In Defense of Flogging” isn’t a joke, a satire or a thought experiment. Peter Moskos, a former Baltimore cop who’s now a professor at John Jay College of Criminal Justice, seriously wants to reintroduce corporal punishment in the United States.

Don’t laugh: He makes a convincing case. From the straightforward question he begins with — “Given the choice between five years in prison and 10 brutal lashes, which would you choose?” — he had my attention.

Moskos isn’t a sadist or a fetishist. In fact, he finds flogging distasteful. (He describes the physical effects in graphic detail: “skin is literally ripped from the body,” etc.)

But he’s far more outraged by the American penal system, which incarcerates the largest total number (2.3 million) and the largest per capita proportion (750 per 100,000) of prisoners of any country in the world. When the U.S. has criticized China on human-rights issues, Beijing has had the satisfaction of pointing to these figures in response.

CNN’s Q&A with Moskos:

In your new book, you are proposing that convicted prisoners should be offered a choice between a standard prison sentence and a set number of lashes? Are you serious? Do you think a criminal would choose being whipped?

I’m deadly serious. Given the choice between five years and ten lashes, wouldn’t you choose the lash? What does that say about prison? And if flogging were so bad, where’s the harm in offering it as a choice?

Of course some people are too dangerous to release, but these people are kept behind bars simply because we’re afraid of them. But for most criminals, those we just want to punish, flogging is a more honest. It’s also a lot cheaper. Simply to bring our prison population down to levels we had until the 1970s, we’d have to release 85 percent of our prisoners. How are we going to do that unless we end the war on drugs or have alternative forms of punishment?

How would flogging work—what would the flogging procedure look like?

I propose we flog as they do in Singapore and Malaysia. Basically, they tie a person to a large flogging stand, pull down the pants, protect the vital organs and lash the behind with a rattan cane. A doctor tends to the wounds. It’s a horrible, brutal, and bloody process. But it is over in a few minutes.

    Someone else mentioned Singapore’s caning punishments. Before going on liberty there with the Navy, we were warned about Singapore’s strict laws on littering, the punishment for which was caning. I assure you, we were very good visitors, and it was a very clean city. I like this idea as an alternate sentence for some crimes, but I fear it would never make it through the legislative process in America today. We don’t have the guts for it.

    First of all, give the ACLU half of all the lashes that the prisoners get or kick them out of the country. But instead of giving them lashes, let them work their butts off everyday instead of relaxing and crying their sick all the time. If they don‘t work they don’t get medical treatment or privileges. Let them make little rocks out of big ones all day, I guarantee that there will be a lot less wanting in prison. Let them grow their own food or most of it anyway. Then they will become self supporting. Let them buy their own seeds and plow the ground by hand. Anything besides letting them sit in prison hollering about their rights.

    I look at the Bible. The first murderer wasn’t given the death penalty, so I believe the death penalty should be done away with. However, the rest of the system needs adjustment as well. Prison (like hell) should be a place of torment. If it were, the majority of sentences could be reduced and prisons would not be considered government issued Marriotts with bars on the windows. BUT because our constitution strictly prohibits torment as a means of punishment, though I disagree with it on this point, I would respect it. It was written by better men than me.

    Duh, Blacks and Mexicans make up the largest population of inmates. So, why not start there instead of changing the rules because there are so many prison inmates?     Some of you need to go back and reread the article. Some offenders would be given the CHOICE of flogging or serving time. No one would be flogged without choosing it over the prison sentence.

    California and a few other states need to unload their prisoners into a desert camp, contracting with Sheriff Joe to run it in the AZ desert. This will be fairly low cost as proven by Joe and the chain gangs will look pretty good to the detainees whose alternative will be sitting in tents in their pink underwear watching the Weather Channel to confirm how hot it is. The perfect spot is near the border where their labor can be used to build the wall with Mexico.

      ZOOSE< I agree with you . it is punishment. though criminals can never make amends for what they do. All I have to say is this. Property can be replaced.The time lost replaceing it can't be for once that time has passed it is irretrievable. So the time one could have been using for his/her family is used to replace what was damaged or stolen.
      Now to where I hqave the GREATEST ISSUE! A life once extinguished is NEVER COMMING BACK! THE PAIN AND SCARS NEVER CALM OR HEAL! Those left to live do the best they can with that struggle every day. So for those who think it cruel to punish what have you to say to those left behind. I say let the victoms do the caning.The officer discibed it as blooddy and brutal but it is over quickly. I wish it were so for the one I loved. It was bloody , it was brutal , but it took an entire night for her to pass. I can't prat anymore it's no longer in me. Just hope that none of you actually learn what it is to understand this.

