Hawaii Considers Banning Toy Gun Sales to Minors

When squirt guns are outlawed, will only outlaws have squirt guns?
Hawaii is currently considering adding some fairly serious restrictions on the sale of toy guns. TOY GUNS… like cap guns, squirt guns, pop guns, etc. From HB number 432;
RELATING TO TOY GUNS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 709, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
“§709- Sale of toy guns to minors prohibited. (1) It shall be unlawful to sell, attempt to sell, or offer for sale a toy gun to a minor under eighteen years of age; provided that it shall be an affirmative defense to any prosecution that the:
(a) Purchaser falsely represented the purchaser‘s age by producing a driver’s license bearing a photograph of the licensee, a state identification card, or similar card purporting to be a valid identification card indicating that the purchaser was eighteen years of age or older;
(b) Appearance of the purchaser was such that an ordinary prudent person would believe the purchaser to be eighteen years of age or older; and
(c) Sale was made in good faith relying upon the indicators of age in paragraphs (a) and (b).
(2) Any person who violates this section shall be subject to a fine of not more than $2,000, imprisonment of not more than ninety days, or both.”
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
The proposed legislation is reported to have come from Democrat Scott K. Saiki, who has been represented the state’s 22nd district since 1996. Representative Saiki apparently believes that selling a toy gun to anyone under the age of 18 is a crime that would require a fine up to $2000, 90 days in jail or BOTH.
Requests for any data supporting the rationale for this proposed legislation have been made to Saiki’s office. Are squirt guns and toy guns considered to be “gateway weapons” that lead to more gun use later in life? This information might be helpful to other states considering such monitoring and legislating of toy sales. Seriously.

I am brought back to my senior year of high school, where my fellow classmates and I had a game of water pistols going on. We carried water pistols and squirted each other in a way that wouldn’t get our water guns taken away. Harmless fun. Many laughs, and great memories 21 years later. This game now would have gotten us all kicked out of school.
When will people be able to use common sense and their minds when making decisions? Government is taking over what we can and cannot do. It reminds me of what our Founding Fathers fought for.

I’ll never live in Hawaii and if they want those ridiculous laws, feel free. When they start losing residence and tax revenue, they’ll rethink their position. If people are still willing to live there and give their tax dollars to their state legislature, they’ll continue to take their rights away.
I’m all for states rights, I thought most of you were too?

State’s rights apply to an extent, but they do not mean that, say, Idaho can vote to become a Soviet dictatorship and start killing “capitalists” immediately, or that New York can ban freedom of assembly, or that Ohio can declare that soldiers by golly CAN be quartered in your home without your consent. There are limits, which is the whole reason behind the 14th amendment.
Where state’s rights come in is working under the umbrella of commonly understood constitutional restraint. You can legislate that your state will refuse an unconstitutional federal mandate, for example, or you can legislate that your state will not enforce invalid Federal laws (war on drugs, for example), or that your state will sell alcohol to 16 year olds, or not have seat belt laws, nor helmet laws, and so on.

However, we are beyond a day-to-day escalation of countless attacks on our Western European Civilization. Hell, Western European Civilization (remember the 3 hour course back in College by that name?) is all but a distant memory in Western Europe. In this country of ours and even in TX we are being conditioned to believe the absurd and to discount the clearly obvious threats on our horizon. My three-days-per-week voluntary/charitable contribution of skill and time at a major trauma center leaves me as befuddled lately as did the three weeks of emergency medicine for Katrina refugees in the old Astrodome. That is a story in itself – how people would donate and pass out food and drink and clothes to those refugees from NOLA only to see most of those souls take a bite, a sip, or whatever and then throw the remainder on the floor and then complain that the floor is messy. I had hoped that what I witnessed there was an abberation that reflected the stress reaction and the trauma caused by the hurricane. Actually, it was induced because we have made those still-human beings into willing takers who give nothing – not even appreciation. I was okay as long as I still believed that the Katrina experience was “special.” Now I see our Nation adopting that behavior pattern – and the world. Ignorant sheep with no though in their head except their next high, their next orgasm, or their next handout. God help us.

Last time I looked, there are thousands of military members here. Doesn’t the military use guns? Is the socialist ban going after them next? I live here and can’t wait to get off of this island of misfits but you might have figured that out already.

Posted on February 3, 2011 at 5:13pmmarried to a 80% Hawaiian girl….her whole family first can’t believe she married a Holie….second can’t understand when she talks about money issues since 90% of her relatives have been on welfare since they had their first kid at 14 or got a 14 year old girl in the neighborhood pregnant when they were 19-20…(this happens a lot in Hawaii, the older brah’s -losers that sit and smoke out, surf, and drink roam the high schools and middle schools hitting on the hot tita’s)…many are on their third or fourth marriage…if they are married or ever did…and have multiple kids from multiple people…all staying in Auntie’s house (auntie is not always a relative…just an older woman in the family or a long time family friend) and all waiting for their next welfare check…
watch Dog the Bounty Hunter when he is in Hawaii and goes over to the Big Island or to the leeward side of Oahu – Wainei/Makaha/Nanikuli side….see how they live…not all are like that but a large portion are….it isn’t just TV making it look that bad…it really is like that…scary and sad really… generation upon generation that just sit around, jobless, on welfare, and proud of it….

The even had Indian Guides when we were kids and we didn’t take field trips to massacre Mahwah or Ramsey Indians with bows and arrows (we lived in Upper saddle river Jersey then, all towns named for Indian tribes up there)
We always had real guns in the home and didn’t turn into crack smoking welfare hounds with jobs and no future doing life sentences with free lawyers fighting for our lives across the country either!!!
That just happens in the urban areas where they seem to have a problem discerning between reality and Hollywood thanks to zero parenting and rappers who SHOULD BE BANNED and aren’t!!!!
