Georgia ‘Birther’ Convicted in Plot to Take Over Tenn Courthouse

Georgia Birther Convicted in Tennessee Courthouse Plot

A jury convicted 41-year-old Darren Wesley Huff Tuesday on federal firearms charges for carrying guns across state lines. Authorities say Huff was arrested in the middle of an attempt to take over a Tennessee courthouse and force President Barack Obama out of office.

The Georgia man was found guilty of carrying a firearm in interstate commerce with the intent to use it in a civil disorder, but acquitted of using his .45-caliber handgun and Ak-47 assault rifle to takeover a Monroe County courthouse in April 2010, according to the Knoxville News Sentinel. AP writes that Huff faces up to five years in prison:

“The verdict on count one reflects exactly what the law is supposed to do, which is prevent harm before shots get fired, people hurt, or property damaged,” Assistant U.S. Attorney Will Mackie told reporters after the verdict.

Scott Green, Huff’s attorney, did not comment after the verdict. When he spoke with The Associated Press on Monday before the verdict, Green quoted former New York City Mayor John V. Lindsay: “Those who suppress freedom always do so in the name of law and order.”

The Knoxville News Sentinel writes that Green argued Huff, who has no criminal record, has obeyed the law in the year since he first was arrested and then freed pending trial.

AP writes that Huff tearfully told the jury Friday that he was humiliated because “my government has called me a potential domestic terrorist.”

Huff was stopped by Tennessee officers in April 2010 and told them he was bringing guns into the state from Dallas, Georgia. Huff was a part of a Georgia militia and the ‘birther’ movement according to AP.Officers who arrested Huff said he had a document he claimed was a “citizens’ arrest warrant” for officials, saying they were domestic enemies and had been charged with treason.

Huff denies ever threatening to take over the courthouse in Monroe County. Huff claimed he was going to Madisonville to protest the arrest of “birther” Walter Fitzpatrick.

“I have never made a statement about taking over the courthouse, the city, the state, nothing,” Huff said.

A sentencing hearing was scheduled in February.

      Yet this man will go to prison for freedom of speech? Bill Ayers and his lovely wife Bernardine Dohrn once fugitives running from the FBI they now walk the streets and work to educate the gullible… in US universities

      True patriot. Here we are in a free country, as free men, and yet being told by our own government we are a dangerous threat to them because of the speech we make or assembly we’re in. Our liberty irritates the Government to such an extent that they fear of loosing their own power and force. And will expand and protect at our expense of Life, Liberty and the pursuit of Happiness. I say the hell with them. We’ve had enough of their nanny, for your safety, we know best, you must obey, you can’t do that BS coming out of their mouth.     This “event” happened in my home county. I still live within 30 minutes. I have heard nothing about this even though my family still lives there. Is that strange or what? It is a small county without many people. Things like this usually are talked about over and over but in this case its been hush hush. Something is very fishy.

      It’s not such a small county anymore bro. Cobb County has overflowed into Paulding big time. When I moved there 12 years ago, there were like a half dozen stores. Now when you come into to Hiram, at night, it looks like Las Vegas! Stores and restaurants everywhere. Of course like everywhere else (except around DC) the growth has stopped the last couple of years. It’s still turned into suburbia. However, I first met this guy at the car wash in Hiram right by the DQ. That was about 8 or so months ago so I guess the incident was pretty recent. He seemed real nice…I loved his truck! He told me everything that happened there in TN. I believe him. Truth is, he seems like the kind of guy that would give you the shirt off of his back.

      @ JB I don‘t live in the county any more so I don’t see the local news. Even so, what is odd is that no one in my family has mentioned it. This is the kind of thing that might get them talking…along with about half the population of the area. I seems as if it is being hushed for some reason.

      A search of the local paper (Advocate Democrat) website turned up two stories. One about him, the other about the guy Huff was going to defend. He didn’t brandish any weapons according to the Knoxville News Sentinal and had a permit(Georgia Permits are reciprocal in TN). Why did the Feds get need to get involved? Guns across state lines? Even with permits? Something seems off. Then again, this guy may just be a nutball and no one cares what happens to him.

      @JB… Yes..I’ve saw that truck at the car wash that day and since around town here and there. Actually I saw him about a couple of weeks ago and waived to him. That day at the car wash was the first time. We struck up a conversation and he told me all about the situation in TN. He gave me a card that I wish I could find. It has his website on it.

    So when was the 2nd Amendment revoked? This man who apparently has no criminal record at least as far as current news reports go will now be unable to own or possess guns because somehow the Federal Constitution is void when involving interstate conduct. I guess I missed something in the definition of Federal. I have never been able to figure out how the 14th amendment does not apply to the 2nd Amendment, but clearly allows for abortion. Apparently the idea behind the movie Minority Report is alive and well today.

      Huff was convicted not because he brought guns across state lines, but because he did that with the intent to commit a crime. It’s like the Mann Act which prohibits taking women across state lines for prostitution or illegal sexual acts. It is not against the law to take women across state lines, only if it’s for immoral purposes. It is not against the law to take firearms across state lines, only if you are taking the guns to commit a crime.

