The state of Illinois is currently weighing this question. On Monday, state Attorney General Lisa Madigan’s office issued a ruling that declared the names of gun permit holders to be public information that must be disclosed. But the agency overseeing such permits — the Illinois State Police — may challenge the ruling in court once it becomes binding.

The Chicago Tribune notes that state police officials have long believed that releasing such information about firearm permit holders would an unwarranted invasion of privacy and ultimately endanger the lives of gun owners of those who don’t have firearms. But the attorney general disagrees, claiming the public has a “legitimate interest” in knowing who owns a gun.

The debate began after the Associated Press filed a Freedom of Information Act (FOIA) request last September for the names of each state permit holder and their permits’ expiration dates. When the state police agency denied the AP’s request, the public access counselor intervened.

“The General Assembly has clearly determined that it is in the public interest to provide a system for identifying those who are qualified to acquire or possess firearms through the issuance of FOID [Firearm Owners identification] cards,” assistant public access counselor Matthew Rogina wrote at the time. “The public, therefore, has a legitimate interest in ISP’s enforcement of the FOID card act.”

The attorney general later insisted that addresses and telephone numbers of FOID cardholders should remain private.

On Tuesday, a state police attorney announced that the agency may take the matter to court. Meanwhile, Republican state lawmakers are planning to debate legislation that would make the state’s 1.3 million gun owners’ names permanently private.

“You can own a handgun, and information about whether you do or don’t is private information,” state Rep. Ron Stephens said. “There is no reason for anyone or any government agency to make available to you or anyone else whether I have a FOID card.”

But Brian Malte of the Brady Campaign to Prevent Gun Violence disagrees. “There should be public scrutiny on any licensing system, whether it’s to own or to buy or to carry,” Malte said. “The public has a right to know how well those systems are working, especially when it involves firearms.”

Knowing who has guns and who doesn’t means criminals know whom to burglarize, or worse, said Todd Vandermyde, Illinois lobbyist for the National Rifle Association (NRA). “You potentially make us targets… Or, on the inverse, you could say, ‘These are the homes that don’t have FOID cards so it‘s likely they don’t have guns, so therefore they make better targets.’”

The state police made the same argument, but the attorney general dismissed it as “speculative and conclusory.”

“ISP has offered no details to support its argument that disclosure of this information to the AP would result in a safety threat to any individual,” Rogina wrote.

State Sen. Kirk Dillard, a Republican sponsoring the Senate legislation making FOID information private, also warned that people who want to own guns but don‘t want their names publicized may be forced not to comply with existing law if the attorney general’s decree stands.

    I live in this piece of crap of a State. States and cities run by Democrats are so much more likely to be in the toilet than not. This has to be unconstitutional. We have a right to have this information kept out in the public domain. I see a big lawsuit coming.

    As the rights of citizens are reduced, the ability of government to regulate increases. I would not be surprised if the Second Amendment becomes a Federal enforcement issue, no longer will the states decide. If this becomes law, then it will be one more step toward an Orwellian future.

      It will also mean a lot of needless deaths, cops don’t want the job because they know in many states the public out guns them, so the only way to disarm the law abiding citizens is the military.

    @ COMMONSENSEGUY The good folks who have registered their guns should have only registered their pea shooter and not the heavy artillery cause the crims will be at the front doorstep in tiny pieces.Saw this one coming years ago so abided by the rule that said register your “hand” guns before they once again changed the rules.Don’t worry as stupid as this is alot of vets out there are p.o‘d and aren’t following the rules.

      In Florida you don’t have to register your gun, because of cases like this. You have to jump thru the federal hoops and waiting periods to get a gun, but they are not registered/recorded here. So they have no idea what types of guns or how many guns you have.

      I have no doubt the Dept of Justice will try to get all that info in the near future. That‘s why it’s not wise to participate in these blogs nor register in order to post messages. The lower profile you can keep the better. That’s not to suggest hiding in fear…its just suggesting being wise as a serpent using forsight. But…too late for me. We make ourselves vulnerable to police action simply by being here on the Blaze. I almost didn’t register for that very reason. Everytime someone runs their mouth in these blogs saying foolish things which make for vulnerability they might want to consider their words coming back to bite them as incriminating evidence 5 or 10 years down the road. Digital records never go away. I shake my head and ask what happened to my country? We need to pray that God will give us a national revivel soon. In my opinion the entire problem in this country is that we as a nation stopped seeking God and started worshiping materialism. Wev’e gone astray as a nation. And now, because of our disreguard for Gods wisdom reguarding the borrower being the slave of the lender, we are about to become a slave nation worried about the government kicking down front doors searching for guns and probably bibles also. There you go. Check out what sin does to people and nations. They are in outright rebellion against God, and the spirit of lawlessness is taking over in our government and on the streets.. I suppose this AG, while holding that gun owners have no right to privacy, also holds the “right to privacy” supports a woman’s “right” (sic) to abortion on demand–even for minors–and parental notification rights are non-existent? Hell, post a list on the walls of parole boards, etc. I think it should be mandatory for all gun owners to plant signs with a skull and crossbones in their yard as well. We can call it: Operation Reality Check. The Democrat party will be bankrupt the week after lefty houses are targeted and gun owners sip sweet tea on their porches at night.       Something that no one has mentioned here is another reason why they want to have the information about who owns guns. And it isn’t the “public” that needs this information, it is the “government”. When they know who has the guns, and they get ready to take them away from us, they will have an idea where to start. Only thing is, this is “licensed or permitted weapons”. They didn’t say another about the unpermitted ones. If they get it in IL, then they will try for it in another State. The more they get, the better chance they have of taking them. Personally, it is no ones business IF I have a gun, or how many guns I have. Unless I go out and commit a crime with them, the government needs to stay out of my life. I pay taxes….unlike a lot of people, and if they push me, I’ll quit my job and let them do without my tax $$$’s…lol! (joking about this of course) But it does make you think.