      Why can’t it be both? Locking people up without a chance at rehabilitation just creates more career criminals. 80% of the people in jail have a drug or alcohol problem. Throwing them in jail without addressing their problems won’t help at all.

      then explain to me how it is ok to inflict cruel and unusual punishment on the majority of the population that is honest but cradling criminals and nut punishing them? they need to PAY for thier actions and if they commit murder or partake in actions that precipitate murder they die.     well if prisons were run like they were in the early part of the century, the dregs of society might think twice before performing actions that would place them there

    that being said, the war on drugs is a failure, due to the complete disregard to family unity policies that destroy family cohesion

    if you promote policies that strengthen the famly and its values instead of destroying them you would have fewer inmates.

    if you brought back labor prisons where they actually had to put in hard labor such as in road crews where you work them hard during there stay, not only would the infrastructure be improved cheaply and with little cost to the taxpayer, they would also pay their own way through prison and learn a trade. when they get out, they would be used to the idea of a days work, and have a trade they could market to help them when they get out.

    im not talking about having them work for pennies a day, but minimum wage would surly suffice, and then you deduct room and board from their income. This will also enable them to assist in financing support for those family members on the outside that would go on welfare thus costing tax payers even more.

    i dont see why this would be a problem. its not essentially slave labor because they receive compensation thru room and board, have to follow labor laws, etc.

    and then tax payers would have to pay less in taxes for their room and board, and for repairing the infrastructure

      Anyway, I agree that once The Government has incarcerated someone as a criminal, it has an obligation to maintain him or her at some humane standard — which does NOT necessarily include wide-screen TV and internet access. 8th Am.d prohibits “cruel and unusual punishment” — there is no “except for” for someone who wants to take 20 lashes instead of 20 days. However, the Constitution does EXPLICITLY provide for the lawfulness of “involuntary servitude… as a punishment for crime whereof the party shall have been duly convicted…”. So yeah, I’ve got no problem with the licence plate shop or the chain gang making little ones out of big ones, or whatever productive activity a warden can come up with.

      Hey here’s a notion, killing two birds with one stone — maybe prisoners could do all those jobs that ‘other’ Americans won’t do, and we won’t have the current problem with illegal border-crossers.

      No, in a perfect world I would follow the Japanese model of the Prison System. Instead of knocking people down, I would rather build them up to benefit society in a much more healthy fashion. But we live in a flawed world were people have flaws, thats why such things as prisons exist.

      There are such things as consequences whether talking about justice or in general. If you wanna say the prison warden is taking retribution for the state or the people in incarcerating criminals, I couldn’t agree more. It is consequence of action and absolutely necessary. A society of no consequences is anarchy. You are not alone in your anti-retribution sentiments, there are thousands of high schoolers and college sophomores who haven’t lived long enough to understand the positive and negative consequences of actions.

      The implementation of Sharia Law which is true and faithful to Islam IS intolerant of any other religion. It would require a Christian become a believer and follower of Islam. To follow or worship any other God other then Allah would be Idolatry according to Sharia Law which would be true and faithful to Islam. Sharia Law, as it is in a number of Middle eastern countries, implements extreme penalties for such Idolatry. For those who become believers in Jesus Christ, Sharia Law would mean swift and brutal punishment with the last step being beheading. This is only after flogging and other forms of extreme persuasion.

      Then you are putting American workers off the job because prison labor is cheap. Haven’t you seen Shawshank?

      Look at Singapores crime rate compared to ours. The numbers speak for themselves as to why we should spank people. If you need somewhere else to look, look at our schools. Since spanking has dropped, schools have been declining in performance ever since. And do I really need to mention the generation of kids we have today? LOL.

      Bullets cost money–how about this. Set the maximum number each prisoncan hold. Then, when you need space for a new one, execute the prisoner with the longest time to serve. It wouldn’t take long for the inmates to take care of this overcrowding problem—-look at all the money you’d save—fewer guards…..

      Agreed, and no wieght room,social services,2meals not three(no bithcinggg allowed or the cattle prod comes out), no smokes, anyone caughth with contraban hang them by the wrists for a day with hourly beatings.that’s just a warm up. If caught doing “buisiness” with other criminals in or out of prison public electric chair for the other inmates to see.

      I have had some ideas for a long time, including having to wear a chain for every lawer you have. For every pre-trial motion your lawers submit, you lose a meal. And 7 days a week hard labor. You get sunday off if you have religeon, but certanly no T.V. Add this to speedy executions, and the repeat offenders would disappear. When they come out of prison as old tired men, not trendy, well fed, fitness jailhouse-lawers.