      I do not see how carrying your guns across state lines is a crime. He was not using them in the commission of a crime. I do not know of a law that says you cannot go to a rally with your legal weapons in your vehicle, unless you take them out and start using them or threatening to use them against innocent people. Who were the jurors that convicted him? They should be ashamed of themselves.

    First of all I am not a obama supporter nor do i care the direction of our great nation but everyone that is on his birth certificate needs to actually understand the law it says in order to be prsident ypu are to be a natural born citizen of the United States and have resided in country for a period of seven consecutive years prior to running for president. We know his mother was an U.S. citizen theirfore according to the law he is a natural born citizen of the United States no matter what country he was born in. The law was wrote that way to allow people whos parents where overseas when giving birth to allow them to be an U.S. citizen so please everyone let it rest and concentrate your focus on the more important issuses effecting our great nation at the present like the civil unrest with th occupy wallstreet movement that is pretty much a way in which obama can actually use to prevent himself from having to give up the presidency when he loses the next election

      Actually the law was written to force the southern states to accept children born to blacks as citizens. It was not written in anticipation of overseas births or illegal immigrants working the system over. The fourteenth amendment is one of the poorest written amendments in the Constitution and least thought out. I would have to say the least thought out is the 16th amendment.

      By your statement you seem to implying having a parent that is a US citizen is enough. However, the term used is parents. That’s plural not singular. Further it states not having loyalty to another nation. The fact obama’s father was a citizen of Great Britain at the time of his birth that means he had loyalties to another nation. It doesn’t seem it can be interpreted any other way in either case.

Only one parent has to be a U.S. citizen and the child is a citizen. There is no law that says both have to be a U.S. citizen. Many countries recognize dual citizenship. Had my daughter, who was born in Turkey, was born a male, the Turkish Army could have forced my son to serve if he was in the country at age 18 because he was a dual citizen. She is immune from the rule.

    I was there that day,, there was no attempt to take over a court house or any thing else.

    He was NOT arrested until 10 days after the day they claim an attempt was made to take over the court house lol..

    The only weapons I saw that day were carried by the Swat team and other Law Enforcement there.

    Don’t understand the charge of carrying a gun across the a state line. Hunters and people moving from state to state do that all the time. Sounds like a law that should be challenged in court.     Obama’s recent release of his purported birth certificate alleging “where” he was born, also indicates his parent’s citizenship “when” he was born. Unless Obama admits fraud, these equally important “facts” are now beyond Obama’s ability to refute, alter or hide!

      There is a difference between a naturalized citizen and a natural born citizen, Obama was born on US soil he is a natural born citizen. In the case of United States v. Wong Kim Ark, 169 U.S. 649 (1898), the Supreme Court ruled that a person becomes a citizen of the United States at the time of birth, by virtue of the first clause of the 14th Amendment. The 14th Amendment has provided the definition that was absent in the Constitution.

      Obama’s recent release of his purported birth certificate alleging “where” he was born, also indicates his parent’s citizenship “when” he was born. Unless Obama admits fraud, these equally important “facts” are now beyond Obama’s ability to refute, alter or hide!

      The now inescapable truth, is that his Kenyan father absolutely precludes Obama from being a natural born citizen, as required for eligibility to serve as President by Article 2, Section 1, of the US Constitution!

      Please don’t let the biased media or even uninformed conservative talk radio or TV hosts, dissuade you from learning the truth about his ineligibility or from demanding his removal from office, while also preparing to cast an informed vote in the next election. Let it be their credibility that‘s hurt by dismissing Obama’s birth certificate and social security anomalies while also sadly ignoring the Constitution, not yours! Why risk Obama being reelected by anti-American socialists and imminent vote fraud?

      Get the truth about his fake birth certificate & social security number as alleged by experts, and the Constitutional proof that a “natural born citizen” is one born in the US of TWO US citizen parents!

      See the simple proof that a “natural born citizen” is not the same thing as a citizen!

      It costs nothing to look, but it could cost you everything if you don’t.

You need them to construct cogent opinions and arguments. Wouldn’t that be nice for a change, rather than feeling compelled to irrationally criticize and insult others based on apparently unfulfilled emotional issues?

      You like facts? I’m amazed to hear that, because you’ve shown an amazing capacity for ignoring them, like the fact that your local sheriff doesn’t have the authority to arrest or even investigate the President of the United States. I’m pretty sure that people have pointed that fact out to you before, but it never seems to make any impression. Another interesting fact is that if you have a different theory of what the law says or should say from the one held by Congress and the Supreme Court, all judges everywhere in the country have to rule based on what Congress and the Supreme Court say the law is instead of what you say it is, no matter how sure you are that you are right. I can’t count the number of times people have tried to get you to face this fact, but it just doesn’t seem to exist in the strange parallel world you have created for yourself.

    “federal firearms charges for carrying guns across state lines” is what I can determine.
    Five years sounds way over the top for that. He should get a slap on the wrist and told that he should not do that again, but too bad he is not a Black Panther.
