Blaze Confirms: Conservative Blogger Arrested Following Court Hearing With Convicted Speedway Bomber Brett Kimberlin

UPDATE II: At approximately 5:30 p.m. ET Aaron Walker tweeted that he has been released from custody but that he cannot reveal any additional details until he speaks with his lawyer. The attorney was charged with “incitement,” but released on his own recognizance.

Earlier, The Blaze spoke to a clerk at the District Court of Maryland for Montgomery County who confirmed that Aaron Walker had been arrested following his hearing with Brett Kimberlin. According to the clerk, he was arrested on second degree assault charges that were previously filed by Kimberlin when Walker, following a separate court hearing, took and held at bay Kimberlin’s iPad. The clerk’s account turned out to be incorrect, however, as the incitement charge indicates.

Walker laid out the details of the iPad incident in both The Blaze interview and his discussion with Glenn Beck last week. That account can be read here detailing how convicted Speedway Bomber Brett Kimberlin has been terrorizing bloggers across the country. Today, one of those victims, Aaron Walker has been arrested at court following his most recent hearing with Kimberlin, who had taken a restraining order out on the respected attorney (ironic, considering the convicted domestic terrorist was the one doing the harassing).

 

Aaron Walker Arrested in Montgomery County Maryland Following Brett Kimberlin Hearing

Aaron Walker, whose complaint against convicted terrorist Brett Kimberlin became a conservative cause célèbre this past week, was reportedly taken into custody today after a court hearing in Rockville, Maryland.

One person who attended the hearing in Montgomery County District Court said that Kimberlin asserted that Walker’s continued blogging represented a violation of a “peace order” Kimberlin had obtained against the Virginia attorney, who says Kimberlin tried to “frame” him for assault earlier this year.

During the course of the hearing — which reportedly lasted about an hour — Judge C.J. Vaughey appeared to become increasingly hostile toward Walker, who was taken into custody when the hearing concluded.

According to one of McCain’s sources, Kimberlin claimed during the hearing that he has received death threats as a result of what he calls Walker’s violation of the peace order.

A copy of the “final peace order” (time-stamped 10:52 a.m.) states that Kimberlin is “in fear of imminent serious bodily harm” as a result of a “countless number” of death threats, and that “there is clear and convincing evidence that [Walker] is likely to commit a prohibited act in the future against [Kimberlin].”

An eyewitness writing for OlympiaPress claims that it “went bad for Waler pretty quickly”  and that Montgomery County Chief Justice Cornelius Vaughey, who presided over the case, is “a guy who retired in ’04, and still takes the odd shift when stuff gets busy or there are vacations.” In other words, it can be argued that the judge’s attention (and patience) in the matter may have been less than up to par. Based on witness accounts the judge also did not seem not to be social media-savvy, leaving him at a disadvantage when it came to understanding what Twitter and Facebook entail. Olympia continues:

If you’ve followed the matter, and I know not a lot of people have, Walker, who is an attorney, acted in an advisory capacity for another blogger who had dealings with Kimberlin. Kimberlin later accused Walker of assault; those charges were null-processed; Walker wrote about things like you’ll read on Kimberlin’s wikipedia page, as well as his own dealings with Kimberlin.

Judge Vaughan had read up on the matter, knew Kimberlin’s history of felony convictions, but clearly was technically ignorant of even basic facts about what Twitter is, in one instance point saying “He Googled you 500,000 times” through the Tubes or whatever. The Judge had identified himself, earlier, as being “of the Royal Typewriter Generation,” and at another point, when confronted with the voluminous material from both sides, asked “don’t people have jobs, who reads this stuff?”

 

The judges lack of knowledge regarding social media is important given that Kimberlin’s main argument contended that Walker was tweeting about him routinely — something he claimed was in violation of the peace order

    I hope there are attorneys taking this case on a fast track appeal. I have never heard of a restraining order that outlawed freedom of speech. The only precedent for this is in family law cases where judges attempted to silence individuals that were criticizing the guardian ad litem, social workers or the judge itself in blogs. None of these “gag” orders were upheld on appeal.

