Texas Homeowner Guns Down Teen Burglar

Three youngsters in the Dallas Fort Worth area learned to their sorrow that trying to pull a fast one by stealing from the town’s residents can be a fatal idea. In fact, one of them died in the attempt. According to KDFW Fox 4 Dallas Fort-Worth’s report on the subject:

Three youngsters rang the doorbell and then ran to the back of the home, prompting the homeowner to call 911.

The trio then allegedly kicked in the back door and entered the home, where the unidentified resident opened fire, killing 14-year-old Luis Avila.[...]

Neighbors said they saw a couple of kids who looked like they were up to no good running from the house. They also heard five gunshots, a pause and then three more shots.

KDFW also has a video report on the incident.

The homeowner in question is a man named Lee Cobbler, according to this report from KENS 5 San Antonio’s video report, linked below:

No charges have been filed, though the case will reportedly be reviewed by a grand jury, according to the AP.

      It’s just a hunch, but I think if a homeowner is currently home, and someone kicks in their home-door it seems like the homeowner would think “Someone is here to kill me” because the homeowner doesn‘t know the intruder doesn’t know the homeowner is home.

      I live in a nice neighborhood where I wouldn’t be afraid to take a walk at night, BUT: I never go out without my CHL (concealed handgun license) and one of several carry pieces. I don’t even go to answer the door without one in my pocket. I’ve never had to draw but have had an occasion or two that just having it there allowed me not to show fear in dangerous situations. Even this sense of confidence can be the difference between becoming a victim.
      I will pray for the kid who got shot, but especially for the poor man who shot him, who will live a life of never knowing if things could have turned out better or worse.

      Here in Oklahoma we have Texas beat – we have Castle Doctrine. There is a Pharamist in Oklahoma City who shot a kid a few years ago that shot a kid during a robbery. The only problem is he emptied the gun and I just saw where he is going to prison. I understand that after Obama is re-elected he will pass a law to limit a home owner to only legally shoot 1 shot. If that person shoots 2 shots the 2nd will be to their own tempal.

      The only crime is the Texas gun laws. The home owner is a murder, he acted as judge, jury and executioner and in cold blood ended the lives of three children.

If one of my boys were to do such a thing, I would strip 7 layers off their backside. My children are the most honest, polite, hard working young people. They have been taught since birth that their behavior is a direct reflection upon my skills as a parent. Schools do not raise children, it is time for parents to be held accountable.

His actions got him killed by forcing the home owner to react. I know that I don’t hate anybody, but I will protect my home and family in a similar manner if an antagonist puts me in that position.

      encinom – I usually ignore your opinions – I respect the fact that you have the right to your opinions…and defend your place here in the forum.

      However in this case it is clear you did not read or comprehend the article as you stated that the homeowner ended the life of 3 children. This points out that even in the most simplistic areas of fact you disregard it to make your case. I think it is reasonable to say that you are willfully uninformed.

      The two kids that got away and caught later – will probably serve a year in Juvenile Detention. Then their crappy life happens. Every Job in Texas that is worthy of any type of decent income requires a Back Ground Check and a drug Test.

      The Oil Business is booming in many states – Texas Oil Companies have to screen 100 potential employees to find 10 to 15 applicants that can pass a Drug Test and Criminal Background Check.

      I have a feeling the two that were not shot will have a long a measurable life of crime ahead of them.

      ENCINOM(AN), RANGERP is quite correct. I am retired from law enforcement having worked both in the military as well as civilian. Have responded to a call after the fact to find him to be true. Either to a dead or injured home owner, or a dead or injured thug who attacked the armed home owner. There is too much area for a police shift in any area to be right on top of a crime in progress at all times. I’d much rather have found a dead or wounded perpetrator rather than a dead or wounded innocent victim. Thugs are not innocent.

This young Criminal was killed during the commision of a Felony while breaking and entering. The Homeowner sucussfully defended him self againt 3 younger stronger youths, hell bent on coming to his home forceably.
      Like they say, “Don’t pick a fight with an old man, he’s too old to fight, and will just kill you instead”!

      And for Encinoman, Let‘s see hear how you’d handle having three young, strong, determined criminals after they kick in your back door and rush you! Not uncommon for kids like this to beat you to death and then steal your TV and Cell Phone. Realize they may not let you give them the tv. You‘re a witness and it’s easier to kill you for it.

