BIRMINGHAM, Ala. (The Blaze/AP) — Hispanic students have started vanishing from Alabama public schools in the wake of a court ruling that upheld the state’s tough new law cracking down on illegal immigration.

Education officials say scores of immigrant families have withdrawn their children from classes or kept them home this week, afraid that sending the kids to school would draw attention from authorities.


There are no precise statewide numbers. But several districts with large immigrant enrollments — from small towns to large urban districts — reported a sudden exodus of children from Hispanic families, some of whom told officials they would leave the state to avoid trouble with the law, which requires schools to check students’ immigration status.

The anxiety has become so intense that the superintendent in one of the state’s largest cities, Huntsville, went on a Spanish-language television show Thursday to try to calm worried parents.

“In the case of this law, our students do not have anything to fear,” Casey Wardynski said in halting Spanish. He urged families to send students to class and explained that the state is only trying to compile statistics.

Police, he insisted, were not getting involved in schools.

In Montgomery County, more than 200 Hispanic students were absent the morning after the judge’s ruling, and a handful have withdrawn. In tiny Albertville, 35 students withdrew from school in one day. About 20 students either withdrew or told teachers they were leaving in Shelby County, in suburban Birmingham.

Local and state officials are pleading with immigrant families to keep their children enrolled. The law does not ban anyone from school, they say, and neither students nor parents will be arrested for trying to get an education.

But so far, many Spanish-speaking families aren’t waiting around to see what happens.

A school worker in Albertville — a community with a large poultry industry that employs many Hispanic workers — said Friday many families might leave town over the weekend for other states. About 22 percent of the community’s 4,200 students are Hispanic.

“I met a Hispanic mother in the hallway at our community learning center this morning, where enrollment and withdrawal happens. She looked at me with tears in her eyes. I asked, ‘Are you leaving?‘ She said ’Yes,’ and hugged me, crying,” said the worker, who spoke on condition of anonymity because she was not an authorized spokeswoman.

In Russellville, which has one of the largest immigrant populations in the state because of its poultry plants, overall school attendance was down more than 2 percent after the ruling, and the rate was higher among Hispanic students.

There’s “no firm data yet, but several students have related to their teachers that they may be moving soon,” said George Harper, who works in the central office.

Schools in Baldwin County, a heavily agricultural and tourist area near the Gulf Coast, and in Decatur in the Tennessee Valley also reported sudden decreases in Hispanic attendance.

The law does not require proof of citizenship to enroll, and it does not apply to any students who were enrolled before Sept. 1. While most students are not affected, school systems are supposed to begin checking the status of first-time enrollees now.

The state has distributed to schools sample letters that can be sent to parents of new students informing them of the law’s requirements for either citizenship documents or sworn statements by parents.

In an attempt to calm fears that the law may lead to arrests, the letter tells parents immigration information will be used only to gather statistics.

“Rest assured,” the letter states, “that it will not be a problem if you are unable or unwilling to provide either of the documents.”

      I live in Ohio. Its full of mexicans. Many years ago I tried to get assistance and couldn’t but the room was full of spanish speaking people. I’d be willing to bet they got theirs. How many times have I been in a grocery store paying with my hard earned money and have seen a hispanic paying with food stamps. How many times have I seen them then get into a nice vehicle while I get into a rusty 12 year old truck? Its sickening whats happening to our country both with the influx of hispanics and muslims especially after 9/11. Aren’t there alot of people out of work that would love to have a job in a poultry plant? I say take all the unused buses, put them on them and drive them back to where they came from. Then repeal the stupid anchor baby law, Send the military down to the border while volunteer American citizens build that damn fence once and for all, while making it a law that no one shall reside here unless they are a citizen period!!!!!

      The following came from a article in Jan 2009 for the state of North Carolina

      K-12 Education. The estimated 120,000 children of illegal aliens in public schools cost taxpayers more than $1 billion annually.
      Health care. Uncompensated health care for illegal aliens costs North Carolina an estimated $130 million a year.
      Incarceration. Besides the human and economic costs of crimes by criminal illegal aliens, incarcerating the perpetrators carries a $49 million annual price tag

      There was a time when I quit my hard working labor job of 11 year in which I worked in a cooler, opened my own business, went back to school for engineering and got a new job after about 1 year of struggling. This all happened to me in the past one year! I did not get any unemployment nor did I have any help from the government! Why should we ever give hand-outs and keep throwing money at problems where people do not ever get up on their feet??? They should have training programs in teaching people how to make it in today’s society! Immigration is not the issue, it is illegal immigration and that we are paying for it because of the people whom we employ will not enforce the law! We need to change our way of thinking and throw our government representatives out of office who do not enforce the law for which it stands!

I do not blame Alabama for enforcing its illegal alien laws or any other states.       The sooner all 50 states adopt this measure, and others, the sooner we will get rid of this economic enemy.
      Special teachers, to teach spanish, as well as the drain on entitlements for these lawbreakers will go down.
      Next, start arresting ‘Illegals’, and “Redistibute the Wealth”(confiscate their assets), and use it to send as many of these lawbreakers back to where they came from, “On Their Dime”, not on taxpayers dime!!!!

