Illegal Alien Fatally Shoots Alleged Car Burglar Outside His Houston Home But Was He Justified?

A Houston man shot and killed another man who was allegedly trying to break into his car outside his home on Friday, according to police.

The shooting took place at around 6 a.m. in southwest Houston, KPRC-TV reports.

The man told police that he heard some commotion before going outside and finding an unidentified man holding a shovel trying to break into his vehicle. He opened fire and shot the suspect. Police did not say how many rounds were fired or how many times the burglary suspect was shot.

The suspect was rushed to a local hospital and was later declared dead.

In a shocking twist, KPRC reports the homeowner is actually in the U.S. illegally and owns a gun — both of which are against the law. Police have not released any names.

The illegal alien and his roommate were brought in for questioning about the incident.

The ongoing investigation will now be handed over to Immigration and Customs Enforcement (ICE). The District Attorney’s Office will consider whether or not charges will be filed in the case.

In May, a three-judge panel in Denver upheld federal gun laws passed by Congress that prohibits illegal aliens from owning guns.

From a previous Reuters report:

“Even those admitted on non-immigrant visas … are prohibited from having firearms and ammunition unless they secure a special waiver or happen to be hunters or diplomatic or law-enforcement officials here on business,” the judges wrote.

The case stemmed from the conviction of Emmanuel Huitron-Guizar, who was sentenced to 18 months in prison under a federal law that bars gun ownership by illegal aliens.

Huitron-Guizar’s lawyer, Ronald Pretty, told Reuters he will appeal the ruling to the U.S. Supreme Court.

      Thank you the 60% who actually was quick to point out beside the fact that he is an illegal he should not have had a gun!

      Now, if this was a law abiding US citizen, I‘ll stab in the dark and though not knowing Texas law or Houston’s laws, shooting a person committing a crime that is not committing harm to anyone or an attempt to break into a residence specifically, yours is a big no no.

      If so, there are a few WalMart parking lots that should be littered with car theives.

      But this is one of the protected ones…At WORST they’ll have 1 week of jail time and silently sent back to Meh-he-Co where he will cross the border and continue his life in HIS HOUSTON HOME????
      Guess how much this is going to cost the tax payers for Houston, Texas and the United States?

      (Hint: It‘s big than a bread box full of 100’s)

      i think you need more than 4 options on this poll…..how about He is justified in protecting his property, but he is still illegal and that is a separate issue that needs to be looked at.

      He should not be up on murder charges, but the illegal status should be looked into.

      There shouldn’t be any such thing as “illegal guns”, unless one is in possesion of a stolen gun. The right to bear and keep arms is based on the NATURAL right to self defense and preservation which EVERYONE has. The right to own and use guns is a fundamental right, and constitutionally secured. It doesn’t matter who you are, or what you’ve done. Just as EVERYONE has a right to ALWAYS use the public roads and to travel, so everyone, so as long as they have life, and are at liberty (not inprisoned or in detention), they may use force to defend themselves or those around them. These are UNALIENABLE RIGHTS! Get that in your head. All these progressive laws do NOTHING to effectively stop criminals intent on obtaining or using a gun, they only effect the law abiding citizens. NO ONE is above the law, wherefore there should be no lists consisting of certain classes of people that may use arms, and another prohibiting other classes or certain types of people from using guns.

      Got it all right except about rights being secured by the constitution. The constitution is an old contract between the states and the feds which has nothing to do with us, the people, which is why the people never signed it. Also the contract is well over 200 years old which means it can only be enforced on entities like firms or corporations that signed on to it. I know I never signed it.
      Anyhow, your rights are granted by God and secured by his blessings. It is up to you to defend them. Not the corporation our forefathers created.

      And nearly 60 percent of polled seem to agree with this assessment.
      But what is wrong with the whole situation is that, as Americans, we have Constitutional rights in the Second Amendment, and everyone seems to think that only Americans have the right to defend themselves, family, others, and their property.
      Where is it written that the rest of the world does not have the same God-given rights we Americans have? Why shouldn’t every person in the world be allowed the right to defend themselves, regardless where they live, are living, or what country they’re in, legally or otherwise?
      I agree that being here illegally he should be imprisoned while awaiting deportation, and that done post-haste. But I also agree he has every human right that I, or any, has, irrespective of race, religion, or creed.
      Ergo, the man was right in defending his property, though according to the ‘letter of the law’ (which is ilegal even for Americans) he is guilty of a crime.
      Definitely a Catch 22 for all of us- one and all- on the planet.

      How the heck did he buy a house? I had to show 2 forms of ID and get a credit check. Unless he was renting and the landlords just didn’t care. I know people who have to get a background check and fill out an application to RENT!

      Southwest Houston car thieves all carry. They will kill you as soon as look at you. If they are after your car they will take it without regard for any life but their own. Illegals know this by symbiosis. And if they’re wounded, the lawyers enter the picture. In this case they should put the illegal in jail for having a hot gun. That would take care of the stupid controversy of being an alien. Which he won’t be prosecuted for. Defending his property is what everybody should do in any case. No charge. It doesn‘t say if the thief was carrying but if he wasn’t he had an accomplice close by that was. He probably didn’t walk to the crime scene.

      Obviously we need a NEW law that clarifies when you can use lethal or other force against a thievin’ thug. We can call it the “The Criminal Property Acquisition Rights Act of 2012”. This new law would clearly make it illegal to use whatever means necessary to stop a criminal in the performance of his duty. Criminals have Rights too, and obviously one of them is the right to take your property unfettered by your unlawful assumption that it actually belongs to you..

    It’s going to be interesting to see how existing guns laws will be enforced. Of course our govt will decide that we need more gun laws to not enforce. If they haven’t decide to press charges the guy must be free to head for the border. If he bails to Mexico our govt won’t have to decide whether or not to press those charges will they? Is that an ICE escort car that just pulled up in his driveway?

    While I don’t support him being in america, because he is an illegal, and while ABSOLUTELY unequivocally do not want illegal immigrants having guns, since who knows if they are terrorists or cartel members. And while ANYONE with an illegal gun should be immediately prosecuted. (I do support fully the 2nd amendment, but you dont get a black market gun if your planning to do happy things with it.)

    Despite all that, the dude still was on his property. So I don’t know.

    Pretty simple. Illegal has no property therefore has no rights for use of a firearm in self defense, nor is the gun his legally anyways.

    The law of whether stealing a car is legal form of force would have to be determined by the state. NC old law before Dec 1. 2011 would have said no. The castle doctrine and laws since to current would say yes. I don’t know TX law in the area but the fact his car is not in a garage and seperate from the house could also be at question.

    i guess its up in the air regarding his allowance to kill on his property. The law is pretty clear on that one. if this guy was breaking in to your car on your property, you can shoot him. I haven’t lived in Texas in a long time now, but I‘m pretty sure the mass majority of Texans aren’t going to stand still while you take liberties of their property, just because it‘s not ’inside’ their home.       The laws are to protect law abiding, tax paying citizens. If he does not abide by those laws and pay those taxes he does not deserve a break. In fact, I’m not sure that our police should be allowed to respond to 911 calls from illegals. They are not doing their part to contribute to society, so why should society protect them? And if they have to use deadly force to protect themselves, then we must prosecute them for the use of such deadly force, because the make my day laws are to protect the property of law abiding, tax paying citizens.
