Homeless Man David Ivins Has Seizure After Brutal Attack

BELMAR, N.J. (The Blaze/AP) — A homeless New Jersey man whose shocking and senseless videotaped beating was posted on YouTube, leading to an outpouring of charity, has suffered a seizure.

The Asbury Park Press reports David Ivins was at the Belmar Police Department Wednesday night picking up a bicycle that had been donated to him when he became stricken. Police rushed him to the hospital; his condition wasn’t available.

Ivins, who has battled alcoholism, said he hoped to use his fresh start to stop drinking.

“I think I’ll pull out of it, I will stop drinking,” he told the Park Press.

The 50-year-old has received donations and support from an outraged community after the videotape showed a young man punching and kicking Ivins in the face, bloodying his nose, before telling him, “Merry Christmas.” You can see partial video of the beating below:

According to Ivins, he’s seen his attackers before.

“They came running from out of nowhere,” he said. “I’ve seen them before. They’ve thrown rocks and bottles at me before on the train tracks.”

Twenty-year-old Taylor Giresi, the main attacker, faces charges including aggravated assault.

The 17-year-old cameraman has been released to his parents.

The beating has now prompted New Jersey legislators to seek harsher penalties and mandatory jail time for those who record assaults and distribute them, according to the Park Press:

“It is absolutely appalling that two young men found it amusing to stalk and attack a homeless man,” said [Republican Assemblywoman Mary Pat] Angelini in a prepared release. “The fact that the young men posted the attack on the Internet as if it was entertainment is frightening and we must send a clear message that this behavior will not be tolerated in our state.”

Under their proposed legislation, videotaping and distributing the recording of an assault will result in an automatic second-degree aggravated assault charge. A person convicted of second-degree aggravated assault is subject to five to 10 years in prison and a fine of up to $150,000.

After the attack, Ivins was brought to the police station so he could have a place to stay. Since the attack, the local Belmar Inn donated a room for him to have until Jan. 3.

    How was it the Van Jones said the best and the brightest are the youth.

    We went through this here in south Florida when some over indulged youths beat s few homeless, killing one. As a former educator, I believe that corporal punishment has it’s place in schools. This ideology that hug and caress assailants is insane. We are making monsters and celebrating their monstrosity. A little discipline along the way would correct much of this depravity.

      We are supporting illegal immigrants to the tune of 338.3 billion a year…We send foreign aid to Haiti..many of our people adopt ed Haitian chidren..we get how many black Somalian muslims imported to here with jobs awaiting them.?.       He’s in NJ, very strict gun laws.. probably the worst in the nation. The punks knew there was no chance he was armed. You can even be arrested for hollow points. If I have to be homeless, which I pray never happens, it will be in florida, texas or utah.

      He’s a homeless alcoholic. Somehow I don’t think owning a gun would have been at all likely.

      And no, I was hoping that the police would show up and arrest the men (which they did, eventually). I don’t need to see images of young men with their brains splattered all over the ground, even if they’ve committed evil acts and violent crimes.

      I couldn’t watch the video i think the crimes against these poor people
      are some of the worst being committed. Lock the parents up along side
      of these punks. I hope the one videoing doesn’t get off. I hope the other
      get the maximum but that is only a dream. The punk will probably only get
      community service. Sickening…. and depraved… I pray for the victim and
      hope he can get some lasting help.Maybe the punk can serve enough time
      to be treated the same way only worse. The parents should be charged also.

      Here’s a hopeful scenario, first he will go to jail where Bubba makes him his b#%@*, then as time progresses, he discovers he likes it. Then he gets out and finds he can’t handle the guilt from realizing he is a ****, so he starts drinking heavy and between that and his criminal record, finds he can’t hold down a job. The next thing you know he is a homeless alcoholic just like the victim.

      Merry Christmas to the both of you and I hope your folks that raised you also have a very merry time with your legal bills, press scrutiny, public outrage, I hope they have to hang their heads in shame for what you’ve done when they go to the local grocery store and where people know them. Maybe that ordeal will make you think about how your actions will affect other people…even the people you care dearly about…I doubt it.

      This is symptomatic of the times we live in…these kids appear to be well dressed but yet they attack a homeless and weak person of the human race for no reason other than to get their jollies. Videoing it to show to other what they have done just demonstrates there is no shame in it and they know others will enjoy seeing what they’ve done.

      If 2 guys started attacking me, repeatedly, and I have a knife & a gun – guess which one an intelligent person pulls?       You don’t actually own a gun, do you? What‘s the first rule when you’re learning about guns?

      If you aim a gun at someone, you aim to kill them.

