‘Here’s How Romney Might Have Paid No Taxes’: Read How U.S. News Just Tried to Defend Reid’s Claim

Sen. Harry “They’re Putting Mercury in the Water” Reid (D-NV) last Tuesday accused Republican presidential hopeful Mitt Romney of dodging his taxes for 10 years.
As mentioned yesterday on TheBlaze, the shocked reaction to Reid’s unfounded accusation has been somewhat bipartisan, with members on both sides of the aisle suggesting the Nevada senator to offer up something a bit more substantial than “the word’s out.” However, just because we said the reaction has been relatively bipartisan, it doesn’t mean some people aren‘t rushing to Reid’s defense. And by “rushing to Reid’s defense,” we mean “willing to make his accusation seem plausible.”
From U.S. News and World Report, we bring you this: “Here’s How Mitt Romney Might Have Paid No Taxes.” Wait, really? Shouldn’t we wait until either a) Romney releases his taxes or b) Reid elaborates on his super-secret anonymous source?
“Did he or didn’t he? This is the oddly intriguing question swirling around Mitt Romney as critics contend that he may have paid no income tax for some portion of the last 10 years,” writes U.S. News’ Rick Newman.
And by “critics,” he means Senators Chuck Schumer (D-NY), Reid, and former adviser to President Bill Clinton Paul Begala.
“If Romney has paid taxes, as he insists, he could clear up the whole controversy by simply releasing several years’ worth of tax returns, beyond the 2010 return and the 2011 estimate he’s already released. But he has refused, and there may be good reason for that,” Newman adds.
If Romney has nothing to hide, as the insinuation goes, then he wouldn’t mind releasing his returns. But Romney refuses. Therefore, he must be guilty of something.
“I wouldn’t be surprised if he paid nearly zero taxes in 2008 and 2009,” Brad Badertscher, an accounting professor at the University of Notre Dame, told U.S. News. “It’s going to look bad no matter what he does.”
The report goes on to speculate how Romney might have used totally legal means to avoid a higher tax burden.
“Theories about Romney’s tax strategy tend to focus on offshore investment vehicles and secretive accounts, but basic investing and accounting scenarios could easily explain a low tax bill,” Newman writes.
“The clue comes in Schedule D of his 2010 return, in which he claimed a $4.8 million loss carried over from prior years. That helped reduce his tax bill for 2010, in which he paid $3 million in taxes on $21.7 million of income, for an effective tax rate of 13.9 percent,” he adds.
It continues:
The carryover means that Romney probably claimed a much bigger loss a year or two earlier, which could easily have pushed his tax rate for 2008 or 2009 down to the low single digits.
[...]
During bad years, wealthy investors often use a legal strategy called “tax harvesting” in which they sell weak investments at a loss, which they can use to offset the tax they’d need to pay on gains from better-performing investments. The loss can be carried forward, to help lower the tax bill in later years when investments might have done better.
[...]
In 2010, all of Romney’s income came from investments as capital gains, dividends and interest. He claimed no income from wages or salaries. So his maximum tax rate would have topped out at around 15 percent—the rate that applies to most investment income. The loss carryover, sizeable charitable donations and other deductions helped shave his effective rate to 13.9 percent.
About half of Romney’s income in 2010 came from capital gains. If that were zeroed out in 2008, say, on account of the crumbling economy, it could have cut his income for that year to $10 million or less, with a huge deduction for a capital loss. Combined with the same sorts of charitable donations and other deductions he claimed in 2010, that could have pushed his tax burden close to zero. If Romney’s losses were big enough in 2008, he could have carried a portion of the loss forward into 2009, helping lower his taxes then, too. The fact that the loss carryover appeared on his 2010 return suggests that may well have happened.
If you’re confused, you’re not the only one. Wasn’t it the point of the article to explain how Romney might have dodged taxes, not how clever investors lower their tax burden? The article seems to have done the latter, not the former.
So low tax rate or not, we’re not entirely sure how this translates into not paying taxes for 10 years. See, when a guy says someone hasn’t paid taxes for 10 years, we assume he means he has not paid taxes for 10 years. Where is the communication breakdown coming from?

What does this mean? Only that you are wasting your time, and with Appelate Courts already standing behind and saying gays cannot under the Constitution, specifically 14th Amendment, Equal Protection Clause, be denied rights of all taxpayers.
It’s only a matter of time when gay marriage will be as legal here as in Canada, UK, Spain and elsewhere. Of course, it is already legal in a number of US states, progressive ones, of course.
You have every right to your opinion, but Jesus would say, as Bible clearly indicates he did, Love your neighbor, Do unto others. Give it some thought.
You are likely unaccostomed to losing, but you can’t really think going against the courts, the billionaires and millionaires, Prime Minister Cameron and President Obama that in this instance you have even a small chance of being on the winning side. From 8000 at the end of the cheney/bush reign of error to over 13000 now: historic creation of wealth for Americans who own stocks, funds, 401k, annuities and pensions? Never before under any prez such a dramatic rise in wealth for the private sector. Surely no one wants a repeat of the cheney/bush reign of error, huge deficits/debt. BILL CLINTON GAVE BUSH A SURPLUS AND BUSH GAVE OBAMA A TRILLION DOLLAR DEFICITS. So, pubs can’t govern, we know that. You lost lots of money under bush if you owned stocks, funds, 401k, annuities, surely you don’t want to return to THOSE BAD OLD DAYS. President Obama got bin laden, bush couldn’t. Got us out of iraq where bush never should have taken the country: over 5000 dead and over 30000 wounded, many badly, amputations, head wounds. So what does this data tell us?
For starters, given that all of these two-term presidents experienced better job growth without the assistance of the massive tax cuts for the wealthy provided by President George W. Bush, it certainly seems fair to note that a certain amount of job growth would have come during the years George W. was president—whether he had given us the tax cuts or not.
And if one feels the need to argue that tax cuts are the great driver of employment, the comparative numbers presented make it shockingly clear that these tax benefits to the wealthy do little to nothing to even keep up with the employment increases under all of the other two term presidents of the modern era, with the exception of poor old Ike.

