Hold the Brownies! Obama Set to Sign Bill Limiting School Bake Sales

WASHINGTON (AP) — Don’t touch my brownies!

A child nutrition bill on its way to President Barack Obama — and championed by the first lady — gives the government power to limit school bake sales and other fundraisers that health advocates say sometimes replace wholesome meals in the lunchroom.

Republicans, notably Sarah Palin, and public school organizations decry the bill as an unnecessary intrusion on a common practice often used to raise money.

“This could be a real train wreck for school districts,” Lucy Gettman of the National School Boards Association said Friday, a day after the House cleared the bill. “The federal government should not be in the business of regulating this kind of activity at the local level.”

The legislation, part of first lady Michelle Obama’s campaign to stem childhood obesity, provides more meals at school for needy kids, including dinner, and directs the Agriculture Department to write guidelines to make those meals healthier. The legislation would apply to all foods sold in schools during regular class hours, including in the cafeteria line, vending machines and at fundraisers.

It wouldn’t apply to after-hours events or concession stands at sports events.

Public health groups pushed for the language on fundraisers, which encourages the secretary of Agriculture to allow them only if they are infrequent. The language is broad enough that a president’s administration could even ban bake sales, but Secretary Tom Vilsack signaled in a letter to House Education and Labor Committee Chairman George Miller, D-Calif., this week that he does not intend to do that. The USDA has a year to write rules that decide how frequent is infrequent.

Margo Wootan of the Center for Science in the Public Interest says the bill is aimed at curbing daily or weekly bake sales or pizza fundraisers that become a regular part of kids’ lunchtime routines. She says selling junk food can easily be substituted with nonfood fundraisers.

“These fundraisers are happening all the time,” Wootan said. “It’s a pizza sale one day, doughnuts the next… It’s endless. This is really about supporting parental choice. Most parents don’t want their kids to use their lunch money to buy junk food. They expect they’ll use their lunch money to buy a balanced school meal.”

Not all see it that way.

Palin mocked the efforts last month by bringing a plate of cookies to a school speech in Pennsylvania. Rep. John Kline of Minnesota, the senior Republican on the House Education and Labor Committee, said the federal government “has really gone too far” when it is deciding when to hold bake sales.

Some parents say they are perplexed by what the new rules might allow.

In Seminole, Fla., the Seminole High Warhawks Marching Band‘s booster club held a bake sale to help send the band’s 173 members to this year‘s Macy’s Thanksgiving Day parade in New York. One of the bake sale’s specialties: New York-style cheesecake, an homage to the destination they’d pursued for 10 years.

“Limiting bake sales is so narrow-minded,” said Laura Shortway, whose 17-year-old daughter, Mallory, is a drummer in the band. “Having bake sales keeps these fundraisers community based, which is very appealing to the person making the purchase.”

Several school districts and state education departments already have policies suggesting or enforcing limits on bake sales, both for nutritional reasons and to keep the events from competing for dollars against school cafeterias. In Connecticut, for instance, about 70 percent of the state‘s school districts have signed on to the state education department’s voluntary guidelines encouraging healthy foods in place of high-sugar, high-fat options.

Under those rules, bake sales cannot be held on school grounds unless the items meet nutrition standards that specifically limit portion sizes, fat content, sodium and sugars. That two-ounce, low-fat granola bar? Probably OK, depending what’s in it. But grandma’s homemade oversized brownie with cream cheese frosting and chocolate chips inside? Probably not.

One loophole in Connecticut: The nutritional standards apply if the food is being sold at a bake sale, but not if it’s being given away free, such as by a parent for a child’s birthday.

“If a mom wants to send in cupcakes to celebrate St. Patrick’s Day, that would not be subject to the state guidelines,” said Thomas Murphy, a spokesman for the state’s education department.

In New York City, a rule enacted in 2009 allows bake sales only once a month, and they must comply with nutritional standards and be part of a parent group fundraiser.

