‘A Clear Overreach’: Gibson CEO Blasts Justice Department

Gibson CEO Blasts Justice DepartmentGibson Guitar Corp.’s chief slammed the U.S. government on Wednesday for sending armed agents to raid two Tennessee factories under a law aimed at curbing the illegal harvest of tropical hardwoods, reports Reuters.

“Armed people came in our factory … evacuated our employees, then seized half a million dollars of our goods without any charges having been filed,” Gibson CEO Henry Juszkiewicz told reporters and others at a Washington lunch.

“I think it’s a clear overreach,” he said.

Government agents seized a total of over $1 million worth of rosewood, ebony and finished guitars from Gibson factories in Memphis and Nashville in raids in 2009 and August of this year, Juszkiewicz told Reuters.

Gibson’s factories remain open “under great difficulty” because the raids took most of the company’s raw materials, the CEO said. In a Capitol Hill forum Wednesday, Juszkiewicz told Republican lawmakers the raids have so far cost the company more than $3 million in legal fees and manufacturing disruptions.

The price of their products will likely go up because of the financial hit they have taken.

Furthermore, the CEO cautioned that American jobs could sent overseas as a result of the federal harassment.

“You know, there’s a very real possibility we will have to move at least some processing [jobs] overseas,” the Daily Caller reports Juszkiewicz saying. “I’m trying to avoid that. But you know, I have to do what the business requires, and that’s a very realistic possibility.”

The U.S. Justice Department declined on Wednesday to comment on the case but provided information on the Lacey Act, which aims to curb trafficking in wildlife, fish and plant products, including illegally obtained timber.

“By prohibiting trafficking in wood illegally harvested overseas, the Lacey Act prohibits companies from undercutting law-abiding U.S. wood products companies … by trading in artificially inexpensive raw materials that have been illegally harvested from foreign forests,” Justice and Interior department officials wrote in a letter.

Gibson Guitar uses a small fraction of the world’s tropical hardwoods, compared to that used for furniture and flooring, and because it uses so little it can use it sustainably, Juszkiewicz said.

“The issue here is not illegal logging or some conservation abuse,” he said. “The laws that are being identified by the Department of Justice have to do with protectionism by the country of origin, keeping work in that country and therefore not allowing something that isn’t that value-added to be exported.”

Gibson has filed suit in federal court in Nashville to recover the seized material, but that suit has been stayed while the investigation continues, reports Reuters.

Furthermore,  the guitar manufacturer has hired a Washington law firm to lobby on its behalf.

The Tennessean reports that Crowley & Morley LLP will lobby against the Lacey Act, which federal officials are investigating Gibson of violating.

Gibson’s chief said the law should be changed.

“I believe in the intent of the law … but I do believe that the way it‘s currently written allows what’s happening to me to happen to other companies, and that’s wrong,” he said.

    This is nothing more or less than every one of these regulatory laws being passed by nameless, faceless beaurocrats receiving quid pro cash from these lobbying firms. Our legislators spend their valuable time lobbying lobbyists for “campaign contributions” and then turn over their IOUs for those dollars to beaurocrats who write some regulation to pay off the congressweasel’s debt.

      JMORCAN: By that logic any company that donated money to the Reps or Dems ALSO deserve to be raided. That would mean almost every company in the USA would have to lose their inventory (taken by the cops)..

      I also find it ironic that Obama talks about “creating” jobs, and yet here’s a company that has been severely damaged by this raid (their inventory was taken), and will probably be forced to move overseas to survive. Hence thousands of Americans will be put out of work.

      Do those workers also “deserve whatever they get”? They didn’t do anything wrong, and yet the government is jeopardizing their jobs too.

The comment by jmorcan says it all, if you donate to the republican party then you will get a visit from the injustice department for allegedly breaking a law of a foreign government, but if you are a guitar manufacturer who donates to the democrats and use the same wood from the same countries your golden. This administration is the most corrupt this country has seen since Taft and the injustice department has become the collections arm of the democrat party.