      Wake Up America. We’ve coddeled this punks and thugs long enough. Teach them some manners!

      This is a tragic case, but it certainly seems like the home owner was within his rights. Still, it’s disturbing to see commenters here applauding the death of a 14 year old boy. People do stupid and thoughtless things as children and grow up to be okay adults. It does happen. This boy will never have that chance. His fault, maybe, but nothing to be cheering about.

      Youv’e got that right, I lived in texas for several years and you don’t mess with home owners.Ihad a co-workerwho was driving past his house on a service call and noticed a vehicle backed up to his garage,He pulled in and grabbed a gun he kept in his garage and killed the two guys robbing his house,The company made him show on his time card that he was at lunch at the time of the incident because they didn’t want it to look like he killed them on company time.

      The second amendment may be in response to tyrannical governments, but it’s certainly not limited to that. I would expect your conservative outlook to understand that. Guns are for personal defense, not just government overthrows (though they may be used for that should the time come)

      I agree — several years ago, in Florida, a neighbor’s kids were arrested for shoplifting, but the law prohibited disclosure of their names.

      After a couple days of harsh ‘stay in your room’ punishment, the kids were right back at it.

      Had they publicized the kids‘ AND THE PARENTS’ names, I can’t help but think the punishment might have been a bit more lasting!!

      Texas has a Castle Law not a Stand Your Ground Law. I would expect the Grand Jury to exonerate Lee. The thugs knew he was home — they rang the bell in the front then went to the rear.

      Since my home has weapons within seconds of a person illegally entering my home by force {namely the kitchen knife block on my kitchen counter} . An intruder is within seconds of holding deadly force upon me, so the age of the intruder should not enter the mindset, when defending ones life. In this instance I would encourage the homeowner to sue the 14 year olds parents to have their child’s blood, and or brain matter, removed from my floors, and or carpets and drapes.

      I planted red white and blue flowers in my back yard and I take great pride in them. They are at the base of of three flag poles that proudly fly old glory, rebel,and tea party flags. My neighborhood has lots of kids in it and they are of all nationalities. During one of their games of kick ball the ball came into my yard! A kid maybe eight or nine years old(wearing a ‘hoodie) hopped my fence to retrieve the ball. He was trespassing and might have had bad intentions. I let it go this time (I kept their ball) but next time I will use deadly force and the new law will make it o.k. What a great country!

      14 is old enough to know what you’re doing is wrong, but plenty young enough to be caught up in doing something stupid with friends that you would never do on your own or later in life. I take it you’ve never regretted anything you did at that age?

      The homeowner was within his rights to shoot, but I highly doubt whether this shooting was necessary (simply based on the facts given in this article). Protecting yourself and your home does not mean you have to kill the thief. I’ve saved myself from a robbery without ever firing a shot. Point it at them and tell them not to move while you call the police; fire a warning shot if you need to, but fire at them only if you are in mortal danger. God made all life sacred; we should never be eager to see anyone killed, especially not misguided teenagers who have the potential to shape up and become productive members of society.

      Skimmer57…if you brandish, shoot, or kill one kid for climbing a fence to retrieve a ball, I suspect you’ll be facing a stretch in prison. One child would not normally represent a “disparity of force”, but three thugs kicking in a door could. Does this kid going for his ball have a weapon that is visible? Is your life in “immediate danger” or “serious bodily injury” from some kid getting his ball? If not, and you kill him, you’ll be convicted of murder….and should be.

      Seekeremerald—- I was in Mliwaukee the other day and was stopped at a red light when out of the blue a guy came up to my pick-up truck (he was in a hoodie) and started to clean my windshield! I thought it was a car jacking and thanks to the new concealed carry I was this close to taking matters into my own hands! The 14 year old “thug” was one lucky brother.I would have been perfectly within my rights! What a great country!

