Illegal Alien Arrested for 3rd DUI–This Time With Young Son

An illegal alien from El Salvador has been arrested in Michigan for his third DUI, and this time he had his 1-year-old son and girlfriend in the car with him.
Police were alerted to 35-year-old Juan Carlos Banoschavez’s erratic driving when other motorists spotted him driving the wrong way down a street. The girlfriend claims Banoschaves only had one drink, and that he was driving in order to rush their son to the hospital:

“He’s a good guy, and it’s not like he drives all the time. This was an emergency,” said Shirley Munez, the suspect’s girlfriend.
She claims their son had a 105 degree fever and they needed to rush him to the hospital.
“He had a drink like around 4:00 p.m. and then my son woke up crying around midnight,” Munez said. “I’m told him we had to take him to the emergency room, and on our way back we got lost and we ended up going to wrong way and we got pulled over.”
It appears Banoschavez had more than one drink. The video shows him failing his sobriety test, and police say he had a blood alcohol level of 0.12.
Banoschavez has been arrested and charged with operating a vehicle under the influence and drunk driving was a passenger under the age of 16.
Banoschavez’s license had already been revoked because of his previous drunk driving arrests.
Even if he posts bond, FOX 2 has learned he will be handed over to U.S. Immigration officials, and there’s a good chance he will be deported.

The issue shouldnt be that he “might” get deported this time, it should be that he IS deported.
And take his little nino with him, when his child turns 18, he may apply for re-entry into the US (the child, not the father!)

Posted on December 22, 2010 at 9:49amI‘m not positive but some states allow illegals to have driver’s licenses. New Mexico was giving out driver’s licenses and the police reported 66% of those stopped for violations had no license and no insurance. But I’m sure they were fined for this and the driver quickly paid the fines. :)

If we deport him, he would have to pay a coyote a ton of money to be smuggled across the border again, and he has a family to feed. Maybe we should give him some taxpayer cash to cover his expenses for the return trip. He would also need bus fare from AZ to MI also.

Many States have or still do issue Driver Lic to Illegals, and even the ones that do not officially up until the last couple of years most states on gave a cursory inspection of the ID Documents, meaning often Drivers Lic could easily be Obtained with Forged Documents. Since most states only Require renewal every 6-10 years it is very likely that many illegals have valid drivers lic. Plus 4 or 5 states still give out valid lic to illegals that are, by law, good in all 50 states.

Unfortunately, it takes convictions to qualify as a criminal alien. This guy has been arrested 3 times for DUI, but it makes no mention of convictions. Based on current law, Immigration and Customs can’t act based on arrests … the local jurisdictions, arrest and pat them on the butt and let them go … without prosecution.
Our immigration laws need to be changed. Illegal is illegal. If you do not come here legally, you should should have Human Rights, but no Constitutional Rights. You should only have the right to go home by whatever means is available, with no right to complain about it. You should not have property rights as a result of being here illegally, and anything you’ve acquired while here should be summarily confiscated. Children born here should (are) citizens of your home country, not our home. If you are illegally here, you should Never be allowed to gain legal status. End of rant.

It is a national issue to anybody concerned about our immigration policy. How many times do we have to read about somebody here illegally, killing or injuring our fellow taxpayers? What about the border with Mexico and all the problems that arise from this policy, drugs, gangs, murder of our Border Patrol agents, and killing of recreational boaters on the Texas border lake. AND…the cost in dollars it requires to jail, feed and provide legal defense? They get better treatment than our homeless veterans who gave far more to this country than you will ever be able to.

I know that your argument is that illegals pay taxes too…..but aren’t they the major recepients of emergency room visits that the taxpayers wind up paying for? Not to mention enetitlement programs and free public education and preferences on college tuition funding…..they take far more than they contribute….I’m sure that the Huffington Post will disagree. As for taxes, most of us here, you and you ilk excluded, are people who actually do pay taxes. It’s our blood the leeches on the left are sucking.