Wootan says she hopes the rules will prompt schools to try different options for fundraising.

“Schools are so used to doing the same fundraisers every year that they need a strong nudge to do something new,” she says. “The most important rebuttal to all of these arguments is that schools can make money other ways — you don’t have to harm kids health.”

      This is not a small issue. It ultimately leaves the SEIU in control of the food industry. That’s what Me-Chelle is up to here.
      1) Invent crisis.
      2) Publicize crisis.
      3) Offer heavyhanded government solution for crisis.
      4) Once government in control of crisis, bring workers in industry under Federal umbrella.
      5) Unionize workers through SEIU.
      6) A portion of every paycheck and every food sale goes to the SEIU, and now the DNC.

      And it all started because the Left had the best of intentions for your children and you agreed.

    Don’t most bake sales happen after hours anyhow? I can’t imagine selling baked goods to the school kids is a huge money maker, it’s at sports events and other events like that where I think you would make the most money from bake sales and such.

      No. it is fairly common for Student government and other clubs to have bake sales to raise funds on a weekly basis. These may happen “after school” but before students have left campus,so they would fall into the regulated bake sale category.

      @cognitivedissonance, the school bake sale at my kids’ school during the annual Christmas program is the biggest single money making fundraiser they have and happens during school hours. The bill would ban it.

    The way I see it, if the Government stops kids/schools from raising money, the schools will have to become more reliant on Government money. Besides, aren’t the parents the ones who buy all the cakes, etc. at these bake sales?

    God help us now; we elected these idiots of the lame duck society, and are reaping the final whirlwind before they (hopefully) will be checked. This goes beyond ridiculous and ludicrous and hopefully some one will challenge these legislation’s in court and win against them; or have them overturned within the congress.

    Pray the Almighty will see us through the night; for the storm is now at hand and making landfall.

    What is the next step now? The fed’s will mandate people shacking up with someone they chose for you, and to have x# of kids with?

    Will not surprise me at the least.

      This bill is more dangerous and more sad than people realize. It is about STEALING kids from their families. It is about destroying the family. It is not about nutition. The health care act empowers the state to take over full responsibility and authority for the ‘adult formation of children”. Providing breakfast, lunch and dinner takes a child away from the family for nuture and nutrion. WATCH OUT PEOPLE. THE CHILDREN NOW BELONG TO THE STATE. Part of the health care regulations being established by Herr director of Health and Human Services is to mandate that every child has a pychocological eval every year to find “mental health” issues before they become problems. What that means is that they will be seeking out those kids who dream dreams of freedom and squelching them. THIS IS NOT ABOUT FREEDOM…NOT ABOUT NUTRITION…NOT ABOUT HEALTH CARE. IT IS ABOUT TYRANNY.

      Can we not hold our bake sales at the local churches? Advertise it as a class benefit for such and such and hold the sale away from the school premises. Or just move off school property a foot or two to accomplish the goal. I’m trying to express a way to “beat them at their own game” NOT support such a bill. I think this bill violates our right to freedom!!!!

      That’s my question too. I can’t believe this. Schools are already way over their budgets. When I was a kid I played sports because there usually wasn’t a fee and if there was it was not much. Today. only the rich can afford to allow their kids to play multiple sports. But, with this new law (should it pass the senate will be the final nail in the coffin for a lot of sports. With more kids not playing sports, more kids will get fat. So, I don’t know how this is suppose to help. I am at the decision point, I may be pulling my kids from the public school system.

      Not a bad idea, nice job thinking out of the box!

      I would worry that they may seek to quash that tactic by claiming that, because it was in any way associated with a Christian church (Mosques would probably be A-OK though…), those funds earned cannot be used toward any school-related function or even any function that occurred on or used school grounds or facilities due to “Separation Doctrine” issues.

