Herman Cain Speaks Out: Sexual Harassment Claims Are ‘Baseless’ & ‘False’

Negative press may eclipse GOP presidential candidate Herman Cain’s surge in the polls. The successful businessman is pushing back against allegations that he sexually harassed female staffers during his tenure as the head of the National Restaurant Association in the 1990s.
In his first appearance since Politico broke what could shape up to be image-shattering allegations, Cain told Fox News’ Jenna Lee that the charges waged against him are both “baseless” and “false.’ Additionally, he says that if there was a cash settlement, he was “unaware of it.” Here’s a rough transcript of the exchange (via Mediaite/TV Eyes):
Jenna Lee: Let’s start with the truth. that’s always the best place to start. What is the truth about these allegations of sexual harassment or sexual misconduct? Have you ever been accused at any time of either?
Herman Cain: I have never sexually harassed anyone, let’s say that. Secondly, I’ve never sexually harassed anyone, and yes, I was falsely accused while I was at the National Restaurant Association, and I say falsely, because it turned out, after the investigation, to be baseless. The people mentioned in that article were the ones who would be aware of any misdoings, and they have attested to my integrity and my character. It is totally baseless, and totally false, never have I committed any sort of sexual harassment.
Lee: Have you ever had to settle a claim, falsely accused or not, sometimes a settlement happens when a false accusation is made. Have you ever had to settle a claim, giving money, or paid someone because a claim of sexual harassment or sexual misconduct.
Cain: Outside of the Restaurant Association, absolutely not. If the restaurant association did a settlement, I am not — I wasn’t even aware of it and I hope it wasn’t for much, because nothing happened. So if there was a settlement, it was handled by some of the other officers that worked for me at the association. So the answer is absolutely not.
Cain claims that any other allegations that may surface would have to be falsified. While he admits knowing about these allegations years ago, he “I have never sexually harassed anyone and — these are false accusations.”

Posted on October 31, 2011 at 2:38pmNobody is more wishy washy than Cain. He has come out and stumbled badly with very basic softball questions. To say he was not aware of any settlement is more than unbelievable. 5 figures are nothing to sneeze at so I would find it absolutely astonishing if he was not made aware of that. That right there would make him a liar. He has been caught saying he would not audit the Fed Reserve and another time that he would. He has said that he could easily see himself negotiating with terrorists and would empty Gitmo for even one U.S. citizen. He has left it very uncertain to weather his is pro life or pro choice. He cannot even answer basic questions on Foreign policy other than saying he would hire competent advisers. Sorry but what would happen if an incident happened that required a split second decision there would be no time to consult competent advisers. There should be red flags going up all over the place with this guy he is the least prepared person I have ever witnessed running for President and that includes the disaster that is presently in the White House. He has been both for an electrified fence and when criticized said it was a joke and there was no laughter or smile when he said it then he later reversed his reversal saying he was for an electrified fence when he seen that it was popular. He is very much a crony capitalist for Koch as one example and worked for them as a lobbyist.

Posted on October 31, 2011 at 3:09pmPlease look at what is happening. Divide and conquer by Obama’s campaign.
Sexual harassment today is anything “perceived” by the person doing the accusing. It can be anything that the person feels makes them uncomfortable.
So if a man or woman tells someone that they look nice today and it makes that person “uncomfortable” then they can be accused. How do you proved you did nothing to what someone may perceive in their mind?
Settlements do not always equal guilt.
http://www.eeoc.gov/laws/types/sexual_harassment.cfm
I am against real sexual harassment but it has gotten to the point that people can’t even say something nice to a coworker these days.
Strange that he has been running for President for months yet this doesn’t come up until the usual Friday dump of another solar company going bankrupt.
As all of you complain here about the other conservative or republican presidential candidates that you don’t support, or provide links to other stories against the candidate you don’t like, and in doing so you are just playing into Obama’s hands and handing him the 2012 on a silver platter.
Obama‘s campaign doesn’t even have to defend his bad policies you are so busy fighting each other that you aren’t fighting him. All of this is giving him control of the conversation.

