Here‘s What You Need to Know About the Gov’t Possibly Mandating Vehicle ‘Black Boxes’

The government has been inching along a mandate requiring a little black box in all vehicles forward for years. In fact, most cars already have them voluntarily. But recently, the Senate has passed a bill (S.1813) that would make it mandatory for all new cars by 2015 to come with a system that would record information from the vehicle in the moments before and after an accident.
More technically known as MAP-21 (Moving Ahead for Progress in the 21st Century Act), the bill has several provisions affecting transportation, but it’s Section 31406 — “Vehicle Event Data Recorders” — that has those fearful of Big Brother overstepping its bounds. The section states that, if passed, the law would require new vehicles starting in 2015 to be equipped with black box-like devices that would “capture and store data related to motor vehicle safety covering a reasonable time period before, during, and after a motor vehicle crash or airbag deployment, including a rollover.”
The bill states that all data on the black boxes would be property of the vehicle owner or lessee. If data from the device needed to be obtained for any reason, the owner would have to provide consent or a court order would have to be presented for it. It does state that in an emergency situation, data may be retrieved without explicit consent.
IEEE Spectrum states that 85 percent of vehicles already come with black boxes, according to the National Highway Transportation and Safety Administrion, and speculates that the average driver in an accident has “no idea [... the] data stored in the box details how the car was being driven in the moments before impact.” And, although still not mandatory, IEEE Spectrum reports NHTSA has guidelines for cars with black boxes that must be met by 2013. The guidelines include variables that must be measured such as speed; position of the gas pedal; if the brakes were pressed; seat belt usage; and the time it took for airbags to deploy.
Here‘s an example showing how cars’ black boxes are already being used. Earlier this year, the data recorder from Massachusetts Lt. Gov. Timothy Murray revealed he was speeding in a Nov. 2011 accident that totaled his vehicle. Yahoo! News reported the data also showed Murray was not wearing a seat belt. This case, which landed Murray with a fine, had some calling for tougher regulations for how authorities can obtain data from black boxes. Yahoo reports:
But most states have no such rules, and the data can often be easily accessed after a crash by insurers or investigators. There’s also no way to shut off data recording, which safety systems rely on to decide when to deploy an air bag or take other measures.
Last year, USA Today reported 13 states had established laws to limit access to information stored on these devices. But even if consent were required, it’s not available in all instances, as the recently passed Senate bill acknowledges. USA Today provides an example:
Getting that data is easier on some vehicles than others, but a Nashville company, VCE Inc., has been at the forefront of using information from the recorders to reconstruct traffic accidents since the introduction of the devices in the mid-1990s.
“We have been involved from the start and were among the first ones to begin downloading the data from these recorders for the accident reconstructions we do for attorneys and insurance companies,” VCI Vice President Todd Hutchison said.
“We typically get permission from the owner of the vehicle, but that’s not necessarily who owned it at the time of the accident,” he pointed out. “If the insurance company has bought the salvaged vehicle, they can give us permission.”
The National Motorists Association has taken the stance that “there is no rational or scientific need nor justification to equip tens of millions of vehicles on a perpetual basis with black boxes.” It states:
While denials abound there is good reason to believe that the promotion of universal black box installation in new vehicles has more to do with regulatory, enforcement, judicial, and corporate economic interests; all at the expense of vehicle owners who are forced to pay for and retain this form of self-surveillance.
The NMA does not object to safety research that involves the use of black boxes, as long as the participants are informed and willing and they are allowed to opt out of research project without negative consequences. As noted, such research can be reliably conducted with thousands of willing participants, versus millions of uninformed conscripts.
Although privacy advocates may consider black box systems stepping on the toes of personal privacy, a recent study by a UK car insurance provider saw 20 percent fewer accidents among young drivers who knew they had the devices in the car. The Guardian has more:
Telematics, or “black box” insurance, involves in-car tracking equipment to monitor driving behaviour such as braking and acceleration, cornering, speed and what time of day the car is driven. The data is then used to calculate insurance premiums: the better the driving, the lower the premium.
Co-operative Insurance has analysed the driving habits of 10,000 telematics insurance customers aged 17 to 25 across the UK, finding that they were 20% less likely to have a crash than those with standard insurance. Telematics customers have less serious accidents, with a typical claim 30% less than ordinary customers.
As for the potential for mandating black boxes in vehicles by 2015, the next step is for the bill to pass in the House. According to the Washington Post last month, the House rejected the bill with a procedural vote but passed an extension to continue funding through September.

More than just black box devices are on the line with the bill, leading some to be upset at yet another extension. According to Transportation for America, the bill includes funding provisions for transportation and infrastructure projects.
Other measures in the bill some consider “Big Brother” include provisions to develop technology to “detect drug-impaired” drivers and development of specifications/testing for similar devices that measure alcohol concentration in the body while in the car.

There is a reason why we only have a select few brands of vehicle here in the US. For every model of car that is produced, the gov’t requires thousands of hours of safety testing and ridiculous requirements like catalytic converters, ABS, TCS, etc. All of which are unnecessary, wasteful, and anti-capitalist. I’d rather just drive a rusted out old nova or pickup than have to drive a 4,000 pound data recorder on wheels.