      Why? Using the information act all info should by law be released. Who gets to pick and chose. Also he has it wrong! The freedom of info act is on government documents about government actions not it’s citizens. With his logic I want to file and find out everyone’s social security numbers right now.

      So another crony or supporter of the POTUS agenda has emerged; to put it simply, when the list of names is released to the public, then those who want all guns taken away will be able to target the owners for violence, hence making their argument of guns leading to violence a reality when those same owners use them for self defense.

      Also, as others have posted, the people who want to steal the guns will know where and what ones are availible; who has how many of them, and especially who does not, so they can also target the most vulnerable at the same time.

      The main question I have to ask also, is why in the blasted depths of the oceans abyssal plane does the Associated Press want this information for? And why should they be allowed to endanger others with it?

      There seems to be something else going on here…look in the direction of the Federal AJ office…that is where the next move will come from.

      Here is what I find that pile of smelly stuff is planning :
      Step 1. Get a list of all legal gun-owners, their addresses and phone #s, using a marxist judge

      Step 2 : Get google to map those addresses and consolidate all their other info

      Step 3 : Accidently and unknowingly have that info leaked to a foreign source

      Step 4 : Use the crisis to retaliate against legal gun owners and also give more power to local anti-American entities while adding even more security around the families and houses of the marxists themselves

      Okay…On Glenn’s TV program today, he barely (but did) “mention” the Eric Holder: Focus on Black Panther Case Demeans ‘My People’ statement…would someone like to explain to me why Glenn didn’t make a HUGE DEAL ABOUT THIS ON TV? THIS IS A HUGE DEAL! The DOJ is riddled with corruption and Glenn knows it! Glenn talked about it on his radio program…the article was posted here on The Blaze…BUT…ONLY A BARE MENTION of it on TV? WHY? Very, very disappointing to me! I’m on Mountain Time so the program has about 10 more minutes to air…MAYBE he’ll bring it up again before the program ends, but I doubt it! I was also confused about his reporting today on the financial meltdown of 2008…Everyone knows that the entire meltdown “Stinks On Ice”…AGAIN, Glenn just blamed US…for overspending…Okay…Glenn is now talking about his program tomorrow…it will be about “The Enemy Within”…perhaps he’ll nail Mr. Holder then…I can only hope…

      You just hit upon something of major interest there; look at what has been going on with the police in Seattle, if I remember correctly, and the ‘social justice’ program and indoctrination they are cramming down the officers throats…if the criminals take the guns, then the police departments in Illinois who have such programs will just let the gun crimes go unsolved, thefts will be regarded as making sure the social justice is being carried out and such other nonsense down the line…

      This seems to be one way the line is being connected point by point; and now with the Federal AJ speaking about the black panthers intimidating voters, and refusing to bring charges in cases where a minority commits hate crimes on a caucasion person, these views begin to now make more and more sense in being connected.

      there is no right to privacy! only the protection from unreasonable search and siezure.(misspelled) .but we do have a RIGHT to keep and bear arms.
      now my question is this, will the felons whom are denied they‘re rights even after doing they’re required sentence be on that list,because they won’t be (legally registered).although they get to keep ALL of the other rights afforded the bill of rights.
      UNDERSTANDABLY some folks shouldn’t carry,but then again some people should shut thee hell up,(not dirrected at you)and this is not an endorsement of criminals running around armed,just sayin, what righs shoud be up held and which shouldn’t,(again not @ you but @ this politician.)

      The whole point of the Seccond Amendment was to protect citizens from government, so the “details” would be found in our founding documents.

      Regarding protection from other citizens, which was not the purpose of the Second Amendment, but is nevertheless a concern, the “details” for that would be in the very reason the Left cites as reason to restrict gun ownership – namely, the fact that would-be robbers, themselves, think that guns are an effective deterrant to force, as evidenced by their choice to use them.

      Arm yourselves, America. And hide them from government knowledge. It’s our right, and our protection from corrupt government.

