Carl Funk can’t walk.
But the 58-year-old south Florida resident certainly threw a courtroom audience for a loop when he seemed to do just that on Friday — right after explaining he’s confined to a bed for the rest of his life.
Funk was appearing before a Broward County judge via a jailhouse-courtroom video link for a 2005 trespassing and open container violation. A deputy helped him into a chair before Funk explained his situation to Judge John Hurley, according to the Fort Lauderdale Sun-Sentinel.
“I am disabled and it’s really a problem for me to move around,” Funk said. “I really need to be in my bed and that‘s where I’ll be for the rest of my life.”
Hurley, reading from a police report stating Funk was trespassing on private property, replied, “It didn’t look like you were in bed at that time.”
“I was [dragged] out by two unknown people,” Funk said.
He said he did not have an open container of alcohol in his hand.
“I plead not guilty, Your Honor, it wasn’t in my hand,” Funk said.
Hurley — who pokes fun at the defendant for most of the hearing — interrupted Funk, pointing out that the violation occurred seven years ago and asking, “How do you remember where it was?”
After some additional back and forth, the judge set bond for Funk at $50 — down from $100, which Funk said he could not pay — with a six-month payment plan in exchange for a guilty plea.
“We are defendant-friendly in this courtroom,” Hurley said. “Good luck, Funk.”
That’s when Funk stood up and walked away — and the courtroom audience started to laugh.
Astonished, the judge asked the deputy what had happened. The deputy explained Funk had used a walker not visible on camera.
“He’s been cured!” Hurley said while raising his hands.
Watch video of the hearing below, which includes plenty of light-hearted one-liners from the judge:

Posted on July 21, 2012 at 4:46pmI know an overweight man in his 30′s who was in a large delivery truck and was hit from behind by a car. He is now claiming back injury. He helped a friend carry a large flat screen tv in to his basement. He rides a motorcycle and mows his lawn. This lazy, fat, fart is trying to collect over 100,000.00 dollars and it is likely he’ll get it. In the mean time he sits around all day eating and doing absolutely nothing. He‘s going to be a drain because he’s too freaking lazy to work.

Posted on July 20, 2012 at 11:48amI have been in the defendants chair a time or two and it‘s refreshing to see a judge who doesn’t take himself too seriously. That was lighthearted fun…no need to get all preachy about the judicial system and government on this one…take it easy folks.

Posted on July 20, 2012 at 1:22amI have fourth stage breast cancer (yeah, I’m a guy, it happens) It runs up my neck to where it is eating at my jaw and down my arm to the elbow. I spend five hours a day vomiting and in herniatal collapse of my diaphram. And I don’t expect Jack squat from the government: THAT IS NOT WHY IT EXISTS. Army and Mail delivery. Do that and we’re all good. Anymore than that: It becomes fascism. And yes, prezo: I did build my company DESPITE your government. Despite it.

Posted on July 19, 2012 at 7:31pmThis is just a reflection on what our judicial and penal system has become. A joke! Lying, cheating, stealing, fraud…and with no real restitution to make people stop doing so. Just a reflection on half this once great nation, and almost all politicians in government, federal and state. Hope, Change & Forward.

Posted on July 19, 2012 at 5:31pmAmazing how many “disabled” people can do all sorts of stuff when they either forget or think nobody’s watching. The fakers need to be dumped from the disability rolls, so that the truly disabled can be better helped.

Posted on July 19, 2012 at 6:33pmI am not sure I get what the issue is. I can see the defendant stand up slowly using either the chair or the walker for assistance and then walk off using his walker.

Posted on July 19, 2012 at 4:45pmAt least he didn’t say “I’m late for my aroebics class.” But he wasn’t disabled by himself, someone else made that happen, a teacher, doctor, or judge helped him become disabled. He couldn’t sponge off of society on his own, the Govt. was their to help him.

Posted on July 19, 2012 at 4:54pmYes .. and I would bet that a LOT of drugs and drinking when into making him “disabled” also. People are going on and on about people who are a bit overweight and such .. but people like FUNK are the ones putting the greater strain on society. But it isn’t politically correct to say so .. they are “victims”.