Posted on October 31, 2011 at 1:57pmCain, use the facts!
Obama’s birth certificate alleges “where” he was born and his parent’s citizenship “when” he was born. These equally important “facts” are now beyond Obama’s ability to refute, alter or hide! Unless fake, his Kenyan father inescapably precludes his Constitutional eligibility as a natural born citizen by not being born within US jurisdiction to TWO US citizen parents.
Candidates for President, each having “legal standing” are therefore obligated to sue Obama, Pelosi and the DNC for fraud and failure to qualify as a natural born citizen, or be dismissed as untrustworthy!
Constitution, Art. 2, Sec. 1, “No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible … .”
Exempting a “citizen” from being a “natural born citizen” proves they aren’t equal, or no exemption was needed. Being not less than nor equal, a NBC must be more than the minimum requisite for citizenship then, which was US birth to a US citizen parent. Only US birth to US citizen parents (plural) is greater, thus defining a natural born citizen.
The Supreme Court agreed in Minor v. Happersett, 1874. “The Court held that Minor was a member of the “class” of persons who were natural born citizens. They defined this class as those born in the US to “parents” (plural) who were citizens.” Leo Donofrio, JD.

You know perfectly well that the Supreme Court made it very clear in their decision on Minor v Happersett that they were NOT setting a precedent by establishing a complete and exclusive definition of natural born citizen?
“Some authorities go further and include as citizens children born within the jurisdiction without reference to the citizenship of their parents. As to this class there have been doubts, but never as to the first. For the purposes of this case it is not necessary to solve these doubts.”
And that there is no definition in the Constitution, and that the Supreme Court finally settled the issue in 1898 when they said that anyone who was born here is a natural born citizen regardless of their parentage, and that has been the law of the land ever since. And you should know that even if you were right on the legal theory. the candidates aren’t going to sue, because they know that no judge can rule against what the Congress and the Supreme Court say the law is.

You failed to mention what case you are referring to. However based on predictable and repetitive errors purposefully perpetuated by various trolls here, presumably it’s U.S. v Wong Kim Ark, 1898.
In U.S. v Wong Kim Ark, 1898, the court simply ruled that Wong Kim Ark was a citizen. “Since Wong Kim Ark didn’t fit into the class of natural-born citizens as defined by Minor, the Court looked to the 14th Amendment to grant him US citizenship.” — Leo Donofrio, JD.
“Citizenship wasn’t acquired by birth on US soil prior to the 1965 Immigration Act, considered by many to be a misinterpretation of the 14th amendment and contrary to the original intent of providing emancipated slaves who, without a US citizen parent even if born on US soil, had no other means of acquiring citizenship. The 14th amendment affects only citizenship, not a natural born citizen: one born on US soil to US citizen parents (plural)”. [1]
Representative John Bingham, framer of the 14th Amendment, speaking before The US House of Representatives, clearly agreed.
“I find no fault with the introductory clause [S 61 Bill], which is simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen.” (Cong. Globe, 39th, 1st Sess., 1291, March 9, 1866)

I am aware of Donofrio as a birther kook whose ramblings are reprinted all over the internet, I just don’t know how he distinguished himself in his alleged legal career sufficiently that anyone should give a hoot about his opinion. I know that he is wrong about US v Wong Kim Ark not defining natural born citizenship, because I have read the decision.
“It thus clearly appears that by the law of England for the last three centuries, beginning before the settlement of this country, and continuing to the present day, aliens, while residing in the dominions possessed by the crown of England, were within the allegiance, the obedience, the faith or loyalty, the protection, the power, and the jurisdiction of the English sovereign; and therefore every child born in England of alien parents was a natural-born subject …
III. The same rule was in force in all the English colonies upon this continent down to the time of the Declaration of Independence, and in the United States afterwards, and continued to prevail under the constitution as originally established.”
The Court quite reasonably assumed that since the Founding Fathers included the top lawyers in America at that time,, they would have known what the law was and if they had wanted to change it they would have done so by actually writing a new law, which they never did.

If it’s my position is that BO is “not eligible even if he was born here” as you say, then I am a “birther” how?
Articles at the Blaze pertaining to the candidates, including Obama, are hardly immune from factual observations that one of them is Constitutionally ineligible, as alleged by numerous experts. Furthermore, my factual comments cite properly referenced source material for anyone to verify, if they are so inclined.
Obviously that excludes you as facts are not the forte of a propagandist only interested in the dissemination of false information, conveniently lacking any references to source material. Speaking of which, plagiarism presented as one’s personal opinion is easily exposed, yet often your opinions are so uninspiring that they hardly merit wasting one’s time with further investigation.
Furthermore as you have apparently discovered, lies, insults and other Alinsky tactics employed to ridicule the messenger, rather ineptly I might add, by those who can’t discredit the message, will not be tolerated, and especially not by trolls.
There’s no doubt that you, and I quote: “believe in free speech, even for crackpots spreading misinformation“ as that is essentially your modus operandi in a ”nutshell” as the case may be.