      SOUL LEISTER, LOL, these thugs should be careful who they mess with. My SIG P226 has a 20 round mag in it with one in the chamber. The holster it is in has a flexible mag pouch mounted with another 20 round mag. Once I pick that up I have 41 rounds at my finger tips. A nearby mag bag has plenty of 15 and 17 round mags and extra boxes of Federal Hydra-Shock Plus-P-Plus. I fired expert with the rifle annually, and twice a year with the pistol, and was a top shot when I was on a civilian police department. It’s a good thing that I am way out in the boonies of a rural area where such hoodlums are rare, but there are a few anyway. I am so far out that when seconds count, the deputies or staties are usually far more than mere minutes away, and believe in protecting myself. We also have Stand Your Ground laws to back us up.

      BTW, I lived for a while in a rural BC, Canada. There was a string of house burglaries in the area, the houses to my right and left on the road were all burglarized. Mine was not. A RCMP officer came by to my house to query if I heard or saw something. I told him I was on a trip the previous day. He pointed to a sign on my door that had a pic of a magnum and text “We don’t call 911!” on it.
      Officer: “You’ve got a licensed handgun?”
      Me: “No, only a rifle.”
      Officer, after 3 seconds of thinking: “Well, it seems to work. Have a nice day.”

Many home invasions have ended with the murder of the residents, so this man was wise in not taking a chance. The blame belongs on the criminals, but the liberals are probably going to blame the homeowner for protecting his own home and life.

      The “stand your ground” portion of the law means you’re not required to run into your bedroom and hide under the bed when an intruder kicks your door in.
      It should be noted that the evidencee indicates Zimmerman shot little Trayvon while getting his head hammered into the concrete. I suppose Zimmerman could have tried curling into the fetal position, but that would have been difficult with little Trayvon on top of him clutching his head.

      You don‘t know what you’re talking about. I live in Florida and I carry. Without the Stand Your Ground Law I would have to retreat as far away as possible, giving my attacker every opportunity to advance on me before I could defend myself. No. I will take every opportunity to avoid shooting a human, however, that does not include placing myself in greater danger from said human.

      You (and the MSM) will discover as time goes on that Zimmerman was right and Trayvon was wrong.

      “Stand your ground” varies a little bit from state to state but generally means that if met with a threat, you are not required to try to flee before taking more aggressive action to protect persons (including but not limited to your own) or property (in the case of Castle Law).

      The Castle Law and Stand your ground in Texas extends to your vehicle as well so that if you are in your vehicle and someone tries to smash your window or pull you out, you may use deadly force to prevent that from happening you do not have to flee.

      It also extends to neighboring properties if, say my neighbor goes on vacation and says to me, “can you keep an eye on our place, feed the horse and the dogs etc” if later I see someone trying to break in, or trespassing, the rights of my neighbor under the Castle law also extend to me.

      IF your response was to my post, I assure you that I know exactly what the Texas law allows and restricts. IF not, I apologize in advance.

      I discussed it in length with both a lawyer friend (Fmr. Prosecuter and 2009 top 10 lawyer in the US) and a SWAT friend following a controversial shooting a few years ago.

      As a resident and a gun owner/ daily user, I take the law rather seriously. Perhaps you should read about Joe Horn, didn’t receive the same attention nationally as the most recent case, but it was a big deal here in Texas.

      These two dead men were described as Afro-Hispanics and they were shot in the back after robbing his neighbor’s house and the dispatcher telling him NOT to go outside.

      Horn was charged and the grand jury failed to indict him.

      The case helped to define the limitations and allowances of the Castle Doctrine in Texas.

      Stand Your Ground does not allow you to shoot anyone who scares you. It simply removes the requirement for you to attempt egress from the situation prior to defending yourself. It could also be called the “Don’t Get Yourself Shot in the Back” law.

      It is only speculation at this point that SYG was why Zimmerman was not charged right away. The police wanted to charge him but the prosecutor did not. IF the prosecutor misapplied SYG in this situation, that does not make SYG bad.
      As with everything, it is up to a human to make the call. And sometimes, for whatever reason, humans make bad calls.

      You are correct, it did get national/international scrutiny (I added a BBC report in my links) but Jackson and Sharpton were not camped out in Houston stirring the pot and after a couple of weeks it died down no talk of starting race wars or Nat. Socialists vs. NBP. Trayvon was killed in the beginning of March, we are approaching mid April.

