Illinois Man Faces 75 Years in Jail for Filming Police

In many states, you can record police in public spaces without their consent, but one Illinois man is facing 75 years in prison for doing just that.Michael Allison Faces 75 Years in Jail for Recording Cops with Cell Phone

What exactly did he do? The man, Michael Allison, recorded police officers on duty in his front yard inspecting vehicles he was repairing.

Allison was fined for failing to register the vehicles, and so he requested an ordinance hearing, and once again he brought his camera into the court and hit record.

For those simple acts, Allison is facing five felony charges calling for 15 years in prison per each count– a possible total of 75 years. If found guilty, he could easily spend the rest of his life behind bars for “eavesdropping.”

WTWO-TV Channel 2 in Indiana reported on the whole ordeal back in June when Allison was arrested and has more details. According to the outlet, Allison‘s spat with police started because he fixed old cars on his mother’s property but refused to register the vehicles (and pay a registration fee, of course). Despite being fined, as mentioned earlier, authorities also confiscated the cars he was working on. That’s the exchange he initially recorded.

Allison then went to the Robinson police department with his cell phone camera in hand for an ordinance hearing. He claimed that officers selectively applied the car registration statutes against him, and told the judge he had recordings of his interaction with the officers. He also recorded those proceedings, and told the judge he was doing so.

It was on his way out from the hearing that Allison was immediately arrested, and charged with the five felony eavesdropping counts.

In Illinois, recording law enforcement officers without their consent is considered a serious crime — or at least the authorities choose to interpret an old eavesdropping statute that way. According to WBBH, 12 other states have a similar interpretation of the law, including Florida, Massachusetts, and Maryland.

But could this be a brazen double standard? Consider that police in Illinois are specifically exempted from the eavesdropping law, and constantly record citizens without their consent. Citizens such as Allison, however, can go to jail for it.

Allison was offered a plea deal for a lesser felony with a guarantee of no jail time, but he turned it down. He believes the law under which he is being prosecuted is grossly unconstitutional, and he is doing a service for fellow citizens of Illinois by seeing the case through.

“You’ve got to stare down the face of this big government that we have,” he told WBBH in an interview about the case, “If you don’t fight for these freedoms here at home, we’re all going to lose them.”

A pre-trial hearing for the case was held on August 18th, and a judge is expected to rule in the next few weeks if the case will go to trial. Allison is currently out on bail.

The State’s Attorney in charge of the case has refused to publicly comment on why this case has not been dropped like many similar ones across the country.

    It isn’t illegal to videotape the cops anywhere in the United States.

    Like the Supreme Court ruled, the cops also have no reasonable expectation of privacy in public.

    Additionally, these are our public servants. In what dimension does the public servants have the right to videotape citizens in public along with recording their comments but the public can’t do the same?

    I was protesting the Nazi Police State in front of their taxpayer funded-and-built Police Station Castle Fortress, and the Nazis actually came outside and threatened to arrest me for using foul language in public, saying they had recorded me cursing!

    I told them to get the hell out of my face, and then I whipped out MY OWN AUDIO RECORDER and threatened to SUE THEM if they continue to threaten my 1st Amendment Right to Free Speech!

      Our law enforcement commuity is quickly degenerating into something that much more resembles a strong arm secret police force, like you would find in Nazi Germany or Communist China. I have alot of respect for the people that enforce our laws and protect us, but as in any other group, you will find the dirty ones, that are in it for the ability to project their own twisted sense of power. When you couple this with the greedy, lying and power hungry politicians who make the rules these days, you are ending up with nothing less than state sponsored thugs whose primary job is to deprive you of your rights, while at the same time emptying your pockets of your hard earned money, so it can be used to line the pockets of lazy, brutish public officials……Welcome to the new America folks….Remember to keep your head down, your eyes straight ahead while toiling away for the nickels and dimes that the State requires you to “donate” to them, so they can fund the removal of the freedom you once held dear.

      Well, if he does get charged and he does get convicted and he does get sentenced to the max, I say he should shoot as many cops and judges as he can before they lock him up, so that he actually earns the punishment he might be getting, since he wouldn’t then see the outside world again anyway.

      I lived in North Chicago for a while. Took a trip to the place where you can look up your heritage, family records, etc. A friend was driving me, and he stopped at a stop sign and 2 guys descended on us with open drugs, as if we wanted to buy. We were later told that no one stops at that stop sign because if you do, you want drugs. Jeez, they should mark those places.

