Under Pressure From ACLU, Hawaii Senate Ends Daily Prayer

HONOLULU (AP) — Fearing a possible court challenge, Hawaii’s state Senate has voted to silence the daily prayer offered before each session began — making it the first state legislative body in the nation to halt the practice.
A citizen’s complaint had prompted the American Civil Liberties Union last summer to send the Senate a letter noting that its invocations often referenced Jesus Christ, contravening the separation of church and state.
That prompted the state attorney general’s office to advise the Senate that their handling of prayers — by inviting speakers from various religions to preach before every session — wouldn’t survive a likely court challenge, said Democratic Majority Leader Brickwood Galuteria.
“Above all, our responsibility is to adhere to the Constitution,” Galuteria said after Thursday’s vote to halt the daily blessings.
A three-member Senate committee formed to evaluate the issue recommended allowing nonsectarian, nonpolitical invocations that avoided references to deities, but the legislative body decided to do away with prayers altogether rather than constrain them.
“They (the ACLU) continue to threaten governments with lawsuits to try to force them into capitulating to their view of society,” said Brett Harvey, an attorney for the Alliance Defense Fund, made up of Christian lawyers to defend free faith speech. “Governments should take a stand for this cherished historical practice.”
While every state legislature prays to bless their public work, methods vary widely across the country. Some states pay a chaplain, others require remarks be submitted in advance and many like Hawaii invite members of the community to speak on any topic of their choosing.
The Indiana House temporarily halted opening prayers because of an ACLU lawsuit, but prayers returned in 2008 after a federal appeals court overturned a lower court’s decision.
The U.S. Supreme Court has ruled that legislative prayers are permissible in some circumstances, but the court hasn’t considered the issue since 1983. ACLU of Hawaii Legal Director Lois Perrin said the U.S. Supreme Court has interpreted the First Amendment to mean that the government can’t display a preference for one particular sect or creed.
“The Senate’s action does not conflict, and clearly aims at creating an environment where all will feel welcome regardless of spiritual beliefs,” Perrin said.
Sen. Sam Slom, the only Republican in the 25-member Senate, pleaded for making prayers voluntary rather than eliminating them altogether.
“The Senate must stand for something and not back away when there are challenges by individuals or organizations who make it their point nationally to have this as an objective,” Slom said. “As intelligent as we may be, we can still call on someone higher to help us and guide us.”
A protester who was arrested for disrupting a Senate invocation last April applauded legislators’ action to keep the business of government and religion separate.
“They’re a legal body, they make the laws, and they ought to follow them,” said Mitch Kahle, founder of Hawaii Citizens for the Separation of State and Church, who would have been a plaintiff in a potential ACLU lawsuit.
Neither the Alliance Defense Fund nor Americans United for the Separation of Church and State knew of any other state legislature that prevents prayers.
The Hawaii House also is considering limiting prayer, but opened with daily invocations as the legislative session began this week. The House will likely continue allowing invocations as long as they don’t mention a specific deity or religion, said Democratic Majority Leader Blake Oshiro.
The Senate’s last prayer was a Hawaiian-language invocation Wednesday.

In this case and point, Hawaii is a state of pure wimps. Looks like they all have sun stroke and forgot how to read the U.S. Constitution or at least historical background on the separation issue!!!!
The phrase separation of church and state (sometimes “wall of separation between church and state”), attributed to Thomas Jefferson and others, and since quoted by the Supreme Court of the United States, tries to fashion an understanding of the intent and function of the Establishment Clause of the First Amendment to the Constitution of the United States.
The First Amendment reads “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof ….”, while Article VI specifies that “no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.” The modern concept of a wholly secular government is sometimes credited to the writings of English philosopher John Locke, but the phrase “separation of church and state” in this context is generally traced to an January 1802 letter by Thomas Jefferson, addressed to the Danbury, Connecticut, Baptist Association, and published in a Massachusetts newspaper. Echoing the language of the founder of the first Baptist church in America, Roger Williams—who had written in 1644 of “[A] hedge or wall of separation between the garden of the church and the wilderness of the world, God hath ever broke down the wall itself, removed the candlestick, and made his garden a wilderness.”—,
Jefferson wrote, “I contemplate with sovereign reverence that act of the whole American people which declared that their legislature should ‘make no law respecting an establishment of religion, or prohibiting the free exercise thereof,’ thus building a wall of separation between Church & State”.
What is most amazing is where the jackasses in the Supreme Court dare to interpret the intent of Jefferson’s words and ignore the historical context of their origination.
Although Jefferson is clearly speaking to the establishment of a “state religion” like the Church of England; Jefferson’s metaphor of a wall of separation has been cited repeatedly by the U.S. Supreme Court. In its 1879 Reynolds v. United States decision, the court allowed that Jefferson’s comments “may be accepted almost as an authoritative declaration of the scope and effect of the [First] Amendment.” In the 1947 Everson v. Board of Education decision, Justice Hugo Black wrote, “In the words of Thomas Jefferson, the clause against establishment of religion by law was intended to erect a wall of separation between church and state.” However, the Court has not always interpreted the constitutional principle as meaning absolute separation of government from all things religious.
Hawaii is just ripe for a nice big earthquake and a volcanic bonfire of the biggest kind. Marshmallows anyone?

