House Follows Senate’s Lead and Approves Patriot Act Extension

Following the Senate’s lead, the U.S. House of Representatives has approved an extension on key Patriot Act provisions. According to CNN:

The U.S. House followed the Senate on Thursday in voting to extend three key provisions of the Patriot Act scheduled to expire at midnight, sending the measure to President Barack Obama to be signed into law.

By a 250-153 vote, the Republican-led House agreed to extend the expiring provisions of the law passed after the September 11, 2001, terrorist attacks. They deal with roving wiretaps, the tracking of alleged “lone wolf” terrorists and the ability of law enforcement officials to obtain any records they deem relevant to an investigation after securing an order from a federal court…

The House vote was tighter, with lawmakers on the right and left opposing an extension for various reasons. For example, some members of Congress are concerned about the law’s impact on civil liberties, while others support the law but think it should be made permanent.

ABC News has an interesting piece regarding how the president will “virtually” sign the bill into law (remember, he‘s overseas and can’t be there to do it in person):

President Obama, currently on an overseas trip, is not at the White House to sign the bill, a requirement for the measure to become law.

So the president will use an autopen –- a machine that replicates Obama’s signature -– to sign the extension, according to White House spokesman Nick Shapiro.

“Failure to sign this legislation poses a significant risk to U.S. national security. As long as Congress approves the extension, the President will direct the use of the autopen to sign it,” Shapiro said in a statement.

      Watch their movements, tap the phone, enter the homes… No, need for a Patriot Act though, just probable cause and a warrant system that was already available without the creation of ‘Homeland’ Security. That ‘Homeland’ part always struck me as Stalinist for some reason.

      R. Mueller, pointed out the lack of communications between the FBI field offices led to the failure to act on information available several weeks prior to 9/11. There was plenty of lead time to get warrants. Just the act of bringing them in for interviews and then placing them under ‘lawful’ surveillance would have most likely prevented the act. Hey, ‘my guy’ is going to the airport, ‘mine too’, ‘mine three’, mine, etc… take them all into custody!!

      There is no need for warrant less ‘sneak and peaks’, ‘home entries’, ‘tapping phones/dsl’, ‘secret detentions’ unless there is an imminent threat. Even then, this is the digital generation where a judge is mere seconds away and can review/send an electronic warrant.

      The recent Supreme Court ruling on warrant less entry to stop the destruction of evidence ignores basic police procedure. The police served a warrant on Apt A, finished and walked past Apt B. Apt B had a strange odour they noted. At that point the police should have left the immediate area, contacted a judge, sent in an electronic warrant, judge reviews, sends it back, police serve the warrant-bad guy arrested. Bill of Rights intact!

    Keep in Mind, the Patriot Act was written by then Congressman Joe Biden, and approved by President George W. Bush when the Democrats and Biden still saw Muslim Extremists as a threat after 9/11.

    Any legislator who voted for thisUn-Patriot Act should be tried for treason as they have taken an oath to uphold the freedoms that are granted to all the people of this country as outlined in the Bill of Rights.
    We will be even less honorable than them if we vote to return these traitors to offce in the next election!!!!

    The ones that passed this abortion of law again called the “patriot act” are both Democrat and Republican. They need to be removed. I don’t care what bill these idiots tie the patriot act to so they can point the finger and say “Well if I voted no small business would suffer.”

    Small Business would adapt and survive the short term hardships brought on by this obvious attempt to hold onto powers that were never really needed in the first place. Crony capitalism wins another one for the advancement towards the decline and fall of America and the western way of life.

      @ GDBHUSKER I already told my Senator in an e-mail that if he voted to extend the three things that Rand Paul (my other Senator) had purposed amendments to I would contact the Kentucky TeaParty and actively work to get him removed from his senate seat..By the way he’s the Minority leader Mitch McConnell..I also said the same thing to my Rep. Brett Gutherie..I know McConnell voted for the extention but will have to check on Gutherie.

      true not all guns are registered :) but they can take that information if they are registered, and they can wire tap w/o a warrant and god knows what other information they can just grab,
      sure they may have to pry your gun from your cold dead hands but freedom is not often taken in big dramatic moves like rounding up firearms,

      Any Republican that votes to take away ANY liberties is not really a Republican. To blatantly trash the Fourth Amendment and call it a “Patriot” act and to use fear to get us to agree to this is disgusting (almost as disgusting as the fact that we sheepishly fall in line or worse yet support the taking of liberties). To say that we need to violate the Constitution in order to keep us safe or that “if you’re not a terrorist you have nothing to worry about” is so unbelievably naive. I have not yet seen the voting rolls to know which Republicrats voted to extend this, but I hope one day we wake up and stop electing these phonies. Thank God for people like Rand Paul and Ron Paul – at least liberty has a voice in Congress – even if the rest of them aren’t listening.

      Sure hope somebody reminds him that it is 2011, not 2008, when he signs it. His gaffe on the Westminster guestbook was really a subconscious wish that he could go back to the days of 2008 when half the country thought he could walk on water. Whatever his religious affliliation and with all of his atrocious missteps, it is pretty clear by now to most Americans that he is NOT our savior.

      Davis (KY) voted yes. Had already unsubscribed.
      Rogers (KY) voted yes.

      Only 4 in the Senate voted not to table to Rand’s amendment. A few others didn’t vote, one of which was Rubio.

      I’m not taking sides on this issue but it is an important one because it illustrates that on many issues there is a trade-off. Nothing is black or white only, everything – sorry to be the one to tell you – almost everything is gray. Gray and a trade-off.

      In today’s world, if you want to fly an airplane and not have it blown up in midair, then you have to check passengers (a golf ball sized amount of the explosive PETN would take an airplane out of the sky).

      And please don‘t say let’s “profile.” Even if you assume only Muslims blow up planes, there are plenty of black Muslims, white Muslims, and Muslims who look like could look like they could be members of other ethnic groups. The idea that you give extra attention to people in Arab garb is just about the stupidest thing I’ve ever heard.

      Frankly I believe the the Patriot Act is Unconstitutional because it authorizes warrentless wiretaps. On the other hand, I’m not worried about anything the government might find out about me.

      It really is pretty simple. Do we give up some of our privacy rights so that the government can do everything it can do stop the bad guys before they kill Americans? Do we trust that the Government is actually trying to stop the bad guys and not collecting information for some other nefarious purpose? Or do we let the bad guys exploit the fact that we won’t monitor anyone without a warrant?