      I have been involved in the MI industry for over 30 years. Some of you might even be using some of my work product in your studios.. When he acquired Gibson he became no one’s best friend. This isn’t the place to go over it but PLEASE.. google and research this guy before you go out and buy GIbsons and jump in his bandwagon. I implore you all to be careful about which side you pick in this situation. I am NO fan of this admin or the dirty DOJ.

      Regardless if you like him or approve of him it still does not give the Gov. the right to seize property, shut down a business, incurr costs that could lead to bankrupsy without due process. It has been two years and two raids and still no charges have been filed. After two years if they still haven’t found cause to file actual charges then it is nothing less than harrasement at the point of a gun.
      Does that sound like the America we believe in?

      The point is that Gibson’s CEO _could be_ capable of less than ethical practices. I haven’t seen a complete offering from the DOJ so instead of jumping on the same bandwagon with the rest of you I will patiently wait for some facts.     This is part of the problem. The gov. has been doing this to people for decades, and your local police have assisted them in their illegal seizures. Your city councilperson, county supervisor, state rep, have all sworn an oath to uphold, and defend the constitution against all enemies foreign, and domestic. they have the authority to fire law enforcement who participate in these raids. Also, people need to wake up, and speak out in general, not just when the gov. is stepping on their toes, like this CEO. Hold your local officials accountable.

    I am sad to hear the CEO of Gibson say this because if he really understood the Obama administration, he would understand that the Justice Dept along will all the other government departments are the long arms of the Obama administration and are tasks with carrying out his agenda. So this is exactly what they want to destroy this nation is to force manufacturers to send more jobs overseas. They speak with fork tongues. They say they want jobs but the really want to destroy the economy of this country in their plot to destroy Capitalism. I hope the CEO rethinks and challenges them legally instead of sending the jobs overseas. Stand strong!

      Actually, his already doing what you hope he would: challenging it in court and trying to keep the jobs here. The operative part of what the story says is that the lawsuit has been stayed by the courts while “the investigation continues”. That’s the point! The “investigation” has been going on for 2 years! It’s a clear attempt to destry Gibson because Gibson is owned and run by a Conservative, and no campaign donations were made to the Obama campaign. Obama runs around screaming about passing a jobs bill while simultaneously destroying American businesses and trying to force more jobs overseas and putting more Americans out of work. Look at the AT&T/T-Mobile merger that the Obamanation “Justice” Dept. shot down under “anti-Trust” laws; That deal would have brought abut 5,000 overseas tech and support jobs back to the US from overseas, but oh, no! Obama can’t have that…! The “Justice” Dept. already told Gibson that their problems would “go away” if they moved their fretboard production to Madagascar.

      Sorry Gibson knew they were breaking the law with the importation of the hard woods, now that they got their hands caught in the cookie jar are they crying.

      The filing — which argues Gibson lacks the right to claim ownership over the seized ebony because it is contraband — includes text from internal Gibson emails.

      “[A] Gibson employee…wrote that ‘[t]he true Ebony species preferred by Gibson Musical Instruments is found only in Madagascar (Diospryos perrieri). This is a slow-growing tree species with very little conservation protection and supplies are considered to be highly threatened in its native environment due to over exploitation.’ In fact, [he] ‘spent two and a half weeks in Madagascar this June [2008],’ writing on his return, ‘I represented our company along with two other guitar manufacturers…. All legal timber and wood exports are prohibited because of wide spread corruption and theft of valuable woods like rosewood and ebony.’”

    I’m the proud owner of a 1986 Gibson Explorer. That guitar has some miles on it and plays even better than the day I bought it new. Like a fine violin, Gibson guitars get even better with age.

      That explains the annoying tinny weak-assed sound that Fender guitars produce as compared to the deep rich ballsy sound that Gibson guitars produce.

      Come on WarriorPitbull, You can make a Strat scream. Jimmi, SRV, Blackmore? I have Gibbies and Fenders and love them both. Leo wasn’t a commie and he invented the Strat and Tele. Where would country be without the Tele?

      We’re going to disagree on everything. The Martin D28 etc., is the best designed guitar. The Strat is no higher that number 4.

    I have a Gibson guitar. When this started, I bought another. If there was one single thing that would prevent me from voting for Mr. Obama, this would be enough. That there are other reasons makes this point moot, but by itself, this would be enough.