      They are doing this to discourage local population’s participation in, and attention to, how their children are educated. It broadens the scope of their control over our food supply. It also adds tension and distrust between the people and government which they hope will create an incident they can use to declare an emergency and suspend individual rights.

      Most every little “nudge” (she actually said that in the above piece) the Progressives implement have multiple effects on multiple levels, and even multiple simultaneous goals. Every move must be looked at from many various angles, and one cannot halt analysis of a move they’ve made at just the “main goal” and one or two…even three, four or more…”sub-goals”.

      I wonder if anyone ever asked any of these Progressives, particularly the ones in Congress and this administration, if they are dumb enough to actually believe they would be allowed to live if the Progressive/Socialist/Communist movement they work so hard to advance actually succeeded in taking over? In all history, men in their roles were *always* executed/imprisoned after the revolution despite any previous promises of safety whether the takeover was a success or not.

      How about just nudging thier fat little asses out for some PE? The problem isn’t what they eat in school it is what they eat at home sitting on thier butts watching TV or playing video games all day. The kids should get lunch in school and that’s it, the parents who are taking advantage of lunch breakfast and dinner on our dime need thier asses kicked.
      It doesn‘t help that these ne’er do wells get food stamps that allow them to buy any food on the planet, and if a parent is too lazy to support thier child you know they are buying TV dinners and crap. Give them food boxes with healthy crap in them instead of stamps and see how many of them all of the sudden start finding the money to buy thier own darned food.

      Our local school district went down this road a few years ago and, let’s just say that the most polite description of the outcome was “it did not end well.” Just a friendly word of advice to Mama Obama – “Don’t go there, girlfriend.”

      It ended up affecting band uniforms, school field trips, sports equipment, sports meets, and alot of the after hour school clubs and events. The food service staff was busy jumping through hoops trying to make food that looked attractive, and actually tasted better than pine bark. One parent was whining so much that the head of the food service company actually came to one of the Board meetings and said, “Look, you don’t want sugar, you don’t want salt. Fine, but give the dietitian and the staff some time to figure out how to adjust the recipes. They’re working on it.”

      One of the nearby towns busted a student who sold a candy bar to another student. God’s truth. They called the police and had the kid arrested and suspended. BIG LAWSUIT.

      Actually, I think the administration should be open, transparent and honest about all this. They should issue orange jumpsuits to all the inmates – I mean students and remind everyone that once those kids set foot on school property, they lose all their rights.

      Oh, yeah, are they planning on busting the kids who bring their own lunches? Peanut butter is already restricted. Now it’s going to be chocolate?

      And what about the teachers? Are they going to be required to be sugar free, too? No sugar in the coffee, no chocolate for the women when they need a little boost? Oh, it will be just glorious, you’ll see.

      I am in no way advocating an armed overthrow of the government BUT if absolutely nessesary it is a last resort option. It is our DUTY to protect liberty at all cost. It is what we are SUPPOSED to do if all else fails. We have the right to arms for one reason and one reason only!! The second ammendment has NOTHING to do with duck hunting nor does it have anything to do with protecting your house from burglars. The SOLE purpose of the 2nd ammendment is to protect against a TYRANNIC GOVERNMENT. The way I see it the only one that should have a problem with me bearing arms against a tyrannic government IS a tryrannic government. I dont want to see it happen but as a last resort to protect liberty it is our DUTY!!!!

      Uumm, JZS ,, it’s called a choice.. you see, we conservatives realize that if you start to control OUR choice then you are taking OUR freedoms away, and we LOVE our freedom.. Bake sales and vending machines are NOT a “ requirement ” They are there to give a choice.. If you‘re a parent and can’t control your kid with what YOU want them to eat and set standards and rules to be followed then that is your problem but DON’T make the rest of us suffer for your failures as a parent.. And last thing, If you don‘t have money to take care of your kids then don’t have kids, period.. why should WE pay for your child to eat a dinner at school ? Now, I know people need help and fall on hard times, those things just happen, and I’m all for helping anyone that really needs help but, that’s what they have a welfare system for…

      Seeing as how ILLEGAL IMMIGRATION is “virtually legal” I think the new fundraiser should be an illegal immigrant auction. And if the illegal immigrant that you purchase has a back pack full of meth or coke well then bonus … instant diet for all the calories from past bake sales. Arizona could pack them up and ship them to a school district near you. The money that they make could off set there court cost for the bill they passed.
      I see no down side to this. Remember it’s for the kids. Barry could sign the bill with a flock of illegals in shackles while a band kid is standing next to him, playing a socialist national anthem.

