Gun Rights Win in Florida: State Law Will Soon End Local Firearms Restrictions

Florida has decided to finally protect the 2nd Amendment at the state level and eliminate onerous restrictions that many municipalities and communities have enacted against gun rights.
Starting October 1st, any public official who passes or enforces gun regulations below the state level faces a $5,000 personal fine and could even be removed from office by the governor for enacting or enforcing local gun laws.
While Florida has had a law on its books since 1987 that makes it illegal to pass gun regulations beyond state statutes, there was no enforcement mechanism in place. As a result, towns and cities have created ordinances at will. In the process, many of them have criminalized otherwise completely law-abiding citizens who unintentionally ran afoul of arbitrary, localized gun rules.
But thanks to the law recently signed by Governor Rick Scott, that’s all about to change in the Sunshine State.
Called the Penalties for Violating Firearms Preemption Law, the new state forces the repeal of any and all regulations, policies, and ordinances that violate the firearms preemption law of 1987. Its passage has already had an impact as assorted town and county bureaucrats are scrambling to come into compliance by the October 1 deadline. The Orlando Sentinel reported on the changes now underway that:
“Orange County employees have started removing ‘no firearms’ signs at county parks, and soon they’ll probably black out the same words on brochures. In Groveland, leaders recently erased from the books an ordinance that banned firing a gun into the air….in Boca Raton, the “no guns allowed” sign has come down at City Hall. In Lake County, commissioners recently deleted a provision in an ordinance that would have banned firearms on public lands, including its parks.”
The new law will make for consistent, state-wide rules for guns, including those with concealed carry permits. It will not affect rules already in place at the state level for firearms, the Orlando Sentinel points out, which include making it illegal to ‘fire into buildings, cars, across streets and in public places, except for self-defense.‘ The new law won’t really expand gun rights so much as it will greatly clarify legal firearms possession, transport, and use- eliminating inevitable confusion for law enforcement and citizens alike.
What is certain is this- Governor Rick Scott has sent a clear message that the right to bear arms enshrined in the 2nd amendment to the Constitution is not a parking regulation or a picnic permit to be issued, denied, or changed at the whim of any middling bureaucrat.
On top of that, the 6000% increase in aluminum baseball bat sales in the U.K. this week due to the shocking riots there may have refocused Floridians on their right to protect their persons and property as enshrined in our Bill of Rights, regardless of what any town or country says.

In Ohio a locality/political body/police department can easily be sued for violating state pre-emption, and has to cover your legal fees as well. It didn’t take long for most places to clean up their act once organized human rights groups started suing police departments and cities. The last holdout was Cleveland, which just lost it’s “grand case” trying to re-establish local ordinances.
I’m happy for Florida gun owners and human rights enforcers. Good on them!

When citizens have the liberty to execize their 2nd amendment right to arm and protect themselves, they become “deterrents” and not “perpetrators” of cimes that are committed by firearms. Firearm legislation benefits the criminals and not the average citizens.

Posted on August 15, 2011 at 9:44amPeople need to understand that these laws and local ordnances don’t regulate “guns”, they regulate gun owners, since guns are inanimate objects and can’t do anything, legal or illegal. That‘s why the Second Amendment addresses the rights of citizens to bear arms and doesn’t say anything about the weapons themselves. Our Founding Fathers understood that words have meaning. The entire Constitution is based upon the principle of Subsidiarity, which simply means that government should not do for citizens those things citizens are able to do for themselves or by free association with other citizens. Having been guaranteed the right to bear arms, citizens have an obligation to regulate their own management of those weapons and to do so responsibly.

Local officials do so many wrong things it is absolutely vital to have laws on the books making their actions open to criminal prosecution. It’s the only way to keep them in line and under control.
We had 5 county officials in my area caught in an FBI sting accepting bribes, one of which was a commissioner for 30 years, always raising taxes and promoting more governmental control over the people.
This kind of criminality is rife throughout local politics and we should applaud any efforts by the legislatures to bring it under control.

