WNYW-TV, New York City’s local FOX affiliate (also known as FOX 5), is finding itself in the midst of an impending legal battle with an ice cream chain. The company is suing the station over a report it aired by consumer watchdog Arnold Diaz. TVSpy has more:
In May, Diaz targeted New York locations of the D’Lites ice cream chain for his popular “Shame, Shame, Shame” series and found that the stores were selling servings of ice cream that often contained four times the amount of calories and almost 10 times the amount of sugar as was listed on menu.
According to Reuters, Matthew Prince, the owner of the Long Island ice cream stores (part of a larger national chain), claims that the laboratory Diaz used was testing unfrozen and concentrated ice cream mix. Prince claims that the discrepancies in what is advertised versus what Diaz found are a result of this difference. The actual ice cream, he contends, is diluted. Prince says he has results from another lab that back his contentions.
In the lawsuit, News Corp (the parent company of the station and of FOX News Network, among other major media outlets) and FOX 5 are named. In it, Prince alleges that the broadcasters “knowingly ignored” the corrected findings so that they could produce a good — and scandalous — news story. As a result, Prince says business has taken a dive.
So far, the station is standing by Diaz’s story. Watch the explosive report that started the entire legal debacle, below:

Posted on June 23, 2011 at 12:34amThe truth is an absolute defense against any charge of slander or libel. Get a neutral third party to do a secret shopper buy of the same and other ice creams and then have them independently tested.

Posted on June 22, 2011 at 11:52pmD’Lites was also a “healthy” fast food chain in the 80′s. They had great hamburgers and frozen yougurt! And I always got sparkling Apple Juice instead of Cokes there. I wonder if this new company is infringing on any trademarks?

Posted on June 22, 2011 at 11:37pmI checked for more information on this story on Google. I found a link to a story on the “Puffington Host.” I can’t believe how moronic many of those people are. People kept mentioning that the laboratory used by Fox had tested the concentrated stuff, not the stuff you actually get from the ice cream place. No where have I seen that in the video. And then they keep saying that Fox‘s lab did the tests a second time and achieved results that affirmed the claims of D’Lites. Bunch of bull. The video says that actual ice cream from the shop was tested, not concentrate. How in blazes could Fox get the concentrate? Baloney. Prince made various claims that were reported on the “Puffington Host.”

Posted on June 22, 2011 at 10:19pmI watched the entire video and the potions are “served” way over sized and a 40 gram serving fills about 1/2 the small cup and does not overflow like served to the customer. So in essence, its the same ice cream only smaller portions. OHH yea they charge you much more. The brother is a PUNK! and needs someone to to open up a can of whoop-ass on that guy.

Posted on June 23, 2011 at 2:19amIce cream doesn’t make you fat. Ice cream is made from milk which contains healthy levels of essential vitamin, minerals, amino acids, and proteins. Most ice cream now isn’t even made from whole milk, so much of the fat is already removed. I eat more ice cream than anyone should and I’m not fat. The trick is to not sit on the couch all day. Go move around and get some exercise, maybe actually do some work. The Marine thing couldn’t hurt either.
Another bit of FYI, whey protein is the part of milk leftover from making cheese. And we all know what whey protein is used for. That same protein is in all milk products, except cheese.

and how and from where did Diaz procure the unfrozen and concentrated ice-cream mix ? Who sells that ?
They sell actual ice cream at their stores, and that is what got tested.

If you click on the small triangle in right hand corner of the ad, you’ll get a notice like this:
Report Post »“This ad has been matched to your interests. It was selected for you based on your browsing activity.”
If you clear your “recent history” files, you’ll get new ads. :-)

I think common sense would say that if you run up to me and bump me with your chest, that would be touching in a very disrespectful way and a punch to the face, or at least a hard push away is justified…..
As for the story….yeah yeah technically the stats are off…..but these people were just trying to “Hook a brotha up” with more than they paid for…at least that is what i got out of it….i was more intrigued with the placement of hands argument….

Posted on June 23, 2011 at 2:11amFor all of you who don’t understand ice cream, here is a little info. Ice cream when frozen contains an amount of air inside of it to make it light and airy. When you measure out a half cup of ice cream when frozen it is actually the half cup. When the idiots let it melt and release all the air, the caloric values go up because more ice cream fits in the half cup due to the loss of air. It also looks as though the guys working there were being nice and filling the cups up like a dairy queen would. How could anyone but a fat cow trying to lose weight eating ice cream be mad that they got more ice cream than they paid for?
Shame on this fox affiliate. Shame shame shame.