      The intent of these laws are based on the following scenario:
      Armed law abiding citizen is approaching a car in a dark parking garage and witnesses a break-in he yells at criminal to stop, criminal produces weapon and approaches law abiding citizen who fearing for their life shoots criminal.
      Or
      Law abiding citizen stops at convenience store gas station walks in on armed robbery and shoots criminal.
      Or
      Law abiding citizen is in class at university and whack job kid commences fire. Citizen shoots whack job and saves many lives.
      It gives the right for someone to stop a disaster.
      If I see someone break into my neighbors home and know that they are home I will do whatever necessary to protect them.

But that situation would have been avoided if he had not pursued Trayvon, But then I believ that when the confrontation occured he reacted with an attitude like you can see when blacks get their order wrong at Mc Donalds, and probably did assault Zimm.       Sorry I couldn’t get back yesterday, but PPMSTUDIOS and TWOBYFOUR, the official story for almost a month was that Zimmerman was following in his car, and the 911 operator told him “We don’t need you to do that.” Zimmerman then got out of his car and started following on foot before running into the boy and the incident followed. It has only been the last week that the story is starting to be told differently so that Zimmerman doesn’t look as bad. And he is a “self-appointed neighborhood watch” captain with a neighborhood watch that has never registered as a neighborhood watch. So, technically, he was stalking the boy. Even the Florida legislator that wrote the stand your ground law for Florida said that once Zimmerman ignored the 911 advice, he became the aggressor and stand your ground does not apply. It is the same as going into a bar, starting a fight, and then when you start getting whooped, pull out your gun and claim self-defense.

    Good homeowner. Now, he should sue the parents of this kid for all of his mental anguish. They created this monster that had to be dispatched. Imagine how hardened this kid would have been by the age of 27 – he probably would have killed 3 or more people by then. This homeowner saved lives, in my opinion.

A person that doesn‘t have self respect can’t have respect for others. These kids obviously went to cause trouble and do harm.       I, too, thought I was indestructible at one time. It was through the “school of hard knocks” that I learned that I wasn’t, and from suffering the pain and consequences of stupid decisions and actions but ONLY because my parents allowed me to suffer and pay for my errors when they were small screw ups that I learned to be careful to avoid the big ones. I blame the parents for this sort of thing, raising young criminals. Not the homeowner.

      A year ago we accidentally scared the crap out of a delivery guy from the city who came out to drop off a present for my in-laws (we were supposed to take it over for Thanksgiving dinner)

      We were all (Me, Hubby, Two sons, Daughter, Son in Law and Son in laws parents and Son in law’s two brothers) getting ready to go target shoot down at the range in the back of the property and were expecting two more people so when dogs started barking and then the door bell rang, we went to the door assuming it was them.

      I had my glock holstered on my hip, my daughter was holding a part of her disassembled weapon and my son-in-law was holding his AK (pointed at the ceiling of course).

      When we opened the door the expression on the guy’s face was priceless and he almost dropped the “edible arrangement” he was holding.

      Combined with the 135 lb dog my husband was holding back, barking like he was going to eat the kid, I actually felt bad for him and gave him an extra tip!

      Response to violence (burglary in this case), if consistent in a specific area, does not propagate further violence. See crime stats for areas that have anti-gun laws–the violent crime level is on an ascending pattern.

      I worked with a man who was shot in the side with a 38 caliber pistol as a gang initiation. He was at a 7-11 store and a 13 year old kid came up to his pick-up truck and opened the door, stuck the gun in his side and pulled the trigger. The man ended up with a colostomy bag and later had his intestines reconnected. Three times in a row, the man went to court, traveling hundreds of miles each time but the case kept on being continued. He was told that tourist are the favorite targets because they are the least likely to show up to testify. He told me that the prosecutor suspected that they would keep manufacturing continuations until the day he could not show up for the trial and try to cut a better deal. The surgeries were paid for by workman’s comp because he was working out of town at the time of the crime. So far his boss has let him off every time the trial is rescheduled.

      Racial Murder… you do realize a 14 year old can kill you by pulling the trigger just as fast as an adult. Someone breaks into my home and I don’t care what color they are… they are going down! White, Black, Brown, Yellow… doesn’t matter… what matters are their actions, it isn’t about race at all…but you clearly are very racial.
