Georgia Cops Shut Down Girls Lemonade Stand for Lack of Business License

MIDWAY, Ga. (AP/The Blaze) — Police in Georgia have shut down a lemonade stand run by three girls trying to save up for a trip to a water park, saying they didn’t have a business license or the required permits.

Midway Police Chief Kelly Morningstar says police also didn’t know how the lemonade was made, who made it or what was in it.


The girls had been operating for one day when Morningstar and another officer cruised by.

The girls needed a business license, peddler’s permit and food permit to operate, even on residential property. The permits cost $50 a day or $180 per year.

One girl, 14-year-old Casity Dixon, says the three had to listen to police and shut down.

The girls are now doing chores and yard work to make money.

    I tried to have a lemonade stand when I was about 7. My cousin was babysitting us and, because he didnt want to have to watch us outside, he said that we needed permits and a license from the city. So, we didnt have one. And, I never tried again. Don’t know if that is related, but I hope the parents of these children keep encouraging them.

      Robert Jordan sued the New Haven, Conn., police department after it rejected him as a police officer because he scored too high on an intelligence test. But U.S. District Judge Peter C. Dorsey has dismissed Jordan’s suit, ruling that he “may have been disqualified unwisely, but he was not denied equal protection” as defined by law. Jordan’s IQ is approximately 125, versus a national average police officer IQ of 104. New Haven argued that a too-smart cop “could soon get bored with police work and quit after undergoing costly academy training.” (AP) …More likely, the brass realized he’d outrank them within two years.

      You just have to wonder how many illegal aliens there are? How many actual convicts there are molesting kids and they have to shut down a lemonade stand. These troopers deserve medals for their courage for stopping this clear violation of the laws.

      It’s no wonder our kids have no get up & go about them. Their hands are tied at everything they could do to legally make some money. Guess our laws would rather the kids go out and steal from stores & others homes to make a few bucks. When I was 11, I was selling our flowers, veggies etc. I even made a little cart to pull behind my bike to sell soda pop to a construction site near us. Then I’d go back and collect the bottles for a refund.

      Congratulations on your heroic effort in shutting down yet another terrorist lemonade stand run by the worst criminal organization this country has seen since the creation of the Federal Reserve! You should all be proud and start to order the medals your officers deserve to be given at your next pinning ceremony. How dare 14 year old girls and those younger to try and get past the laws that make such common sense! Isn’t there a harsher punishment you can impose? The minute I saw the WJCL news clip, I called our local home alarm company and had a new system installed. Did you see the eyes on those girls? Those fake tears don’t fool me! They are dangerous and should be locked away for life!

      It is a comfort knowing that your town ordinance is protecting your citizens. Those who wrote this into law should be commended for their just and swift reaction to such a crime that plagues this great nation of ours!

      People should understand that they only need purchase the lemonade that is available in their local stores. So what if it is loaded with Aspartame! The government says it is good for us so we should believe that! If not lemonade then simply stay home and drink good old tap water. So what if it is loaded with sodium fluoride! The government says it is good for us so we should believe that too! The nerve of these adolescent criminals to take business away from big corporations that care only for the people and not for self profit!

      This is at most a “code enforcement” issue. What the heck are the police doing there? Family should have told the police to go away. Since when do the police enforce health codes in restaurants? They don’t. So why were they sent to this little lemonade stand?

      I have to respond to your post as it is unfairly collectivist in stating that police officers are required to have low IQs. I am somewhat familiar with Mr. Jordans story and I assure you that it is an anomaly. I am a veteran police officer and I know many police officers who are highly intelligent. (Of course police, like any other profession, have a wide variety of personalities and intellects).
      Do you (like so many others on The Blaze) read a story about a black person or group of black people misbehaving and conclude that all black people are bad? I doubt it. I read most of your posts (because you and I have very similar political beliefs) and I know that you are not a collectivist so please don’t stoop to that level in regards to police officers. Many are very good people.

      The girls should reopen their stand, offering FREE LEMONADE, with a sign that they may except donations to the worthy cause of a trip to the water park. It would all be legal and the progressive’s police force could go back to being the keystone cops they apparently are.

      Isn’t it strange…the cops will shut down a lemonade stand in an instant, but groups of tens of crack-dealers standing around on every corner of a couple specific streets in my town every day of the week hawking their wares, even approaching cars stopped at intersections and knocking on windows, are all but totally ignored. There are streets in my town you just avoid if at all possible, as it’s like that.

      But heck, this is Michigan, a state historically controlled by the Democrats and labor unions. Drug dealing is the only growth-business that exists here. I’m waiting for the unions to try to organize the dealers.

