George Zimmerman’s Case Weakens Even as Public Opinion Turns in His Favor

The plot thickens surrounding the Trayvon Martin case, as the biggest media circus since the Duke Lacrosse rape case continues. And while a string of revelations in recent weeks has put defendant George Zimmerman on a seemingly implacable path to a not guilty verdict, holes are emerging in Zimmerman’s case, too, now – holes that could breathe new life into the controversy.

Long-time followers of the case will recall that recently, revelations surfaced suggesting that Zimmerman had shot Trayvon Martin at close range, that Zimmerman had been badly injured (and psychologically traumatized) by the confrontation, and that several witnesses had come forward claiming that Trayvon Martin was the aggressor. Today, a poll from Rasmussen Reports shows that these facts have definitely swayed public opinion:

A new Rasmussen Reports national telephone survey finds that 24% of American Adults still believe the man who shot Martin should be found guilty of murder. But that’s down from 33% in late March when the case first began to draw national headlines and 30% in early April.

Forty percent (40%) now think George Zimmerman, who has been charged with second degree murder in the Martin shooting, acted in self-defense. That’s up 25 points from 15% in March and up 16 points from 24% last month. Thirty-six percent (36%) remain undecided, compared to 55% two months ago

So in other words, if the trial were held today, Zimmerman would probably walk out completely unscathed. Numbers like this scream “reasonable doubt.”

However, that might not last, as new interviews with witnesses who had previously been key to Zimmerman‘s side of the story have revealed that those witnesses’ accounts aren’t nearly as strong as the defense in the case might like. The Orlando Sentinel reports:

A young mother, who is also a neighbor in the townhome community, never gave a recorded interview to Sanford police, according to prosecution records released last week. She first sat down for an audio-recorded interview with an FDLE agent March 20, more than three weeks after the shooting.

During that session, she said she saw two people on the ground immediately after the shooting and was not sure who was on top, Zimmerman or Trayvon.[...]

Six days later, however, she was sure: It was Zimmerman on top, she told trial prosecutor Bernie de la Rionda during a 2 1/2-minute recorded session.[...]

witness lived a few feet from where Trayvon and Zimmerman had their fight. On the night of the shooting, he told Serino he saw a black man on top of a lighter-skinned man “just throwing down blows on the guy, MMA-style,” a reference to mixed martial arts.

He also said the one calling for help was “the one being beat up,” a reference to Zimmerman.

But three weeks later, when he was interviewed by an FDLE agent, the man said he was no longer sure which one called for help.

Some other problems present themselves in the report. For instance, one witness who had claimed she saw the two men, has instead said she only was really aware of one person, and heard that person more than saw them. Another witness has changed his story to suggest Zimmerman’s reaction after the shooting was almost nonchalant, suggesting that it wasn’t quite as psychologically traumatizing as all that.

There are areas where Zimmerman can take encouragement, though. For instance, even with a changed story, one of the witnesses involved is still quite sure that Trayvon Martin was on top of Zimmerman in the fight. These are also unlikely to be the last interviews the witnesses give, as the defense will also have a chance to question them.

Even so, this trial is unlikely to be completely open and shut any time soon. Readers are advised to proceed with caution, as the evidence still isn’t conclusive about what happened.

      Lets see the exit wound on Trayvon. Also, trajectory is going to tell you something in this case. There are way more questions than what has been raised to date. Frankly, I hope Z walks. This is all hype.

      Any defense lawyer worth his salt will be able to defend these reports. A lady reports that she “somewhat” saw what happened and then recants days later… I call foul. It is not that I want Zimmerman innocent; but as a defense lawyer the media and inconsistent evidence should prove an innocent verdict. The 4th amendment was violated way before he was officially arrested by the media. He will never receive an impartial jury due to the irresponsibility of the media.

      Worst thing is… Guilty or not, there will still be riots of a racial manner.. Savages…

      There‘s more blacks in jail because they’re committing more “crime”… 65% of the murders committed in this country are done by black males and they only make up 6% of the population.