      What state is this? Oh yeah, it is illinois Obama’s “Home state if you believe his line” and te state in which Chicago is located. If Obama has his way, this kind of charge will be the law of the land.

      This law is a clear violation od the Constitution and I don’t blame te gentleman for fighting it. If necessary, take it all the way to the Supreme Court. (That is if Obama‘s appointees don’t continue to destroy the Constitution.)

      Obama wasn’t kidding when he said he wanted a “Civilian police force” I didn’t realize he would CO-OP the so-called REAL policemen who took a vow to protect the Constitution.

      This is why I live in TX. But I’ve harped about this kind of nonsense for years. Even in TX the word of an officer is considered more reputable than a citizen. I know there are a lot of dirt bags out there, but people are still innocent until proven guilty. Even for trivial crimes like speeding, they should be required to provide proof. Officers often exceed their authority. These bad officers may be a minority, but they still exist. It’s a prevalent problem. I imagine in a corrupt environment like Chicago, IL, it’s a huge problem though. Just look at the Frank Lucas case. Just this one mans testimony led to nearly all the officers in a NY drug task force being put behind bars. 100+ convictions. And also, law enforcement lobbies are perhaps the greatest force against our 2nd amendment rights. I think it’s very telling that cops are generally against the second amendment. I’m just saying.

    It should be mandatory for citizens to video tape their civil servants. Especially since, in the last week, you have a drunk off duty cop yell at and shoot up a car of trannies, a cop screwing a lady on the hood of his patrol car and a thousand other abuses of power I’m not going to waste my time typing about. These people are abusing their power an awful lot and need to be held accountable.

      My son was l6 the first time a bunch of pigs jumped my son, breaking his collar bone, knee cap, while they were arresting him. I was there, it was in my front yard, they swooped on him, threw him in a police car, took off, then parked & beat him half to death. They lied about it all, it never happened. Yet he was in the hospital a week, after 2 surgeries & since has had 3 more surgeries, they ruined him, his body. He is always in pain. We gotta reigh these out of control pigs, kick them out, charge them for Assaut & THROW THEM IN PRISON WHERE THEY BELONG!!!! I CAN’T RESPECT C COP.

      They’re supposed to be able to do that with no one being the wiser.

    Every elected person that can be traced from the police officer through his supervisors up to the chief and city manager, mayor and all members of the city government needs to be voted out of office top down. Fire the city manager, fire the chief hire new one. Have him fire all the way down to the cop including the cop. People rule these towns not government. We simply vote them out. We rule.

    If citizens can not expect privacy in public – neither can law enforcement. Since the cop is a “public servant” what he/she does is knowable by said public – with exceptions where the action or disclosure thereof would cause bodily harm, etc. The judge should rule in such fashion – but – hey, it’s Illinois!

      police not wanting to be recorded is all about control and to stop anyon from from knowing what they really do. think about it – there are no good cops because if there were -from the lowest to the chief-

      I lived in Illinois for 30 years, what a septic tank of crooks and thieves. Most of them in public office let alone public employees. I know of many damn good cops but most were messed up in the head.

      Not even close in your analogy. Everyone in this country, regardless of their employment, has NO “reasonable expectation of privacy in public” and that include peace officers.
      If you disagree, then who will stand up for the GLBT community when THEY are arrested in Illinois fr filming police officers in public? (Oh, that’s “different”somehow?)
      No, the Supreme Court has already ruled on privacy in public. However, if he was charged for filing inside court without permission, I’ve no problem with his arrest.
      a peace officers “peace” cannot be disturbed, another US Supreme Court decision long ago. So this fellow getting arrested and charged for being on private property filming officers, isn’t going to fly at all. Inside the Court room however is an entirely different situation legally.

      That is one of the stupidest things I’ve heard. This guy is arrested for recording people (regardless of who they were) in HIS OWN YARD? This sounds like the typical Illinois portrait. I would be willing to be that Abraham Lincoln would disavow being from this state that way that it’s proving to be over and over again!

      You weigh this police action toward One citizen,, with the police that had to kill that Mentally handicapped man with a Toy Rifle. Police want citizen back up when the second incident happens, but pull this crap when browbeating a citizen. They can’t have it both ways.

    Now this is more assinine than the pastor wanting to create a Atheist Registry.

    It is not against the law to film. Hell the police do it all the time out of their vehicles. If this is the case, then we as citizens have the right to arrest them and send them to jail for 75 years for filming us without our permission.

      There is a man in my neighborhood who has 4 separate assault convictions and he never got prison time. This is just plain ridiculous. I have lost all faith in our justice system.