      I just sent an e-mail to the contact address of the town & requested that they forward it to the Chief of Police. I suggest that everyone who feels this is wrong do the same. If you are worried about sanitation, why not give the kids the price of a cup and tell them you don’t need the lemonade. “Cross-contamination” — do you even know what that means? BTW, a couple of weeks ago a little girl set up a little table on the corner near my house & was selling lemonade for 25 cents a cup. Something about it touched me, and I bought a cup for my husband and one for myself and gave the little girl a dollar and told her she deserved the tip for sitting in the hot sun (and it WAS hot). The lemonade was terrible, and my husband and I both dumped it out, but I had a wonderful day after that! Children taking the initiative to do something like that deserve encouragement.

      Unfortunately for the police it is always the worst of us who seem to get the most attention. They make it difficult for us all. I think you would be surprised to know that there are really quite a few of my police officer friends who greatly admire Ron Paul. The problem is that most of them buy into the “he can’t win” philosophy. I work on them when I can and there is a small group of us in my city that will vote for only Ron Paul in the next election, even if we have to write him in.
      All police officers swore an oath to uphold the Constitution. I know that many (just like many elected officials) forget that oath when confronted with adversity. There are also many (again, like the politicians) who took the oath but are not very knowledgable in regards to the Constitution. However I do think you would be surprised at how many keep that oath in mind and do their best to understand the Constitution and live up to it. Believe me – most police don’t want a police state and are just as bothered (probably more so) at the ones who abuse their position.

    What is wrong with us? Laws are for adults or should be. A child is to be protected and cared for by all adults in the good ole USA. A childs right is LIFE, LIBERTY and a HAPPY one. Its adults that should see to it that happens. This includes the one million aborted ones each year. Shame on us for not living for our children until adulthood. Will these little girls now fear the PD in Midway? Will they fear to call 911? The mayor should should apologize and have a talk with the police in that PD. As a Georgian i am not pleased it happened here.

      I have I ever bought a cup of lemonade from a kid on the street? The answer is, NO!
      As the officer stated you don’t know anything about it. It’s okay to feel victemized and to think your Innocent childeren are victems in this case, but what if the kids cross contaminated it? Ask one of those kids if there is a possibility it was. What would the expression on their face be? Confusion?!

      I would trust that Stand over any Government Approved Food Place paying their Employees below minimum wage where they do god knows what to your food.

      But This kinda of crap, on a much larger scale, is the reason we have poor job growth, and the economy still stucks, when you have to have 4 different permits from probably at least 2 government agency just for a child to open a simple lemonade stand THERE IS A MASSIVE PROBLEM. and you can only image what someone must go through to open a real job producing business…. and why most people choose not to do so…..

      First, thanks & respect for serving.

      You have a point about the laws being enforced. However, the problem is with selective enforcement. There are certain streets in my town that are open-air markets for drugs, with dealers standing around openly selling crack and even approaching cars at intersections, and users openly smoking crack right on the sidewalk.

      This activity goes on 24/7/365. Every couple years, a particularly-horrific multiple-homicide on one of the streets will receive some attention and the cops will patrol for a couple weeks, then enforcement stops and things return to “normal” and the dealers are back.

      But, just let some kids try to sell some lemonade! They’ll be lucky not to be tazed & arrested.

      I guess it’s a “nudge” towards the occupations government wants our children to be encouraged to follow. “You can’t have a lemonade stand little boy/girl, but we’ll ignore you if you carry a gun and sell crack to your classmates & neighbors.”

      This isn’t the first time a lemonade stand has been shut down in GA so, frankly, the parents should have known better. Do I agree with it, NO. If there are concerns about how the lemonade was mixed, then don’t buy it, but usually close neighbors and friends are the ones participating to help the kids with their projects. If other ways are suggested they will probably regulate those too – I‘m surprised they aren’t required to have a ‘chore’ permit to help around the house. Oops, better not give them the idea.

    I am a retired Tacoma, WA police officer and this is the type of thing that gives all cops a bad rap. When my partner and I would be on patrol we would deliberately stop at these stands to buy a cup of lemonade. If the cost was 50 cents we would give them a buck. All PD’s in the US talk about Community Oriented Policing and this act of stupidity violates every aspect of that program. This is not how a PD gets the public on their side and this action creates suspicion of police from the public.