Private insurers will either insure you or they won;t based on whether you have these devices.
Many people involved in an auto accident will not call it an accident or fate. they will have the police retrieve the data from their vehicle & use the ion formation in a lawsuit. It won’t he said / she said. It will be measurements by the state police of skid marks, retrieval of data of use or non-use of cell phone data, one side’s statements, the other sides statements & the black box data.
There will less leeway for a defense attorney to lie about what happened or wave their hands & muddy the waters.
It is going to happen via lawsuits or private insurance agencies.

This was a single car crash, but what if it had not been? 2nd time recently a governor or Lt. governor has been purposely speeding by a great deal & breaking the law. Remember Corzine?

Well I didn’t think most if any would agree with me, but it is all good.
I do have some qualms about having such a device on a car & I definitely have a problem with it increasing the price.
That said I think 50% of the parties involved in an accident will be glad they have one. Police can reconstruct accidents using skid marks & stuff, but there is error involved no matter how good the police do their jobs. They can only estimate a cars speed +/- so many mph.

Map-21 also includes a mandate to revoke US Citizen passports who owe the IRS 50k or more. The problem is not trying to collect money from people who owe the IRS, The problem is wreckless spending (Our money not theirs) and giving billions to other countries… all the while our Gov.t is taking away our travel rights essentually making us prisoners as if we are in jail. Posted on April 19, 2012 at 3:23pmI couldn’t agree with you more. But my guess is that they will install this inside the same system that actually controls the engine and all other electronics. Essentially the cars central computer/processor. Unfortunately this means that it won’t be something you can just “unplug”. However, we as a people are rather resourceful….:). If it comes right down to it it’s a matter of letting a few engineers figure out which wires need to be yanked… or which soldier joints need to be broken or bypassed in order to render data recording kaput. Hopefully it will never get passed, but if you’re an electrical engineer maybe you should start looking into this…LOL. Many car manufacturers use the same electronics modules from places like Bosch. I know at one point Ford, Honda and I think VW all were using the same antilock brake control units made at a plant owned at one time by Motorola. This won’t be as easy to muck with….. however once someone figures it out they could probably make a fortune doing the modification. :) Call your congressman or woman though so hopefully it will never get to the point of us having to do this. I‘m sick to death of this big brother crap as I’m sure most of the rest of you are.

Will it be part of vehicle inspection to get your car licensed? Would it be a crime to have a non functioning black box on your car as you drive it, or just to sell it?

My grandfather bought a new Cadillac a few years ago. He was driving around and the engine just shut off; no check engine light, no power loss, just stopped in the middle of the road. The OnStar people called and advised him that his car reported to them that its emissions were higher than normal and they had shut the car down.
He returned it to the dealership that day.

Over 1,000 pounds of the average car is government mandated. The government wants to track your travel, your speed, your driving ability, your fuel efficiency, your emissions; they want to be able to stop the car on demand for any reason at any time.
The free market would make this equipment optional.
“Not driving” is not a free market answer to this. Most people have to drive to actually work, get food, perform basic life duties.

During a thunderstorm, 10 people died from lightning strikes while holding umbrellas. Therefore “drive-in-movies” caused people to die and since people no longer drove their cars…well, two rights equal zero. I don’t like that over-used word “right” so…two priviledges equal zero. That way they can tax you per mile, find out your driving habits, who you drive with, record your conversations, etc etc etc.
Remember when TSA was just for airports? Now its “VIPR Teams” on highways and “Bus Safe” programs looking in peoples‘ purses and asking them why they’re on the bus. Now its black boxes in cars. Just more control. Gubmint is not content to just leave the average American alone. Don’t want to fly? OK we’ll put tabs on your car.
Heck I almost forgot to mention them using drones over America.
Time to choose sides folks. Time to decide how far you’ll go.

Posted on April 19, 2012 at 2:21pmGod has allowed us to be here at this time in history. I prayed that Obama would not get into office. When he did, I had questions about the voters in this country. As time passed, I prayed & as in my life, peaks & valleys & thought there has to be a reason. Pres. Obama has, like that young lady in the audience said, (A Specter meeting), “you woke-up a sleeping giant”. Whow…this admin. has done about 70% worth of damage but we woke-up. More & more I feel Mitt Romney is going to do well. I agree with many that say it will be a close election so we must be very vigilant as far as fraud that will be everywhere. I don’t trust another country monitoring the vote numbers. Whose bright-idea was that? If it was Pres. Bush, then guess we deserve a $60 light bulb! (he did that to us not Obama)
Report Post »It is time for the other 2 to get out of the running. No chance to win. We’ll save thousands of $ & Newt can rub-noses with a penguin on his own nickel! Mitt is the man we need to get into office. I support him 100%…our lives depend on this election.
I hope to live long enough to see another Rep.president in office & watch “the young-guns” take control of D.C. & secure this nation for their children! Shout-out to Rubio & Ryan!

Have a little faith that God will step in and give us all a hand where we need it. By laying down and being completely defeatist about it you show poor character, a low set of standards and that you’re being a total wussy. Please cease and desist such behavior. This country wasn’t founded by QUITTERS….. stop acting like a liberal and get on your feet and knees when needed. We all play a part in this. The kind of attitude you’re currently exhibiting is what got us all into this position. It will not get us out. Live and Fight for what’s right regardless of how much time you think you may or may not have left. Make it count as you may end up being with us longer than you think.