Far from disseminating “false information, conveniently lacking any references to source material.” I have accurately quoted the most relevant original source material – the actual text of Supreme Court decisions, which anyone with a fourth grade level of reading comprehension can recognize as amply demonstrating the untenable nature of your position. You run articles full of quotes from kooks you found on other websites, but apparently lack the critical thinking skills to inquire who these people that you see as “the big boys” are, or why anyone should accept them as authorities on Constitutional law. Why not just come clean and say that the company chose the best route was to settle rather than dragging it through court? Why does he continue to lie? It makes me feel like the accusations were true. If I had someone accuse me, I would fight tooth and nail to discredit them, and make them show proof of any accusation (I am innocent until proven guilty) before I would ever pay someone a red cent. Plus I would file a counter suit for defamation of character.
I take no joy in these accusations coming out, it just makes me fear his candidacy more. His response is giving me a hard time giving him any benefit of the doubt.

Are you deaf and dumb little man? He said he is not aware of any settlement that may or may not have been paid. Is he supposed to admit to things that he is unaware of to satisfy the nutcase liberals?
Report Post »JohnnyMidknight
Posted on October 31, 2011 at 2:32pm@ JMILLER You would fight tooth and nail, but the costs to the company would be in the Millions. Many companies settle to control costs. That fact that it was settled means that the accuser didn’t want to go to court either and just wanted money. You are being too quick to call Cain a liar. It is pretty much standard practice.
A perfect example is getting pulled over for speeding. Though people may have been falsely accused of the action, many pay the fines and take the points than waste time in court and compounded costs that are far more expensive than the $75-400 ticket. Even if you prove your innocence, the $800-3000 may be unaffordable. Doesn’t mean that you were actually speeding though.

Posted on October 31, 2011 at 3:00pmJOHNNYMIDKNIGHT,
What you are saying about paying to avoid the hassle has merit, but you would be well aware of the pay out. If you do not find that to be very unbelievable that he was not aware of any settlement would be a total lie. The company would make certain he knew of the disposition of the case, I am sure he was very much involved both from the standpoint the charges were filed against him and the fact that there was a settlement. This guy deserves no more benefit of the doubt he has been given way more than he should have and now it is getting to the point where his supporters are getting desperate to defend him and are beginning to lose their own credibility. Giving that many passes is how we ended up with Obama.
Report Post »JohnnyMidknight
Posted on October 31, 2011 at 3:31pm@JMILLER How do you know it is a lie? Do you have information that we are not aware of?
I stated on a previous post on another article about this matter. He knows the allegations because HR representatives would review the claim with him. It is standard protocol. The fact you do not know this seems that you have very little experience with these matters. Seeing as Cain was the President of the organization, he would be kept out of the resolution and removed from the investigation. It is called conflict of interest for Cain to have a position in an investigation surrounding him. It is standard protocol within corporate America.
So, he is not lying if he was made unaware of any settlements. I would be more afraid if he stated he spearheaded the settlement and asked for her resignation. That is strictly against the law as it would be considered retaliation. The claim was most likely found baseless, and the persons were ask to resign with a severance package as false accusations can not be tolerated as it would produce a negative work environment for 99% of the organization. The allegations were made on his well known southern soft speech. Many older southern folk call people darling, honey, and sweetie. In the 90′s many sexual harassment cases were filed on these and thrown out since then. These are not sexual harassment and if it makes the person feel uncomfortable, it is their duty to make such known to the party making the statement.
Report Post »JohnnyMidknight
Posted on October 31, 2011 at 3:37pm@JMILLER You really need to read up on the law reading Sexual Harassment before claiming parties lied or are purposely avoiding the issue. These are serious allegations and seem to have been handle according to the what the organization felt the best course. If Herman was guilty, he would have been fired. Please stop spreading your hate speech without facts or educating yourself on the subject.
You have a right to speak, but when you say:
“But I can understand coming to a small settlement. But Cain lies and says he didn’t know whether or not there was a settlement????? Tell me how he knew that he was being accused, but didn’t know if there was a settlement???? IT IS A LIE”
You are being just like the people smearing Cain falsely. We understand you love Ron Paul. But if you can not conduct yourself reasonably, you will discounted as a hack, troll, and mud thrower. Worse than being a liar is stating things as facts without a shred of evidence to support it.

If she doesn’t like you then you are breaking the law. You have to remember that all women are innocent victims and all men are predators. I have worked in work places where most of my coworkers were women and in those where most were men. I much prefer it now where all my coworkers are men.