      I live about 10 miles from Midway in the Hinesville/Fort Stewart area (Home of the 3rd ID). Midway is so small, it has only one traffic light & that’s only where two major highways intersect. I don’t know much about this police chief other than to say she must not be from the area, as in most small towns, everyone knows everyone & wouldn’t stop some kids trying to develop a work ethic by earning their own money. What’s even more troubling is that TWO of the signers of the Declaration of Independence from Georgia lived in Midway & two prominent Generals from the Revolutionary War are buried there. These guys fought for the right to “Life, Liberty and the pursuit of Happiness”, yet the police chief shuts them down, makes no sense to me. LET THE GIRLS HAVE THEIR LEMONADE STAND!!

    I recently read that a lemonade stand ran by a few kids was shutdown. I’m glad to hear that capitalism, the free market, individual liberty, and self dependence is still encouraged and not restricted here in the good old Soviet Socialist Union of America. Great job in going after those little pesky kids. They need to be taught that they can’t be free and enjoy the fruit of their labor without the Government having its “fair” share and say. They must learn that when in need they must apply for welfare or some other Government ran program or licensing scheme. They should have known that in America they cannot be at liberty to aspire to be entrepreneurs and act on that spirit, especially if using their own property, money, time and effort.

      How about this… If the girls are doing yard work after you shut down their lemonade stand you better cite them for not having an agricultural license. If anyone says ya‘ll are wrong for doing these things just tell them about the laws restricting jews from owning businesses or land in pre WWII germany and the law abiding officers who were just doing their jobs enforcing the ’Law of the Land’ when they carted them off. Thank God for officers like this applying their sense of impartiallity to the law. The U.S. would not be the country it is with out them.

    It should read, young entreprenuers shut down so they will never try again. This my dear people is a way to keep our children and grandchildren from ever learning how to make a living. How very innocent to sell lemonade or koolaid and have a police officer do this to them. I would be ashamed to call this city police or town council mine.       Makes me think of a commercial I happened to see on television where a young girl got an I-pad as a gift from here dad, and in one day she was CEO of her own huge corporation. Yeah right!     So much for learning how to run a business. Regulations get in the way and you’re shut down. Even if you‘re a 5 year old selling lemonade for american currency that’s worthless anyway. $50 a day to have a peddlers permit? The girls would have to sell 50 glasses at $1.00 each to pay for the permit and they haven’t purchased the lemons yet or allocated their time.. The problem is, life didn’t give the kids lemons to make lemonade, It would have gone to the government first . Where can I send the kids some money and tell the police chief in Midway, GA to shove it!

    So what makes that any different than buying lemonade in a cafe? or 711? or any convenience mart? The laws have become so twisted that they cannot be FAIRLY enforced anymore. What happened to “common sense prevails?” Guess there isn’t any anymore.

      What gets me is in some cities “law enforcement” will turn a blind eye to illegal aliens, but turn around and bust a crime family, distributing a dangerous lemon substance that alters the hapless victim’s mental health and makes them happy and quenches their thirst. And profit off of the refreshing bliss they create!….. Dispicable little brats!!

    Question is WHO is the NAZI that initiated the removal of their stand. Find out who that is and where they stand politically. I will bet they are liberal progressive, I cannot see a street cop doing this. Someone, a radical imo, saw this and reported these children.

    Its deplorable I will be most of the Blazers here along with staff did this when they were a kid. This is complete insanity enough is enough OUT the people who are responsible. Turn their lives upside down I will bet they have broken some rules themselves!

    I guess that will show those “kids” .. don’t try to earn money in business in the USSA … it is no longer “business friendly” … who are they hurting? and yes .. it is usually other neighborhood kids and parents who buy from neighborhood stands .. from people they KNOW like these girls.

      If I ran across one run by a couple of kids, I would buy a cup in a heartbeat.

      Leave it to government agents, like some police, to get all dented over a thing like this instead of dealing with real crimes. Heck–in my day, if some kids had a lemonade stand, cops would probably stop and buy a cup, too.

      Here’s just one more example of why cutting back the police and government employees is probably the only good thing that has come from this economic downturn.

      If all they have to do is pursue frivolous unimportant incidents like this, then they’re way over staffed.

      Here‘s hoping this particular police force will either be cut back so severely it won’t have time for nonsense pursuits or it’s disbanded altogether. I’m betting these authorities are whining about having their budget cut also. If they’ not in a bind financially, they will be soon, and that will be a good thing.

      $50 per day, plus $180 per year for a license is no more than a revenue acquiring gimmick by corrupt demagogues rife within these governmental jurisdictions. Costs like that certainly aren’t justified.

      I’ve notice the small towns in my area, plus the sheriff’s office and especially the Highway Patrol, are lurking around everywhere writing tickets as if there’s no tomorrow, hoping to bring enough money in to keep whatever authorities are involved from going under.

      We need more citizen defense groups and fewer police.