      They should’ve never been allowed the power they have and this is the reason….
      Not to mention the wasted taxpayer dollars, the union abuses, etc and so on.
      Huge report this year on how many billions wasted on preschool. With min ease
      you can find reports on waste all the way back to the late 70s.

      Get the government out of our childrens education. Defund and axe all of it.
      Let the states and local community handle how it’s ran.

      @Ameriwoman – This has nothing to do with the DOE. This falls under the jurisdiction of the USDA which is responsible for the National School Lunch Program. (Though I do agree with you – the DOE needs to go. I’ve been waiting for that to happen since Reagan was in office.)

      What is the argument here? This is a bill that provides food for the most poor children in our country, children that might otherwise have nothing to eat. Maybe churches should be doing that, but they’re not. They can’t.

      Why should the school system be required to provide fatty, unhealthy food to children? This is a classic example of conservative hypocrisy. Parent can take full responsibility for what their children eat: send their lunch in one of those little brown bags. Send them to school with ten Twinkies if that’s what you want them to eat for lunch.

      This is the “Nanny State” in reverse: “Yes, I could send my child to school with candy bars and sodas, and pay less than the vending machine price, but I want the Government to make those things available to my child. And I‘ll pay more of my income to let my my child eat candy bars for lunch provided I don’t have to think about it.”

      Parents who object to this kind of thing are relinquishing their responsibility as parents under the false banner of Freedom. They are unwilling to send their children to school with candy and sodas – although that’s more economical. They want the school system to make the unhealthy food available so they don’t have to have that discussion with their kids. Nanny State in reverse.

      This is just insane. I am absolutely for promoting healthy foods for kids; they get some much fast food advertising/programming that there needs to be something to counteract it. But promoting something is a whole lot different than banning something.

      @JZS, you missed the point. This isn’t about school lunches. The food nazis have already ruined those things. This is about school fundraisers such as bake sales and candy sales. My kids’ school uses both to help raise money to off set field trips and the like. How are they going to do that if they can’t hold what are the 2 biggest fund-raising events that they have? I for one don’t buy the whole, “We won’t target them,” BS, This is exactly what will be the prime target if you read how obscure the bill is and what the cow in the White House has said multiple times.

      Kids shouldn’t need to have a bake sale to raise money for anything. Schools get $18,000 per year, per student. New schools are architectural masterpieces. Administrators drive Mercedes CLKs. Teachers drive Lexuses. But the kids have to pander for money with a bake sale, or sell candy bars door-to-door to earn money to buy something we are paying taxes to provide them.

      We don’t want any part of our U.S. Government controlling what our kids eat. They have more important things on the docket….like lowering our National Debt and our taxes so the American people can get back to work! This great fat lady, I mean the First Lady, admitted before cameras, that she didn’t like America very much! So now she thinks we will let her un-American husband control what our kids eat! The only thing our kids need to do is to back away from the TV monitor and limit their game playing to one day a week. The American parents has the responsibility of fulfilling this task! NOT UNCLE SAM! These lazy Democrats put Obama in office and a lot of them still love him. But they are the ones that don’t care if we are a Socialized Government! They will always be wanting the government to take care of them! Now getting back to the BAKE SALES; Let’s all for a change, instead of sweets in our bake sales, lets all take baked PORK CHOPS instead! There are not fattening and taste very good!