    If the immigration laws of 1986 and 1996 were indeed enforced, illegal alien immigration would not be a problem, and the proof is right here in BIRMINGHAM, Ala.. Since we have passed laws in Arizona against illegal aliens we have seen a decline here in Az. as well.

    We all want a better life for our children, does this give us the right to
    go against the law for the betterment of our children? Or is the right to
    thwart the law reserved only for illegal aliens, illegal alien parents and their children from Mexico and around the world?

      To the schools, its a numbers game. The more kids, the money. They dont care if your a illegal alien or not. Thats a shame. These children of illegal aliens should pay out of state tuition at a minimum. Then we should stop the anchor baby allowance. Repeal it for any illegal alien.

      Do you think your child would learn better in a classroom with 50 kids for 1 teacher?

      Then throw in kids showing up that can’t even speak the language.

      Another reason to DUMP the PUBLIC SCHOOL SYSTEM and give vouchers to parents to choose their own schools. I bet most parents would NOT stand for crowded classrooms that could easily be thinned out if the school “asked for proof of citazenship” from the kids which Thanks to the SUPREME COURT we HAVE to give an education to BUT the schools can turn that child ILLEGAL information over to ICE to deport the parents which gets rid of the kid.

      And Ron Paul is right – STOP giving US citizenship to illegal children. That amendment was for the children of slaves NOT illegals who break our laws and sneak into the country to drop an anchor baby.

    This happened in Oklahoma a few years back when the state implemented tough illegal alien laws. There was all kinds of doom and gloom aimed against the law as tens of thousands of illegals fled the state because of these tougher laws. Liberals and Hispanic groups were complaining that a lot of ethnic businesses in the state would close because their clientele have left the state. I say, why would anyone build a business based on illegal clientele? That’s just stupid.

    Oklahoma is a great place to live and has one of the 5th lowest national unemployment rate at 5.6%.

    I say all illegals need to be removed from our country ASAP. That includes students of illegals. That may sound harsh but these parents know exactly how this country operates and they’re exploiting us at every opportunity. I don’t want law breakers here period.

      If current laws would be enforced, the illegals would return to their countries of origin. It is sad that the kids are caught in the middle, but the parents should have been responsible. Then again, the children were created as “anchor babies” to ensure the illegal parents could remain in America. Sad situation for everyone involved, but you have to draw a line somewhere.

      Not all residents of a state pay for the schools, it’s only the property owners that pay the school levies. So even many renters here legally are getting a great deal.

      Taxes not too bad. just got my property tax $436 for the year. We do have a state income tax also not too bad ( could be worse ). Sales tax around 8%. unemployment rate in my area ( Huntsville ) below national average

      The unemployment is 10.1, so I’m sure that if the illegals leave…..maybe some AMERICANS can go to work……….whatcha’ think? I‘m so tired of hearing about them doing work we won’t. I planted an acre garden this year and me and my husband (after work a lot of times) kept it weed free and growing great. It’s hard work, but that’s what it takes to make it.       Thank you JUST SOUTH OF HEAVEN! I live in an area where the majority of people are in the Democrat party, Christian and the Nursery Capital, all employee illegal aliens and pay them in cash. This situtation has effected our public schools, our unemployment rate and our property taxes as well as the judicial system. Our streets and highways look like trash bumps along the southern border and the schools are teaching the childern Spanish instead of the Mexicans learning English. I understand one of the Nursery owners stood in a courtroom and told the Judge that no one will touch “his Mexicans”.

    This law may have got past one judge but don’t get your hopes up, it probably won’t make it past the next one. There are too many “but the kids shouldn’t have to pay” folks out there to let this law stand for very long. An up side, the poulty businesses may be looking for help. Get some of those unemployed folks working. Then we can say that the illegals were taking up American jobs.

      Exactly what happened here in MN when they raided Chipoltle and sent some 500 illegals packing. Those “jobs nobody else wanted” were filled in a week by Americans. Yes it will be hard for the illegal kids because their parents were irresponsible, but the unemployment rate in Mexico is only 4% vs our 15% so they won’t have any problem finding a job.

    Good maybe they will go back to mexico with thier families. Sorry but we pay for them to be educated we pay for them to eat we pay thier rent and you cant tell me we dont go to any state or federal agency and read thier paperwork.. they make sure those who speak spanish get the best service

    While I‘m sorry the kids aren’t in school, perhaps laws like this will discourage the influx of illegal immigrants since they will be nervous about sending their kids to school (though from the article we know that is unjustified.) I have no problem with LEGAL immigrants, but I know that here in Texas services and schools are being pushed to the breaking point serving those who are not here legally.

    Our country cannot afford to pay for the upkeep of every person in this hemisphere, it cannot even afford to take care of everyone who is already here legally.
    I would wish them no harm, but they should go back to Mexico, their own government needs to take care of them!

      Just guilty of border crossing? LMAO. Stealing falls in the realm of crimes that are a prosecutable offense. Every illegal that is mooching off of the tax dollars of American citizens IS A THIEF! As well as being a National Security threat from having entered against the legal process of Naturalization and Citizenship.