      You’re sixty times more likely to be shot by a black male than any other race. This has nothing to do with the “white” court system doing anything it’s just plain fact.

      A black friend of mine was saying “the courts aren’t fair almost all of my friends have felony records” and I said so how did they get a felony conviction? They would have had to of committed a felony first.

      Police aren’t just kicking in doors and dragging innocent people out of their homes and charging them with felonies for nothing. I’m white and none of my friends have been arrested because… they weren’t committing any crimes!

      They bussed inner city blacks into my high school and all of a sudden there was trouble. All of a sudden we needed armed security guards at our school. Blacks were always getting hauled into the principle’s office and expelled. And it was because they were doing things they weren’t supposed to, fighting, drugs, etc. It had nothing to do with the “white” principle system oppressing them.

      Just like Trayvon was kicked out of school for doing drugs and spray painting lockers. Not surprised at all.

      No plea deal will be forthcoming. Why? The prosecutor is hell bent on trying the case as Murder 2. But, and this is the big but, there will be either an acquittal or hung jury. Remember, he has to be found guilty beyond a reasonable doubt. There is plenty of reasonable doubt to go around. Witnesses that change their stories will be impeached by both sides and in the final analysis, it will be forensics that will weigh the case in favor of Z.

      Zimmerman is in more danger now of being sent to prison than before.

      1. The White House and the news media must crucify Zimmerman now, they cannot loose face.

      2. The whole purpose of the Zimmerman case was to use the shooting of a black by a white man to get a judge declare all Florida type laws un-constitutional. Blacks were already alerted to march before it was discovered that Zimmerman was not a white man but Hispanic.

      3. The White House and news media failed at their attempt to label Zimmerman a white man and are now enraged.

      4. The truth is out and everyone knows Zimmerman was telling the truth and was attacked. None of this will matter and will be ignored. Zimmerman and all the money on earth cannot defend against the Obama government.

      Zimmerman must be nailed to a cross on the interstate highways for all to see as a warning to others. No one will dare come to his defense and he is doomed as are we all.

      It no longer matters. This “trial” has already accomplished it’s mission. This will make people on the fence of purchasing a fire arm for protection second guess because what’s the sence if you do defend your self the liberal media will crusify you and the giovernment will prosecute you. Fewer and fewer people will defend firearm ownership and sometime down the road the second amendment will be erased. I own several firearms and live in an “iffy” neiborhood, I myself would likely think twice in defending anyone but myself and my loved ones. In the end I would hope I make the right call but I feel the presure from the government and I would wonder if protecting some stranger would be worth it.

      I don’t know what the law in Florida is, BUT, given the attendant racism within a plurality of the African American sub-set, perhaps Zimmerman would stand a better chance of a fair trial by way of a Judge, rather than a Jury?

    “Eyewitness” testimony is one of the worst forms of evidence because our memories can change based on subsequent events. The Sanford police erred in not capturing the interviews right away. Recordings made three weeks later are virtually worthless because the witness‘ opinions will be shaped by other accounts they’ve since read and the public turmoil.

      I agree with that. A witness who makes their first statements more than a week after the incident takes place is most likely lieing their arse off to give false testimony and single handedly determine the outcome of the case. Such testimony should be at least disregarded and at most the person should be questioned by the court to determine if the person is willfully supplying conflicting testimony to sway the case. IF such is the case, that person should do time in prison for tampering with the ability of another person to receive an impartial and fair trial.

      THAT was TREVON! That was my little boy… people will hear what they want to hear. Voice technology can make a reasonable determination as to whose voice was heard… recorded. People will see what they want to see, they will hear what they want to hear, have someone streak a university lecture hall during a lecture… 100 eye witnesses and not one can even give a partially accurate description. A grieving mother, father… will hear what they want to hear. Get the facts in front of an unbiased jury who can make the call. Mistakes were made, it just takes a second of time to change everything, going left vs right in traffic… Sad this young man died, sad this young man had to take a life; what will be real sad is after all has been put in front of a jury and the jury would make a call based on disinformation distributed throughout the main street media which seldom goes challenged… Sad but true.