      If some punks come up and try to beat you and you pull a gun, there’s almost no chance that you can “kneecap” them in the heat of the moment. If they back off when you pull your gun out and then you take that time to aim and purposely shoot them anyway, that’s no longer self-defense… it’s a crime.

      Also, several of the remarks about killing or vengeance, not using a gun at a deterrent. “Death is too good for them” was just a couple of posts before yours. The charming one about having them get raped in jail was another. Saying “just waste them” was a third.

      Get off your high horse, and actually learn how to use firearms. These people should be sent to prison for their crime. They should not be killed for it; that’s vengeance speaking, not responsible gun ownership.

Another example of why we need to bring paddling back to elementary schools across this country. We stopped paddling back in the late 80’s and these kids have grown up to be spoiled brats ever since.       Though shooting them and taking them out of the gene pool would be considered heroic, they are just dumb kids that act in a way that the environment has taught them to act. Failings of a society, while the societal correction would be impossible for any one person to bring about themselves, if we all band together we can bring about the change required to do so. Stand up for every human life period, if anyone is in trouble rise to the occasion and step in.       rt. Sigh, we cant fix this. As this gets worse and worse people will stand up and begin to kill lots and lots of these p.o.s. and I will not fault them. There are many stories in the Bible were the Jews began to turn away from God and started to do things against him. He would warn them tell them to go back and be faithful, they would not listen. So he would allow armies to come and capture Israel, he told the Jews that this was going to happen and not to resist, that this was their punishment. If they just went into slavery and continued on with their lives as much as they could he would take care of them. The ones that stood and fought the coming invaders were routed, chased down and killed. There has been many warnings to us and yet we still kill 3million babies a year, promote unnatural sexual activities, promote drug and alcohol abuse, sexuality of children, and pretty much every other sin there is. Well the punishment is here with more to follow, since you older people didn’t do anything to stop the course when the warnings were coming, why are you claiming you want to do something to avoid the punishment. The punishment is just, we deserve this.
      It‘s not the kids it’s the culture, the culture is promoted by the media. What movies do you see, what shows do you watch, what songs do you listen to when played backwards say “Murder Murder Jesus”
      I haven’t decided yet if I will fight the punishment, but if I do i know its through hate of those that could not see.

    Stiff penalities?! This is a pre meditated attack! Throw the book at these thugs. Of course the local government wants stronger legislation for releasing the video. How about the local law enforcement simply say thanks for the incriminating evidence against you and off to prison you go for the mandatory 10 years that already exists. Oh and the 17 year old thug gets to go home and hang with his absentee parents. It is nice to see the local citizens, again, are willing to help the victim. Put these clowns in with some real hard core criminals and see how long they last.

      We as parents must always be aware of our children and how they treat others. I worked full time and raised children on my own. I almost bought into the mindset of letting the schools teach them morals, because after all, I was working a full-time. I believed that stay at home moms were just lazy and stupid. This is what my public school taught me in the 60‘s and 70’s. I bought into the progressive agenda that my happiness should come first and I liked to work. I realized the problem with this thinking when I saw my young son being very insensitive to a disabled neighbor child. Right then and there, I scrapped these progressive ideas, returned to the Lord and decided to take my children’s moral education on myself. My kids turned out fine. Not perfect….but fine.

    Wonderful! Only New Jersey would miss the entire boat on this and inject politics into this by making it about posting videos in their efforts to control the internet. Forget the fact that the very act by these thugs is wrong and deserve to be punished by the law regardless of their age. Assault is wrong, posting a video is legal.

      The parents of juviniles committing crimes like this need to pay a civil penalty and the kids need to do time. The only way it’ll stop is when parents are forced to be involved in their little bstrds lives weather its paying fines for their behavior or standing before a judge answering questions as to why their kid sucks.

I hope some similar justice happens to the one in jail. Maybe a few bruises will help them get the message. We are way to lenient to teenage boys. I don’t want to hear about violence, these kids earned it when they became violent.

    Every time a crime goes viral – we have lawmakers clamoring for NEW laws. I suppose justice is not served with our current laws?

    I would suggest no jail for the punks. Community service at homeless shelters would seem to have a better impact on them – contact the victim in private and let him decide which approach is best.

      I know what you mean,when someone is attacked and beaten and a video is put out showing the crime politicians have to make a new laws because somehow assault isn’t appropriate.Another one is drug free zones,it’s really moronic.As for the punks punishment a good caning in public would benefit them greatly,of course we all know that won’t happen but it should.

I watched for the past year as commenters from all over the world and USA called for “revolution in the streets” of America in comments in their mouthpiece, The New York Times. This entire “movement” is international in origin. The International Lefty Workers of the World and their domestic allies in our current White House “ Unionistas ” have been in cahoots from the get go.
