Iraq War Vet Arrested on Felony Terrorist Charges After Jogging With Toy Gun

An Army National Guardsman and Iraq war veteran found himself in jail, charged with “committing a terroristic act and wearing body armor while committing a felony offense” after he was arrested while jogging and holding an air-soft gun.
William Everett Alemar was taken into custody after police in Martinsburg, W.Va. responded to multiple calls at 7 a.m. on Aug. 20 about a man running down the road near a school in army fatigues and a protective vest, clutching what looked like an assault rifle, The Herald Mail reports.
Shortly after, three officers reportedly pulled their weapons and ordered Alemar to the ground and took the rifle from his hands.
Police soon found out that the rifle was merely an air-soft “training” AR-15 rifle that anyone can buy at their local sporting goods store. The Herald Mail reports the gun also had the “red tip” that indicates it was a toy gun. However, police also found two knives, a number of empty rifle magazines and ceramic plates in his vest.
Alemar is currently being held on $50,000 bail for the designated “terrorist act,” the paper reports.
Police say the veteran’s actions caused the community to view him as an immediate threat.
“My son is not a terrorist, he’s a good kid,” Alemar’s dad told reporters. He said his son was trying to stay in shape for his next military assignment.
Berkeley County Prosecuting Attorney Pamela Games-Neely told The Herald Mail Thursday that Alemar was actually drunk, registering a .213 blood-alcohol reading. The legal limit for motorists in West Virginia is .08 percent.
While there is certainly an argument to be made that running with anything that resembles a rifle and also carrying knives and empty magazines — especially when intoxicated — is unintelligent, there will surely be some debate over whether his actions warranted being charged with a felony and labeled a “terrorist.”

All in the name of a ZERO tolerance for bringing WEAPONS to school. This struck me at first as being the same thing, but being drunk while doing this is just a bit different. At the most, a public drunkenness charge would suffice if it is in accordance to the local ordinances. I knew how to spot an airsoft toy gun even when I was still on the police department and that has been quite a while since I left. Naturally, one should stop and check it out but carefully. But, to bring a terror charge? It’s either laughable, or I am too out of touch these days. But, I think that I am correct calling it laughable.

Read my other post below. Beck talked about this this morning. How Doctors are trying to get Vets to admit to PTSD to get “major benefits” but, they find out later that a PTSD diagnosis means they own guns anymore. The terrorist charge is just to get him to admit to PTSD and then they will drop all charges or lower it to drunk in public.
He needs a really good attorney… and quick.

This dude has issues. When I first started to read, I though it might have just been a soldier doint PT in his field gear. The whole part about being drunk changed my mind on that idea.

Posted on August 24, 2012 at 5:31pmSure am glad I live in TX where gun racks (with real guns) are standard for pickups and the Concealed Handgun License must be issued unless you have a mental problem or have been convicted of certain crimes. I also normally carry a knife and have since I was 8 years old. The only people I have shot or stabbed were while I was carrying a military issued weapon (they were not toys)
I don’t know how he could run with a BA like that – he should have passed out.

I’ll wait to hear from his attorney before making assumptions about the alcohol issue.
Also, have you ever tried to run, with all that gear, in the summer with a .213 BAC? I think he would be stumbling all aver the place and that should reflect in the 911 calls when, and if, we ever hear them.

I agree with you for the most part, however although It didn’t happen but a few times in my life there have been a time or two when I went out drinking and still had to muster and be ready for training and I never missed PT, or been late for training no matter what condition I was in.
I’m not a partier or drinker but I do know many who are and do report for duty after a long night. Or even drink early and go workout. To me the problem is drinking and being at top shape for duty not being a terrorist.

If you have been to the VA after combat chances are you have been tagged PTSD. Everyone I know at the VA without exception has been diagnosed with PTSD. What happens if they make it illegal for us to bear arms?

If you threaten to harm someone or act like your going to use a weapon to hurt them you will be charged with this. Dumb a55 shouldn’t be charged but should be punched in the face a couple of times to make it sink in the fact that he is a dumb a55.

I‘v already got several holsters and I’m starting off with a Rugar Black hawk .30 cal – carbine. Sometime I will carry my .45 ACP and sometimes I will just carry a Browning .22 cal. My wife is planing on just carrying her .38 Lady Smith and don’t monkey with her because shes a better shot than me

When a REAL terrorist commits a terroristic attack (and they are Muslim), then the news media AND the President of the Untied States provide cover for him and calls him a “lone wolf” with no affiliation to any terrorist cell – Remember Fort Hood and Nidal Hasan. Posted on August 25, 2012 at 7:43amWhile in the Marines we ran in “boots and utes” all the time and we would alternate w/ and w/o a rubber drill rifle (or sand bag… or log…) and the PPE that we WOULD be wearing when we would actually need it… In fact, we would take it a step further and wear our gas masks (man, talk about making a nice pre-dawn jaunt along a NC beach SUCK! haha). Now I‘m pretty sure you can’t do those types of runs as unit PT because of the possibility of joint damage over the long term and new hazing regs but I’m pretty sure they can still do it on the individual level.
What I‘m getting at is that this shouldn’t be too uncommon sight near a military installation although I’m not arguing the fact that it was STUPID to do it off base (and excuse me if I missed anything saying that he was a reservist or possibly at home far from any bases), in a perfect world throw him in the tank, call him an idiot and then let his command have at him and tear him to shreds. Not ruin his life and any chance of a career in or out of the service… I do find it funny that an Army cat had to be nearly black out drunk to do something that a Marine calls his ordinary ‘moto PT’ haha (and yes, I make that little jab at the army with much love and respect for them)