      Actually the police did interview two eyewitnesses the night of the shooting right after the shooting. And both of them said the guy in the hoodie was on top of and wailing on the guy on the bottom screaming for help.

      The one witness is the one that was about 30 feet away that called police and he said he yelled at the guy in the hoodie saying “stop I’m calling 911″.

      I agree with some of the other comments that people are fearful and scared of their previous “real” testimony of supporting Zimmerman. Several black friends of Zimmerman in the neighborhood supported him but asked not to be identified because they were fearful of black reprisal.

      The black community is ruthless if you don’t tow the line. If you even say you’re a republican they turn on you. Let alone say you support an innocent man that shot a black youth in self defense. This would explain the changing story they probably don‘t want to be dragged into court which is a shame the truth can’t be told.

      When you have Black Panthers saying they‘ll kill anyone supporting Zimmerman and a DOJ run by the Holder that refuses to do anything about it there’s little wonder and can hardly blame them.

      The eyewitnesses most likely received some type of incentive to “mis-remember” what they originally saw. Memory is dulled with enough time and money. Or intimidation may have been used, either way, their original stories will be questioned by both sides.

      You are spot on. But I wonder if it will make a difference in the end. Amazing that it has gone this far resulting in Zimmerman being charged with 2nd degree murder when they had the evidence. Don’t forget the O.J. was found innocent. I think Eric Holder has a big hand in this as well as Obama. It’s sickening that an innocent man can go down to fullfill a political agenda.       I lost a lot of respect for Glenn Beck when he was piling on George Zimmerman along with the rest of the media. He went so far as to say in one of his daily emails that it appeared that Zimmerman was just a racist who shot Trayvon simply because he was black. He made other comments at various times including saying that Zimmerman was very likely guilty, yet never citing any evidence to support that conclusion. Glenn was as big a disgrace as the major news networks.

      Also, if you search “glenn beck george zimmerman very likely guilty,“ you should find a link to a news story from this very site about the ”Bubba Effect.” In the description you can see where The Blaze wrote, “Beck clarified that he is not defending Zimmerman and believes he is likely guilty.” It seems that The Blaze edited the story at some point, though, because now the actual story says “there is a probability that he is guilty.”

      I have heard with my OWN FRICKING EARS Glen Beck say that he thought Zim was guilty. I heard it several times.       MIL-DOT, I listen to Beck daily and what I recall hearing from him regarding Zimmerman, was basically to wait and see what the evidence eventually reveals. He has added to that “IF” Zimmerman “WHERE TO BE FOUND GUILTY” that the courts should met out the proper justice. Most recently he has said that the evidence does tend to favor his story, but is still not picking sides.

    Zimmerman was the only party that night, with a few arrests for violent behavior, aggressive behavior and assaults, He was also on numerous medications that night and NEVER tested for alcohol.

      @ CHARLES116; Yes he had been *prescribed* numerous medications at the time this happened, but since he didn’t get drug tested no one even knows if he were taking all of his medications.
      At any rate, the medications he had prescriptions for are made to calm patients down, not to hype them up, so it’s not likely they would have influenced him to go ballistic on someone.

      Yes, the Martin autopsy says Martin had injuries to his knuckles – the only injury other than the bullet. George has two cuts on his head, a broken nose, split lip and his back was soaked.

      This case is a joke. There is NOTHING that points to murder by George. Obviously some 17 y.o. punk football player thought he could attack a citizen and get away with it and the wisdom of the 2nd amendment shows through.

      Martin is dead because he deserves to be dead, he was a thug who thought he’d beat an adult to death and he got what he deserved.