      Actually, no. I’ve changed my mind after going back and ploughing through the whole thing again.

      It is a murky and twisted tale, but it all seems to be there. This guy (Kimberlin) is clearly a master manipulator and sociopath. You could try to read the whole thing at once so that you can hold all the threads in your head.

      There still seem to be some missing pieces, but it all appears to fit together.

      There is no rule of law. The president doesn’t abide by it, the DOJ doesn’t abide by it. All the way down to police enforcement. People are literally getting away with murder and attempted murder. If you report something, now you get arrested instead of the bad guy. Where do you turn for justice?       I initially fell into this trap of thinking something malicious needed to be done to stop Kimberlin; however, after reading a lot of y‘all’s responses, I realize that taking the law into your own hands is NOT the answer!! Why is everyone advocating anarchy by collapsing the system? Why is everyone so stoked to grab their guns and march to Washington, DC? I side with conservatives on most issues but I can see why the Left ridicules the Right for “clinging to their guns and Bibles.” The last thing our country needs right now is more violence!! The Left ditches their own when they become a liability, so I would say expose Brett Kimberlin in a legal way!

    Since when does a restraining order have anything to do with speech. That’s amazing. It does not say in the article that the blogger made the death threats, so I am assuming that the alleged death threats were allegedly made by the readers of the blog. Since this article is based on what happened with his blog are we actually acting in conjunction with Aaron Walker and could we be arrested too? I think that my head just exploded, this is insanity. If this actually sticks then free speech is gone. This is seriously messed up.

      1. When you go thru screening before boarding a plane they make you turn on you PC to ensure that it is a PC & not a bomb

      2. Given this guys history, it is not unreasonable to assume that he might do it again.

      3. Kimberlin was probably acting strange to entice a person to overreact. But again given his history, who would blame a person for being suspicious of Kimberlin unless you are a leftist.

      As near as I can tell, Kimberlin may be violating Maryland law as we speak. I searched the Maryland Secretary of State website for listed charities(501c3). I could not find a listing for Kimberlin’s 501c3 Justice Through Music Project. The 501c3 that reportedly gets some funding from George Soros, Barbara Striesand and the Heinz Foundation(i.e. Teresa Kerry, whose husband served in Vietnam)

    Some individuals fail to recognize that even the most patient person has a point of no return. Everyone has an edge and it differs from person to person. Kimberlin won’t get “taken care of” by someone who threatens him but rather by someone who loves or is a good friend or acquaintance of someone Kimberlin screwed over. His days are numbered.

    Legally, is there a way to send Kimberlin back to prison? He’s been able to take down two lawyers already, so why can’t anyone nail down some charge against him that sticks in court? I know the left protect their own but they also eat their own when one really slips up. What can be done?

    Frightening, increasing lawlessness, injustice…. “good is evil”, “evil is good” liberal Progressive agenda and beliefs spreading their destructive ideology like cancer…..even judges of like mind everywhere. And that’s not even mentioning the Muslim Brotherhood – Islam also spreading, infiltrated everywhere like them with goals of taking us over and uniting with them to accomplish it.

    How does the victim (Walker) become the terrorist? Looks like the presiding judge is crooked. This is what is so disgusting (and scary) in this country: it’s getting harder and harder to get an impartial hearing in court-which is the last resort of law-abiding citizens.

      Nothing contrary about it. Libertarians liberated this country using not so passive means. There is a proper time for violence, and this is one of those cases where violence is good fit. Justice is getting what you deserve. It can be a good thing or a bad thing, depending on what it is you have earned.

      @ Hidden, I almost want to agree with you but once people start revolting against authority, then all of the extremists come out and turn what was deemed a “good” thing into a nightmare/anarchy/chaos. I’m sure a lot of Occupy Wall Street had legitimate complaints until they staged mass protests, which attracted all of the radicals to use this in a destructive way.