Posted on August 7, 2012 at 5:37pmLtDan – I have finally figured out why this is a huge problem for the conservatives.
The hallmark of any conservative administration’s tax and budget reforms would be to require that the 48% of Americans who are now tax exempt from paying income tax because of their low-income status need to start paying it. But if conservatives are defending the very wealthy Romney’s legal right to pay little to no taxes through the use of loopholes, and at the same time do not defend the many poor people in this country’s legal right to pay little to no income taxes through use of their tax exempt status, than it will be nearly impossible for a Romney Administration to ever produce an equitable tax code or a conservative budget. You can’t expect Americans to go along with your “equitable” tax and budget ideas once it suites you and you are in power while you once defended the wealthy’s right to not pay income tax but not defend a family-of-5-making-under-$40k-a-year’s right to pay none. America wouldn’t stand for it.

Posted on August 8, 2012 at 9:28amCircled – you’re absolutely correct. Romney likes how the tax codes benefit him. And the conservatives don‘t want him to release his tax returns because if they show he hasn’t paid any tax due to loopholes, they’ll still have to support him if they want him to win. Then, after the election, they‘ll have a real problem getting things changed in the tax code and with introducing a conservative budget since during the campaign they defended his right to not legally pay income tax while not defending those in poverty’s right to not legally pay income tax.

Posted on August 7, 2012 at 4:06pmI may be wrong and I am not an accountant or tax attorney but the way I understand this it is simple math. If I make two investments of one million dollars each. In the end one goes down by half a million and the other goes up a half a million, how much have I gained in the end? Zero. If there are limits as to how much you can write off each year that are less than what you lost, why would it be fair to ignor the remaining loss? I would be paying taxes on the portion that was left after what was able to be written off. Or you could ask if one investment made $500,000 and one lost $250,000 your net gain is $250,000 not the $500,000.

Posted on August 7, 2012 at 3:58pmit’s all speculation (what other choice is there), but the article shows how it would have been possible to pay zero or next to zero for a year or more. if that is true, it highlights the fact that wealthy investment class individuals don’t necessarily pay as high a percentage as ordinary workers earning a wage.
the Obama campaign thinks this is not fair, and it’s a point worth discussing. Progressives favor a progressive tax system where those making higher wages pay higher percentages. Conservatives favor a flat tax or regressive tax policy. i’m not an economist, but it seems that since our tax policy has become less progressive over time (income taxes before Reagan were over 80%), things have gotten worse for ordinary Americans.
however, rural America has accepted their lot in life. they are poor and they know they will stay this way. at least many who live in the ghetto want to get out of the ghetto. they favor Conservative policy makers not for their economic schemes, but for their social agendas. when you believe that life on earth is temporary while an eternal afterlife awaits, who cares if you suffer economic damage for the time being. for these voters it’s more important to vote conscience so that Bible believing Christians can feel that they are saving souls here on Earth. and the politicians KNOW it, and pander to this base, and take advantage of your piety.

Posted on August 7, 2012 at 3:58pmI am certain that the powers-that-be in the current administration know that some of those years in the past 10 years Romney paid little to no taxes. I am certain also that it’s perfectly legal as well. Romney just did what anyone would do to pay as little taxes as possible.
There is likely a year where he deferred his taxes to the next year and paid the penalties for it because his money was making much more money in some investment that it would in paying the penalties.
The problem is this. The administration isn’t trying to find Romney doing something illegal, they are trying to convince Joe Public how unfair it is to be rich. They’ll take a year he deferred his tax or a year where he paid very little in taxes and compare it some struggling worker and say. “Is it right that Romney a multimillionaire paid less in taxes than this guy?” (Cuts to a scene of some hard working guy with a sad face and a dirty hardhat).
Since most of the public doesn’t understand capitol gains, and investing, nor deferring taxes to the next year, this tactic will be highly effective and be the icing on the cake for their “Rich People Suck, and Don’t pay their fair share meme.”
In about a month or so, after continued refusual to show his tax returns, an unknown “patriot of the liberal cause” who works for the IRS will release his tax returns anonomously, or some hacker group.

It’s less hassle if a hacker group releases it anonymously and fades away into the background.