SNOW, look on the bright side, you were actually given a personal sense of purpose by the “counterfeiter”. Judging by how much time you have invested in the anonymous aspect of the Blaze, to actually have a real (albeit still virtual) “personal” cause in which to engage and for which to “fight” must have been incredibly fulfilling for you. Imagine how many even more fulfilling causes and interactions await you away from your computer in the actual, real, non-virtual world?
I wish to thank you for the demonstration of pure sarcastic whit as sharp as a dulled tree stump. It is for the exact reasoning of your ability to make said comment, and mine along with others to have the freedom to agree and disagree that the ACLU should be watching for – the attempts at the supression of the rights and freedoms we enjoy as Americans.
The ACLU should be a watch dog, not a hunter seeking to cull the heard into their own idea of what the rights of all people must be; when the individual is endangered by unconstitutional laws or charges then they should step up and go to bat for them.
Otherwise, watch and wait on guard duty.

I, however, believe as long as there is even ONE Christian in His favor, He will listen, and heal our nation. There, of course, are many Christians in America, so I have no doubt He will listen, and pull the curtain down on the evil doers and expose them for what they are. I will not give up! I will not stop contacting my reps in Washington, and my state of my concerns on the issues at hand. We WILL prevail. We must pray, and pray often. Amend. to the Federal Constitution to put up such a barrier, as the 1st Amend. specifically says “**Congress** shall make no law…” State legislatures are not bound by it.
As a note, I do support the notion of a “separation of church and state”, just not in the same way the ACLU does.

(yes) Are state officials the ones who create the rules regarding chamber proceedings? (yes) Are the meetings open to the public? (yes) Does the 14th amendment extend federal stautes to the states as well? (yes) From where I sit, prayer is a religious exercise being conducted by our government officials, on tax payer time. I have no objections to any elected official professing their religious beliefs, but as they represent a WIDE variety of constituents, it seems like the 1st amendment applies directly to this issue of prayer of a particular faith while conducting official business. I do think this is a violation, but I would like to hear what everyone else thinks.

I read the article again and saw the prayer they offered was in the native Hawaiian language.

If we lose the fact that the heart of morality is the acknowledgement that morality indeed, civilization itself must be predicated on the belief in God. Unless we recognize a Higher Power to whom we are responsible to and who observes and knows our actions, we will not transcend the selfishness of our character and the subjectivity of our intellect. If man himself is the final arbiter of right and wrong, then “right”, for him or her, will be what they desire, regardless of its consequences to everyone else.
This is the heart of the problem! Our so called education system has been socially and culturally reengineering society through our youth. They teach that there is no absolute right or wrong and that morals are just constructs of society. (In other words whatever academia tells you they are!) They have pushed themselves and their agendas on the American people, with no care as to the consequences. They arrogantly believe their intellect superior to those who have faith in our Creator and the moral code written in the Bible.
All you have to do is look at the culture of the 50’s when Biblical morals and ethics we held dear where still taught in our schools. Now compare our society and culture today with the academic version of ethics and morals that our youth have been indoctrinated into. We are now reaping what has been sown through the social reengineering perpetrated by the public education system.

With 1 Republican in the senate it is not surprising that they would not stand up to ACLU intimidation. The ACLU should be labeled an enemy of America and the lawyers there should be tried for treason and sh%&. Oh, thats right, can”t say that. Shows lack of courage and cowardliness on the part of these “Christian” congress people or whatever faith these congress peoples from Hawaii claim to be. They are allowing a non religious group to dictate their faith and where they practice it. Thats actually violates the first amendment and if they had any balls and attorneys with logical wit they would win the case and help put the ACLU in their place. Cowards.

The ACLU has defended conservative stances as well (religion including Christianity, and gun ownership). I am aware that they don’t always take the popular side, but shouldn’t they be applauded for trying to make sure everyone is treated fairly?

Always against Christianity, but they do fight to support Islamic causes, women wearing full face covering for a drivers license photos for example. The ACLU is an enemy of America.