      George is justified in self defense even without the “stand your ground” law, in fact that doesn’t even come in to play.

      2) Trayvon Martin was trespassing in a GATED COMMUNITY where neither he nor his father lived.
      3) Zimmerman was asked by his community leaders to be the neighborhood watch man.
      4) Zimmerman had EVERY RIGHT to follow Trayvon who was trespassing.
      5) Zimmerman was obviously in a physical fight with someone who was trespassing in his GATED COMMUNITY.
      6) There are many gated communities in Florida. They are gated for a reason. If you dont live there dont be there. If you are in a gated community that you have entered illegally it is a jailable offense.
      7) Trayvon Martin was breaking the law at the time Zimmerman was following him.

    There’s no doubt that the guy doing the beating and causing the visible injuries was calling for help. That’s what everybody does – they yell for help while they’re beating on somebody. The person receiving wounds on their head, getting their eyes blacked and their nose broken always stays silent through the incident.

    As I keep stating to everyone, even if the charges are dropped or a jury trial declares his non guilt (and I do not see he is guilty of murder), then we still have Holder talking of bringing civil rights violations down on him and the bounty for dead/alive by the NBPP that Holder willingly does nothing about.

    Understand clearly people, this mans future is overwith, no matter what occurs, he will always have to watch his back and that of his family from those radicals seeking revenge upon his head; and that of the DOJ coming crashing down as well w/o mercy or hesitation.

      I have never taken sides in this from the beginning, but the most recent reports do lean more towards Zimmerman’s side.       Actually, Charles, Zimmerman‘s position is the one thing in this fiasco that hasn’t changed.

      Everything else, including some of the players, have changed, and now the witness statements (or some of them) have changed. Zimmerman‘s story hasn’t, which is often a sign of truthfulness.

      And who knows but what if there were any witness tampering, it didn’t come from the DOJ? I wouldn’t doubt it.

    witnesses changing story as media plays up Zimmerman’s guilt on TV. witnesses uncertain now that they see groups of protestors intimidating and making threats to anyone sympathetic to Zimmerman.

    big deal.

    the whole point is ‘beyond a reasonable doubt’. even if a witness is ‘not sure’ that they saw Martin on top, apparently hitting Zimmerman with his bag of skittles and iced tea, they are also equally ‘not sure’ that Zimmerman hunted the young man down like a dog.

    there are apparently no witnesses to back the state’s case. the state has the burden of proof.

    i just hope Zimmerman doesn’t take a plea and he lets the courts hear the full case.

      If Z takes a plea on Murder-2 his lawyer is a fool.. the DA didn’t even have enough in the affidavit to cover bringing the case to court! The judge simply playing to the State Attorney for political reasons..

      So the witness has changed her story? She described the clothes worn by the person on the bottom, which matched what Zimmerman was wearing.

      I wonder how much Al Sharpton paid her to change her mind?

      Martin didnt have ANY rights to stand your ground BECAUSE HE WAS BREAKING THE LAW AT THE TIME. HE WAS TRESPASSING IN A GATED COMMUNITY.

      his ground when You refuse to give him your Wallet.

      Some of you need to turn off Fox News and get some facts. Walking in a community in which your family lives and you are an invited guest is not trespassing, or illegal in any way. Trayvon had just as much of a right to defend himself under stand your ground as Zimmerman did. Neither of them were on their own property when the altercation took place, and neither were trespassing in the community.

      I am really annoyed at you. DO YOU LIVE IN SANFORD? I DO. Trayvon Martins fathers girlfriend lives in the community BEHIND the one he died in. She DOES NOT live in the community he died in. TRAYVON DIDNT WANT TO WALK ALL THE WAY AROUND THE BLOCK SO HE WAS CUTTING THROUGH A GATED COMMUNITY. He had no rights whatsoever to be there. He illegally entered A GATED COMMUNITY. He was trespassing. PERIOD.

      Learn the facts before you open your mouth and start spreading BS that isnt true.