      I’m with you on that Barbarian prisons should be a zero tolerence facility and corporal punishment should an acceptable practice for those who refuse to co-operate. And manitory death sentences carried out the same day for anyone who kills another inmate not in self defense.

      One lash per year is NOT enough…I would say One lash per week might be better.
      I would make a machine that would give one lash every five minutes…therefore all lashes would be the same,.limit the number of lashes to 20 with five days between until the required punishment is finished.

      75% of people in prison are political prisoners (unjust laws) states largest revenue is from the Feds based on how many people the state has incarcerated. Guess when money gets tight and the free flow of money ends, they will come up with any pathetic way to beat people down. If you have ever witnessed a real flogging you will find death would be a better choice than 10 lashes.

      I imagine they will take prison. Three squares a day, all the drugs you want, free medical, dental and eye exams, clean living conditions, most have cable and all the exercise equipment they need. Most of them come out with a degree of some sort. Yes, they lose their freedom, but we are all in that boat aren’t we? I agree, if they would carry out the death penalty instead of giving them free room and board for 10 to 25 years, maybe California could save some money. Just maybe this would put an end to th overpopulation problem. With 46000 criminals being let go and the immigration problem California is not looking like a very good place to live. Do I sense another bailout coming?

      Isn’t the heart of man wicked enough? I read just a few comments till I saw one lash a week….. We ALL think these things. Why are we so AGAINST spanking children so they never grow up to be criminals, but once grown we want to grant a trade of time in prison for one lash a week? Are we a blood thirsty society? The Bible says Proverbs 22:6 “Train up a child in the way he should go: and when he is old, he will not depart from it.” Proverbs 13:24 “He that spareth his rod hateth his son: but he that loveth him chasteneth him betimes.” Let us get back to the Bible and demonstrate our love to our children so that we maintain civility in our older years. God’s wisdom is far above that of man. Learn to spank the child on the bottom using the rod, which stings, not the foot or fist that damages and it will take one generation for our society to straighten out again. Until then, we will pay for our stubborn ways using an overcrowded prison system.

      A Hebrew speaker/scholar can correct me, but I believe the original in your 13:24 example referred not to a stick for corporal punishment, but to a shepherd’s crook, which gives a much different interpretation. The idea was to reel them back in before it’s too late. Now with that said, I firmly believe sometimes the best way to reel a child in is the timely application of smack in the rear, I just think those times need to be clearly defined beforehand and exceedingly rare.

      it is no longer the days of the shawshank prison, chain gangs, the green mile…my husband has worked on a few prisons, he hooked up cable for every cell, along with the gyms they put in, and the medical facilities they have, I’m not saying whip them, but is this really paying for what crimes you committed?..three hots and a cot is pretty much their motto!

      Yea, sounds like a good idea. Except, the constitution prohibits cruel and unusual punishment and flogging would fall into that category. Unless your into S&M. Have I gone into a coma and awoken in Iran? There a number of just punishments, especially for some of the more egregious crimes, I can think of but most are prohibited by the constitution for good reason. I don’t know why the incarceration rate is so high. Maybe its the constant blurring of the ounce clear line between wrong and right and romancing of a-moral, even immoral behavior from the idiot box called television. Maybe it just seems that way. Maybe we have always been this way, just more of us to lock up now.
      Someone posted that a majority of those incarcerated in this country are political prisoners. Really?I’m sure they mean that all those locked up for drug offenses are just users, not the peddlers and victims themselves. Rapists and murderers are victims of an unjust system as well.

      Another posted that pot should be legalized which I don’t disagree with but went on to say they would choose death before going to prison. I‘m thinking maybe they shouldn’t smoke pot, assuming that they do, since it could be potentially deadly for them.

      One guy posted that fear is a sign of ignorance. One of the basic emotions all us humans have. So I guess we are all ignorant.
      I did like one comment. It was a rip-off from Jim Carey that I am now going to rip. In Liar Liar client in jail needs advice. STOP BREAKI

      maybe they should start cutting off fingers for theft as well. I gurrantee robbery and theft crimes would drop by 50% the first year. When all the youth starts seeing people being losing digits and being whipped for minor crimes. And in murder cases the family should get to decide the sentences as it was thier lose and not the state’s. The prisons would clear out in a hurry.

      I like it. Prison should be a place no one wants to be. They should be given a Bible( yes I said it) a Bible to read. No TV at all, no Radios, and chain gangs to clean the roads. If they are well behaved they maybe able to work in a greenhouse or with shelter pets to take care of.
