At least not for one illegal immigrant, Jose Antonio Cua-Toc, who won a $750,000 jackpot in Georgia but was reluctant to cash in his winnings for fear of alerting authorities to his immigration status. To avert danger, Cua-Toc asked his boss to claim the cash prize for him, but Erick Cervantes and his wife allegedly stole the money and started spending it all.

That’s when Cua-Toc lost it.

According to Fox News, Cua-Toc was then arrested after allegedly threatening to kill Cervantes and his wife.

Well, the authorities certainly know about Cua-Toc’s immigration status now.

Now, he apparently has a week and a half to leave the country on his own accord or face deportation. But Cua-Toc is standing his ground, fighting the deportation and suing Cervantes to return his lottery winnings.

During Kelly’s Court, Lis Wiehl argued that since Cua-Toc couldn’t present a valid social security number, which is required to claim lottery winnings, he was exempt from collecting the prize in the first place.

Mark Eiglarsh, however, argued that Cua-Toc’s immigration status does not affects his legal right to recover money that he won lawfully.

    A person does not have to have a “social security number” to collect gambling winnings in the U.S. Otherwise, how could the U.S. have a tourist industry? How could a German tourist gamble in Vegas or wherever? They just have to fill out a form W-8, saying they are a foreign person with no “social security number.” Neither to Americans have to have a social security number. The IRS would love to give a social security number to anyone and everyone; that means there are more taxpayers. They don’t care if someone volunteers to get something they are not supposed to have, as long as they get money.

      Your case has too many holes to hold any water. Those tourists are here legally. Any ill gotten goods that are obtained in the commission of a crime are not the property of the criminal. His crime being here illegally. That is still a crime isn’t it?

    How about send them ALL back, of course then the lottery winnings would go to the “EDUCATIONAL SYSTEM” that apparently STILL DOES NOT KNOW how to educate our children…you know, reading, writing, math and science.. ENGLISH, (but has no problem with sex education from day 1) Yep, that’s the ticket, money for nothing, what you don’t see…you can’t miss. Baaaaaaa….Baaaaaaaa.

      you mean his own countryman stole from him? say it aint so!
      some lawyer will take the case. HE will get some money and they he should be sued by the state to get it all back including the lawyers fee as it was all due the state anyway.

    if a teen gives money to someone with ID to buy alcohol… what happens legally to teen? do they get $ back? If the booze is bought & the older folks drink it effectively stealing the teens cash… what happens to them? or the teens?

    I have a feeling tho at the end of the day the illegal will be deported & they will do an IRS style investigation on Mr Boss & get the money back & send him to jail

    I think the illegal immigrant and his crook boss (illegal employees) should both be in hot water. Deport the illegal immigrant. Jail the boss. Donate the money to the Arizona border fence fund.

    I feel the Lottery should do the right thing and find out if this criminal really did win the lotto and gave it to his boss(DIRTBAG)…. if he did then the lotto should demand the $$$ back because this sore loser did not win legit. and the so called boss(DIRTBAG) SHOULD NOT HAVE SPENT ANY OF IT! WASN’T HIS TO SPEND IT WAS WON BY AN ILLEGAL ILLEGALLY!!
    HE SHOULD HAVE TO REPAY IT BACK.
    This would give an American who played the same lotto a chance to win it and WIN legit.
    Someone else lost out because of ALL OF THESE DIRTBAGS!

      Maybe he boss legally won the money, the illegal immigrant found out about it and decided to say he did.

      There are always 4 sides to an arguement, his side, her side (or whatever sex the particiapants are), the truth and the side everyone is going to talk about.

      Since the illegal won the money illegally does it follow the rule that 2 wrongs make a right? Does that make him legal as well? Hmmm……
      Then again, he did also commit an 3rd illegal act by threatening his boss thereby making it 3 wrongs. What a dilemma.

    I want to know if there was any security camera in the store that shows Cua-Toc actually bought the ticket. If someone I know buys a lottery ticket and wins, can I say it’s my ticket and sue that person for “MY” winnings?
    Further more, he’s here ILLEGALLY! Anything he does is basically illegal. The defense attorney said he won the winnings legally and has a legal right to those winnings. How can he win them legally when he’s here illegally in the first place? If he would have obeyed our laws and never came here he wouldn’t have been in the position to purchase the winning ticket. Therefore, it was illegal for him to be here to purchase a ticket.
    End of story.

    He is here illegally. He should be deported. He WAS a victim of a crime, but the death threat is a greater crime — on balance the law should not be applied to benefit a felon.
    As for the money: He played the lottery. Lotteries have rules. One rule is that you present a social security number to collect, BUT the Lottery Commision has interpretted that requirement to be subject to being satisfied by an illegal immigrant. How?, I wonder. Maybe they just want to make sure that taxes are paid on to winnings. He could have a valid claim for the money . . .BUT the employer could counter-claim for emotional distress from the death threat. The award for such counter-claim is a matter of fact to be decided by the jury.