Homeland Security refused to call it a terrorist act and said it was “workplace violence”. My best guess is that the next real terrorist act in the U.S. will be called a “man-caused disaster”.

Posted on August 25, 2012 at 11:13pmBeen in the reserves for 11 years and I’ve heard a lot of ex-infantry guys talk about how their unit would do “Land-Navigation” and their would be kegs at each point. They would PT drunk for the sake “Combat Conditions.” Many times on active duty people were drinking all night and showed up still drunk for morning PT.
1. Terrorism – I don’t this fits a reasonable person quota. If I saw a dude running around with full gear on, I would assume they are training. And… Knives are legal.
2. Public Drunkness – I think their should be a Constitutional Amendment saying you can’t be arrested for being drunk. It’s absurd. People should be arrested for actions, not a state of being. If he was running while sober it wouldn’t be an issue, but now he’s running and drunk. How does being drunk while running change things? If your going to be arrested for being intoxicated it should only be under actions of being disorderly and that means your screaming at people and trying to cause fights.

As grunts we are trained to endure pain and “suck it up” remember this is what America asked of us. Before I was Medically Retired for back injuries me and my buddies would work out drunk just to push the limits of our bodies. We had a saying in the Infantry “If you ain’t an alcoholic, smoker, tobacco dipper, and have at least one ex wife by the time you are 23 you ain’t a real Infantryman. So that is why he was most likely drunk. DUMB to do it in public during these times but a hell. Just know my brothers still stand tall even when we are persecuted for what we stood up to do.

I had to sit down with him several times to convince him to make sure he kept all of his gear and especially the paintball guns in duffel bags to and from the fields or woods. One of his guns in particular with the hopper and tank removed could be mistaken for a real gun by anybody who is not that familiar with real weapons. Once called, the police would respond with all weapons drawn. I know very well from having been on that department 12 years ago.

As for the public intoxication; I don’t believe the .08 limitations is the same on public drinking, so It would be foolish to even charge him for public intoxication unless he was showing signs of being drunk. The same thing happened to my neighbor 2 months ago. He was playing with his son shooting cans in their yard, shortly after he was slammed to the ground by 5 cops with their weapons drawn. He had an air-soft pistol with the visible red tip. He got no apology ,but he was not charged with a crime. It is not a crime to wear a uniform or carry a knife. I guess he can wear his army fatigues in Iraq wear the soldiers voices are not heard here. The media does those guys no justice. They come home and they are feared. The police should of questioned him; observed if he was drunk; made a decision on that at the scene and the others charges are way out of line. You are still innocent until proven guilty right?

There was a rash of problems in California back a few years where gang members were painting their real gun tips, or even the entire gun, orange, so that it looked like a toy. You can never know, red top or not. Unless it looks like a super soaker, but even that’s not safe since there was a news story a few months back of someone who converted a super soaker into a 12 gauge shotgun.
I don’t agree with the charges and I think this guy is an idiot for doing what he did.
If he was doing it for PT, he would have been better off to carry a log or make a weapon out of wood. Airsoft guns are light as hell, especially if this was the kind bought at sporting good stores. Yes, they have Airsoft M4′s that are made of aluminum and are fairly heavy, but a plastic airsoft gun doesn’t carry enough weight to justify carrying it for a field gear PT run. Empty magazines are useless too. Full magazines are about 1lb each, he would have been better to put a 10lb weight in a medium size aid pouch on the front of his chest to simulate the weight of loaded magazines….

They‘ll just tell him if he pleads guilty to public intox they’ll drop the felony. Courts use more serious charges to get people to plead to misdemeanors so they don’t have to go to trial.

He’s a grown man, an actual soldier, therefore he should know better than to run around dressed like he was ready for a confrontation. If he wants to stay in shape, can’t he practice on a military base? However, he committed no crime, therefore, we should reserve the term “terrorist act” for REAL acts of terror. “Behaving Suspiciously” is more accurate.

This man is charged with being a ‘terrorist’ and yet radical groups sanctioning and calling for terrorism and the overthrow of the Republic – unions and the NBPP, are uninvestigated and unreported by the MSM.

Why escalate it to a ‘terrorist’ charge? Sounds like grandstanding by the local police for some reason. Perhaps they were simply young officers that wanted to make a splash. Hopefully, cooler heads will prevail and the charges will be dropped. We want badly to be a free people again.