      If this goes through, maybe the legislature should look at ALL kinds of information that the public has a “legitimate interest” in learning.
      If I lived in Illinois I would be telling my representatives that I have a legitimate interest in knowing:

      Which public officials have ever had (or have)a sexually transmitted disease.
      The square footage of the houses of all public officials and their energy use.
      All vehicles owned by all public officials.
      The bank account balances of all public officials.
      Phone logs of all phones used by public officials.

      I could go on…..but you get the point.

      (on second thought…..my ideas might just get enacted in Illinoistan)

      This idea is probably worse for the non gun owner. Once the criminals know who own guns they will bypass that house for the unarmed, undefended home. You need to realize private gun ownership is a very stressful concept for criminals whis is why they are so in favor of strict gun controls. .

      Yea,,,good idea. Let every thug/criminal know who is permitted to carry a gun in Illinois. If I was a resident who didn’t have guns, I’d be concerned, as the criminals then KNOW which homes to intrude. (Recall the Florida crime rate went DOWN when more liberal guns laws were passed for the law abiding citizen.)

      I live in Louisiana and not Illinois but It doesn’t bother me if my name is on a list made public.
      Here in LA. most people have guns and are proud of that fact. A lot of the gun owners also have cc permits as I do. I am proud of my 2nd amendment right to bear arms. I carry every day and I would
      even protect one of those Democrats, socialist, Marxist and global warming nuts even tho they probably don’t deserve protection. There is an old saying in the southwestern part of Louisiana.
      PROTECT THE INNOCENT, NOT THE STUPID OR THE LAZY. Having said that I would still defend them. Just for full disclosure I own may many guns.

      Reading the comments, most of you seem to care for their poor neighbours that dont have a gun and might become victims through such an act. All fine and dandy.

      But all in all there is a question coming to my mind: Why are americans so brutal, why do so little americans obey the law? Why do you do this kind of stuff to each other?

      Take a look at “peacefull” Germany: 60 Years ago it may well have been the most militaristic and brutal society ever known. But today? WAY less crimes than the US, WAY less murders. And nealy NO guns.

      Whats wrong here in the US? Why cant we manage to live together without the possibility to kill each other any moment?

      So what can they do with this if you own a gun? Yeah everyone knows it, but the second amendment still allows us to carry right? they cannot remove our arms unless we have done something stupid to break the law. If you make them stand on what they truly believe you burn the floor out from under them. You can always turn the progressive argument on its head. be smart enough to recognize their progressivism and be able to question them on why their theory is better than individual freedom? Why punish the upper class with higher tax rates? That will take money away that they would/could have invested for more jobs. A million dollars creates many more jobs in the private sector than the public sector could ever dream of because according to Obama Gibbs job making 172200 is modest. 1,000,000 could only pay for just under 6 Gibbs jobs. 1,000,000 would could create 20 jobs at close to the average american at 50,000 per job.

      I guess we surrender all our rights to privacy when we legally apply for one of these permits for firearms. It makes one think; what else they are going to use this a stepping stone for? Oh that’s right, when they ban firearms they will know exactly where to go to take them back. This is a terrible idea making this information public knowledge. What if this information fell into the wrong people hands?

      Privacy? Heck, here in Illinois we don’t even have a right to carry a firearm. Lisa Madigan and the General Assembly just ignore the Supreme Court decisions called Heller versus D.C. and McDonald versus Chicago. Many folks mistake FOID as a permit to carry, but it is only a requirement to possess and purchase. Stand alone, Illinois is the only state where Citizens are totally denied their right to carry. Note: Lisa Madigan joined the losing side in both of those cases so it is no surprise she would slam gun owners by saying a list of FOID holders must be made public.

      There has never been a right to privacy. The only thing even remotely close constitutionally is the protection from unreasonable search and siezure. Legislators are free to make laws deeming basically anything either public information or explicitly private, but there is no basic constitutional right to privacy.

      Having said that this request is idiotic and it should not be allowed. The people requesting it have no valid reason for requesting it. They just want a list of names they can drag through the mud.

      Wow, I wonder if the Illinois Attorney General will show up to the National home burglary association convention to receive his award, as new best friend to all home burglars. As a 25 yr vet. in a large city police dept. I just can’t believe this AG does not realize he would be releasing a one stop shopping list showing every burglar where to go to steal weapons, to use on police, store clerks, bank tellers, and who knows maybe even AG’s.       The public does NOT have a right to know whether an individual does or does not exercise their God given, Constitutionally protected right to be armed for their personal defense, or sport. Law enforcement should and does have access to this information– the article states that the State Police is the administering agency. Sounds about right to me. The only people that gun laws and gun regulations ever hinder from having guns, or using guns, are the people who are going to ignore the laws and regulations. The law abiding are sunk. Keep your grubby, grabbing hands off my guns and out of my private business!

      I grew up in the Liberal Police State of Chicago, Illinois However I would never again make my home in any state run by the scum known as the democrats. If you live there and have your business there then you deserve what you get. Just take a look at Detroit. That is your future.

      This is real smart, it’s going to be interesting to see the ILL Attorney General posting all of the illegal people holding on to or possesing firearms as well.
