ongoing basis. It’s okay … to survey a forest to make sure there are no forest fires. But it would not be okay if that individual who purchased the drone then decided ‘I think I’ll go and check and see what‘s going on over in my neighbor’s backyard’,” Rep. Ed Markey, D-Mass., said. “That would be wrong and that has to be protected against.”
According to the FAA, later this year it will release a proposed rule that would establish policies, procedures and standards for all the various users of small unmanned aerial vehicles, which it says “will likely experience the greatest near-term growth in civil and commercial operations because of their versatility and relatively low initial cost and operating expenses.”

But then I remembered that I live in Chicago. Home of Barack Obama, Michelle Obama, Valerie Jarrett, David Axelrod, Rahm Emanuel, the Richard Daleys, Jessee Jackson, Jessee Jackson Junior, Dick Durbin, Jan Shakowski, Ray LaHood, Bill Ayers, Bernadette Dohrn, Rod Blagojevich, Tony Rezko, and Jeremiah Wright.
Then I realized once again that we don’t live in a perfect world. When it comes to privacy, what little we have left is largely an illusion, not because of an evil plot, but because public officials are far less than perfect. Consider the widespread use of public surveillance cameras, stoplight cameras, now speed cameras, supposedly forbidden federal gun ownership records, the sale of drivers license records, warrantless “voluntary” vehicle searches, inspection of cell phones during traffic stops, sobriety checkpoints, license plate scanners, invasive TSA full body patdowns, “naked” body scanners…and those are just the things that come to mind. None of these were created with a nefarious purpose. But they can and have been abused.
Now they want to expand the use of drones? As I write this, there are drones over the city of Chicago warming up for the NATO conference.

Posted on May 16, 2012 at 1:32pmI can remember being a kid of 14 back in like 1969 Los Angeles floating around in an innertube in our big backyard pool at night watching both the city and county helicopters with their big searchlights flying around crisscrossing the cities, lighting up streets, backyards, people walking, anything moving outside after dark. They would hover over our pool and light it up if they saw someone out in it after dark, even though the pool was lighted, the patio next to it was lighted, and our parents were sitting there under the patio. “Just flip them off and they will go away” Dad would say. And this has been going on like that since then, so I don’t see what difference having full sized choppers constantly watching you versus small drones flying around watching stuff would be.

I want a ban on all weapons issued to federal authorities unless they have a bona fide law enforcement role in their charter. I want a ban on state and local agencies routinely surveilling internet traffic at the drop of a hat. I want a ban on warrantless “voluntary” searches of vehicles without probable cause. I want a ban on ninja swat uniforms issued by every law enforcement agency in the United States. I want a ban on routine deliberate lying by police during interrogations. I want a ban on localized versions of the 4th and 5th amendments. I want federal laws like immigration laws to be either uniformly and justly enforced by the federal government or repealed altogether. I want judges who are unable to base their decisions on actual law and rule based on political considerations to be removed from the bench. More than anything else, though, I want partisan politics completely banned from law enforcement.

It won’t be long before these are used to invade privacy. It’s the nature of people to snoop, push their limits, see what they can get away with, rationalize… We didn’t need cameras on every corner, cameras on traffic lights, we don’t need this. It will become an invasion to our way of life as we know it. Just think of the possibilities these can be used for if in the wrong hands: spying, peeping Toms, goverment (local or national) watching, police invading our rights, it’s endless. Once they are allowed it can only go downhill from there.

An officer can gaze into your property from the road (and may or may not see anything), so why couldn’t a drone gaze down from above? Also, given the fact that the drone doesn’t have to be directly above your property, all they have to do is hover above a roadway to see in.
Don’t get me wrong, I’m not disagreeing with your point, just not sure what the current rules are.

Want to use an ATV? Ya, sitting in a canoe floating down a river sipping a “cold one” when a couple of these jokers is hopping from gravel bar to gravel bar is annoying and they don’t leave the place “pristine” (until the next flood rearranges all that gravel and changes the channel has it has for millennial) but these guys DO give you a good chuckle when they hit a hole and submerge the air intake in water… Again, if I had 25 or more acres or more, they’d be a necessary tool, especially to haul out that venison for the smoker.

But air rights only extend to 500 feet which is why airlines can get away with flying over your house. If you rights extended into space you would be entitled to compensation unless the airlines were granted special privileges. But those privileges would have to be agreed upon by you.