I used take my gun when I am going to drop off the deposit bag on a Saturday night when there was 20K in cash in it, and my choice was go some where I felt a little unsafe, or keep 20K in cash in my home all weekend. I’m sure not going to go in, or allow my family to go in a park that I feel so unsafe in, that I won’t go unarmed. Mississippi just changed their law, to allow people to take guns in malls, bars, restaurants and a whole list of other private places even if the owners don’t want guns in their shops. As someone who has owned several bars, it worries the heck out of me, Alcohol and guns don’t mix, I have had dozens of incidents where drunks with concealed weapons did some stupid things in my bars, that should have never happened. I always had at least one armed off duty police officer in my places if they were open for business, so there was never a time that any customer needed a gun to protect themselves.

I bet many women who were raped in parks felt safe, I bet many parents who’s children were abducted at a park felt the park was safe. Just because a local park “feels safe” doesn‘t mean a situation can’t arise, ESPECIALLY in this ECONOMY. Law abiding people don;t carry guns because they don’t feel safe or they are looking for something, they carry them because they know this ISN’T a perfect world and cops only exist to CLEAN-UP the mess after YOU ARE DEAD. People who go around life thinking “Oh, this is safe, it will never happen to me” are ignorant.

The thing that gets me is that guns were getting into places even with the regulations. It wasn’t law abiding citizens who was breaking this law but criminals. Laws that hinder the rights of the citizen will always bring about criminal behavior. To say that controlling guns is the answer is to hide one’s head in the sand so to speak.

He also wants to require volunteer service for unemployed and make it easier for employers to deny benefits which will help keep the unemployment insurance rates lower to the employer. Gov. Scott is only slightly less destructive than Hurricane Andrew. Great way to treat a handle a economy were jobs are an issue, destroy worker protections and hand out pink slips. The only good thing about Scott is that he is a one term loser.

While we‘re on the topic of IQ’s and what not, can you tell me where the money/funding comes from for those gov’t jobs? Those tax dollars could not be put to better use in the private sector, creating jobs that actually create goods and services? The first rule of survival for any parasite, is to not kill the host. The government, instead of creating a symbiotic relationship, has created a lethal parasitic relationship….destroying job creation and entrepreneurship.

Brandishing is against the law in most places, probably all for that matter. For the adults info, I have had a CCW in Alabama since 1976. I carry EVERY DAY. Only my closest friends and family even know it.
In all that time, I have only pulled my firearm ONCE. In 2004, I was accosted by four young blacks in a mall parking lot. In broad daylight.
I park my vehicles far from the entrance of any shopping establishment to keep the dings down. Four young blacks came up on me right when I had opened my car door. They told me to give them the keys and my wallet or they were going to kill me. I pulled my weapon, a Taurus PT-145 45acp. Two of the young men looked uncomfortable and started to edge away until one of the men said” Do you really think you can all of us before we get you?” He was grinning when he said it. I just grinned back and said “You may not be 1st, but you CAN be next”. Just that quick, they scattered like cockroaches. Obviously, they knew I was serious.
I didn’t WANT to kill them, but if even one had made a move for me, or a pocket, it would have been REAL messy. I think that, yes, I could have gotten all of them. 10 in the mag, and one in the chamber. And I go to the range 1-2 times a month.
Point?
Anyone that thinks that it will never happen to them is an idiot. And that I had it when I needed it, for the 1st time in 28 years, made the whole hassle of carrying worth while.

I’m 100% for the 2nd Amendment, and 100% for property rights as well. If a place doesn’t post, I’m packing in it, if they do post “no firearms” I disarm out of both courtesy towards their property rights and out of respect for the law (at least the law here in Ohio).

You may absolutely carry legally in Disneyworld, Target, 7-11, or wherever else you happen to see such a sign. The only places you cannot legally carry in Florida or those places listed in the CWL statute.
That said, if you are caught carrying they have every right to ask you to leave. If you do not leave, you can be charged with armed trespass. Generally, it is a good rule of the thumb to leave private property when requested anyway. ;)
We just went to Disney and Universal a couple weeks back, and they don’t have metal detectors or anything like that. They glance through purses/bags and will check your pockets if you look suspicious (I only saw one person get their pockets checked). Wouldn’t carry if you are planning on riding roller coasters though.

The looks we was getting from the people getting their bags rifled by the “security” folks was priceless. It’s like, “wait a minute, you’re digging through me stuff looking for a toe nail clipper, meanwhile that dude waltzes in with wearing a colt!” Sort of makes those security folks obsolete, don’t it.
